संख्या 17/16/99-1 टी०सी०पी०.- पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र नियमित विकास निर्बन्धन नियम, 1965, हरियाणा राज्यार्थ, को आगे संषोधित करने के लिए नियमों का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल, हरियाणा अनुसूचित सड़क तथा नियंत्रित क्षेत्र अनियमित विकास निर्बन्धन अधिनियम, 1963 (1963 का पंजाब अधिनियम 41) की धारा 25 की उपधारा (2) के साथ पठित उपधारा (1) द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करते है, उक्त धारा की उपधारा (1) द्वारा यथा अपेक्षित ऐसे सभी व्यक्तियों की जानकारी के लिए, इसके द्वारा प्रकाषित किया जाता है, जिनके इससे प्रभावित होने की संभावना है;
इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाषन की तिथि से तीस दिन की अवधि की समाप्ति पर अथवा उसके पश्चात् सरकार, नियमों के प्रारूप पर, ऐसे आक्षेपों या सुझावों सहित, यदि कोई हों, जो अतिरिक्त मुख्य सचिव, हरियाणा सरकार, नगर तथा ग्राम आयोजना विभाग, चण्डीगढ़ द्वारा लिखित रूप में प्रारूप नियमों के सम्बन्ध में किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि समाप्ति से पूर्व प्राप्त किए जाएं, विचार करेगी।
प्रारूप नियम
1. ये नियम पंजाब अनुसूचित सड़क तथा नियंत्रित क्षेत्र अनियमित विकास निर्बन्धन (हरियाणा संषोधन) नियम, 2021, कहे जा सकते हैं।
2. पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन नियम, 1965 में, नियम 130 में :-
(i) उप-नियम (1) में, ''अपने स्वयं के विभाग, जिससे संबंध रखता है'' चिह्न तथा शब्दों के स्थान पर ''नगर एवं ग्राम आयोजना विभाग, हरियाणा'' शब्द तथा चिह्न प्रतिस्थापित किए जाएंगे; तथा
(ii) उप-नियम (4) के स्थान पर, निम्नलिखित उपनियम प्रतिस्थापित किया जाएगा, अर्थात् :-
''(4) अधिकरण का अध्यक्ष, तीन वर्ष की अवधि के लिए पद धारण करेगा तथा एक और अवधि के लिए पुनः नियुक्ति के लिए पात्र होगा तथा सदस्य, तीन वर्ष की अवधि के लिए या छियासठ वर्ष की आयु तक, जो भी पहले हो, पद धारण करेगा।''। 4290 HARYANA GOVT. GAZ. (EXTRA.), DEC. 30, 2021 (PAUS. 9, 1943 SAKA)

No. 17/16/99-1TCP.— The following draft of the rules further to amend the Punjab Scheduled Roads and Controlled Areas Restriction of Unregualted Development Rules, 1965 in its application to the State of Haryana, which the Governor of Haryana proposes to make in exercise of the powers conferred by sub-section (1) read with sub-section (2) of section 25 of the Haryana Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 (Punjab Act 41 of 1963), is hereby published as required under sub-section (1) of the said section, for information of persons likely to be affected thereby.
Notice is hereby given that the draft of the rules shall be taken into consideration by the Government on or after the expiry a period of thirty days from the date of publication of this notification in the Official Gazette, together with objections and suggestions, if any, which may be received in writing, to the Additional Chief Secretary to Government, Haryana, Town and Country Planning Department, from any person in respect of the draft rules before the expiry of the period so specified:–
Draft Rules
1. These rules may be called the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development (Haryana Amendment) Rules, 2021.
2. In the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Rules, 1965, in rule 130,–
(i) in sub-rule (1), for the words ―from his own department to which he belongs‖, the words and sign ―from Town and Country Planning Department, Haryana‖;
(ii) for sub-rule (4), the following sub-rule shall be substituted, namely:–
―(4) The Chairman of the Tribunal shall hold office for a term of three years and shall be eligible for reappointment for another term and the Member shall hold office for a period of three years or upto the age of sixty-six years, whichever is earlier:‖.
