संख्या का०आ० 43/ह०अ० 13/1994/धा० 15/2021.- नियमों का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल हरियाणा किसान पास बुक अधिनियम, 1994 (1994 का 13) की धारा 15 की उप-धारा (1) तथा (2) द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए, हरियाणा किसान पास बुक नियम, 1996 को आगे संषोधित करने का प्रस्ताव करते हैं और उपरोक्त उप-धारा (1) द्वारा यथा अपेक्षित सभी व्यक्तियों, जिनके इससे प्रभावित होने की संभावना है, की जानकारी के लिए अधिसूचित करते हैं;
इसके द्वारा, नोटिस दिया जाता है कि प्रारूप नियमों के राजपत्र में प्रकाषन की तिथि से पैंतालीस दिन की अवधि की समाप्ति पर अथवा इसके पश्चात् राज्य सरकार, ऐसे आक्षेपों तथा सुझावाें, यदि कोई हो, सहित प्रारूप के नियमाें पर विचार करेगी, जो वित्तायुक्त राजस्व तथा अपर मुख्य सचिव, हरियाणा सरकार, राजस्व तथा आपदा प्रबन्धन विभाग, चण्डीगढ़ को किसी व्यक्ति से लिखित में ऐसे प्रारूप नियमों के संबंध में इस प्रकार विनिष्र्दिट अवधि की समाप्ति से पूर्व प्राप्त किए जाएं।
प्रारूप नियम
1. ये नियम हरियाणा किसान पास बुक (संषोधन) नियम, 2021 कहे जा सकते हैं।
2. हरियाणा किसान पास बुक नियम, 1996 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 9 में उप नियम (2) में,
(i) द्वितीय तथा तृतीय पंक्ति में, "पास बुक" षब्दों के स्थान पर ,"किसान पास बुक" षब्द प्रतिस्थापित किए जाएंगे;
तथा
(ii) चतुर्थ पंकित में, "एक सप्ताह के भीतर" षब्दाें के स्थान पर , "पन्द्रह दिन के भीतर" षब्द प्रतिस्थापित किए जाएंगे।
3. उक्त नियमों में, नियम 10 में, उप- नियम (3) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, अर्थात्ः-
"(3) किसान से किसान पास बुक को सुरक्षित अभिरक्षा के सभी पूर्वोपाय करने की अपेक्षा की जाएगी और इसकी क्षति होने, नष्ट होने और नुकसान होने से रक्षा करेगा। यदि सभी पूर्व सावधानियाें के वाबजूद भी किसान पास बुक गुम हो जाती है या पूर्णतया नष्ट हो जाती है, तो किसान, किसान पास बुक की प्रतिलिपि जारी करने के लिए प्ररूप 4 में अपना आवेदन प्रस्तुत करेगा ओर उसका आवेदन परिमण्डल राजस्व अधिकारी द्वारा ग्रहण किया जाएगा। इस प्रकार किए गए आवेदन के साथ नष्ट या विकृत किसान पास बुक अथवा वचनबद्धता कि किसान पास बुक गुम या नष्ट हो गई है, लगाई जाएगी।"।
4. उक्त नियमों में, प्ररूप I मेें, भाग I के स्थान पर, निम्नलिखित भाग प्रतिस्थापित किया जाएगा, अर्थात्ः-

(EXTRA.), AUG. 18, 2021 (SRVN. 27, 1943 SAKA) 5. उक्त नियमों में, प्ररूप 4 मेें, क्रम संख्या 6 तथा उसके सामने व़िद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित क्रम संख्या तथा उसके सामने निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएगी, अर्थात्ः-
"6 क्या खाना 5 (iii) तथा (iv) ........................" । की दषा में खराब अथवा विकृत पास बुक साथ सलंग्न है
6. उक्त नियमों में , अनुबन्ध क मेें,-
(i) पैरा 14 मंें, "अथवा छह मास के लिए कारावास दोनों"श्षब्दों का लोप कर दिया जाएगा; तथा
(ii) पैरा संख्या 15 का लोप कर दिया जाएगा।

Notification
The 18th August, 2021
No. S.O. 43/H.A. 13/1994/S. 15/2021.— In exercise of the powers conferred by sub-section (1) and (2) of section 15 of the Haryana Kisan Pass Book Act, 1994 (13 of 1994), the Governor of Haryana hereby makes the following rules further to amend the Haryana Kisan Pass Book Rules, 1996.
Notice is hereby given that the draft of rules shall be taken into consideration by the Government on or after the expiry a period of 45 days from the date of publication of this notification in the Official Gazette together with objections and suggestions, if any, which may be received by the Financial Commissioner Revenue and Additional Chief Secretary to Government, Haryana, Revenue and Disaster Management Department, from any person with respect to the draft of rules before the expiry of the period so specified.
Draft Rules
1. These rules may be called the Haryana Kisan Pass Book (Amendment) Rules, 2021.
2. In the Haryana Kisan Pass Book Rules, 1996 (hereinafter called the said rules), in rule 3, in sub-rule (5), for the word "joinly" the word "jointly" shall be substituted.
3. In the said rules, in rule 9, in sub-rule (2),-
(i) for the words "Pass Book" wherever occurring, the words "Kisan Pass Book" shall be substituted; and (ii) for the words "within a week", the words "within fifteen days" shall be substituted.
4. In the said rules, in rule 10 for sub-rule (3), the following sub-rule shall be substituted, namely:-
"(3) The Kisan will be required to take all precautions for the safe custody of the Kisan Pass Book and will guard it from damage, destruction and loss. If inspite of all precautions the Kisan Pass Book is lost or completely destroyed, the Kisan will submit his application in Form 4 for issue of a duplicate Kisan Pass Book and that shall be entertained by the Circle Revenue Officer. The application so made shall be accompanied by the damaged or mutilated Kisan Pass Book or an undertaking that the Kisan Pass Book has been lost or damaged."
5. In the said rules, in rule 12, for the words "for i the", the words "for the" shall be substituted.
6. In the said rules, in Form 1, for Part I , the following part shall be substituted, namely:-

Name of Kisan------------------."402 HARYANA GOVT. GAZ. (EXTRA.), AUG. 18, 2021 (SRVN. 27, 1943 SAKA) 7. In the said rules, in Form 4, against serial number 6(a) and entries thereagainst, the following serial number and entries thereagainst shall be substituted, namely:-
"6. Whether the damaged or mutilated Pass Book is enclosed [in case of 5(iii) and 5(iv)] _____________".
8. In the said rules, in Annexure A,-
(i) In para 14, the words "or imprisonment for six months or both" shall be omitted; and
(ii) Para number 15 shall be omitted.
