सं० 76/हरि-वि.स./33/उप-निर्वा0/2021.- यतः भारत निर्वाचन आयोग द्वारा दिनांक 29 सितम्बर, 2020 के प्रेस नोट सं० ईसीआई/पीएन/67/2020 के तहत 33-बरोदा विधान सभा निर्वाचन क्षेत्र के उप-निर्वाचन, 2020 विधानसभा की घोषणा की गई थी और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे की सही प्रति संबद्ध जिला निर्वाचन अधिकारी को प्रस्तुत करनी होती है, और यतः, 33-बरोदा विधानसभा निर्वाचन क्षेत्र के लिए निर्वाचन के परिणाम रिटर्निंग ऑफिसर द्वारा दिनांक 10 नवंबर, 2020 को घोषित किए गए थे और इस प्रकार निर्वाचन व्यय के लेखे को दाखिल करने की अन्तिम तारीख 10 दिसम्बर, 2020 थी, और यतः, जिला निर्वाचन अधिकारी, सोनीपत जिला द्वारा प्रस्तुत दिनांक 14 दिसम्बर, 2020 की रिपोर्ट के अनुसार श्री रामफल शर्मा, जो हरियाणा के 33-बरोदा विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाला अभ्यर्थी, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का लेखा दाखिल करने में विफल रहे हैं, और यतः, जिला निर्वाचन अधिकारी की उक्त रिपोर्ट के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों के संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री रामफल शर्मा को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए दिनांक 24 फरवरी, 2020 को कारण बताओ नोटिस सं. 76/हरि-वि.स./33/उप-निर्वा0/2021 जारी किया गया था, और यतः, उपर्युक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अनुसार श्री रामफल शर्मा को अपना अभ्यावेदन, जिसमें लेखा प्रस्तुत न किए जाने संबंधी कारणों को स्पष्ट किया गया हो, आयोग को लिखित रूप मेंं प्रस्तुत करने और यह नोटिस प्राप्त होने के 20 दिनों के अंदर जिला निर्वाचन अधिकारी, सोनीपत को अपने निर्वाचन व्यय का पूर्ण लेखा प्रस्तुत करने का निदेष दिया गया था, और

GAZ., AUG. 10, 2021 (SRVN. 19, 1943 SAKA) [PART II यतः, जिला निर्वाचन अधिकारी, सोनीपत ने बताया है कि श्री रामफल शर्मा को उक्त नोटिस दिनांक 13 अप्रैल, 2021 को तामील किया गया था, और यतः, जिला निर्वाचन अधिकारी, सोनीपत, हरियाणा ने दिनांक 18 जून, 2021 की अपनी अनुपूरक रिपोर्ट में यह बताया कि श्री रामफल शर्मा ने कोई भी अभ्यावेदन अथवा मूल वाउचरों आदि के साथ विधिवित रूप से हस्ताक्षरित अपने निर्वाचन व्यय का सही लेखा प्रस्तुत नहीं किया है। इसके अतिरिक्त उक्त नोटिस मिलने के उपरान्त भी श्री रामफल शर्मा ने विधि के अंतर्गत यथा-विहित लेखे प्रस्तुत करने में अपनी विफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है, और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह विहित है किः ''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति
(क) इस अधिनियम के द्वारा अथवा इसके अधीन अपेक्षित समय के भीतर और रीति में निर्वाचन व्यय लेखा दाखिल करने में विफल रहा है, और
(ख) उसके पास इस विफलता को कोई उचित कारण अथवा औचित्य नहीं है
तो निर्वाचन आयोग, सरकारी राजपत्र में आदेश प्रकाषित करके उसे निरर्हित घोषित करेगा और ऐसा कोई भी व्यक्ति इस आदेष की तारीख से तीन वर्ष की अवधि के लिए निरर्हित रहेगा। यतः, तथ्यों और उपलब्ध रिकाडों के आधार पर आयोग का यह समाधान हो गया है कि श्री रामफल शर्मा अपने निर्वाचन व्यय के लेखे दाखिल करने में विफल रहे है और उनके पास ऐसा करने में विफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है, और अतः अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा घोषणा करता है कि हरियाणा राज्य की विधानसभा के उप-निर्वाचन, 2020 के 33-बरोदा विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दअभ्यर्थी श्री रामफल शर्मा, गांव उरलाना कलां, तहसील मतलोड़ा, जिला पानीपत, हरियाणा इस आदेष की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधानसभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरर्हित होंगे।

No. 76/HR-LA/33/Bye -Elec./2021.— WHEREAS, the Bye-Election to the Legislative Assembly of Haryana 2020 for 33-Baroda Assembly Constituency was announced by the Election Commission of India vide Press Note No ECl/PN/67/2020 dated 29.09.2020; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate has to lodge a true copy of his account of election expenses within 30 days with the concerned District Election Officer, from the date of election of returned candidate; and
WHEREAS, the result of the election for 33-Baroda Assembly Constituency was declared by the Returning Officer on 10th November, 2020 and hence the last date for lodging the account of Election Expenses was 10th December, 2020; andPART II] HARYANA GOVT. GAZ., AUG. 10, 2021 (SRVN. 19, 1943 SAKA) 13 WHEREAS, as per the report dated 14th December, 2020 submitted by the District Election Officer, Sonipat District, Ramphal Sharma, a contesting candidate from 33- Baroda Assembly Constituency of Haryana, 2020 has failed to lodge account of Election Expenses as required by law; and
WHEREAS, on the basis of the said report of the District Election Officer, a Show Cause notice No. 76/HR- LA/33/Bye-elec./2021 dated 24th February, 2021 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Ramphal Sharma for not lodging of accounts of Election expenses; and
WHEREAS, through the above said Show Cause Notice and under sub rule(6) of Rule 89 of the Conduct of Elections Rules, 1961, Ramphal Sharma was directed to submit representation in writing to the Commission explaining the reason for not lodging of accounts and also to lodge complete accounts of election expenses to the District Election Officer, Sonipat within 20 days from the date of receipt of the notice, and
WHEREAS, the District Election Officer, Sonipat, Haryana, has reported that the said notice was served to Ramphal Sharma on 13th April, 2021 ; and
WHEREAS, the District Election Officer, Sonipat, Haryana in his supplementary report dated 18th June, 2021 reported that Ramphal Sharma has not submitted any representation or a statement of correct account of his election expenses, duly signed alongwith original vouchers etc. Further, after receipt of the said notice Ramphal Sharma has neither furnished any reason nor explanation to the Election Commission of India, for his failure to lodge the account as prescribed under law; and
WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that:–
"If the Election Commission is satisfied that a person–
(a) has failed to lodge an account of election expenses within the time and in the manner required by or under this Act; and
(b) has no good reason or justification for the failure,
the Election Commission shall by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from the date of the order."
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Ramphal Sharma has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Ramphal Sharma, resident of Vill. Urlana Kalan, Tehsil Madlauda, Panipat, Haryana and a contesting candidate from for the Bye-Election to the Legislative Assembly of Haryana 2020 from 33-- Baroda Assembly Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
