विषय :- आधार अधिनियम 2016 की धारा-7 के तहत कक्षा पहली से आठवीं तक के बीसी-ए वर्ग के छात्रों के लिए मासिक वज़ीफा की अधिसूचना (जैसा कि आधार और अन्य कानून (संशोधन) अधिनियम, 2019 में संशोधन किया गया है)।

सेवाओं या लाभों या प्रसुविधाओं या सहायिकियों के परिदान के लिए एक पहचान दस्तावेज के रूप में आधार का उपयोग सरकारी परिदान प्रक्रियाओं को सरलीकरण करता है, पारदर्शिता और दक्षता लाता है और लाभार्थियों को सुविधाजनक और निर्बाध रीति में उनकी हकदारियों को सीधे प्राप्त करने में समर्थ बनाता है और आधार किसी व्यक्ति की पहचान को साबित करने के लिए विभिन्न दस्तावेज प्रस्तुत करने की आवष्यकता को समाप्त करता है;

और जबकि, मौलिक शिक्षा विभाग (जिसे इसमें इसके पष्चात्‌ विभाग कहा गया है), पिछड़ी जाति वर्ग के छात्रों को सहायता प्रदान करने के लिए कक्षा 1 से 8 वीं (जिसे इसमें इसके पष्चात्‌ योजना कहा गया है) में बीसी-ए वर्ग के छात्रों को मासिक वज़ीफा की योजना का संचालन कर रहा है। हरियाणा के सरकारी स्कूलों में बीसी-ए वर्ग के परिवार के बच्चों के प्रवेश और प्रतिधारण की सहायता के लिए;

और इस योजना के अधीन, राज्य सरकार बीसी-ए वर्ग के सरकारी स्कूलों में विभिन्न कक्षाओं में पढ़ने वाले छात्रों (जिसे इसमें इसके पष्चात लाभार्थी कहा गया है) को मासिक वज़ीफा (जिसे इसमें इसके पष्चात प्रसुविधा कहा गया है) प्रदान करती है। मौजूदा योजना के दिशानिर्देश जो सरकारी स्कूलों के हैड टीचर/हैड मास्टर के माध्यम से लागू किए जाते हैं;

और उपरोक्त योजना में हरियाणा के समेकित निधि से होने वाला आवर्ती व्यय शामिल है : अतः अब हरियाणा राज्य सरकार आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18) (जिसे इसमें इसके पष्चात उक्त अधिनियम कहा गया है), की धारा 7 के उपबंधों के अनुसरण में निम्नलिखित अधिसूचित करती है, अर्थात्‌ - 1. (1) योजना के अधीन प्रसुविधा लेने के इच्छुक प्रत्येक पात्र बच्चे से अपेक्षा की जाती है कि वह आधार संख्या रखने का प्रमाण प्रस्तुत करे या आधार अधिप्रमाणन कराए : (2) योजना के अधीन प्रसुविधा पाने का इच्छुक प्रत्येक बच्चा जो आधार संख्या नहीं रखता है या जिसने आधार के लिए अभी तक नामांकन नहीं किया है, उसे योजना के लिए पंजीकरण करने से पहले आधार हेतु अपने माता-पिता या अभिभावकों की सहमति से आधार नामांकन के लिए आवेदन करना होगा, परन्तु वह उक्त अधिनियम की धारा 3 के उपबंधों के अनुसार आधार प्राप्त करने का हकदार है और ऐसे बच्चे आधार नामांकन के लिए किसी भी आधार नामांकन केंद्र (केन्द्रों की सूची भारतीय विशिष्ट पहचान प्राधिकरण (यूआईडीएआई) की वेबसाइट www.uidai.gov.in पर उपलब्ध है) पर सम्पर्क कर सकेंगे।

GAZ., AUG. 10, 2021 (SRVN. 19, 1943 SAKA) 577 (3) आधार (नामांकन और अद्यतन) अधिनियम, 2016 के विनियमन 12 के अनुसार विभाग द्वारा कार्यान्वयन एजेंसियों के माध्यम से, उन लाभार्थियों के लिए जो अभी आधार हेतु नामांकित नहीं हुए हैं, के आधार नामांकन सुविधाओं की व्यवस्था करना अपेक्षित है और यदि संबंधित ब्लॉक या तालुका या तहसील में आधार नामांकन केंद्र स्थित नहीं हो तो विभाग कार्यान्वयन एजेंसियों के माध्यम से यूआईडीएआई के मौजूदा रजिस्ट्रार के सहयोग से या स्वतः यूआईडीएआई रजिस्ट्रार बनते हुए सुविधाजनक स्थान पर आधार नामांकन सुविधाएं उपलब्ध कराएगा :

बषर्ते कि किसी बच्चे को आधार प्रदान किए जाने तक उसे निम्नलिखित दस्तावेजों को प्रस्तुत करने पर प्रसुविधा दी जाएगी, अर्थात :-

(क) यदि बच्चा पांच साल की उम्र (बायोमेट्रिक्स संग्रह के साथ), प्राप्त करने के बाद नामांकित किया गया है, उसकी आधार नामांकन पहचान पर्ची, या बायोमैट्रिक अपडेट पहचान पर्ची; और

(ख) निम्नलिखित दस्तावेजों में से कोई एक हो, अर्थात्‌ :-

(i) जन्म प्रमाणपत्र या यथोचित प्राधिकारी द्वारा जारी किया गया जन्म का रिकॉर्ड; या (ii) स्कूल के प्रधानाचार्य द्वारा विधिवत हस्ताक्षरित स्कूल का पहचान पत्र, जिसमें माता-पिता के नाम हों; और

(ग) मौजूदा योजना के दिषा निर्देषों के अनुरूप, माता-पिता या वैधानिक अभिभावक के साथ प्रसुविधार्थी के संबंध के सबूत के तौर पर निम्नलिखित में से कोई एक दस्तावेज :- (i) जन्म प्रमाणपत्र; या यथोचित प्राधिकारी द्वारा जारी किया गया जन्म का रिकॉर्ड; या (ii) राशन कार्ड; या (iii) भूतपूर्व सैनिक अंशदायी स्वास्थ्य योजना (ई.सी.एच.एस) कार्ड; या कर्मचारी राज्य बीमा निगम (ई.एस.आई.सी) कार्ड; या केंद्र सरकार की स्वास्थ्य योजना (सी.जी.एच.एस) कार्ड; या (iv) पेंशन कार्ड; या (v) आर्मी कैंटीन कार्ड; या (vi) कोई भी सरकारी परिवार पात्रता/हकदारी; या (vii) विभाग द्वारा विनिर्दिष्ट कोई अन्य दस्तावेज;

बषर्ते कि उपर्युक्त दस्तावेजों की जांच विभाग द्वारा इस कार्य हेतु विशेष रूप से नामनिर्दिष्ट अधिकारी द्वारा की जाएगी। 2. योजना के अधीन लाभार्थियों को सरलतापूर्वक प्रसुविधा प्रदान करने के लिए विभाग उक्त योजना के तहत आधार की आवश्यकता के प्रति लाभार्थियों को जागरूक बनाने के लिए मीडिया के माध्यम से व्यापक प्रचार सुनिश्चित करेगा तथा इस हेतु सभी आवश्यक प्रबंध करेगा। 3. उन सभी मामलों में, जहां आधार अधिप्रमाणन लाभार्थियों के खराब बायोमैट्रिक्स के कारण या किसी अन्य कारण से असफल रहता है, वहां निम्नलिखित उपचारात्मक तंत्र अपनाया जाएगा, अर्थात्‌ :-

(क) खराब अंगुलीछाप गुणवता के मामले में, अधिप्रमाणन के लिए आईरिस स्कैन या चेहरा अधिप्रमाणन सुविधा अपनाई जाएगी, इस हेतु विभाग आईरिस स्कैनर्स या चेहरा अधिप्रमाणन के साथ अंगुलीछाप अधिप्रमाणन के लिए प्रावधान करेगा ताकि निर्बाध रीति से प्रसुविधा प्रदान की जा सके;

(ख) जहां अंगुली छाप के माध्यम से बायोमैट्रिक्स अधिप्रमाणन या आईरिस या चेहरा अधिप्रमाणन सफल न हो वहां व्यवहार्यता एवं स्वीकार्यता अनुसार सीमित समय वैधता वाले आधार वन टाईम पासवर्ड (ओटीपी) या समय आधारित वन टाइम पासवर्ड, जैसा भी मामला हो, द्वारा अधिप्रमाणन किया जाएगा;

(ग) अन्य सभी मामलों में जहां बायोमैट्रिक्स या आधार वन टाइम पासवर्ड या समय-आधारित वन-टाइम अधिप्रमाणन संभव नहीं है वहां योजना के अधीन प्रसुविधाएं भौतिक आधार पत्र के आधार पर प्रदान की जा सकती हैं, जिनकी अधिप्रामाणिकता आधार पत्र पर मुद्रित कोड से त्वरित प्रतिक्रिया (क्यूआर) के माध्यम से सत्यापित की जा सकती है और त्वरित प्रतिक्रिया कोड रीडर विभाग द्वारा सुविधाजनक स्थान पर आवष्यक रूप से उपलब्ध कराया जाएगा;

4. उपरोक्त बातों के बावजूद, किसी भी बच्चे को प्रमाणीकरण के माध्यम से अपनी पहचान स्थापित करने में विफलता के मामले में या आधार संख्या का सबूत प्रस्तुत न कर पाने या जिसे आधार नंबर प्राप्त नहीं हुआ है, को नामांकन हेतु आवेदन पत्र की प्रति प्रस्तुत करने में विफल रहने पर भी योजना के तहत प्रसुविधा से वंचित नहीं किया जाएगा। इसे प्रसुविधा अन्य दस्तावेजों के आधार पर उसकी पहचान को सत्यापित करके प्रदान की जाएगी जैसा कि अनुच्छेद 1 के उप-अनुच्छेद (3) के उपबंधों (ख) और (ग) में वर्णित है, और जहां प्रसुविधा ऐसे अन्य दस्तावेजों के आधार पर प्रदान की जाएगी, इस हेतु एक अलग रजिस्टर में इसका रिकॉर्ड रखा जाएगा, जिसकी विभाग द्वारा समय-समय पर समीक्षा की जाएगी और ऑडिट किया जाएगा। 5. यह अधिसूचना राजपत्र में इसके प्रकाशन की तारीख से प्रभावी होगी।

Subject :- Notification of Monthly Stipend to BC-A students in Classes 1st to 8th under Section-7 of the

Adhaar Act 2016 (as amended by the Adhaar and Other Laws (Amendment) Act, 2019).

The use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Elementary Education Department (hereinafter referred to as the Department), is administering the scheme of Monthly Stipend to BC-A students in Classes 1st to 8th (hereinafter referred to as the Scheme) to provide support to the students from Backward Class category 'A' (BC-A) families for their admission and retention in the Haryana Govt. Schools;

And whereas, under the Scheme, the State Government grant a monthly allowance (hereinafter referred to as the benefit) at different rates to the BC-A category students studying in different classes in Government schools (hereinafter referred to as the beneficiaries), as per the extant scheme guidelines which is implemented through Head Teacher/Head Master Government Schools;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Haryana;

Now, therefore, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the State Government of Haryana hereby notifies the following, namely: -

1. (1) A child desirous of availing the benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any child desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent of his parents or guardians, before registering for the Scheme provided that he is entitled to obtain Aadhaar as per section 3 of the said Act and such children shall visit any Aadhaar enrolment centre (list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves;

Provided that till the time Aadhaar is assigned to the child, the benefit under the Scheme shall be given to such children Subject to production of the following documents, namely:-

(a) if the child has been enrolled after attaining the age of five years (with biometrics collection), his Aadhaar Enrolment Identification Slip, or of bio-metric update identification slip; and (b) any one of the following documents, namely:-

(i) Birth Certificate; or Record of birth issued by the appropriate authority; or (ii) School identity card, duly signed by the Principal of the school, containing parents' names; and

(C) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely:-

(i) Birth Certificate; or Record of birth issued by the appropriate authority; or (ii) Ration Card; or

(iii) Ex-Servicemen Contributory Health Scheme (ECHS) Card; or Employees' State Insurance Corporation (ESIC) Card; or Central Government Health Scheme (CGHS) Card; orPART I] HARYANA GOVT. GAZ., AUG. 10, 2021 (SRVN. 19, 1943 SAKA) 579 (iv) Pension Card; or

(v) Army Canteen Card; or

(vi) any Government Family Entitlement Card; or

(vii) any other document as specified by the Department;

Provided further that the above documents shall be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department shall make all the required arrangements to ensure that wide publicity through media shall be given to the beneficiaries to make them aware of the requirement of Adhaar under the Scheme.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:-

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time- based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password (OTP) or Time-based One-Time Password authentication is not possible, benefits under the scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response (QR) code printed on the Aadhaar letter and the necessary arrangement of QR code reader shall be provided at the convenient locations by the Department.

4. Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. The benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses (b) and (c) of the proviso of sub- paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department.

5. This notification shall come into effect on the date of its publication in the Official Gazette.
