संख्या सा०का०नि० 01/संविधान 29/अनु० 309/2020 ़- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा लोक निर्माण विभाग, जन स्वास्थ्य षाखा, मुख्यालय कार्यालय लिपिकीय (ग्रुप ग) सेवा नियम, 1982, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः- 1. ये नियम हरियाणा लोक निर्माण विभाग, जन स्वास्थ्य षाखा, मुख्यालय कार्यालय लिपिकीय (ग्रुप ग) सेवा (संषोधन) नियम, 2020, कहे जा सकते हैं। 2. हरियाणा लोक निर्माण विभाग, जन स्वास्थ्य षाखा, मुख्यालय कार्यालय लिपिकीय (ग्रुप ग) सेवा नियम, 1982, (जिन्हें इसमें, इसके बाद, मूल नियम कहा जाता है) में, नियम 2 में, खण्ड (क) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाएगा, अर्थात्‌ः- "(क)" आयोग" से अभिप्राय है "हरियाणा कर्मचारी चयन आयोग";

3. उक्त नियमों में, नियम 5 में, "30 वर्ष" अंकों तथा षब्द के स्थान पर, "बयालिस वर्ष" षब्द प्रतिस्थापित किए जाएंगे। 4. उक्त नियमों में, नियम 9 में, उपनियम (1) में;

(i) खण्ड (क) के बाद, निम्नलिखित खण्ड रखा जाएगा, अर्थात्‌ः-

"(कक) निजी सहायक की दषा में,-

(i) वरिष्ठ वेतनमान आषुलिपिकों में से पदोन्नति द्वारा; या (ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से लगे किसी कर्मचारी के स्थानांतरण या प्रतिनियुक्ति द्वारा;"।

(ii) खण्ड (ग) में, उप-खण्ड (ii) के स्थान पर, निम्नलिखित उप-खण्ड प्रतिस्थापित किया जाएगा, अर्थात्‌ः- "(ii) कनिष्ठ वेतनमान आषुलिपिक में से पदोन्नति द्वारा; या "।

5. उक्त नियमों में, नियम 14 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"14 (1.) अनुषासन, षास्तियां तथा अपीलों से सम्बन्धित मामलों में, सेवा के सदस्य, समय-समय पर, यथा संषोधित हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 द्वारा षासित होंगेः

परन्तु ऐसी षास्तियों का स्वरूप जो लगाई जा सकती हैं ऐसी षास्तियां लगाने के लिए सषक्त प्राधिकारी तथा अपील प्राधिकारी भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि या नियमों के उपबन्ध के अधीन रहते हुए वे होंगे, जो नियमों के परिष्ष्टि ग में विनिर्दिष्ट हैं।

(2.) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 के नियम 9 के खण्ड (ग) या खण्ड (घ) के अधीन आदेष पारित करने के लिए सक्षम प्राधिकारी तथा अपील प्राधिकारी भी वही होंगे, जो इन नियमों के परिषिष्ट घ में विनिर्दिष्ट हैं।"।

6. उक्त नियमों में, परिषिष्ट क के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

7. उक्त नियमों में, परिषिष्ट 'ख' में,-

(i) खाना 1, 2 तथा 3 के नीचे, क्रम संख्या 1 तथा उसके सामने विद्यमान प्रविष्टियों के बाद, निम्नलिखित क्रम संख्या तथा प्रविष्टियां रखी जाएंगी, अर्थात्‌ः-

(ii) "मैट्रिक स्तर तक हिन्दी का ज्ञान" षब्द, जहां कहीं भी आएं, के स्थान पर, "मैट्रिक या उच्चतर षिक्षा में एक विषय के रूप में हिन्दी या संस्कृत" षब्द प्रतिस्थापित किये जाएंगे।

8. उक्त नियमों में, परिषिष्ट ग के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

Notification

The 14th February, 2020

No. G.S.R. 01 /Const. 29/Art. 309/2020.― In exercise of the power conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Public Works Department, Public Health Branch, Headquarters Office Ministerial (Group C) Service Rules, 1982, namely:-

1. These rules may be called the Haryana Public Works Department, Public Health Branch, Headquarters Office Ministerial (Group C) Service (Amendment) Rules, 2020.

2. In the Haryana Public Works Department, Public Health Branch, Headquarters Office Ministerial (Group C) Service Rules, 1982, (hereinafter called the said rules) in rule 2, for clause (a), the following clause shall be substituted, namely:-

'(aa) "Commission" means the Haryana Staff Selection Commission;'

3. In the said rules, in rule 5, for the word "thirty", the words and sign "forty-two" shall be substitute.

4. In the said rules, in rule 9, in sub-rule (i) after clause (a), the following clause shall be inserted, namely:-

"(aa) in case of Personal Assistant,-

(i) by promotion from amongst the Senior Scale Stenographers; or

(ii) by transfer or deputation of an official already in the service of any State Government or the Government of India.".

(ii) in clause (c), for item (ii), the following item shall be substituted, namely:-

"(ii) by promotion from amongst the Junior Scale Stenographer; or".

5. In the said rules, for rule 14, the following rule shall be substituted, namely:-

"14 (1) The matters relating to discipline, penalties and appeals, members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016; as amended from time to time:

Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority shall, subject to the provisions of any law or rules made under article 309 of the Constitution of India, be such as are specified in Appendix C to these rules.

(2) The authority competent to pass an order under clause (c) or (d) of rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016 and the appellate authority shall be such as specified in Appendix D to these rules".

6. In the said rules, for Appendix A, the following Appendix shall be substituted, namely:-

7. In the said rules, in Appendix B:-

(i) under columns 1, 2 and 3, after serial number 1 and entries thereagainst, the following serial number and entries thereagainst shall be inserted, namely:-

(ii) for the words "Knowledge of Hindi up to Matric Standard", wherever occurring, the words "Hindi or Sanskrit as one of the subject in Matric or Higher Education" shall be substituted.

8. In the said rules, for Appendix C, the following Appendix shall be substituted, namely:-

9. In the said rules, for Appendix D, the following Appendix shall be substituted, namely:-
