संख्या 18/130/2022-2क1.- हरियाणा नगरपालिका अधिनियम, 1973 (1973 का 24), की धारा 257 की उप-धारा (1) तथा (3) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, नगरपालिका लेखा संहिता, 1930, हरियाणा राज्यार्थ, को आगे संषोधित करने के लिए नियमों का निम्नलिखित प्रारूप बनाने का प्रस्ताव करते हैं, तथा उक्त अधिनियम की धारा 257 की उप-धारा (5) द्वारा यथा अपेक्षित ऐसे व्यक्तियों की जानकारी के लिए इसे प्रकाषित किया जाता है, जिनके इनसे प्रभावित होने की सम्भावना है;
इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाषन की तिथि से दस दिन की अवधि की समाप्ति पर या उसके पष्चात्, सरकार, नियमों के प्रारूप पर, ऐसे आक्षेपों और सुझावों सहित, यदि कोई हाें, जो प्रधान सचिव, हरियाणा सरकार, शहरी स्थानीय निकाय विभाग, हरियाणा, चण्डीगढ़ द्वारा, किसी व्यक्ति से नियमों के प्रारूप के सम्बन्ध में इस प्रकार यथा विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किए जाएं, विचार करेगी।
प्रारूप नियम
1. ये नियम नगरपालिका लेखा (हरियाणा द्वितीय संषोधन) संहिता, 2022, कहे जा सकते हैं। 2. नगरपालिका लेखा संहिता, 1930 (जिसे, इसमें, इसके बाद, उक्त संहिता कहा गया है) में, ''उपायुक्त'' शब्द, जहां कहीं भी आए हैं, के स्थान पर, ''जिला नगर आयुक्त'' शब्द प्रतिस्थापित किए जाएंगे।
3. उक्त संहिता में, नियम XII.4 में, उप-नियम (1-क) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, अर्थात्ः-
"(1-क) सभी चेक जिला मुख्यालय की नगर परिषद् की दषा में, मुख्य कार्यकारी अधिकारी अथवा उसके द्वारा प्राधिकृत किसी अधिकारी, अन्य नगर परिषद्ों की दषा में, कार्यकारी अधिकारी, नगरपालिका समिति की दषा में सचिव, जैसी भी स्थिति हो और वित्त विभाग द्वारा प्रतिनियुक्त लेखा प्रभारी अधिकारी द्वारा संयुक्त रूप से हस्ताक्षरित किए जाएंगे। लेखा प्रभारी अधिकारी की रिक्ति की दषा में, चेक किसी अधिकारी, जो इस सम्बन्ध में प्रषासकीय सचिव, शहरी स्थानीय निकाय विभाग द्वारा विनिर्दिष्ट किया जाए, द्वारा संयुक्त रूप से हस्ताक्षरित किया जाएगा। मुख्य कार्यकारी अधिकारी या कार्यकारी अधिकारी या सचिव, जैसी भी स्थिति हो और लेखा प्रभारी अधिकारी चेक को हस्ताक्षरित करने से पूर्व सुनिष्चित करेंगे कि बिल में भुगतान हेतु विनिर्दिष्ट धनराषि या प्रयोजन, जिसके लिए चेक जारी किया गया है, उक्त प्रयोजन, जो प्राधिकारी द्वारा अनुमोदित हो, के लिए विषिष्ट रूप से अपेक्षित है तथा बजट के अधीन अतंर्गत है।"। 3122 HARYANA GOVT. No. 18/130/2022-2CI.— The following draft of rules further to amend the Municipal Account Code, 1930, in its application to the State of Haryana which the Governor of Haryana proposes to make in exercise of the powers conferred under Sub-sections (1) and (3) of Section 257 of the Haryana Municipal Act, 1973 (24 of 1973), is hereby published as required by Sub-section (5) of Section 257 of the said Act, for the information of persons likely to be affected thereby.
Notice is hereby given that the draft of rules shall be taken into consideration by the State Government on or after the expiry of a period of ten days from the date of publication of this notification in the Official Gazette, together with objections or suggestions, if any, which may be received by the Principal Secretary to Government, Haryana, Urban Local Bodies Department, Chandigarh, from any person with respect to the draft of rules before the expiry of the period so specified.
Draft Rules
1. These rules may be called the Municipal Account (Haryana Second Amendment) Code, 2022.
2. In the Municipal Account Code, 1930 (hereinafter called the said Code), for the words "Deputy Commissioner" wherever occurring, the words "District Municipal Commissioner" shall be substituted.
3. In the said Code, in rule XII.4, for sub-rule (1-A), the following sub-rule shall be substituted, namely:-
"(1-A) All cheques shall be jointly signed by the Chief Executive Officer or any officer authorized by him in case of Municipal Council of District Headquarter, Executive Officer in case of other Municipal Councils, Secretary in case of Municipal Committee, as the case may be and officer incharge of the accounts deputed by Finance Department. In case the post of officer incharge of accounts is vacant, the cheque shall jointly be signed by an officer as may be specified by the Administrative Secretary of Urban Local Bodies Department in this behalf. The Chief Executive Officer or Executive Officer or Secretary, as the case may be and the officer incharge of accounts before signing the cheque shall ensure that the sum specified for payment in the bill or the purpose for which the cheque is drawn, is specifically required for the said purpose as sanctioned by the authority and is covered under the budget.".
