Notification

The 12th March, 2020

No. SEC/4E-II/2020/648.— Whereas, the State Election Commission vide its Notification No. SEC/4E- II/2018/48, dated 11.01.2018 had prescribed the programme for the conduct of election to the seat of Sarpanch, Gram Panchayat Sumain, District Fatehabad according to which nomination papers were to be presented between 18.01.2018 to 24.01.2018 and the polling was scheduled to be held on 04.02.2018. 2. Whereas, in pursuance of orders dated 23.01.2018, passed by Hon'ble Punjab & Haryana High Court in CWP No. 1403 of 2018 Sonil Vs. State of Haryana & others, the Commission vide its notification dated 02.02.2018 ordered that "all activities on the notification referred above in respect of the election of Sarpanch, Gram Panchayat Sumain, Block Tohana, District Fatehabad scheduled for 04.02.2018 shall be kept in abeyance till further orders". Hon'ble High Court vide orders dated 13.02.2020 dismissed the writ petition referred above. 3. Now, the State Election Commission, Haryana in exercise of powers vested under clause (1) of Article 243K of the Constitution of India read with Rule 24 of the Haryana Panchayati Raj (Election) Rules, 1994, and all other powers enabling in this behalf hereby prescribe time schedule for the conduct of elections to the seat of Sarpanch, Gram Panchayat Sumain, Block Tohana, District Fatehabad as under:-

2.	Dates on which Nomination papers shall be presented under Rule 24(2)(i).	20.03.2020 to 26.03.2020 (Except 22.03.2020 & 23.03.2020 being holidays under negotiable act) (10.00 A.M to 3.00 P.M.)
3.	Dates on which the list of Nomination papers received shall be pasted under Rule 24(2) (ii).	20.03.2020 to 26.03.2020
4.	Date by which Affidavit/declaration shall be furnished by the candidate in Form 4-A & 4-B, to the concerned Returning Officer. (Rule 27).	20.03.2020 to 26.03.2020
5.	Date on which the nomination papers shall be scrutinized under Rule 24(2)(iii).	27.03.2020 (10.00 A.M. onwards)
6.	Last date for withdrawal of candidature by a candidate under Rule 24(2)(iv).	28.03.2020 (upto 3.00 P.M.)
7.	Date on which symbols shall be allotted to the contesting candidates.	28.03.2020 (After 3.00 PM)
8.	Date on which the list of contesting candidates shall be pasted under Rule 24(2)(v).	28.03.2020 (immediately after the allotment of symbols)
9.	Date on which the poll, if any, shall be held under Rule 24(2) (vi).	05.04.2020 (Sunday)
10.	Timing of the poll	Between 8.00 A.M. to 4.00 P.M.
11.	Counting of votes	(i) Immediately after the close of poll. (ii) In case of re-poll, the Commission may change the date and time of counting of votes.

3. It is further directed as under:-

I. Deputy Commissioner–cum-District Election Officer, Fatehabad shall give wide publicity to the above programme by munadi in area concerned, Paid advertisements in two local news papers and through electronic media shall be inserted .

II. The nomination papers received in pursuance of earlier Notification dated 11.01.2018 shall also be considered and such candidates need not to file nomination again.

III. The remaining instructions contained in the Notification No.SEC/4E-II/2018/48, dated 11.01.2018 shall remain unchanged.
