संख्या 103/REG-253/Vol-IV.— विद्युत प्रदाय अधिनियम, 1948 की धारा 79 (सी) में निहित प्रावधानों की अनुपालना में दिनांक 15.03.1984 से 13.08.1998 तक यथा लागू तथा हरियाणा विद्युत सुधार अधिनियम, 1997 (1998 की हरियाणा अधिनियम संख्या 10) की धारा 56 (vi) में निहित प्रावधानों के साथ पठित, हरियाणा के राज्यपाल कार्यालय आदेष की तिथि से तत्कालीन हरियाणा राज्य बिजली बोर्ड के कार्यालय आदेष संख्या 44/आरईजी-23/भाग-II दिनांक 15.09.1989 के तहत जारी पंजाब राज्य बिजली बोर्ड सामान्य भविष्य निधि विनियम, 1960 (ह.रा.बि.बोर्ड वर्कर यूनियन (मुख्यालय भिवानी) कर्मचारियों के लिए यथा लागू) में निम्नलिखित संशोधन/परिवर्धन/समापन को अधिसूचित करते हैंः-
विद्युत (प्रदाय) अधिनियम, 1948 की धारा-79 के खण्ड (सी) द्वारा प्रदत शक्तियों तथा इस संबंध में अन्य सभी सक्षम शक्तियों का प्रयोग करते हुए, हरियाणा राज्य बिजली बोर्ड एजद् द्वारा पंजाब राज्य बिजली बोर्ड सामान्य भविष्य निधि विनियम, 1960 (ह.रा.बि.बोर्ड कर्मचारियों के लिए यथा लागू) में निम्नलिखित संशोधन/परिवर्धन/समापन करता हैः- (1) विनियम-17 (1) (ए) (V) के बाद, निम्नलिखित उपबन्ध जोड़ दिए जाएंगेः-
''विनियम-17 (1) (ए) (Vi)''
(ए) सक्षम प्राधिकारी किसी अभिदाता को सामान्य भविष्य निधि में उसके नाम जमा खड़ी राशि में से उसकी प्रार्थना पर उसके निजी प्रयोग के किए कार या मोटर साईकिल या दुपहिया स्कूटर या मोपैड की खरीद के लिए प्रत्यर्पणीय अग्रिम राशि स्वीकार कर सकता है।
(बी) इस प्रयोजन के लिए सामान्य भविष्य निधि में से भविष्य अभियंता को दी गई कोई अग्रिम राशि, उसके सामान्य भविष्य निधि लेखे में जमा बकाये की 3/4 राशि वाहन के वास्तविक मूल्य से, इसमें जो भी कम हो, अधिक नहीं होगी।
(सी) यदि किसी अभिदाता ने बोर्ड से पहले कार या मोटर साइकिल, स्कूटर या मोपैड के लिए अग्रिम राशि (ऋण के रूप में) प्राप्त कर ली थी तो वह अग्रिम धन/ऋण की बकाया राशि के उस पर ब्याज सहित, यदि कोई हो, केवल वापिस लौटाने के बाद ही अपनी सामान्य भविष्य निधि से राशि निकलवाने का हकदार होगा। (डी) अभिदाता से अपेक्षा की जाएगी कि वह कार, मोटर साइकिल, स्कूटर या मोपैड की प्रस्तावित बिक्री के बारे में अपने तथा विक्रेता के बीच निष्पादित किए गए करार या प्राधिकृत कंपनी के विक्रेता (या अभिकर्त्ता) (एजेंट) का लिखित कथन अपने आवेदन-पत्र के साथ एक शपथ-पत्र प्रस्तुत करे कि उसने कार, मोटर साइकिल, स्कूटर

GAZ., AUG. 11, 2020 (SRVN. 20, 1942 SAKA) [PART I 1918 या मोपैड खरीदने के प्रयोजन के लिए अपनी सामान्य भविष्य निधि से पहले कोई अग्रिम राशि (ऋण) नहीं लिया था और आगे यह भी कि उसने सामान्य भविष्य निधि से अग्रिम राशि के लिए आवेदन पत्र प्रस्तुत करने से पहले, यदि उसने बोर्ड से पहले अग्रिम राशि ली थी तो ऋण/अग्रिम धनराशि पर ब्याज समेत, की बकाया राशि का भुगतान कर दिया है। उसे जमा करा दिया है।
(ई) यदि अभिदाता ने कार या मोटर साइकिल या दुपहिया स्कूटर या मोपैड की खरीद के लिए बोर्ड से ऋण प्राप्त किया हो और अभी भी उसकी आवश्यकता पूरी न हुई हो तो ऋण तथा वाहन के वास्तविक मूल्य के भीतर अन्तर या उसके नाम जमा राशि का 75 प्रतिशत, इनमें से जो भी कम हो, उसे अपनी सामान्य भविष्य निधि राशि में से प्रत्यर्पणीय (लौटाने योग्य) अग्रिम राशि ग्राहय होगी।
(एफ) कार, मोटर, साइकिल, स्कूटर या मोपैड की खरीद के लिए अग्रिम राशि की स्वीकृति के प्रयोजन के लिए पात्रता सीमा (विशेष वेतन समेत वेतन) इस प्रकार हैः-
i कार ऋण 3000 रूपये प्रतिमास तथा उससे अधिक मूल
वेतन लेने वाला बोर्ड कर्मचारी।
ii मोटर साइकिल/स्कूटर ऋण 1500 रूपये प्रतिमास तथा उससे अधिक मूल
वेतन लेने वाला बोर्ड कर्मचारी।
iii मोपेड ऋण 1150 रूपये प्रतिमास तथा उससे अधिक मूल
वेतन लेने वाला बोर्ड कर्मचारी।
टिप्पणीः जिस अभिदाता को इस विनियम के अधीन सामान्य भविष्य निधि से धन निकलवाने की अनुमति दी जाए, वह ऋण लेने की तिथि से दो मास की अवधि के भीतर स्वीकृति प्राधिकारी/बोर्ड को, पंजीकरण प्राधिकारी द्वारा/, उसके निजी नाम पर जारी किए गए पंजीकरण विलेख की साक्ष्यांकित अथवा फोटोस्टेट प्रतिलिपि प्रस्तुत करेगा। यदि वह ऐसा न कर पाए तो इस प्रकार निकलवाई गई सारी राशि उस पर ब्याज समेत, अभिदाता द्वारा एकमुश्त अपनी सामान्य भविष्य निधि में जमा कराई जाएगी। परंतु यह और कि यदि वह ऐसा न कर पाए तो स्वीकृति प्राधिकारी ब्याज समेत ऋण की राशि जमा न कराए जाने तक उसका वेतन रोक सकता है।
(2) विनियम-17 (1) (ए) (vii)ः
(ए) सक्षम प्राधिकारी किसी अभियंता को अपने निजी प्रयोग के लिए टेलिवीजन तथा प्रशीतक (रेफ्रिजरेटर) की खरीद के लिए निधि में उसके नाम जमा खड़ी समान्य भविष्य-निधि राशि में से लौटाया जाने वाला ऋण इस शर्त पर स्वीकार कर सकता है कि टी.वी. तथा प्रशीतक (रेफ्रिजरेटर) की खरीद के लिए राशि, प्रत्येक मामले में 5000/-रूपये या सामान्य भविष्य निधि राशि के आधे या टी.वी. तथा प्रशीतक की वास्तविक कीमत से, इनमें से जो भी कम हो, अधिक नहीं होगी।
(बी) टी.वी. तथा प्रशीतक की खरीद के लिए दूसरी अग्रिम राशि पिछली अग्रिम राशि के 10 वर्ष की समाप्ति के बाद विचार किया जाएगा।
(3) सामान्य भविष्य निधि विनियमों से संलग्न अनुबंध-'बी' में निम्नलिखित उपबन्ध शामिल कर दिए जाएंः-
विभागाध्यक्ष विनियम 17 (1) (ए) में निर्धारित शर्त के अधीन रहते हुए पूर्ण शक्तियां (ए) विनियम-(17) (I) (ए) (vi) एवं (17) (I) (ए) (vii) के अधीन अभिदाता को सामान्य भविष्य निधि से प्रत्यर्पणीय अग्रिम राशि स्वीकृत करना।
4. हरियाणा राज्य बिजली बोर्ड कर्मचारियों के लिए यथा लागू पंजाब राज्य बिजली बोर्ड सामान्य भविष्य निधि विनियम, 1960 का विनियम-35 (बी) का इसके द्वारा लोप किया जाता है।
इससे इस विषय पर जारी किया यादी संख्या चेन-5 (1-681) एनजीई/जी-154/एल-I दिनांक 16.4.84 तथा कार्यालय आदेश संख्या 125/जीबी/एलएम-I दिनांक 17.12.87 निरस्त हो जाते हैं।
ये संशोधन 15.09.1989 अर्थात कार्यालय आदेश जारी होने की वास्तविक तिथि से लागू माने जाएंगे।

No. 103/REG-253/Vol-IV.— In compliance with provisions contained in section 79(c) of Electricity Supply Act, 1948 as applicable w.e.f. 15.03.1984 to 13.08.1998 and read with provisions contained in section 56 (vi) of Haryana Electricity Reform Act, 1997 (Haryana Act No. 10 of 1998), the Governor of Haryana is pleased to notify the following amendments/ additional/deletion in the Punjab State Electricity Board General Provident Fund regulations, 1960 (as applicable to the H.S.E.B Worker's Union (H.O. Bhiwani) employees) issued by erstwhile HSEB vide Office Order No. 44/REG-23/Vol-II dated 15.09.1989 w.e.f. date of office order:-
In exercise of the powers conferred under clause ( c) of Section-79 of the electricity (supply) Act, 1948 and all other enabling powers in this behalf, the Haryana State Electricity Board is pleased to make the following amendments/additions/deletion in the Punjab State Electricity Board General Provident Fund regulations, 1960 (as applicable to the H.S.E.B employees) namely:-
(1) The followings provisions shall be added after Regulation-17 (1) (a) (v) :-
"REGULATION-17 (1) (a) (vi)"
(a) A Competent Authority may sanction refundable advance to a subscriber on his request from the amount standing at his credit in the G.P. Fund, for the purchase of a car or Motor Cycle or two wheeler Scooter or a Moped for his personal use.
(b) Any sum advanced to a subscriber for this propose from the amount in G.P. Fund, shall not exceed 3/4th of the balance at his credit in his G.P. Fund Account or the actual price of the vehicle whichever is less.
(c) If, a subscriber had received a Car or Motor Cycle, Scooter or Moped Advanced (in the shape of loan) earlier from the Board he will be entitled to draw the amount from his G.P. Fund only after the re- payment balance amount of advance/Loan, along- with interest , thereon , if any.
(d) The subscriber would be required to produced an aggrement executed between him and the seller or a written statement of the dealer or an agent of authorised company in regard to the proposed sale of Car, Motor-Cycle, Scooter or Moped with application as well as an affidavit to the effect that he had not taken any advanced from his G.P. Fund earlier for the propose of purchasing of Car, Motor Cycle , Scooter or Moped, Further that he has paid/deposited the balance amount of Loan/advance alongwith interest thereon, in case the advanced had been drown by him from the Board before submitting the application for the advance from G.P. Fund.
(e) If the Subscriber has received Loan from the Board, for the purchase of Car or Motor Cycle or two wheeler Scooter or Moped and still his requirement is not fulfilled, then the difference of the Loan and actual price of the vehicle or 75% at his credit whichever is less, will be admissible to him from G.P. fund as refundable advance.
(f) The eligility Limit (pay including special pay) for the purpose of grant of advance for purchase of Car, Motor Cycle, Scooter of Moped , is as under:-
(i) Car Advance: Board's employee drawing basis pay of Rs. 3000/-
P.M. and above.
(ii) Motor Cycle/
Scooter advance Board's employees drawing basic pay of Rs. 1500/- P.M and above.
(ii) Moped advance Boards employee drawing basic pay of Rs. 1150/-
P.M. and above.
NOTE: A subscriber who is permitted to withdraw money from the G.P. Fund under this regulation shal produce an attested or photostate copy of registration deed of the vehicle issued by the Registration Authority /, in his own name to the sanctioning authority/ Board within a period of two months from the date of draw I of advance. In case he fails to do so, the whole of the amount so withdrawn alongwith interest thereon shall be deposited in his G.P. Fund accounts by the subscriber in Lump-sum. Further if he fails to do so the sanctioning authority can with hold his salary till amount of advance alongwith interest is deposited.

(a) A competent authority may sanction refundable advance from the G.P. Fund to a subscriber from the amount standing at his credit in the Fund for the purchase of TV & Refrigerator for his personal use subject to the condition that the amount for the purchase of TV & Refrigerator should not exceed Rs. 5000/- in each case or half of the amount at his credit in G.P. Fund accumulation or the actual price of TV & Refrigerator which –ever is less.
(b) Second advance for the purchase of T.V. and Refrigerator, will be considered after the lapse of 10 years of previous advance.
(3) The following provisions may be incorporated in Annexure – 'B' appended to the General Provident Fund Regulations:-
(a) To sanction refundable advance Head of Department full Power
From G.P. Fund to the subscriber
Under regulation – (17) (I) (a) (vi) & Reg-17 (I) (a) (vii)
Subject to condition laid down in Regulation 17(1) (a) (4) Regulation – 35 (B) of Punjab State Electricity Board General Provident Fund Regulations, 1960, which are applicable to H.S.E.B. employees is hereby deleted.
This supersedes Memo No Ch- 5 (1-681) NGE/G-154/L-1 dated 16-4-84 and office order no 125/GB/LM-1 dated 17-12-87 issued on the subject.
These amendments are deemed to have come into force with effect from 15.09.1989 i.e. actual date of issuance of office order.
