संख्या सा०का०नि० 16/सवि०/अनु० 309/2021.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा स्वैच्छिक राज्य षिक्षा सेवा नियम, 2017 को आगे संशोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः-
1. (1) ये नियम हरियाणा स्वैच्छिक राज्य षिक्षा सेवा (संषोधन) नियम, 2021, कहे जा सकते हैं।
(2) ये राजपत्र में इनके प्रकाषन की तिथि से लागू होंगे।
2. हरियाणा स्वैच्छिक राज्य षिक्षा सेवा नियम, 2017 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 5 में,- (i) उप-नियम (1) में, ''पूर्व में दी गई सेवा की गणना अन्य किसी उद््देश्य तथा परियोजन हेतु नहीं की जाएगी'' शब्दों के स्थान पर, ''पेंशन लाभों को छोड़कर, पूर्व में दी गई सेवा की गणना अन्य किसी उद््देश्य तथा परियोजन हेतु नहीं की जाएगी'' शब्द प्रतिस्थापित किए जाएंगे;
(ii) उप-नियम (3) तथा (4) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किए जाएंगे, अर्थात् :-
''(3) इन नियमों के अधीन नियुक्त कर्मचारी, हरियाणा सिविल सेवा (पेंषन) नियम, 2016 के उपबन्धों के अधीन पेंषन के हकदार होंगे, यदि प्रथम जनवरी, 2006 से पूर्व सहायताप्राप्त विद्यालय में नियुक्त हुए हैं तथा हरियाणा सहायताप्राप्त विद्यालय (विशेष पेंशन तथा अंशदायी भविष्य नीधि) नियम, 2001 के अधीन पेंशन लेने हेतु पात्र है। तथापि, प्रथम जनवरी, 2006 को या उसके बाद नियुक्त और आगे इन नियमों के अधीन नियुक्त कर्मचारी, हरियाणा नई पेंशन स्कीम, 2008 द्वारा शासित होंगे। 404 HARYANA GOVT. No. G.S.R. 16/Const./Art. 309/2021.— In exercise of the powers conferred by the proviso to article 309 of Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Voluntary State Education Service Rules, 2017, namely:-
1. (1) These rules may be called the Haryana Voluntary State Education Service (Amendment) Rules, 2021.
(2) They shall come into force on date of their publication in the Official Gazette.
2. In the Haryana Voluntary State Education Service Rules, 2017 (hereinafter called the said rules), in rule 5,- (i) in sub-rule (1), for the words "The past service rendered shall not be counted for any other intents and purposes" the words and sign "The past service rendered shall not be counted for any other intents and purposes, except pensionary benefits" shall be substituted;
(ii) for sub-rule (3) and (4) the following sub-rules shall be substituted namely:-
"(3) An employee appointed under these rules shall be entitled for pension under the provisions of the Haryana Civil Services (Pension) Rules, 2016, if appointed in the aided school before the 1st January, 2006 and is eligible to get pension under the Haryana Aided Schools (Special Pension and Contributory Provident Fund) Rules, 2001. However, the employee appointed on or after the 1st January, 2006 and appointed under these rules, shall be governed by the Haryana New Pension Scheme, 2008.
(4) An employee appointed under these rules shall be entitled for the amount of contribution towards Contributory Provident Fund/Haryana New Pension Scheme, 2008 alongwith interest liable to be paid by the concerned aided school management for the service rendered in the said school and the Management shall pay the same within a period of one month to the concerned quarters."
