संख्या 1/13/2016-1पी०आर० (एफ०डी०).- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा सिविल सेवा (वेतन) नियम, 2020 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. (1) ये नियम हरियाणा सिविल सेवा (वेतन) संषोधन नियम, 2020, कहे जा सकते हैं।

(2) ये नियम प्रथम जनवरी, 2016 से लागू हुए समझे जाएंगे। 2. हरियाणा सिविल सेवा (वेतन) नियम, 2016 में, नियम 11 में, खण्ड (ii) के स्थान पर निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

"(ii) यदि पश्चातवर्ती नियुक्ति के लिए आवेदन उचित माध्यम से प्रस्तुत किया गया है, तो नियमित आधार पर पद धारण करने वाले किसी सरकारी कर्मचारी का वेतन उसके द्वारा नियमित रूप से धारित पद के उच्चतर स्तर में प्राप्त किए जा रहे वेतन के बराबर चरण में निर्धारित किया जाएगा। यदि ऐसा कोई भी चरण उपलब्ध नहीं हैं, तो नियमित रूप से धारित पद के उच्चतर स्तर में उस द्वारा प्राप्त किए जा रहे वेतन के संबंध में निम्न स्तर में आगामी निम्न चरण में वेतन निर्धारित किया जाएगा और वेतन में अंतर को भविष्य की वेतनवृद्धि (वेतनवृद्धियों) में समायोजित करते हुए वैयक्तिक वेतन के रूप प्रदान किया जा सकता है। यदि निम्न स्तर, जिस पर वह नियुक्त किया गया है, पर वेतन अनुक्रम का अधिकतम अनुलम्ब रैंज, उस द्वारा उच्चतर स्तर में प्राप्त किए जा रहे वेतन से कम होती है, तो उसका वेतन उस अधिकतम तक सीमित हो सकता है।"

No. 1/13/2016-1PR(FD).— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Civil Services (Pay) Rules, 2016, namely:-

1. (1) These rules may be called the Haryana Civil Services (Pay) Amendment Rules, 2020.

(2) These rules shall be deemed to have come into force with effect from the 1st January, 2016.

2. In the Haryana Civil Services (Pay) Rules, 2016 in Rule 11(ii) following clause shall be substituted namely:-

" (ii) If the application for subsequent appointment is submitted through proper channel, pay of the Government employee holding a post on regular basis will be fixed at the stage equal to the pay drawn by him in the higher level of post held regularly. If no such stage is available, the pay will be fixed at the stage next below in the lower level with respect to the pay drawn by him in the higher level of the post held regularly and the difference in the pay may be granted as personal pay to be absorbed in future increment(s). If maximum of the vertical range of pay progression at the lower level in which he is appointed, happens to be less than the pay drawn by him/her in the higher level, his pay may be restricted to that maximum."
