संख्या 1/3/2005-1टी०सी०पी०.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा नगर योजनाकार सेवा (राज्य सेवा श्रेणी-I) नियम, 1976, को आगेे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. येे नियम हरियाणा नगर योजनाकार सेवा (राज्य सेवा श्रेणी- I) संषोधन नियम, 2020, कहे जा सकते हैं। 2. हरियाणा नगर योजनाकार सेवा (राज्य सेवा श्रेणी-I) नियम, 1976 (जिन्हें, इसमें, इसके बाद, मूल नियम कहा गया है ) में, नियम 5 में, ''पैन्तीस वर्ष'' षब्दों के स्थान पर, ''बयालीस वर्ष'' षब्द प्रतिस्थापित किए जाएंगे ।

3. उक्त नियमों में, नियम 14 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

''14. (1) अनुषासन, षास्तियों तथा अपीलों से संबंधित मामलों में, सेवा के सदस्य हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016, द्वारा षासित होंगे :

परन्तु ऐसी षास्तियों का स्वरूप जो लगाई जा सकती हैं, ऐसी षास्तियां लगाने के लिए सषक्त प्राधिकारी तथा अपील प्राधिकारी, भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि या नियमों केे उपबन्धों के अधीन रहते हुए वे हाेंगे, जो इन नियमों के परिषिष्ट ग में विनिर्दिष्ट हैं।

(2) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016, के नियम 9 के खण्ड (ग) या खण्ड (घ) के अधीन आदेष पारित करने के लिए सक्षम प्राधिकारी तथा अपील प्राधिकारी भी वही होंगे, जो इन नियमों के परिषिष्ट घ में विनिर्दिष्ट हैं''।

4. उक्त नियमों में, परिषिष्ट ख में, खाना 4 के नीचे क्रम संख्या 4 के सामने 'पदोन्नति द्वारा' षीर्ष के नीचे, विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएगी, अर्थात्‌ :-

''वरिष्ठ नगर योजनाकार के रूप में कम से कम पांच वर्ष का अनुभव''।

(1398)HARYANA GOVT. GAZ. (EXTRA.), JULY 20, 2020 (ASAR. 29, 1942 SAKA) 1399 5. उक्त नियमों में, परिषिष्ट ग के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

''देखिए नियम 14 (1)}

6. उक्त नियमों में, परिषिष्ट घ के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

'' (देखिए नियम 14 (2)}

No. 1/3/2005-1TCP.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Service of Town Planners (State Service Class I) Rules, 1976, namely :–

1. These rules may be called the Haryana Service of Town Planners (State Service Class I) Amendment Rules, 2020.

2. In the Haryana Service of Town Planners (State Service Class I) Rules, 1976 (herein after called the said rules), in rule 5, for the words and sign ―thirty-five‖, the words and sign ―forty-two‖ shall be substituted.

3. In the said rules, for rule 14, the following rule shall be substituted, namely :–

―14. Discipline, penalties and appeals.- (1) In matters relating to discipline, penalties and appeals, members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016, as amended from time to time:

Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority shall, subject to the provisions of any law or rules made under article 309 of the Constitution of India, be such as are specified in Appendix C to these rules.

(2) The authority competent to pass an order under clauses (c) or (d) of rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016 and the appellate authority shall be such as specified in Appendix D to these rules‖.

4. In the said rules, in Appendix B, under column 4, against serial number 4, under heading ‗By promotion', for the existing entries, the following entries shall be substituted, namely:–

―Minimum five years experience as Senior Town Planner‖.

5. In the said rules, for Appendix C, the following Appendix shall be substituted, namely:-

"APPENDIX C

6. In the said rules, for Appendix D, the following Appendix shall be substituted, namely :-

"APPENDIX D

[see rule 14 (2)]
