संख्या 22/30/2021-3T-I.- हरियाणा मोटरयान नियम, 1993 को आगे संषोधित करने के लिए नियमों का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल, इसके द्वारा, मोटरयान अधिनियम, 1988 (1988 का केन्द्रीय अधिनियम 59), की धारा 28, 38, 65, 93, 95, 96, 107, 111, 138, 176 तथा 213 द्वारा प्रदा षक्तियों का प्रयोग करते हुए, बनाने का प्रस्ताव करते हैं, उक्त अधिनियम की धारा 212 की उप-धारा (1) द्वारा यथा अपेक्षित, इसके द्वारा, उन सभी व्यक्तियों की जानकारी के लिए प्रकाषित किया जाता है, जिनके इससे प्रभावित होने की सम्भावना है।
इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाषन की तिथि से सात दिन की अवधि की समाप्ति पर या उसके बाद, सरकार द्वारा नियमों के प्रारूप पर, ऐसे आक्षेपों या सुझावों, यदि कोई हो, सहित, जो प्रधान सचिव, हरियाणा सरकार, परिवहन विभाग, चण्डीगढ़ द्वारा नियमों के प्रारूप के सम्बन्ध में किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किए जाएं, विचार किया जाएगा।
प्रारूप नियम
1. ये नियम हरियाणा मोटरयान (संषोधन) नियम, 2024 कहे जा सकते हैं।
2. हरियाणा मोटरयान नियम, 1993 (जिन्हे, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 225 के उप-नियम (1), में,-
(i) खण्ड (xvii) में, अन्त में विद्यमान चिह्न " , " के स्थान पर, ";" चिह्न प्रतिस्थापित किया जाएगा; तथा (ii) खण्ड (xvii) के पश्चात, निम्नलिखित खण्ड जोड़ा जाएगा, अर्थात्ः-
"(xviii) परिवहन निरीक्षक, प्रादेषिक परिवहन प्राधिकरण।"
3. उक्त नियमों में, नियम 226 में, उप-नियम (1) में, अनुसूची में,
(i) खाना, 1, 2 तथा 3 के नीचे क्रम संख्या 17 और उसके सामने विद्यमान प्रविष्टियों के पश्चात, निम्नलिखित क्रम संख्या और उसके सामने प्रविष्टियां जोड़ी जाएंगी, अर्थात्ः-

(ii) परन्तुक में,-
(क) अन्त में विद्यमान चिह्न " , " के स्थान पर, ":" चिह्न प्रतिस्थापित किया जाएगा; तथा
(ख) विद्यमान परन्तुक के पश्चात, निम्नलिखित परन्तुक जोड़ा जाएगा, अर्थात्ः-
"परन्तु यह और कि क्रम संख्या 18 के सामने उल्लिखित अधिकारी, सम्बन्धित जिला परिवहन अधिकारी-सह-सचिव, प्रादेषिक परिवहन प्राधिकरण द्वारा, परिवहन आयुक्त, हरियाणा की पूर्वानुमति से जारी किए गए आदेषों के अनुसार ऐसी समयावधि के लिए और ऐसे क्षेत्र के लिए, जैसा उक्त आदेषों में विनिर्दिष्ट किया जाए, चालान की शक्तियों का प्रयोग करेगा।"

No. 22/30/2021-3T-I.— The following draft of the rules further to amend the Haryana Motor Vehicles Rules, 1993, which the Governor of Haryana proposes to make in exercise powers conferred by sections 28, 38, 65, 93, 95, 96, 107, 111, 138, 176 and 213 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for the information of persons likely to be effected thereby.
Notice is hereby given that the draft of the rules will be taken into consideration by the Government on or after the expiry of a period of seven days from the date of publication of this notification in the Official Gazette together with objections or suggestions, if any, which may be received by the Additional Chief Secretary/Principal Secretary to Government, Haryana, Transport Department, Chandigarh, with respect to the draft of the rules before the expiry of the period so specified.–
Draft Rules
1. These rules may be called the Haryana Motor Vehicles (Amendment) Rules, 2024.
2. In the Haryana Motor Vehicles Rules, 1993, (hereinafter called the said rules), in rule 225 in sub-rule (1); (i) in clause (xvii), for the sign "," existing at the end, the sign ";" shall be substituted; and
(ii) after clause (xvii), the following clause shall be added, namely:-
"(xviii) Transport Inspector, Regional Transport Authority."
3. In the said rules, in rule 226, in sub-rule (1), in schedule,-
(i) under columns 1,2 and 3, after serial number 17 and entries there against, the following serial number and entries there against shall be added, namely:

(ii) in the proviso,-
(a) for the sign "," existing at the end, the sign";" shall be substituted; and
(b) after the existing proviso, the following proviso shall be added, namely:-
"Provided further that the officer mentioned against serial number 18 above shall exercise the powers of Challan, as per the orders issued by the concerned DTO-cum-Secretary, Regional Transport Authority with the prior approval of Transport Commissioner, Haryana, for such time period and for such area, as specified in the said order."
