संख्या सा०का०नि०-9/संवि०/अनु० 309.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा परिवहन विभाग (ग्रुप क) सेवा नियम, 1992 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. (1) ये नियम हरियाणा परिवहन विभाग (ग्रुप क) सेवा संषोधन नियम, 2020, कहे जा सकते है।

(2) जब तक अन्यथा से उपबन्धित न हो, ये नियम 27 मार्च, 1992 से लागू हुए समझे जाएंगे।

2. हरियाणा परिवहन विभाग (ग्रुप क) सेवा नियम, 1992 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 5 में, ''पैंतीस'' षब्द के स्थान पर, ''बयालीस'' षब्द प्रतिस्थापित किया जाएगा तथा 26 अगस्त, 2014 से प्रतिस्थापित किया गया समझा जाएगा।

3. उक्त नियमो में, नियम 9 में, उप-नियम (1) में, खण्ड (ठ) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किए जाएंगे, अर्थात्‌ :-

''(ठ) महाप्रबन्धक की दषा में,-

(i) कर्मषाला प्रबन्धक, सेवा अभियन्ता, स्टोर खरीद अधिकारी या यातायात प्रबन्धक में से पदोन्नति द्वारा; या (ii) हरियाणा सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी ग्रुप क अधिकारी के स्थानान्तरण या प्रनिनियुक्ति द्वारा;

(ड) सचिव, प्रादेषिक परिवहन प्राधिकरण की दषा में,-

4. उक्त नियमो में, नियम 14 में,-

(i) उप-नियम (1) में, ''हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 1987'' षब्दो, कोष्ठकों, चिह्‌न तथा अंकों के स्थान पर, ''हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016'' षब्द, कोष्ठक, चिह्‌न तथा अंक प्रतिस्थिापित किए जाएंगे तथा 19 जुलाई, 2016 से प्रतिस्थिापित किए गए समझे जाएंगे; तथा

(ii) उप-नियम (2) में, ''हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 1987 के नियम 9 के उप-नियम (1) के खण्ड (ग) या खण्ड (घ) ''षब्दों, कोष्ठकों, चिह्‌न तथा अंकों के स्थान पर, ''हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 के नियम 9 के खण्ड (ग) या खण्ड (घ)'' षब्द, कोष्ठक चिह्‌न तथा अंक प्रतिस्थिापित किए जाएंगे तथा 19 जुलाई, 2016 से प्रतिस्थिापित किए गए समझे जाएंगे।

5. उक्त नियमों में, परिषिष्ठ क में, अन्त में विद्यमान टिप्पण के स्थान पर, निम्नलिखित टिप्पण प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

'' टिप्पण.- यदि क्रम संख्या 3,4,8,13,14 तथा 15 में वर्णित कोई पद, स्थानान्तरण या प्रतिनियुक्ति द्वारा नियुक्त किसी अधिकारी द्वारा धारण किया जाता है, तो वह अपने संवर्ग में उसे यथा अनुज्ञेय या उपरोक्त यथा विहित वेतनमान, जो भी अधिक हो, में अपना वेतन प्राप्त करेगा''।

6. उक्त नियमों में, परिषिष्ठ ख में, अन्त में विद्यमान टिप्पण 2 के बाद, निम्नलिखित टिप्पण जोड़ा जाएगा, अर्थात्‌ :-

''टिप्पण 3.- यदि क्रम संख्या 14 तथा 15 में वर्णित पद,

स्थानान्तरण या प्रतिनियुक्ति द्वारा नियुक्त किसी अधिकारी द्वारा धारण किया जाता है, तो उपरोक्त खाना 4 मेें वर्णित योग्यताएं तथा अनुभव लागू नहीं होगा।''।316 HARYANA GOVT. GAZ. (EXTRA.), NOV. 26, 2020 (AGHN. 5, 1942 SAKA) 7. उक्त नियमों में, परिषिष्ठ ग में,-

(i) क्रम संख्या 1 से 15 के सामने, खाना 4 के नीचे, विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी तथा 19 जुलाई, 2016 से प्रतिस्थापित की गई समझी जाएंगी, अर्थात्‌ :-

'' 1. छोटी षास्तियां,-

हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 में यथा विहित ।

2. बड़ी षास्तियां, -

हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 में यथा विहित ।'' ।

(ii) निम्नलिखित टिप्पण जोड़ा जाएगा तथा 27 मार्च, 1992 से जोड़ा गया समझा जाएगा, अर्थात्‌ :-

टिप्पण.- यदि क्रम संख्या 2,3,4,6,8,13,14 तथा 15 में वर्णित पद, स्थानान्तरण या प्रतिनियुक्ति द्वारा भरे जाते हैं, तो वे उन्हें यथा लागू उनके अपने-अपने सेवा नियमों द्वारा षासित होेंगे।''।

Notification

The 26th November, 2020

No. G.S.R. 9/Const./Art./309.— In exercise of the powers conferred by the proviso to article 309 of the constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Transport Department (Group A) Service Rules, 1992, namely:-

1. (1) These rules may be called the Haryana Transport Department (Group A) Service Amendment Rules, 2020.

(2) Unless otherwise provided, these rules shall be deemed to have come into force with effect from the 27th March, 1992.

2. In the Haryana Transport Department (Group A) Service Rules, 1992 (hereinafter called the said rules), in rule 5, for the words ―thirty five‖, the words ―forty-two‖ shall be substituted and shall be deemed to have substituted with effect from the 26th August, 2014.

3. In the said rules, in rule 9, for clause (l), the following clauses shall be substituted, namely:–

―(l) in the case of General Manager ,-

(i) by promotion from amongst Works Manager, Service Engineer, Stores Purchase Officer or Traffic Manager; or

(ii) by transfer or deputation of an Officer of Group A already in the service of the Government of Haryana or the Government of India ;

(m) in the case of Secretary, Regional Transport Authority,-

(i) by promotion from amongst Works Manager, Service Engineer, Stores Purchase Officer or Traffic Manager; or

(ii) by transfer or deputation of an Officer of Group A already in the service of the Government of Haryana or the Government of India.‖.

4. In the said rules, in rule 14, –

(i) in sub-rule (1), for the words, signs, figures and brackets ―Haryana Civil Services (Punishment and Appeal) Rules, 1987‖, the words, signs, figures and brackets ―Haryana Civil Services (Punishment and Appeal) Rules, 2016‖ shall be substituted and shall be deemed to have been substituted with effect from 19th July, 2016;

(ii) in sub-rule (2), for the words, signs, figures and brackets ―clause (c) or clause (d) of sub-rule (1) of rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 1987‖, the words, signs, figures and brackets ―clause (c) or clause (d) of rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016‖ shall be substituted and shall be deemed to have been substituted with effect from 19th July 2016.

5. In the said rules, in Appendix A, for the existing Note at the end, the following Note shall be substituted, namely :-

"Note.— If any post mentioned at serial number 3,4,8,13,14 and 15 is held by an Officer appointed by transfer or deputation, then he shall draw pay in the pay scales as admissible to him in his cadre or as prescribed above, whichever is higher.‖

6. In the said rules, in Appendix B, after Note 2, the following Note shall be added, namely :-

"Note 3.— ―If any post mentioned at serial number 14 and 15 is held by an Officer appointed by transfer or deputation, the qualification and experience mentioned in column 4 above shall not be applicable.‖.

7. In the said rules, in Appendix C ,-

(i) against serial numbers 1 to 15, under column 4, for the existing entries, the following entries shall be substituted and shall be deemed to have been substituted with effect from 19th July, 2016, namely:-

―1. Minor Penalities .–

As prescribed in the Haryana Civil Services (Punishment and Appeal) Rules, 2016.

2. Major Penalities.– As prescribed in the Haryana Civil Services (Punishment and Appeal) Rules, 2016.‖.

(ii) the following Note shall be added and shall be deemed to have been added with effect from the 27th March, 1992, namely :-

"Note.— If the posts mentioned at serial number 2,3,4,6,8,13,14 and 15 are filled up by the transfer or deputation, the same shall be governed by their respective Service Rules as applicable to them.‖.
