सं० 76/भा०नि०आ०/आ०/हरि०-वि०स०/29/2019/उ०अनु०-II.- यतः आयोग ने हरियाणा राज्य के 29-राई विधानसभा निर्वाचन क्षेत्र के लिए दिनांक 27.09.2019 की अपनी अधिसूचना के द्वारा हरियाणा विधानसभा के साधारण निर्वाचन आयोजन की घोषणा की तिथि थी और श्री सुनील कुमार पुत्र गुलाब सिंह ने जय महा भारत पार्टी के उमीार के प म पूर्वोक्त निर्वाचन लड़ा था;
और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 77(1) के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, वह तिथि जब उसे नाम-निर्देषित किया गया है और उसके परिणाम की घोषणा की तिथि, दोनों तारिखें सम्मिलित, के बीच अपने द्वारा या अपने निर्वाचत एजेंट द्वारा उपगत या अधिकृत निर्वाचन संबंधी सभी खर्चाें का, या ताव स्वयं या अपने निर्वाचन एजेंट द्वारा एक पृथक और सही लेखा रखेगा और लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, निर्वाचित अधिकारी को दर्ज करेगा जो धारा 77 के अंतर्गत उसके द्वारा उसके निर्वाचन एजेंट द्वारा रखे गए लेखे की सत्य प्रतिलिपि होगी।
और यतः निर्वाचनों का संचालन नियम, 1951 के नियम (2) के अधीन मुख्य निर्वाचन अधिकारी के पत्र संख्या 06(सोनीपत)HVS Elec-Exp.-2019/2333, दिनांक 04.06.2020 के जरिए जिला निर्वाचन अधिकारी, सोनीपत, हरियाणा द्वारा प्रस्तुत रिपोर्ट के अनुसार हरियाणा राज्य के 29-राई विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री सुनील कुमार पुत्र गुलाब सिंह विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई लेखा दाखिल करने में असफल रहे हैं;
और यतः, जिला निर्वाचन अधिकारी, सोनीपत और मुख्य निर्वाचन अधिकारी, हरियाणा की रिपोर्टाें के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल न करने पर, श्री सुनील कुमार पुत्र गुलाब सिंह को कारण बताओ नोटिस दिनांक 23.09.2020 जारी किया गया था;
और यतः निर्वाचनों का संचालन नियम, 1961 के नियम 89क उपनियम (6) के अनुसार, दिनांक 23.09.2020 को उपर्युक्त कारण बताओ नोटिस के माध्यम से, श्री सुनील कुमार पुत्र गुलाब सिंह, को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनाें के भीतर लेखे प्रस्तुत न कर पाने का कारण स्पष्ट करते हुये आयोग को लिखित में अपना
(140)PART II] HARYANA GOVT. GAZ., JULY 19, 2022 (ASAR. 28, 1944 SAKA) 141 अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल/अपने लेखे में त्रुटियो को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें।
और यतः श्री सुनील कुमार पुत्र गुलाब सिंह, द्वारा उक्त नोटिस दिनांक 09.10.2020 को प्राप्त किया गया था। अभ्यर्थी से प्राप्त पावती, जिला निर्वाचन अधिकारी, सोनीपत, द्वारा दिनांक 04.07.2021 के अपने पत्र निर्वाचन-2021/323 के द्वारा आयोग को प्रस्तुत कर दी गई है;
और यतः जिला निर्वाचन अधिकारी, सोनीपत द्वारा दिनांक 10.09..2021 के अपने पत्र सं0 निर्वाचन-2021/649 के द्वारा प्रस्तुत अनुपुरक रिपोर्ट में यह कहा गया है कि श्री सुनील कुमार पुत्र गुलाब सिंह निवासी गांव - नांगल कलां हरियाणा ने न तो कोई अभ्यावेदन दिया है और न ही मूल वाउचर्स सहित विधिवत रूप सेे हस्ताक्षरित निर्वाचन व्यय के सही लेखे प्रस्तुत किए हैं। इसके अतिरिक्त, उन्होेेंने भारत निर्वाचन आयोग के सम्यक् नोटिस की प्राप्ति के बाद भी उक्त असफलता हेतु न तो कोई कारण बताया न ही स्पष्टीकरण दिया है;
और यतः भारत निर्वाचन आयोग को यह समाधान हो गया है कि श्री सुनील कुमार पुत्र गुलाब सिंह निर्वाचन व्यय लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित नहीं है;
और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि :-
"यदि निर्वाचन आयोग को यह समाधान हो जाता है कि कोई व्यक्ति- (क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या कानून के अधीन अपेक्षित है, दाखिल करने में असफल रहा है;
(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित नहीं है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोषित करेगा और ऐसा कोई भी व्यक्ति उस आदेष की तारीख से तीन वर्ष की कालावधी के निरर्हित रहेगा;
अब इसीलिए, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा हरियाणा राज्य के 29-राई विधानसभा निर्वाचन क्षेत्र से विधानसभा के साधारण निर्वाचन-2019 में निर्वाचन लड़ने वाले अभ्यर्थी श्री सुनील कुमार पुत्र गुलाब सिंह निवासी गांव-नांगल कलां, हरियाणा को संसद के किसी भी सदन या राज्य या संघ राज्य और राज्य क्षेत्र की विधानसभा अथवा विधान परिषद के लिए सदस्य चुने जाने या होने के लिए इस आदेष की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है।

Order
No. 76/ECI/ORD/HAR-LA/29/2019/N.S.-II.— WHEREAS, the Election Commission of India had declared to hold Legislative Election to the State of Haryana from 29-Rai Assembly Constituency vide its Notification dated 27.09.2019 and Shri Sunil Kumar S/o Sh. Gulab Singh had contested the aforesaid election as a Jai Maha Bharath Party's candidate;
AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him or by his election agent between (the date on which he has been nominated) and the date of declaration of the result thereof, both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the142 HARYANA GOVT. GAZ., JULY 19, 2022 (ASAR. 28, 1944 SAKA) [PART II date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses which shall be in a true copy of the account kept by him or by his election agent under Section 77.
AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer-cum-Deputy Commissioner, Sonipat, Haryana through the Chief Electoral Officer's letter No. 06 (Sonipat)/HVS Elec. Exp-2019/2333 dated 04.06.2020, Sunil Kumar S/o Sh. Gulab Singh contesting candidate from 29-Rai Assembly Constituency of Haryana, has failed to lodge the account of his election expenses as required by law;
AND WHEREAS, on the basis of the reports of the District Election Officer-cum-Deputy Commissioner, Sonipat, Haryana and the Chief Electoral Officer, Haryana, a Show Cause notice dated 23.09.2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Sunil Kumar S/o Sh. Gulab Singh for non submission of account of Election expenses;
AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 23.09.2020, Shri Sunil Kumar S/o Sh. Gulab Singh was directed to submit his representation in writing in the Commission explaining the reasons for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts before the District Election Officer concerned within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was received by Shri Sunil Kumar S/o Sh. Gulab Singh on 09.10.2020. Acknowledgement receipt obtained from the candidate have been submitted to the Commission by District Election officer, Sonipat vide his letter No. Elect-2021/323, dated 07.04.2021;
AND WHEREAS, in the supplementary report submitted by DEO, Sonipat vide his letter No. Elect- 2021/649, dated 10.09.2021, it has been stated that Shri Sunil Kumar S/o Sh. Gulab Singh has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers. Further, he has neither furnished any reason nor explanation for the said failure, even after receipt of the due notice, to the Election Commission of India as well;
AND WHEREAS, the Commission satisfied that Shri Sunil Kumar S/o Sh. Gulab Singh has failed to lodge an account of election expenses and has no good reason or justification for the failure;
AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person-
(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and
(b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order;
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Sunil Kumar S/o Sh. Gulab Singh resident of Village- Nangal Kalan, Haryana, the contesting candidate for the General Election to Legislative Asslembly Election-2019 from 29- Rai Assembly Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
