संख्या पी०एफ०-69/2021/22174.- हरियाणा नगरीय क्षेत्र विकास तथा विनियमन अधिनियम, 1975 (1975 का 8), की धारा 24 की उपधारा (2) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा हरियाणा सरकार, नगर तथा ग्राम आयोजना विभाग, अधिसूचना संख्या. पी0एफ0-69/2021/12982, दिनांक 3 जून, 2021 के प्रतिनिर्देश से, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा नगरीय क्षेत्र विकास तथा विनियमन नियम, 1976 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते ह,ै अर्थात्ः-
1. ये नियम हरियाणा नगरीय क्षेत्र विकास तथा विनियमन (द्वितीय संषोधन) नियम, 2021, कहे जा सकते हैं। 2. हरियाणा नगरीय क्षेत्र विकास तथा विनियमन नियम, 1976 में, नियम 17क में, उप-नियम (2) तथा उप-नियम (3) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किये जाएंगें, अर्थात्ः-
''(2) स्थानान्तरण के अधीन क्षेत्र के लिए अनुज्ञप्ति फीस, राज्य अवसंरचना विकास प्रभार, संपरिवर्तन प्रभार और बाह्य विकास प्रभार, जिसमें उस पर भुगतान किया गया ब्याज भी शामिल है, प्रथमतः स्थानान्तरण पर प्रदान की जाने वाली नई अनुज्ञप्ति के विरूद्ध, और अतिषेष उसी विकासक/उपनिवेषक की किसी अन्य अनुज्ञप्ति में समायोजित किया जा सकता है। आगे, यदि वहाँ कोई अतिषेष, समायोजन (समायोजनों) के बाद भी रहता है, तो वह समपहृत हो जाएगा। विकासक/उपनिवेषक उस विद्यमान परियोजना, जिसको स्थानान्तरण करने के इच्छुक हैं, के बाह्य विकास प्रभार तथा राज्य अवसंरचना विकास प्रभार पर देय ब्याज पर असंदत्त ब्याज राषि जमा करने के लिए दायी नहीं होगा। (3) स्थानान्तरण पर प्रदान की जाने वाली नई अनुज्ञप्ति के लिए सभी फीस और प्रभार वर्तमान दरों पर वसूल किये जाएंगे। विभाग के पास विकासक/उपनिवेषक द्वारा पूर्व में जमा की गई राषि पर ब्याज का भुगतान नहीं किया जाएगा ।''।

No. PF-69/2021/22174.— In exercise of the powers conferred by Sub-section (1) read with Sub-section (2) of Section 24 of the Haryana Development and Regulation of Urban Areas Act, 1975 (8 of 1975) and with reference to Haryana Government, Town and Country Planning Department, Notification No. PF-69/2021/12982, dated the 3rd June, 2021, the Governor of Haryana hereby makes the following rules further to amend the Haryana Development and Regulation of Urban Areas Rules, 1976, namely:-
1. These rules may be called the Haryana Development and Regulation of Urban Areas (Second Amendment) Rules, 2021.
2. In the Haryana Development and Regulation of Urban Areas Rules, 1976 (hereinafter called the said rules), in rule 17A, for sub-rule (2) and (3), the following sub-rules shall be substituted, namely:-
"(2) The licence fee, State Infrastructure Development Charges, conversion charges and external development charges, including interest paid thereon, for the area under migration may be adjusted, firstly against the fresh license to be granted upon migration, and balance in any other licence of the same developer/ colonizer. Further, if there is any balance remaining, even after such adjustment(s), then the same shall stand forfeited. The developer/colonizer shall not be liable to deposit the unpaid interest amount on external development charges and State Infrastructure Development Charges of the existing project from which he wants to migrate.
(3) For the fresh licence to be granted upon migration, all fees and charges shall be recovered at current rates. No interest shall be payable to the developer/colonizer on amount already deposited with the department.".
