संख्या सा०का०नि० 11/संवि०/अनु० 309/2021.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा बिजली निरीक्षणालय (ग्रुप ग) सेवा नियम, 1998, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌्‌ :-

1. ये नियम हरियाणा बिजली निरीक्षणालय (गु्रप ग) सेवा (संषोधन) नियम, 2021, कहे जा सकते हैं।

2. हरियाणा बिजली निरीक्षणालय (ग्रुप ग) सेवा नियम, 1998 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 9 में, उप-नियम (1) में, खण्ड (कक) का लोप कर दिया जाएगा।

3. उक्त नियमों में, नियम 14 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

''14. अनुषासन, शास्तियां तथा अपीलें । (1) अनुषासन, षास्तियां तथा अपीलों से संबंधित मामलों में, सेवा के सदस्य, समय-समय पर, यथा संषोधित हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016, द्वारा षासित होंगेः परन्तु ऐसी षास्तियों का स्वरूप जो लगाई जा सकती हैं, ऐसी षास्तियां लगाने के लिये सषक्त प्राधिकारी तथा अपील प्राधिकारी भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि या नियमों के उपबन्धों के अधीन रहते हुए वे होंगे, जो इन नियमों के परिषिष्ट ग में विनिर्दिष्ट हैंं।

(2) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 के नियम 9 के खण्ड (ग) या खण्ड (घ) के अधीन आदेष करने के लिये सक्षम प्राधिकारी तथा अपील प्राधिकारी वह होगा जो इन नियमों के परिषिष्ट (घ) में विनिर्दिष्ट है।''।

4. उक्त नियमों में, परिषिष्ट क के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

''परिषिष्ट क

5. उक्त नियमों में, परिषिष्ट ख में,-

(i) ''दसवीं स्तर तक या ''उच्च शिक्षा में हिन्दी/संस्कृत'' शब्द जहाँ कहीं भी आऐं के स्थान पर, ''मैट्रिक या उच्चतर शिक्षा में एक विषय के रूप में हिन्दी या संस्कृत" शब्द प्रतिस्थापित किए जायेंगें; तथा (ii) खाना 1, 2, 3 तथा 4 के नीचे, क्रम संख्या 2 तथा उसके सामने प्रविष्टियों का लोप कर दिया जाएगा तथा परिणामस्वरूप क्रम संख्या 3 से 10 तथा उसके सामने प्रविष्टियों को 2 से 9 के रूप में पुर्नसंख्याकित कर दिया जाएगा।

6. उक्त नियमों में, परिषिष्ट 'ग' और 'घ' के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किये जाऐंगे, अर्थात्‌ :-

Notification

The 2nd July, 2021

No. G.S.R. 11/Const./Art. 309/2021.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Electrical Inspectorate (Group C) Service Rules, 1998, namely;–

1. These rules may be called the Haryana Electrical Inspectorate (Group C) Service (Amendment) Rules, 2021.

2. In the Haryana Electrical Inspectorate (Group C) Service Rules, 1998 (hereinafter called the said rules), in rule 9, in sub–rule (1), clause (aa) shall be omitted.

3. In the said rules, for rule 14, the following rule shall be substituted, namely;–

"14. Discipline, penalties and appeals.- (1) In matters relating to discipline, penalties and appeals, members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016, as amended from time to time:

Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority shall, subject to the provisions of any law or rules made under article 309 of the Constitution of India, be such as are specified in Appendix C to these rules.

(2) The authority competent to pass an order under clause (c) or clause (d) of rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016, and appellate authority shall be such as specified in Appendix D to these rules.".

4. In the said rules, for Appendix A the following Appendix shall be substituted, namely:–326 HARYANA GOVT. GAZ., JULY 6, 2021 (ASAR. 15, 1943 SAKA)

"APPENDIX A

5. In the said rules, in Appendix B,-

(i) For the words and sign "Hindi/Sanskrit upto Matric or higher education" wherever occurring, the words "Hindi or Sanskrit as one of the subject in Matric or Higher Education" shall be substituted; and (ii) Under columns 1, 2, 3 and 4 serial number 2 and entries thereagainst shall be omitted and consequent thereto serial number 3 to 10 and entries thereagainst shall be renumbered as 2 to 9.

6. In the said rules, for Appendices C and D, the following Appendices shall be substituted, namely;-HARYANA GOVT. GAZ., JULY 6, 2021 (ASAR. 15, 1943 SAKA) 327
