संख्या 8/134-2019 पी०एस०(1).- हरियाणा विद्यालय षिक्षा अधिनियम, 1995 (1999 का 12), की धारा 24 की उप-धारा (2) के साथ पठित उप धारा (1) द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा विद्यालय षिक्षा नियम, 2003, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :- 1. (1) ये नियम हरियाणा विद्यालय षिक्षा (संषोधन) नियम, 2021, कहे जा सकते हैं। (2) ये राजपत्र में इनके प्रकाषन की तिथि से लागू होंगे। 2. हरियाणा विद्यालय षिक्षा नियम, 2003 में, नियम 30 में, उप नियम (1) में, खण्ड (ख) में, उप खण्ड (1) के स्थान पर, निम्नलिखित उप खण्ड प्रतिस्थापित किया जायेगा अर्थात्‌ :-

"(i) भूमि

विद्यालय श्षहरी/नियंत्रित क्षेत्र ग्रामीण

प्राईमरी 1500 वर्ग मीटर 2500 वर्ग मीटर मिडल 2000 वर्ग मीटर 3000 वर्ग मीटर माध्यमिक 2500 वर्ग मीटर 4000 वर्ग मीटर वरिष्ठ माध्यमिक 2 संकाय-3000 वर्ग मीटर 2 संकाय-5000 वर्ग मीटर

3 संकाय-3500 वर्ग मीटर 3 संकाय-5500 वर्ग मीटर :

परन्तु हरियाणा विद्यालय षिक्षा नियम, 2003 के प्रारम्भ से पहले मान्यताप्राप्त/अमान्यताप्राप्त चल रहे विद्यालयों के लिए भूमि के मानक निम्न प्रकार से होंगेः-

विद्यालय श्षहरी/नियंत्रित क्षेत्र ग्रामीण

प्राईमरी 250 वर्ग मीटर 350 वर्ग मीटर मिडल 500 वर्ग मीटर 600 वर्ग मीटर माध्यमिक 1200 वर्ग मीटर 1500 वर्ग मीटर

वरिष्ठ माध्यमिक 2 संकाय-1800 वर्ग मीटर 2 संकाय-2250 वर्ग मीटर

3 संकाय-2000 वर्ग मीटर 3 संकाय-2500 वर्ग मीटर "

GAZ., APR. 27, 2021 (VYSK. 7, 1943 SAKA) [PART I 324 उपरोक्त के अतिरिक्त ये विद्यालय विद्यार्थियों की संख्या के अनुसार युक्तियुक्त दूरी के भीतर पर्याप्त खेल के मैदान का प्रबन्ध या व्यवस्था करेंगे। यदि खेल के मैदान की दूरी विद्यालय से 500 मीटर से अधिक है तब विद्यालय प्राधिकारी विद्यार्थियों को मुफ्त यातायात सुविधा प्रदान करेंगे।

विद्यालय, सरकारी विद्यालयों से किसी शैक्षणिक संस्था, स्टेडियम, खुले स्थान को जोड़ सकती है जिनका उपयोग स्थानीय निकायों के खेल के मैदान के रूप में किया जाता है। खेल का मैदान रखने वाले एक प्राधिकरण से अधिकतम दो विद्यालय जोडे़ जा सकते है :

परन्तु यह और कि भूमि के ढील दिए गए मानक उन विद्यालयों को (पथकरूप से संख्या 8/7-09 पी0एस0 (2), दिनांक 21 फरवरी, 2009 द्वारा अधिसूचित) जो 31 मार्च, 2007 से पूर्व अस्तित्व में थे तथा जिन्होंने 10 अप्रैल, 2007 द्वारा मान्यता/अपग्रेडेषन के लिए आवेदन किया हो, को भी लागू होंगे।

आच्छदित क्षेत्र तथा खुला क्षेत्र 35/65 प्रतिषत के अनुपात में होगा। तथापि, जहां शहरी स्थानीय निकाय अथवा नगर आयोजना विभाग निहित विभिन्न फलोर क्षेत्र अनुपात मानक, उनको लागू होंगे।

टिप्पणीः- निजी विद्यालय, कम से कम बीस वर्ष की अवधि के अप्रवर्तनीय पटटाविलेख के साथ पटटाधृति आधार पर किराये पर लिये गये भवन/भूमि में चलाया जा सकता है बषर्तें कि ऐसा विद्यालय इन नियमों के अधीन यथा विनिर्दिष्ट भूमि तथा भवन के मानक पूरे करता हो;"।

Notification

The 16th April, 2021

No. 8/134-2019 PS(1).— In exercise of the powers conferred by sub-section (1) read with sub-section (2) of section 24 of the Haryana School Education Act, 1995 (12 of 1999), the Governor of Haryana hereby makes the following rules further to amend the Haryana School Education Rules, 2003, namely:-

1. (1) These rules may be called the Haryana School Education (Amendment) Rules, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Haryana School Education Rules, 2003 in rule 30, in sub-rule (1), in clause (b), for sub-clause (i), the following sub clause shall be substituted, namely:-

"(i) Land

Schools Urban/Controlled Area Rural

Primary 1500 Square meters 2500 Square meters Middle 2000 Square meters 3000 Square meters Secondary 2500 Square meters 4000 Square meters Senior 2 Stream- 3000 Square meters 2 Streams-5000 Square meters Secondary 3 Stream-3500 Square meters 3 Streams-5500 Square meters:

Provided that the norms of land for the schools running recognized/unrecognized before commencement of the Haryana School Education Rules, 2003, shall be as under:-

Schools Urban/ Controlled Area Rural

Primary 250 Square meters 350 Square meters Middle 500 Square meters 600 Square meters Secondary 1200 Square meters 1500 Square meters Senior 2 Stream-1800 Square meters 2 Streams-2250 Square meters Secondary 3 Stream-2000 Square meters 3 Streams-2500 Square meters" In addition to above, these schools shall provide or make arrangement for adequate playground within a reasonable distance according to the number of students. If the distance of playground is more than 500 meter from the school than the school authority shall provide free transportation to the students.

The school can tie-up with the government schools, any educational institution stadium, open space used as playground of local bodies. Maximum two schools can tie-up with one authority managing the playground:

Provided further that these relaxed norms of land shall also be applicable to the schools (separately notified vide no. 8/7-09 PS (2), dated the 21st February, 2009 that were in existence before the 31st March, 2007 and had applied to the department by the 10th April, 2007 for recognition/up-gradation.

The covered area and open area shall be in the ratio of 35%/65% respectively. However, where the Urban Local Bodies or Town and Country Planning Department have prescribed different Floor Area Ratio norms, the same shall be applicable.

Note:- A private school may be run in a rented building /land on lease hold basis with a minimum period of twenty years irrevocable lease deed; provided such school fulfils the norms of land and building as specified under these rules;
