अधिसूचना

दिनांक 27 नवम्बर, 2020 क्रमांक एस०ई०सी०/3एम०ई०/2020/2632.- यह कि हरियाणा सरकार द्वारा जारी अधिसूचना संख्या का०आ० 52/ह०अ० 24/1973/धा० 257 तथा धारा 276/2020, दिनांक 30 अक्तूबर 2020 द्वारा हरियाणा नगरपालिका अधिनियम, 1973 में संषोधन किए गये हैं, जिसके अनुसार नगर परिषद्‌/नगर पालिका के सभी चुनाव, प्रधान सहित, नगर परिषद्‌/नगर पालिका के वार्डों के व्यक्तियों द्वारा प्रत्यक्ष रूप से किया जाएगा।

2. और यह की, वर्तमान स्थिति में राज्य निर्वाचन आयोग, हरियाणा, भारत के संविधान के अनुच्छेद्‌ 243ZA, हरियाणा नगरपलिका निर्वाचन नियम, 1978 के नियम 18 के उप-नियम (1) के साथ पठित के तहत प्रदत्त षक्तियों और अन्य प्रदत्त षक्तियों का प्रयोग करते हुए, पहले जारी की गई अधिसूचना संख्या क्रमांक एस०ई०सी०/3 एम.ई./2017/175, दिनांक 18.01.2017 का अतिक्रमण करते हुये नगर परिषद्‌/नगर पालिका के सदस्यों एंव प्रधान के चुनाव के लिए निम्नलिखित चुनाव प्रतीकों की सूची प्रकाषित करता है :-

श्रेणी (ग) प्रधान पद के लिए आजाद उम्मीदवारों के चुनाव प्रतीक

श्रेणी (घ) नगर परिषद्‌/नगरपालिका सदस्यों के लिए आजाद उम्मीदवारों के चुनाव प्रतीक

3. राज्य निर्वाचन आयोग, हरियाणा आगे यह भी निर्देषित करता है कि यदि प्रधान पद के उम्मीदवारों के लिए पर्याप्त मुक्त चुनाव प्रतीक नहीं है तो प्रधान के उम्मीदवारों के चुनाव प्रतीक आबंटन का कार्य, नगर परिषद्‌/नगरपालिका के सभी वार्डों के उम्मीदवारों के चुनाव प्रतीकों के आबंटन के पूरा होने तक रोक दिया जाएगा। नगर परिषद्‌/नगरपालिका के सदस्य के लिए सभी वार्डों के उम्मीदवारों को चुनाव प्रतीकों के आबंटन के बाद बचे हुये मुक्त चुनाव प्रतीक प्रधान के उम्मीदवारों को आंबटित किये जा सकते हैं। उदाहरण के लिए प्रधान के उम्मीदवारों के लिए 48 मुक्त चुनाव प्रतीक हैं और सभी आबंटित किए जा चुके है, और नगर परिषद्‌/नगरपालिका के सभी वार्डों में उम्मीदवारों को मुक्त चुनाव प्रतीकों के आंबटन के बाद, षेष बचे हुए मुक्त चुनाव प्रतीकों को प्रधान के उम्मीदवारों को आबंटित किया जा सकता है।

4. राज्य निर्वाचन आयोग हरियाणा यह भी निर्देष देता है कि अगर सदस्य नगर परिषद्‌/नगरपालिका के मामले में भी यही स्थिति उत्पन्न होती है, तो प्रधान पद के षेष बचे हुये मुक्त चुनाव प्रतीक सदस्य उम्मीदवारों को आबंटित किये जा सकते हैं।

Notification

The 27th November, 2020

No. SEC/3ME/2020/2632.— Whereas, the Government of Haryana vide notification No. S.O.52/H.A.24/ 1973/S. 257 & S. 276/2020, dated 30th October, 2020 has amended the Haryana Municipal Act, 1973, according to which including a President of Municipal Council/Committee is to be filled by person chosen by direct election from the territorial constituencies/wards in the Municipal area.

2. And whereas, in view of the present situation, the State Election Commission, Haryana in exercise of powers conferred under Article 243ZA of the Constitution of India, sub rule (1) of rule 18 of the Haryana Municipal Election Rules, 1978 read with para 5 of the Haryana Municipal Councils and Municipal Committees Election Symbols (Reservation and Allotment) Order, 2020 issued vide No. SEC/3ME/2020/2514, dated 27.11.2020 and all other powers enabling in this behalf, hereby supersede its earlier Notification No. SEC/3ME/2017/175, dated 18.01.2017 hereby publish the revised list of symbols for the contesting candidates, contesting election of President and Member of the Municipal Council and Municipal Committee in the Haryana State, as under :–

3. State Election Commission, Haryana further directs that if there is no sufficient free election symbol for the candidates of President of Municipal Council/Committee then the work of allotment of election symbol to thePART-I] HARYANA GOVT. GAZ., DEC. 8, 2020 (AGHN. 17, 1942 SAKA) 2257 candidates of President of Municipal Council/Committee shall be stopped till the completion of allotment of election symbols to the candidates in all wards of Municipal Council/Committee. The free election symbols left after the allotment of election symbols to the candidates in all wards of Municipal Council/Committee. The free election symbols left after the allotment of election symbols to the candidates in all wards for member of Municipal Council/Committee may be allotted to the candidates of President of Municipal Council/Committee. For example there are 48 free election symbols for candidates of President of Municipal Council/Committee and all are allotted, and after allotment of free election symbols to the candidates for members in all wards of Municipal Council/Committee, remaining free election symbols may be allotted to the candidates of President of Municipal Council/Committee.

4. State Election Commission, Haryana also directs that if the same situation arises in the case of member, Municipal Council/Committee then remaining free symbols for the post of President of Municipal Council/ Committee may be allotted to the candidates of members.
