संख्या 3/1/2020-RII.— हरियाणा नगर निगम अधिनियम, 1994 (1994 का 16) की धारा 392 छ के खण्ड (16) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा हरियाणा सरकार, षहरी स्थानीय निकाय विभाग, अधिसूचना संख्या 3/3/2019-आर-II., दिनांक 18 जुलाई, 2019, के प्रतिनिर्देष से, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा नगर निगम विज्ञापन (संषोधन) उप-विधियां, 2018 को आगे संषोधित करने के लिए, निम्नलिखित उप-विधियां बनाते हैं, अर्थात् :- 1. ये उप-विधियां हरियाणा नगर निगम विज्ञापन (संषोधन) उप-विधियां, 2020, कही जा सकती हैं। 2. हरियाणा नगर निगम विज्ञापन उप-विधियां, 2018 (जिन्हें, इसमें, इसके बाद, उक्त उप-विधियां कहा गया है) में, उप-विधि-2 में, खण्ड (1) में, उप-खण्ड (xxvii) के स्थान पर, निम्नलिखित उप-खण्ड प्रतिस्थापित किया जाएगा, अर्थात् :-
''(xxvii) रास्ता अधिकार या (आर.ओ.डब्ल्यू.) से अभिप्राय है,
(क) किसी राष्ट्रीय राजमार्ग की दषा में, राष्ट्रीय राजमार्ग का रखरखाव करने वाले प्राधिकरण के स्वामित्वाधीन भूमि की सीमा ;
(ख) किसी राष्ट्रीय राजमार्ग से भिन्न सड़क की और मुख्य परिवहन मार्ग से ठीक सटी सर्विस लेन वाली दषा में, सर्विस लेन तथा मुख्य परिवहन मार्ग की परिवहन मार्ग की सीमा ;
(ग) किसी राष्ट्रीय राजमार्ग से भिन्न और मुख्य परिवहन-मार्ग से ठीक सटी कोई सर्विस लेन नहीं होने की दषा में, मुख्य परिवहन मार्ग की परिवहन मार्ग सीमा ;''।
3. उक्त उप-विधियोें में, अनुसूची-1 में, पैरा 2 में, उप-पैरा (4) में, मद (i) के स्थान पर, निम्नलिखित मद प्रतिस्थापित की जाएगी, अर्थात् :-
(i) पार्श्विक मानदण्ड
(क) पार्ष्विक दूरी मानदण्ड अनुबन्ध-5 में वर्गीकरण 'क' में परिभाषित ओ.एम.डी. के सिवाए सभी प्रकार की ओ.एम.डी. पर लागू हैं ;
(ख) राष्ट्रीय राजमार्ग तथा राज्य राजमार्ग की दषा में, पार्ष्विक दूरी उप-विधि 2 के खण्ड (1) के उप-खण्ड (xxvii) में यथा परिभाषित आर.ओ.डब्ल्यू. के किनारे से मापी हुई 30 मीटर होगी तथा किसी भी मामले में ओ.एम.डी., राष्ट्रीय राजमार्ग के आर.ओ.डब्ल्यू. के भीतर अनुमत नहीं की जाएगी ;

(EXTRA.), MAY 15, 2020 (VYSK. 25, 1942 SAKA) 697 (ग) पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन अधिनियम, 1963 (1963 का पंजाब अधिनियम 41) के अधीन सरकार द्वारा घोषित अनुसूचित सड़क की दषा में, पार्ष्विक दूरी उप-विधि 2 के खण्ड (1) के उप-खण्ड (xxvii) में यथा परिभाषित आर.ओ.डब्ल्यू. के किनारे से मापी जाएगी। अनुज्ञेय पार्ष्विक दूरी या तो उपरोक्त मापे गए अनुसार सड़क के आर.ओ.डब्ल्यू. कीे चौड़ाई का एक तिहाई या कम से कम 10 मीटर, जो भी अधिक हो, होगी ;
(घ) सेक्टर सड़कों, नगरपालिका सड़कों तथा अनुसूचित स़ड़कों से भिन्न की दषा में, पार्ष्विक दूरी उप-विधि 2 के खण्ड (1) उप-खण्ड (xxvii) में यथा परिभाषित आर.ओ.डब्ल्यू. के किनारे से मापी जाएगी। दूरी आर.ओ.डब्ल्यू. की एक तिहाई या 10 मीटर, जो भी कम हो, होगी ;
(ड़) पार्ष्विक दूरी मानदण्ड, इन उप-विधियों के अनुसार नगर निगम के अनुमोदन के अध्यधीन सार्वजनिक शौचालयों, बस अड्डों, टोल प्लाजा के निकट स्थित टोल प्लाजा संरचना पर ओ.एम.डी. को लागू नहीं होगे ;
(च) किसी भी दषा मेंं, ओ.एम.डी को आर.ओ.डब्ल्यू. के भीतर स्थापित करने की अनुमति नहीं दी जाएगी ; (छ) यदि नगर पालिका सड़क का आर.ओ.डब्ल्यू. 20 मीटर से कम है, तो ओ.एम.डी. परिवहन मार्ग के समानान्तर आर.ओ.डब्ल्यू. के किनारे पर लगाया जाएगा तथा इसका आकार 4.6 x 3.05 मीटर तक निर्बन्धित है।''

Notification

No. 3/1/2020-RII.— In exercise of the powers conferred by clause (16) of Section 392 G of the Haryana Municipal Corporation Act, 1994 (16 of 1994) and with reference to Haryana Government, Urban Local Bodies Department, notification No. 3/3/2019- R II, dated the 18th July, 2019, the Governor of Haryana hereby makes the following bye-laws, further to amend the Haryana Municipal Corporation Advertisement Bye-laws, 2018, namely:-
1. These bye-laws may be called the Haryana Municipal Corporation Advertisement (Amendment) Bye-laws, 2020.
2. In the Haryana Municipal Corporation Advertisement Bye-laws, 2018 (hereinafter called the said bye-laws), in bye-law-2, in clause (1), for item (xxvii), the following items shall be substituted, namely:-
"(xxvii) Right of Way or (RoW)" means –
(a). in case of a National Highway, the extent of land owned by the authority maintaining the National Highway;
(b). in case of a road other than a National Highway and having service lanes immediately abutting the main carriageway, the carriageway limit of the service lanes and the main carriageway;
(c). in case of a road other than a National Highway and not having any service lane immediately abutting the main carriageway, the carriageway limit of the main carriageway.‖
3. In the said bye-laws, in Schedule-I, in clause 2, in sub-clause (4) (i), for item (i), the following item shall be substituted, namely:-
"(i) Lateral Criteria
(a) the lateral distance criteria are applicable to all type of OMDs, except OMDs defined under Typology ―A‖ in Annexure-5.
(b) in case of National Highways and State Highways the lateral distance shall be 30 metres measured from the edge of the ROW as defined in item (xxvii) of clause (1) of bye-law 2; and in no case OMDs, shall be permitted within ROW of the National Highway.
(c) in case of scheduled roads declared by the Government under the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 (Punjab Act 41 of 1963), the lateral distance shall be measured from the edge of the ROW as defined in item (xxiii) of clause (1) of bye-law 2. The permissible lateral distance shall be either 1/3rd of the width of the ROW of the road as measured above or minimum 10 metres, whichever is greater.

(EXTRA.), MAY 15, 2020 (VYSK. 25, 1942 SAKA)(d) in case of sector roads, municipal roads and roads other than scheduled roads, the lateral distance shall be measured from the edge of the ROW as defined in item (xxvii) of clause (1) of bye-law 2. The distance shall be 1/3rd of the ROW or 10 metres, whichever is lesser.
(e) the lateral distance criteria shall not apply to OMDs on public toilets, Bus stops, toll plaza structures located near toll plaza, subject to approval of the Municipal Corporation in accordance with these bye-laws.
(f) in no case, the OMD shall be allowed to install within the ROW.
(g) in case the ROW of municipal road is less than 20 metres, OMD shall be installed at edge of ROW parallel to carriageway and its size is restricted to 4.6 x 3.05 metres‖.
