संख्या सा०का०नि० 17/संवि०/अनु० 309/2021.— भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा षक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा षिक्षा महाविद्यालय संवर्ग (वर्ग ग) सेवा नियम, 1986, को आगे संषोधित करने के लिये निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. ये नियम हरियाणा षिक्षा महाविद्यालय संवर्ग (वर्ग ग) सेवा (संषोधन) नियम, 2021, कहे जा सकते हैं।
2. हरियाणा षिक्षा महाविद्यालय संवर्ग (वर्ग ग) सेवा नियम, 1986 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 5 में, ''पैंतीस वर्ष'', ''17 वर्ष'' तथा ''तीस वर्ष'' षब्दों तथा अंकों के स्थान पर, क्रमषः ''बयालीस वर्ष'', ''अठारह वर्ष'' तथा ''बयालीस वर्ष'' षब्द प्रतिस्थापित किए जाएंगे।
3. उक्त नियमों में, नियम 9 में, उपनियम (1) में, खण्ड (छ) के बाद, निम्नलिखित खण्ड रखा जाएगा, अर्थात् :-
"(छक) वरिष्ठ तबला वादक की दषा में,-
(i) तबला वादकों में से पदोन्नति द्वारा ; या
(ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी कर्मचारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा ;''।
4. उक्त नियमों में, नियम 14 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात् :-
''14. (1) अनुषासन, षास्तियां तथा अपीलों से संबंधित मामलों में सेवा के सदस्य, समय-समय पर, यथा-संषोधित हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 द्वारा षासित होंगे :
परन्तु ऐसी षस्तियों का स्वरूप जो लगाई जा सकती है ऐसी षास्तियां लगाने के लिये सषक्त प्राधिकारी तथा अपील प्राधिकारी भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि या नियमों के उपबंधों के अधीन रहते हुए वे होंगे, जो इस नियमों के परिषिष्ट ग में विनिर्दिष्ट हैं।
(2) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 के नियम 9 के खंड (ग) या खंड (घ) के अधीन आदेष पारित करने के लिये सक्षम प्राधिकारी तथा अपील प्राधिकारी भी वह होगा जो इन नियमों के परिषिष्ट घ में यथाविनिर्दिष्ट है। ''।
5. उक्त नियमों में, परिषिष्ट क में, क्रम संख्या 7 तथा उसके सामने प्रविष्टियों के बाद, निम्नलिखित क्रम संख्या तथा उसके सामने प्रविष्टियां रखी जायेंगी, अर्थात् :-
| "7 क | वरिष्ठ तबला वादक | - | 8 | 8 | एफ0पी0एल0-5 सैल-1 = 29200/- रूपये;''। |
6. उक्त नियमों में, परिषिष्ट ख में, खाना 1, 2, 3 तथा 4 के नीचे, क्रम संख्या 7 तथा उसके सामने प्रविष्टियों के बाद, निम्नलिखित क्रम संख्या तथा उसके सामने प्रविष्टियां रखी जायेंगी, अर्थात् :-

| "7 क | वरिष्ठ तबला वादक | - | पदोन्नति द्वारा - तबला वादक के रूप में बीस वर्ष का अनुभव। स्थानांतरण/प्रतिनियुक्ति द्वारा - किसी राज्य सरकार या भारत (i) सरकार की सेवा में तबला वादक के रूप में बीस वर्ष का अनुभव; तथा मैट्रिक या उच्चतर षिक्षा में एक (ii) विषय के रूप में हिन्दी या संस्कृत ;''। |
7. उक्त नियमों में, परिषिष्ट ग में, -
(i) खाना 1 तथा 2 के नीचे, क्रम संख्या 4 तथा उसके सामने प्रविष्टि के बाद, निम्नलिखित क्रम संख्या तथा उसके सामने प्रविष्टि रखी जायेंगी, अर्थात् :-

(ii) खाना 4 के नीचे, विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जायेगी, अर्थात् :-

| ''I छोटी षास्तियां- हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम 2016 मे यथा विहित। II बडी षास्तियां- हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम 2016 मे यथा विहित।''। |
8. उक्त नियमों में, परिषिष्ट घ में, खाना 1 तथा 2 के नीचे, क्रम संख्या 4 तथा उसके सामने प्रविष्टि के बाद, निम्न्लिखित क्रम संख्या तथा उसके सामने प्रविष्टि रखी जायेगी, अर्थात् :-

No. G.S.R. 17/Const./Art. 309/2021.— In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Education College Cadre (Group C) Service Rules, 1986, namely:-
1. These rules may be called the Haryana Educational College Cadre (Group C) Service (Amendment) Rules, 2021.
2. In the Haryana Educational College Cadre (Group C) Service Rules, 1986 (hereinafter called the said rules), in rule 5, for the words "thirty five years", "seventeen years" and "thirty years" the words "forty two years", "eighteen years" "forty two years" respectively shall be substituted.
3. In the said rules, in rule 9, in sub-rule(1), after clause (g), the following clause shall be inserted, namely:-
"(ga) In the case of Senior Tabla Player,-
(i) by promotion from amongst Tabla Player; or
(ii) by transfer or deputation of an official already in service of any State Government or the Government of India;".
4. In the said rules, for rule 14, the following rules shall be substituted, namely:-
"14. (1) In matters relating to discipline, penalties and appeals, members of the service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016 as amended from time to time:
Provided that the nature of penalties which may be imposed the authorities empowered to impose such penalties and appellate authority shall subject to the provision of any law or rules made under Article 309 of the Constitution of India be as specified in Appendix C to these rules.
(2) The authority competent to pass an order under clause (c) or clause (d) of rule 9 of the Haryana civil Services (Punishment and Appeal) Rules, 2016 and appellate authority, shall be as specified in Appendix D to these rules.".
5. In the said rules, in Appendix A, after serial number 7 and entries thereagainst, the following serial number and entries thereagainst shall be inserted, namely:-
| "7a | Senior Tabla Player | - | 8 | 8 | FPL-5 Cell-1 = Rs. 29200/-". |
6. (i) In the said rules, after Appendix A, in the existing Appendix, for the words, signs and figure "Appendix A (see rules 3), the words signs and figure "Appendix B (see rules 7) shall be substituted.
(ii) In Appendix B, so substituted, after serial number 7 and entries thereagainst, the following serial number and entries thereagainst shall be inserted, namely:-

| "7a | Senior Tabla Player | - | By Promotion :- Twenty years experience as Tabla Player By Transfer /Deputation:- (i) Twenty years experience as Tabla Player in any State Government or the Government of India; and (ii) Hindi or Sanskrit as one subject in matric or higher education.". |
7. In the said rules in Appendix C,—
(i) under columns 1 and 2, after serial number 4 and entry thereagainst, the following serial number and entry thereagainst shall be inserted, namely:-

(ii) under column 4, for the existing entries, the following entries shall be substituted, namely:-

| "I. Minor Penalties - As prescribed in Haryana Civil Services (Punishment and Appeal) Rules, 2016. II. Major Penalties - As prescribed in Haryana Civil Services (Punishment and Appeal) Rules, 2016.". |
8. In the said rules in Appendix D, under columns 1 and 2, after serial number 4 and entry thereagainst, the following serial number and entry thereagainst shall be inserted, namely:-
