संख्या Misc-1026/2021/3390.- पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन नियम, 1965, हरियाणा राज्यार्थ को आगे संशोधित करने के लिए नियमों का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल, पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन अधिनियम, 1963 (1963 का पंजाब अधिनियम 41), की धारा 25 की उपधारा (2) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करते हैं, उक्त धारा की उपधारा (1) द्वारा यथा अपेक्षित ऐसे सभी व्यक्तियों की जानकारी के लिए, इसके द्वारा प्रकाशित किया जाता है, जिनके इससे प्रभावित होने की सम्भावना है।
इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाशन की तिथि से तीस दिन की अवधि की समाप्ति पर अथवा उसके पश्चात् सरकार, नियमों के प्रारूप पर, ऐसे आक्षेपों या सुझ्ाावों सहित, यदि कोई हों, जो प्रधान सचिव, हरियाणा सरकार, नगर तथा ग्राम आयोजना विभाग, चण्डीगढ़ द्वारा लिखित रूप में प्रारूप नियमों के सम्बन्ध में किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किए जायें, विचार करेगी।
प्रारूप नियम
1 ये नियम पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन (द्वितीय संशोधन) नियम, 2020, कहे जा सकते हैं।
2 पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन नियम, 1965 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 26 घ में, खण्ड (छ) में, '' अनुसूची IV'' षब्द तथा अंक के स्थान पर ''अनुसूची IV/IV ख'' षब्द , अंक तथा चिह्न'' 31.03.2022 को समाप्त होने वाली अवधि के लिए प्रतिस्थापित किए जाएंगे।
3 उक्त नियमों में, अनुसूची IV में, खाना 3 के नीचे, '' तथा पंचकुला में परिधि नियन्त्रित क्षेत्र'' चिह्रन तथा षब्दाें का लोप 31.03.2022 तक कर दिया जाएगा।
4 उक्त नियमों में, अनुसूची IV के बाद, निम्नलिखित अनुसूची जोड़ी जाएगी, अर्थात :-

टिप्पणी :-
(i) प्रयुक्त संकेताक्षर एन०एच०ः नेशनल हाईवे, एस०आर०- शैड्यूल रोड ;
(ii) सैक्टर सड़क विकास योजना पर दर्षाये अनुसार सैक्टर विभाजक सड़क है ;
(iii) जहां भूमि का टुकड़ा एक प्रवर्ग से अधिक में पड़ता है, वहां पर उच्चतर/उच्चतम दर लागू होंगी ;
(iv) पचास प्रतिशत संपरिवर्तन प्रभार, उद्योग विभाग, हरियाणा द्वारा घोषित औद्याोगिक रूप से पिछड़े क्षेत्र में अवस्थित खाद्य प्रसंस्करण इकाई के लिए प्रभारित किये जायेंगे ;
(v) हरियाणा राज्य में अक्षय उर्जा विद्युत परियोजनाओं के लिए कोई भी संपरिर्वतन प्रभार तथा संवीक्षा फीस प्रभारित नहीं की जाएगी ;
(vi) आमोद-प्रमोद परियोजनाओं के भीतर वाणिज्यिक घटक जैसे होटल, प्रर्दशनी केन्द्रों, रेस्टोरैंट, सम्मेलन केन्द्र इत्यादि पर लागू वाणिज्यिक दरें प्रभारित की जाएंगी ;
(vii) पचास प्रतिशत संपरिवर्तन प्रभार इन्टरप्राइज्ज प्रमोशन पॉलिसी 2015 में यथा परिभाषित सूक्ष्म, लघु और मध्यम इन्टरप्राइज्ज के लिए सरकार द्वारा यथा अधिसूचित ख, ग और घ प्रवर्ग ब्लॉकस में उदग्रहीत किए जाएंगे ;
(viii) धार्मिक/आध्यात्मिक प्रवचन/नैतिक शिक्षा देने वाली संस्थानाें/संगठनाें की दशा में परिवर्तन प्रभार अनुमोदित आच्छादित क्षेत्र/ फर्श क्षेत्र अनुपात के अनुसार उदग्रहीत होंग ;-
(ix) ट्रांजिट ओरियंटिड विकास की दषा मेंं परिवर्तन प्रभार यथानुपात आधार पर उदग्रहीत किए जाएंगे अर्थात 0.25 फर्श क्षेत्र अनुपात के प्रत्येक बढ़े हुए स्लैब के लिए संबंधित उपयोग के लिए प्रभार विहित दरों के अनुसार 25 प्रतिशत के लिए लागू प्रभारों के अनुसूची-IV बराबर अतिरिक्त शुल्क के लागू होंगे तथापि परिवर्तन प्रभार का पूरा भुगतान ट्रांजिट ओरियंटिड विकास पालिसी के अधीन नई अनुज्ञप्तियों हेतु भूगतान योग्य होगा ;
(x) मिश्रित भूमि उपयोग परियोजना के मामले में परिवर्तन प्रभार उपयोगों के अनुपात में उदगृहीत किए जाएंगे ;
346 HARYANA GOVT. GAZ. (EXTRA.), FEB. 11, 2021 (MAGH. 22, 1942 SAKA)(xi) नई एकीकृत अनुज्ञापन पॉलिसी के लिए आवासीय घटकों पर संपरिवर्तन प्रभार, प्रस्तावित फर्श क्षेत्र अनुपात अर्थात् वर्ग आवासीय कालोनी के लिए अधिसूचित तत्स्थानी दरों के 5/7 की दर के अनुपात में वसूल किये जायेंगे ;
(xii) दीनदयाल जन आवास योजना के अधीन स्वीकृत प्लोटिड आवासीय उपनिवेश के लिए परिवर्तन प्रभारों की छूट दी गई है ;
(xiii) ये प्रभार 31 मार्च, 2022 तक की अनुमति मांगने हेतु किए गए आवेदनों पर लागू होंगें।

No. MISC-1026/Asst.(AK)/2021/3390.— The following draft of rules further to amend the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Rules, 1965, in its application to the State of Haryana, which the Governor of Haryana proposes to make in exercise of the powers conferred by sub-section (1) read with sub-section (2) of section 25 of the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 (Punjab Act 41 of 1963), is hereby published as required by sub-section (1) of the said section, for the information of persons likely to be affected thereby.
Notice is hereby given that the draft of rules shall be taken into consideration by the Government on or after the expiry of a period of thirty days from the date of the publication of this notification in the Official Gazette, together with the objections or suggestions, if any, which may be received in writing, by the Principal Secretary to Government, Haryana, Town and Country Planning Department, Chandigarh, from any person in respect of the draft rules before the expiry of the period so specified.
DRAFT RULES
1. These rules may be called the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development (Second Amendment) Rules, 2020.
2. In the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Rules, 1965 (herein after called the said rules), in rule 26-A, in clause (g), for the word and figure ―Schedule IV‖, the word, figures and sign ―Schedule IV/IVB‖ shall be substituted for the period ending 31.03.2022.
3. In the said rules, in Schedule IV, under column 3, the words ―and periphery controlled area of Panchkula‖ shall be omitted till 31.03.2022.

Notes.—
1. Abbreviations used indicate NH: National Highway; SR: Scheduled Road.
2. Sector Road is the Sector dividing road as indicated on the Development Plan.
3. Where a piece of land falls in more than one category, the Higher/Highest rate shall apply.
4. 50 percent conversion charges shall be charged for food processing unit located in industrially backward area declared by the Industries Department, Haryana.
5. No conversion charges and scrutiny fee shall be charged for renewable energy power projects in the State of Haryana.
6. The commercial components like hotels, exhibition centers, restaurants, convention centers etc. shall be charged at applicable commercial rates within the recreational projects.
7. 50% conversion charges shall be levied in B, C & D category blocks as notified by the Government, for Micro, Small and Medium Enterprise as defined in the Enterprises Promotion Policy-2015.
8. In case of Institutions/Organizations imparting religious/spiritual preaching/moral education, the conversion charges be levied as per covered area/FAR approved.
9. In case of Transit Oriented Development, the conversion charges shall be levied on pro-rata basis i.e. for every increased slab of 0.25 FAR, the additional charges equivalent to the charges applicable for FAR of 25% as per the rates prescribed for respective use in Schedule-IV shall be applicable. However, full payment of conversion charges shall be payable for fresh licences under Transit Oriented Development Policy.
10. The conversion charges shall be levied proportionate to the uses in case of mixed land use project.
11. For New Integrated Licencing Policy, the conversion charges on the residential component shall be recovered in proportion to the proposed FAR i.e. at 5/7th of the corresponding rates notified for group housing colonies.
12. For Affordable Plotted Residential Colonies permitted under Deen Dayal Jan Awas Yojana, the conversion charges are exempted.
13. These charges shall be applicable on the applications for seeking permission upto and including the 31st March, 2022‖.
