संख्या सा०का०नि० 20/संवि०/अनु० 309/2021.— भारत के संविधान के अनुच्छेद 309 के परन्तु द्वारा प्रदत्त शक्तिया का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा पुलिस सेवा नियम, 2002, को आगे संशोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. ये नियम हरियाणा पुलिस सेवा (संशोधन) नियम 2021, कहे जा सकते हैं।
2. हरियाणा पुलिस सेवा नियम, 2002 में, नियम 6 में, उप-नियम (1) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, अर्थात् :-
''(1) पुलिस उप अधीक्षक के 70 (सत्तर) प्रतिशत पद निरीक्षकों के रैंक में पदोन्नति द्वारा 25 (पच्चीस) प्रतिशत पद, सीधी भर्ती द्वारा और 5 (पाँच) प्रतिशत ऑउट ऑफ टर्न पदोन्नति द्वारा भरे जाएंगे :
परन्तु केवल वे निरीक्षक पदोन्नति के लिए पात्र होंगे, जिन्होंने (अधीनस्थ रैंक से पदोन्नत और सीधी भर्ती द्वारा नियुक्त दोनों) निरीक्षक के रूप में नियमित सन्तोषजनक छह वर्ष की सेवा पूरी कर ली है (अनुभव के प्रयोजन के लिए तदर्थ सेवा की गणना नहीं की जाएगी) :
परन्तु यह और कि राज्य सरकार द्वारा व्यक्तिगत कार्य या टीम के सामूहिक प्रयासों द्वारा शासकीय कर्तव्यों के निर्वहन के दौरान असाधारण वीरता और अदम्य साहस का प्रदर्शन और आतंकवादी उग्रवादी/अततायी/समाज विरोधी तत्व/ हिंसक भीड़/कट्टर अपराधी के साथ मुठभेड़ में कानूनी कार्यवाही करने के दौरान या प्रा—तिक आपदा के दौरान या जीवन को खतरे में डालने वाली आपात स्थिति वाले किसी कठिन गतिविधि के दौरान अपने जीवन के लिए आसन्न खतरे या शरीर को गंभीर चोट के दौरान अनुकरणीय साहस दिखाने वाले निरीक्षकों में से ऑउट ऑफ टर्न आधार पर पुलिस उप-अधीक्षक के पद पर पदोन्नति की जाएगी। ऐसी ऑउट ऑफ टर्न पदोन्नति, ऑउट ऑफ टर्न पदोन्नति कोटा के लिए बनी रिक्तियों में से की जाएगीः
परन्तु यह और कि-
(i) असाधारण वीरता या अदम्य साहस के लिए पदों की संख्या सीधे कोटे के लिए बने पुलिस उप-अधीक्षक के कुल पदों का 5 (पांच प्रतिशत) से अधिक नहीं होगी जिसमें से एक तिहाई से अनधिक एक वर्ष या एक समय में पद की उपलब्धता के अध्यधीन भरी जानी चाहिए;
(ii) पुरस्कार / पदोन्नति का दावा करने वाले मामलों हेतु सम्बद्ध अधिकारी द्वारा संबंधित मामले में प्रथम सूचना रिपोर्ट भी दर्ज होनी चाहिए या अधिकारी की भागीदारी या वीरता को सिद्ध करने हेतु संक्षिप्त रिपोर्ट या पुलिस महानिदेशक के स्तर पर एक और अपर मुख्य सचिव, हरियाणा सरकार, गृह विभाग के स्तर पर एक गठित होने वाली संवीक्षा एवं चयन समिति के सदस्यों की मान्य राय होनी चाहिए;
(iii) अपराधियों, जिनके विरुद्ध पुरस्कार घोषित किया गया है या जो जघन्य अपराधों में अन्तवर्तित उद्घोषित अपराधी हैं, को गिरफ्तार करने / मुठभेड़ के लिए समुचित अधिमान दिया जाएगा। ऐसी सिफारिशों के लिए पिछले 3 (तीन) वर्ष के मामलों पर विचार किया जाएगा। पिछले 3 (तीन) वर्ष के मामलों से अभिप्राय है प्रथमतः 20 दिसम्बर, 2019 से पूर्ववर्ती 3 (तीन) वर्ष तथा उसके बाद से वार्षिक आधार पर होंगे;
(iv) ऑउट ऑफ टर्न पदोन्नति के लिए सिफारिषों पर केवल ऑउट ऑफ टर्न कोटा के लिए बनी रिक्तियों की उपलब्धता पर वर्ष-प्रति-वर्ष आधार पर विचार किया जाएगा। मार्च मास में पुलिस की सभी इकाईयों से नाम आमंत्रित किए जाएंगे तथा दोनों संवीक्षा एवं चयन समिति विचारण के लिए राज्य सरकार को 15 (पन्द्रह) दिन के भीतर अपनी सिफारिशें प्रस्तुत करेंगी।''।

No. G.S.R. 20/Const./Art.309/2021.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana Police Service Rules, 2002, namely:–
1. These rules may be called the Haryana Police Service (Amendment) Rules, 2021.
2. In the Haryana Police Service Rules, 2002, in rule 6, for sub-rule (1), the following sub-rule shall be substituted, namely:-
"(1) 70% (seventy percent) posts of Deputy Superintendent of Police shall be filled up by promotion from the rank of Inspectors, 25% (twenty five percent) by direct recruitment and 5% (five percent) by out of turn promotion:
Provided that only those Inspectors shall be eligible for promotion who (both promoted from subordinate ranks and directly recruited) have got six years regular satisfactory service as Inspector (Adhoc service will not be counted for the purpose of experience):
Provided further that promotion to the post of Deputy Superintendent of Police on out of turn basis shall be made by the State Government from amongst the Inspectors for showing extraordinary gallant and indomitable courage during the discharge of official duties by individual act or collective efforts of team and have shown exemplary courage during imminent danger to his life or serious harm to body while taking legal action in encounter with terrorist/militant/desperado/anti-social element/violent mob/hard core criminal or any during a natural calamity or during any difficult operation involving life threatening emergency. Such out of turn promotion shall be made against the vacancies meant for out of turn promotion quota.
Provided further that–
(i) Number of posts awarded for bravery or gallantry shall not be more than 5% (five percent) of total posts of Deputy Superintendent of Police meant for direct quota out of which not more than one third must be filled in one year or at a time subject to the availability of post;
(ii) For the cases claiming reward/promotion, FIR should have also been lodged in the concerned matter by the concerned officer or a conclusive report should be there to prove the involvement or bravery of the officer or there should be a considered opinion of the members of the Scrutiny- cum-Selection Committee to be constituted one at the level of Director General of Police and one at the level of the Addl. Chief Secretary to Govt. Haryana, Home Department;
(iii) Appropriate weightage shall be given for arresting/encounters of criminals against whom the reward is declared or who are proclaimed offenders involved in heinous crimes. Cases of last 3 (three) years shall be taken into consideration for such recommendations. Cases of last 3 (three) years means preceding 3 (three) years from the 20th December, 2019 in the first instance and thereafter it shall be on annual basis.
(iv) The recommendations for out of turn promotion shall be considered year-to year basis only on availability of vacancies meant for out of turn promotion quota. The names shall be invited from all units of Police in the month of March and both the Scrutiny-cum-Selection Committees shall submit their recommendations within 15 (fifteen) days to the State Government for consideration".
