संख्या सा०का०नि० 18/संवि०/अनु० 309/2021.- भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा स्वास्थ्य विभाग अर्ध चिकित्सा तथा विविध पद राज्य (ग्रुप-ग) सेवा नियम, 1998, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः-
1. ये नियम हरियाणा स्वास्थ्य विभाग अर्ध चिकित्सा तथा विविध पद राज्य (ग्रुप-ग) सेवा संषोधन नियम, 2021, कहे जा सकते हैं ।
2. हरियाणा स्वास्थ्य विभाग अर्ध चिकित्सा तथा विविध पद राज्य (ग्रुप-ग) सेवा नियम, 1998 (जिन्हे, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 2 में, खण्ड (क) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाएगा, अर्थात्ः- '(क) "आयोग" से अभिप्राय है, हरियाणा कर्मचारी चयन आयोग; '।
3. उक्त नियमों में, नियम 5 में, "35 वर्ष" अंकों तथा शब्द के स्थान पर, "बयालीस वर्ष" शब्द प्रतिस्थापित किए जाएंगे। 4. उक्त नियमों मे, नियम 9 में, उपनियम (1) में,-
(क) खण्ड (छ) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाएगा, अर्थात्ः-
"(छ) रेडियोग्राफर की दषा में,-
(i) सीधी भर्ती द्वारा, या
(ii) किसी राज्य सरकार या भारत सरकार की सेवा में पहले से ही लगे किसी कर्मचारी के स्थानान्तरण या प्रतिनियुक्ति द्वारा;"।
(ख) खण्ड (ञ) का लोप कर दिया जाएगा ।
5. उक्त नियमों में, नियम 14 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्ः-
"14. अनुषासन, शास्तियां तथा अपील. -(1) अनुषासन, शास्तियां तथा अपीलों से सम्बंधित मामलों में सेवा के सदस्य, समय-समय पर, यथा संषोधित हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 द्वारा शासित होंगे :
परन्तु ऐसी शास्तियों, जो अधिरोपित की जा सकती हैं, का स्वरूप, ऐसी शास्तियोंं को अधिरोपित करने के लिए सषक्त प्राधिकारी तथा अपील प्राधिकारी, भारत के संविधान के अनुच्छेद 309 के अधीन बनाई गई किसी विधि अथवा बनाए गए नियमों के अधीन रहते हुए वे होंगे, जो इन नियमों के परिषिष्ट 'ग' में विनिर्दिष्ट हैं ।
(2) हरियाणा सिविल सेवा (दण्ड तथा अपील) नियम, 2016 के नियम 9 के खण्ड (ग) अथवा खण्ड (घ) के अधीन आदेष पारित करने के लिए सक्षम प्राधिकारी तथा अपील प्राधिकारी ऐसा होगा, जो इन नियमों के परिषिष्ट क में यथा विनिर्दिष्ट है।"।
6. उक्त नियमों में, परिषिष्ट क के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किया जाएगा, अर्थात्ः -

7. उक्त नियमों में, परिषिष्ट ख में,-
(i) खाना 3 तथा 4 के नीचे, "मैट्रिक स्तर तक हिन्दी" तथा "मैट्रिक स्तर तक हिन्दी का ज्ञान" शब्दों, जहां कहीं भी आएं, के स्थान पर, "मैट्रिक या उच्चतर षिक्षा में एक विषय के रूप में हिन्दी या संस्कृत" शब्द प्रतिस्थापित किए जाएंगे;
(ii) खाना 1, 2, 3 तथा 4 के नीचे, क्रम संख्या 7 तथा उसके सामने विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगीं, अर्थात्ः-

Notification
The 24th August, 2021
No. G.S.R. 18/Const./ Art. 309/2021.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Health Department Para- Medical and Miscellaneous, Posts (State Group C) Service Rules, 1998, namely:-
1. These rules may be called the Haryana Health Department Para-Medical and miscellaneous, Posts (State Group C) Service Amendment Rules, 2021.
2. In the Haryana Health Department Para-Medical and miscellaneous, Posts (State Group C) Service Rules, 1998, (hereinafter called the said rules), in rule 2, for clause (a), the following clause shall be substituted, namely:-
'(a) "Commission" means the Haryana Staff Selection Commission;'.
3. In the said rules, in rule 5, for the figure and word "35 years", the words and sign "forty-two years" shall be substituted.
4. In the said rules, in rule 9, in sub- rule (1),-
(a) for clause (g), the following clause shall be substituted, namely:-
"(g) In case of Radiographer,-
(i) by direct recruitment; or
(ii) by transfer or deputation of an official already in the service of any State of Government or the Government of India;";
(b) clause (j) shall be omitted.
5. In the said rules, for rule 14, the following rule shall be substituted, namely:-
"14. Discipline, penalties and appeals.- (1) The matter relating to discipline, penalties and appeals members of the Service shall be governed by the Haryana Civil Services (Punishment and Appeal) Rules, 2016, as amended from time to time:
Provided that the nature of penalties which may be imposed, the authority empowered to impose such penalties and appellate authority shall, subject to the provisions of any law or rules made under article 309 of the Constitution of India, be such as are specified in Appendix C to these rules.
2. The authority competent to pass an order under clause (c) or clause (d) of rule 9 of the Haryana Civil Services (Punishment and Appeal) Rules, 2016 and appellate authority shall be as specified in Appendix D to these rules.".
6. In the said rules, for Appendix A, the following Appendix shall be substituted, namely:-

7. In the said rules, in Appendix B,—
(i) under columns 3 and 4, for the words "Hindi upto Matric Stantard" wherever occurring, the words "Hindi or Sanskrit as an one subject in Matric or Higher Education" shall be substituted;
(ii) under columns 1, 2, 3 and 4 for serial number 7 and existing entries thereagainst, the following serial number and entries thereagainst shall be substituted , namely:-
