संख्या सा०का०नि० 15/संवि०/अनु० 309/2021.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा राजस्व (ग्रुप ख) सेवा नियम, 1988, को आगे संषोधित करने के लिये निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

1. ये नियम हरियाणा राजस्व (ग्रुप ख) सेवा (संषोेधन) नियम, 2021, कहे जा सकते हैं।

2. हरियाणा राजस्व (ग्रुप ख) सेवा नियम, 1988 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 5 में, "तीस" षब्द के स्थान पर, "बयालीस" षब्द प्रतिस्थापित किया जाएगा।

3. उक्त नियमों में, नियम 9 में, उप-नियम (1) में, खण्ड (ख) में, उप-खण्ड (i) के स्थान पर, निम्नलिखित उप-खण्ड प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

"(i) 50 प्रतिषत हरियाणा सिविल सेवा (कार्यकारी षाखा) तथा संबद्ध सेवा परीक्षा के आधार पर नायब तहसीलदार के पद पर नियुक्ति के लिए आयोग द्वारा सिफारिष किए गए व्यक्तियाें की सीधी भर्ती द्वारा ; "। 4. उक्त नियमों में, नियम 15 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

"15 (1) अनुषासन, षास्तियां तथा अपीलों से संबंधित मामलोें में, सेवा के सदस्य समय-समय पर यथा-संषोधित हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 द्वारा षासित होेंगे :

परन्तु ऐसी षास्तियों का स्वरूप जो लगाई जा सकती हैं, ऐसी षास्तियां लगाने के लिये सषक्त प्राधिकारी तथा अपील प्राधिकारी भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि या नियमों के उपबंधों के अधीन रहते हुए वे होंगे, जो इन नियमों के परिषिष्ट ग में विनिर्दिष्ट हैं।

(2) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 के नियम 9 के खंड (ग) या खंड (घ) के अधीन आदेष पारित करने के लिये सक्षम प्राधिकारी तथा अपील प्राधिकारी भी वह होगा जो इन नियमों के परिषिष्ट घ में यथा विनिर्दिष्ट हैै। "।

5. उक्त नियमों में, परिषिष्ट क के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

6. उक्त नियमों में, परिषिष्ट ख में, -

(क) क्रम संख्या 1 तथा 2 के सामने, खाना 3 तथा 4 के नीचे, विद्यमान मद (ii) के स्थान पर, निम्नलिखित मद प्रतिस्थापित की जाएगी, अर्थात्‌ :-

"(ii) मैट्रिक या उच्चतर षिक्षा में एक विषय के रूप में हिन्दी या संस्कृृत" ;

(ख) क्रम संख्या 2 के सामने, खाना 4 के नीचे, "पदोन्नति द्वारा" षीर्ष के नीचे, विद्यमान मद (iii) के स्थान पर, निम्नलिखित मद प्रतिस्थापित की जाएगी, अर्थात्‌ :-

"(iii) काननूगो, जिला राजस्व लेखाकार या वित्तायुक्त, हरियाणा कार्यालय केे वरिष्ठ राजस्व लेखाकार के रूप में पाँच वर्ष का अनुभव और जिसने नायब तहसीलदार की विभागीय परीक्षा उत्तीर्ण कर ली है।"।394 HARYANA GOVT. GAZ. (EXTRA.), AUG. 13, 2021 (SRVN. 22, 1943 SAKA) 7. उक्त नियमों में, परिषिष्ट ग तथा घ के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किए जाएंगे, अर्थात्‌ :-

8. उक्त नियमों में, परिषिष्ट झ में, तालिका में, खाना 2 के नीचे, क्रम संख्या (7) के सामने विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएगी, अर्थात्‌ :-

"पर्चा VII (क.) हरियाणा सिविल सेवा (वेतन) नियम , 2016 ; (ख.) हरियाणा सिविल सेवा (सरकारी कर्मचारी भत्ते) नियम, 2016 ;

(ग.) हरियाणा सिविल सेवा (सामान्य) नियम, 2016 ;

(घ.) हरियाणा सिविल सेवा (अवकाष) नियम, 2016 ;

(ङ.) हरियाणा सिविल सेवा (सरकारी कर्मचारी आचरण) नियम, 2016 ;

(च.) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016।"।

Notification

The 13th August, 2021

No. G.S.R 15/Const./Art.309/2021.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Revenue (Group B) Service Rules, 1988, namely :-

1. These rules may be called the Haryana Revenue (Group B) Service (Amendment) Rules, 2021.

2. In the Haryana Revenue (Group B) Service Rules, 1988 (hereinafter called the said rules), in rule 5, for the word " thirty " the word " forty two " shall be substituted.

3. In rule 9, in sub-rule (1), in clause (b), for sub-clause (i), the following sub-clause shall be substituted, namely:-

" (i) 50% by direct recruitment of persons recommended by the Commission for appointment to the post of Naib-Tehsildar on the basis of Haryana Civil Services (Executive Branch) and Allied Services Examination ;".

4. In the said rules, for rule 15, the following rule shall be substituted, namely:-

"15(1) In matters relating to discipline, penalties and appeals, members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016:

Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority shall, subject to the provisions of any law or rules made under article 309 of the Constitution of India, be such are specified in Appendix C to these rules.

(2)The authority competent to pass an order under clause (c) or clause (d) of rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016 and appellate authority shall be specified in Appendix D to these rules.".

5. In the said rules, for appendix A, the following appendix shall be substituted, namely :-

6. In the said rules, in Appendix B,-

(a) against serial number 1, under column 3, for the existing entries, the following entries shall be substituted, namely :-

"(i) Graduation from a recognized university or its equivalent :

(ii) Hindi or Sanskrit as one of the subject Matric or higher education" :

(b) against serial number 2, under column 3 and 4, for existing item (ii), the following item shall be substituted, namely :-

(ii) Hind or Sanskrit as one of the subject in Matric or higher education":

(c) against serial number 2, under column 4, under heading " By promotion", for item (iii), the following item shall be substituted, namely :-

"(iii) Five years experience as Kanungo or District Revenue Accountant or Senior Revenue Accountant of Financial Commissioner's office, Haryana and who has qualified departmental examination of Naib Tehsildar".

7. In the said rules, for appendices C and D, the following Appendices shall be substituted, namely :-

(f) Haryana Civil Services (Punishment and Appeal) Rules, 2016.".
