ग्राम जल एवं सीवरेज समिति (वीडब्ल्यूएससी)

संख्या 22/57/2022-3PH.- सरकारी अधिसूचना संख्या 19/01/2019-3PH दिनांक 13.12.2019 के आंषिक संषोधन में उक्त आदेष में निहित प्रावधानों में सुधार लाने ओर ग्रामीणों की अधिक से अधिक भागीदारी प्राप्त करने और हरियाणा राज्य के सभी गांवों में पेयजल और सीवरेज सेवाओं में सुधार और सेवा वितरण को मजबूत करने की दृष्टि से संषोधित किया गया है।

जबकि ग्राम पंचायत के कार्यों और कर्तव्यों को हरियाणा पंचायती राज अधिनियम 1994 की धारा 21 में परिभाषित किया गया है, जिसमें पेयजल और जल प्रदूषण पर नियंत्रण शामिल है। जबकि उक्त अधिनियम की धारा 21 में परिभाषित कर्तव्यों और कार्यों को करने के लिए हरियाणा पंचायती राज अधिनियम, 1994 की धारा 22 के तहत प्रत्येक ग्राम पंचायत में उप समितियों का गठन किया जा सकता है। 1. वीडब्ल्यूएससी का गठन

प्रत्येक ग्राम पंचायत एक वीडब्ल्यूएससी का गठन करेगी जिसमें सरपंच के अलावा 3 से अधिक पंच नहीं होंगे और ग्राम सभा द्धारा चुने गए ग्राम समुदाय के ऐसे अन्य सदस्य जो वीडब्ल्यूएससी की संरचना के अनुसार नीचे अनुच्छेद 2 में परिभाषित किया गया है। ग्राम पंचायत वीडब्ल्यूएससी के गठन को मान्यता देते हुए एक प्रस्ताव पारित करेगी और वीडब्ल्यूएससी के संचालन के लिए नियमों और विनियमो को मंजूरी देगी। 2. वीडब्ल्यूएससी की संरचना

वीडब्ल्यूएससी की संरचना निम्नानुसार होगी :

3. वीडब्ल्यूएससी के पदाधिकारी

(क) सरपंच वीडब्ल्यूएससी का पदेन अध्यक्ष होगा,

(ख) जन स्वास्थ्य अभियांत्रिकी विभाग से कनिष्ठ अभियंता या कोई अन्य प्रतिनियुक्त अधिकारी वीडब्ल्यूएससी का तकनीकी सदस्य होगा।

4. सदस्यता का कार्यकाल

(क) वीडब्ल्यूएससी में सभी पदेन सदस्यों यानी सरपंच और पंचों का कार्यकाल उनके सरपंच या पंच के पद के साथ समाप्त होगा।

(ख) ग्राम पंचायत के भंग होने के साथ-साथ, वीडब्ल्यूएससी के सभी सदस्यों की सदस्यता भी भंग हो जाएगी। सरपंच के निलंबित या हटाए जाने और वीडब्ल्यूएससी के अध्यक्ष का पद रिक्त होने पर, एक अधिकारी (बीडीपीओ)/पंच कार्यवाहक सरपंच/प्रषासक के रूप में नियुक्त किया जाएगा। अध्यक्ष के कार्य एवं सरपंच की बहाली पर कार्यवाहक सरपंच/प्रषासक अध्यक्ष का कार्यभार सरपंच को सौंपेेंगे तथा ग्राम पंचायत भंग होने की स्थिति में प्रषासक के रूप में नियुक्त व्यक्ति अध्यक्ष के कार्यों का निर्वहन करेगा। नियुक्त अधिकारी ग्राम पंचायत का पुनर्गठन होते ही अध्यक्ष को पद सौंप देगा।PART I] HARYANA GOVT. GAZ., NOV. 22, 2022 (AGHN. 1, 1944 SAKA) 999 (ग) व्यक्तिगत सदस्य वीडब्ल्यूएससी से इस्तीफा दे सकते हैं या कार्यकाल के दौरान ग्राम सभा द्धारा अनुमोदन के बाद वीडब्ल्यूएससी में नियुक्त किए जा सकते हैं।

(घ) वीडब्ल्यूएससी लगातार तीन महीनों तक अपना कार्यभार संभालने में विफल रहने की स्थिति में, इस अधिसूचना में निर्धारित प्रभावी तरीके से अपनी भूमिकाओं और जिम्मेदारियों को नहीं निभा पाने की स्थिति में, धन का दुरूपयोग/गबन, सदस्य द्धारा खुद को या करीबी रिष्तेदार को फायदा पहुंचाने की स्थिति में, ग्राम सभा, जिला जल एवं सीवरेज मिषन (डीडब्ल्यूएसएम) के अनुमोदन से वीडब्ल्यूएससी के कार्यभार संभालने के लिए जन स्वास्थ्य अभियांत्रिकी विभाग से अनुरोध कर सकती है। ऐसी स्थिति में, जन स्वास्थ्य अभियांत्रिकी विभाग से अनुरोध कर सकती है। ऐसी स्थिति में, जन स्वास्थ्य अभियांत्रिकी विभाग ग्राम पंचायत के माध्यम से गतिविधियों को शुरू करवा सकती है और वीडब्ल्यूएससी को फिर से गठित करने में मदद कर सकती है।

5. पानी समिति :

यदि उप-समिति अर्थात वीडब्लयूएससी में पंचायत के निर्वाचित सदस्यों का कार्यकाल किसी भी कारण से समाप्त हो गया है, तो ग्रामीण जलापूर्ति और सीवरेज सेवा वितरण में सुधार के रूप में कार्य करने के लिए एक पानी समिति का गठन किया जाएगा। पानी समिति का गठन इस प्रकार होगा :

5.1 पानी समिति की संरचना :

प्रत्येक ग्राम पंचायत एक पानी समिति का गठन करेगी जिसमें अध्यक्ष खंड विकास एवं पंचायत अधिकारी (बीडीपीओ) होंगे, ग्राम सभा द्धारा चुने गए ग्राम समुदाय के बीच से समिति की संरचना के अनुसार पानी समिति को संरचना इस प्रकार होगी :

5.3 वीडब्ल्यूएससी/ पानी समिति की भूमिकाएं और जिम्मेदारियां

वीडब्ल्यूएससी/ पानी समिति ग्राम समुदाय की जलापूर्ति और सीवरेज सुविधाएं और सेवाएं प्रदान करने के संबंध में सभी कार्य करेगी, जिनमें सम्मिलित हैं :

I. ग्राम स्तर पर जलापूर्ति और सीवरेज संबंधी योजना बनाना, कार्यान्वयन, पर्यवेक्षण, निगरानी, संचालन और रखरखाव, निर्माण, अधिग्रहण, किराए पर लेना, पुनर्वास, कायाकल्प, अधिग्रहण, पानी की आपूर्ति प्रदान करने के लिए इंट्रा-ग्राम इंफ्रास्ट्रक्चर जैसा कि टयूबवेल, कनाल बेस्ट वाटर वक्र्स, बूस्टर्स, पाइपलाइन, वोल्वस इत्यादि प्रणालियों और अन्य सेवाओं संबंध अनुबंध आदि कार्य करनाः II. गांवों में जलापूर्ति और सीवरेज सेवाएं प्रदान करने के लिए किफायती तकनिकी विकल्पों और योजनाओं पर निर्णय लेनाः

III. गांव में जलापूर्ति या सीवरेज संबंधी समस्याओं के समाधान हेतु जन स्वास्थ्य अभियांत्रिकी विभाग से विस्तृत योजना रिपोर्ट की प्रषासनिक एवं तकनीकी स्वीकृति प्राप्त करनाः

IV. जलापूर्ति और सीवरेज क्षेत्र से जुड़े अन्य विभागों, संस्थानों, ग्राम पंचायत, जन स्वास्थ्य अभियांत्रिकी विभाग के बीच एक कड़ी और संपर्क के रूप में कार्य करनाः

V. ग्राम समुदाय मे स्वास्थ्य, स्वच्छता और जल संसाधन प्रबंधन सहित जल आपूर्ति और सीवरेज के सभी पहलुओं पर सूचना का प्रसार, जागरूकता पैदा करना और षिक्षित करनाः

VI. बैंक खाते खोलना और खातों का संचालन, अपनी भूमिकाओं और जिम्मेदारियों के लिए धन की प्राप्ति और व्यय, बही खातों में सही विवरण को बनाए रखना तथा रिकॉर्ड को ऑडिट/ निरीक्षण के लिए उपलब्ध करानाः

VII. गांव में स्वीकृत जलापूर्ति एवं सीवरेज योजनाओं पर जन स्वास्थ्य अभियांत्रिकी विभाग से धनराषि को प्राप्त करना और उन्हें योजनाओं पर खर्च करनाः

VIII. जिला स्तरीय संस्थानों और जन स्वास्थ्य अभियांत्रिकी विभाग के साथ समझौता ज्ञापन या अन्य प्रकार के समझौते करना :

IX. जन स्वास्थ्य अभियांत्रिकी विभाग द्धारा जारी दिषा-निर्देषों के अनुसार अपनी भूमिका और जिम्मेदारियों को निभाने के लिए कार्यों, वस्तुओ या सेवाओ को प्राप्त करनाः

X. गांव में जलापूर्ति और सीवरेज सम्बंधित कार्यों को क्रियान्वित करने के लिए ठेकेदारों, सहायता संगठनों या अन्य सेवा प्रदाताओं के साथ अनुबंध करना :

XI. जलापूर्ति और सीवरेज की समस्याओ को हल करने और सामुदायिक कार्रवाई के लिए ग्रामीणों को संगठित करना :

XII. ग्राम स्तर पर जलापूर्ति और सीवरेज सुविधाओं की पूंजीगत लागत पर उपयोगकर्ताओं के हिस्से को जुटाने के लिए ग्रामीणों की संगठित करनाः

XIII. सरकारी नीति के अनुसार जलापूर्ति और सीवरेज योजनाओं के संबंध में घरों के लिए कनेक्षन का प्रावधान करनाःPART I] HARYANA GOVT. GAZ., NOV. 22, 2022 (AGHN. 1, 1944 SAKA) 1001 XIV. पानी की आपूर्ति और सीवरेज सुविधाओं के उपयोगकर्ताओं से पर्चे और संग्रह जैसे शुल्क, फीस, दर या जमा, जैसा कि यह पानी की आपूर्ति और सीवरेज, बुनियादी ढांचे, सुविधाओं और सेवाओं के संचालन और रखरखाव की लागत की वसूली के लिए उपयुक्त हो सकता है।

XV. अन्य गांवों के वीडब्ल्यूएससी/ पानी समिति के साथ सहयोग - प्रतिनिधियों को नामित करना, समझौता ज्ञापनों पर हस्ताक्षर करना, जिम्मेदारियों को साझा करना, वित्तिय संसाधनों का योगदान या बहु-गांव, अंतर-ग्राम जलापूर्ति सेवाओं को साझा कर गांव में जलापूर्ति और सीवरेज से संबंधित सेवाओं को प्रदान करनाः

XVI. वीडब्ल्यूएससी/ पानी समिति अपनी सभी गतिविधियों के लिए ग्राम सभा के प्रति जवाबदेह रहेगी। XVII. वीडब्ल्यूएससी/ पानी समिति की सभी गतिविधियां सहभागीदारी आधारित होगी ताकि ग्राम समुदायो के सभी वर्गों को शामिल किया जा सकेः

XVIII. वीडब्ल्यूएससी/ पानी समिति यह सुनिष्चित करेगी कि गांव में सभी को इन गतिविधियों से समान लाभ मिलेः

XIX. वीडब्ल्यूएससी/ पानी समिति की सभी गतिविधियां के सभी सदस्यों को महत्वपूर्ण जानकारी प्रदान कर पारदर्षी तरीके से की जाएः

XX. किसी अन्य कार्यक्रम के तहत गांवों में महाग्राम योजना, नाबार्ड या जन स्वास्थ्य अभियांत्रिकी विभाग द्धारा लागू किए जा रही जलापूर्ति और सीवरेज के किसी भी कार्य मे बाधा या बाधा को रोकनाः XXI. सभी चल और अचल संपति ग्राम पंचायत या जन स्वास्थ्य अभियांत्रिकी विभाग के नाम पर रहेगी और वीडब्ल्यूएससी/ पानी समिति के पास स्वामित्व के लिए किसी अन्य व्यक्ति या संस्थानों को हस्तांतरित करने या संपत्ति पर कोई शुल्क लगाने का कोई अधिकार नहीं होगा। वीडब्ल्यूएससी/ पानी समिति सामग्री और मषीनरी सहित सभी संपत्तियों की सूची का रिकॉर्ड रखेंः

XXII. सभी तकनीकी गतिविधियाँ जन स्वास्थ्य अभियांत्रिकी विभाग के मार्गदर्षन एवं पर्यवेक्षण तथा जन स्वास्थ्य अभियांत्रिकी विभाग द्धारा समय समय पर जारी दिषा-निर्देषों के अनुपालन में की जायेगी। XXIII. वीडल्यूएससी/पानी समिति द्धारा समय-समय पर प्रगति रिपोर्ट और ऐसी अन्य रिपोर्टें प्रस्तुत करेंगी जो जन स्वास्थ्य अभियांत्रिकी विभाग, हरियाणा द्धारा समय समय पर निर्धारित होगीः

XXIV. पूजींगत लागत के लिए सामुदायिक योगदान की व्यवस्था करना - नकद और वस्तु (श्रम, भूमि या सामग्री) दोनों में यदि कोई हो।

XXV. पूर्ण हो चुके जलापूर्ति और सीवरेज कार्यों को चालू करना, उपभोक्ताओ और उनके खातों का लेखा-जोखा सहित अधिग्रहण करनाः

XXVI. बहुग्राम योजना के लिए प्रत्येक गांव की वीडब्ल्रूूएससी/पानी समिति में भाग लेने वाले सदस्यों को शामिल कर योजना स्तरीय समिति (एमवीएसएलसी) के समान भूमिका निभाएंगी।

XXVII. उपभोक्तओं को नए जलापूर्ति एवं सीवरेज कनेक्षन की स्वीकृति करना।

XXVIII. पेयजल आपूर्ति सुनिष्चित करने के लिए अधिकृत प्रयोगषाला से पानी की गुणवत्ता की नियमित जांच करवानाः

XXIX. जन स्वास्थ्य अभियांत्रिकी विभाग से प्राप्त धनराषि का उपयोगिता प्रमाण पत्र जमा करनाः XXX. वीडब्ल्यूएससी/ पानी समिति द्धारा प्राकृतिक आपदाओं जैसे सूखा, बाढ़ और महामारी आदि के समय प्रमुख भूमिका निभाना और आकस्मिक योजना को प्रारूप देनाः

XXXI. वीडब्ल्यूएससी/ पानी समिति ग्राम स्तर पर विभिन्न गतिविधियो को प्रभावी ढंग से करने के लिए आवष्यकताओं के अनुसार स्वैच्छिक व्यक्ति की नियुक्ति कर सकती है। अधिकतम 7 स्वैच्छिक व्यकित को लगाया जा सकता है।

XXXII. वीडब्ल्यूएससी/पानी समिति को किसी भी अवैध कनेकषन/ अस्वच्छ कनेक्षन को काटने या जुर्माना लगाने और कनैक्ष्न को नियमित करने का अधिकार होगाः

XXXIII. वीडब्ल्यूएससी/ पानी समिति संचालन और रखरखाव के खर्चों को पूरा करने के लिए जन स्वास्थ्य अभियांत्रिकी विभाग की अधिसूचना संख्या 19/1/2017-3 पीएच दिनांक 13.12.2019 द्धारा अधिसूचित या समय-समय पर संषोधित पानी के टैरिफ को वीडब्ल्यूएससी की बैठक में एक प्रस्ताव पारित कर बढ़ाने का अधिकार होगा।

यदि किसी भी समय यह पाया जाता है कि वीडब्ल्यूएससी/पानी समिति अपने कार्य नहीं कर रही है, जो इस अधिसूचना के खंड में दिए गए प्रावधानों के अनुसार वीडब्ल्यूएससी/ पानी समिति के भंग कर इसे पुनर्गठित किया जा सकता है।1002 HARYANA GOVT. GAZ., NOV. 22, 2022 (AGHN. 1, 1944 SAKA) [PART I 6. स्वैच्छिक समिति

प्रत्येक ग्राम पंचायत में स्वैच्छिक समिति का गठन किया जा सकता है जहां ग्राम जल एवं सीवरेज समितियां (वीडब्ल्यूएससी)/पानी समिति गठित की गई हो। समिति के सदस्य गांव या ग्राम पंचायत के निवासी होने चाहिए जो गांव के विकास के लिए सक्रिय रूप से काम कर रहे हों, बिना किसी व्यक्तिगत वित्तिय लाभ के समुदाय और सार्वजनिक हितों के लिए अपना समय, सेवा और विषेषज्ञता प्रदान करने के इच्छुक हों। 6.1 स्वैच्छिक समिति के गठन का उद्देष्य

➢ स्वैच्छिक समिति, वीडब्ल्यूएससी/पानी समिति को आत्मर्निभर, समान वितरण और लंबे समय तक टिकाऊ आधार पर सभी घराें में प्र्याप्त पीने योग्य पेयजल को पहुंचाने में सहयोग करेगी। ➢ स्वैच्छिक समिति का गठन जागरूकता को बढ़ावा देने, स्थानीय समुदाय के बीच नकद, वस्तु या स्वैच्छिक श्रम में योगदान के माध्यम से अधिक स्वामित्व को स्थापित करने के लिए है। ➢ यह आत्मनिर्भर, समान वितरण, लगातार, आर्थिक रूप से सुरक्षित, प्र्याप्त पानी और सामान्य साधनों में प्रणाली का संचालन प्राप्त करने के लिए जल आपूर्ति प्रणाली के संचालन और रखरखाव में वीडब्यूएससी/पानी समिति का सामान्य रूप से पानी की व्यवस्था को प्रतिदिन समय पर प्रभावी रूप से संचालन सुनिष्चित करने में सहयोग करेगी।

6.2 स्वैच्छिक समिति का गठन

स्वैच्छिक समिति में 7 सदस्य होंगे और जिसमें पंप ऑपरेटर, इलेक्ट्रीषियन, फिटर, प्लंबर, कुषल श्रमिक या गांव के किसी भी अन्य समुदाय के सदस्य समिति में स्वयंसेवक के रूप में काम करने के इच्छुक हो सकते हैं। ग्राम पंचायत के अंतर्गत आने वाले गांवों और बस्तियो के निवासी ही स्वयंसेवक हो सकते है।

समिति का गठन ग्राम सभा के दौरान किया जाएगा। सम्बन्धित ग्राम पंचायत द्धारा स्थानीय समुदाय को स्वैच्छिक समिति के गठन के सम्बंध में न्यूनतम 7 दिनों की पूर्व सूचना दी जाएगी। पानी समिति के स्वैच्छिक सदस्य बनने के लिए ग्राम सभा की बैठक में ग्राम पंचायत के माध्यम से आवेदन/ अनुरोध कर सकते हैं।

अथवा

यदि, किसी भी स्थिति में, ग्राम पंचायत को भंग या निष्क्रिय कर दिया जाता है, तो संबंधित खंड विकास एवं पंचायत अधिकारी (बीपीडीओ) के पास जन स्वास्थ्य अभियांत्रिकी विभाग, हरियाणा के कनिष्ठ अभियंता से परामर्ष कर स्वयंसेवकों की सिफारिष करने की शक्ति होगी।

यह समिति ग्राम पंचायत के होने की स्थिति में बनी रहेगी। ग्राम सभा द्धारा चुने गए सभी सदस्यों का कार्यकाल तीन वर्ष का होगा और ग्राम सभा सत्र के दौरान वीडब्ल्यूएससी/ पानी समिति की सिफारिष से पुनर्निर्वाचन (अतिकतम दो कार्यकाल) के लिए पात्र होंगे।

यदि किसी भी समय, यह देखा जाता है कि कोई स्वयंसेवक निष्क्रिय या अपनी भूमिकाओं और जिम्मेदारियों का दुरूपयोग कर रहा/रही है, अपने कार्यों को नहीं कर रहा है, तो उसे किसी भी समय वीडब्ल्यूएससी/पानी समिति के प्रस्ताव के माध्यम से हटाया जा सकता है। व्यक्तिगत सदस्य कार्यकाल के दौरान कभी भी इस्तीफा दे सकते है। स्वैच्छिक समिति के निष्क्रिय होने और अपने कार्यो को नहीं करने की स्थिति में इस अधिसूचना मे ंदिए गए प्रावधानों के अनुसार इसे भंग और पुनर्गठित किया जा सकता है। 6.3 स्वैच्छिक समिति की संरचना स्वैच्छिक समिति की संरचना इस प्रकार होगी :

6.4 स्वैच्छिक समिति की भूमिका और जिम्मेदारयिां :

(1) वीडब्ल्यूएससी/ग्राम पंचायत/ जन स्वास्थ्य अभियांत्रिकी विभाग के समन्वय से जल जीवन मिषन के परिचालन, दिषानिर्देषों के अनुसार जलापूर्ति योजनाओं से संबंधित सभी सामुदायिक गतिविधियों का प्रबंधन, समर्थन और संचालन करना।

(2) गांव में ग्रामीण समुदायों के बीच सुरक्षित नल से पेयजल, ग्रे वाटर, प्रबंधन, जल संरक्षण के महत्व आदि पर जागरूकता पैदा करना।

(3) संचालन और रखरखाव के माध्यम से योजना में प्र्याप्त हिस्सेदारी और सवामित्व बनाने के लिए सामुदायिक प्रयास करना।

(4) नए जल कनेक्षन लेने के लिए समुदाय को प्रेरित करना (यदि कोई छूट गया हो या नहीं लिया हो) । (5) पानी के कनेक्षन शुल्क और सुरक्षा राषि जमा करने के लिए प्रेरित करना।

(6) ग्रामीण परिवारों को ग्रामीण बुनयादी ढांचे की पूंजीगत लागत का 5% -10% योगदान का भुगतान करने और नियमित रूप से पानी के शुल्क का भुगतान करने के लिए प्रेरित करना।

(7) पानी एवं स्वच्छता और सफाई के मुद्दों पर समुदाय के बीच समग्र जागरूकता बढ़ाना।

(8) गांव में जल जीवन मिषन के कार्यान्वयन के लिए ग्राम पंचायत (जीपी)/ ग्राम जल एवं स्वच्छता समिति (वीडब्ल्यूएससी) को सहायता प्रदान करना।

(9) जन स्वास्थ्य एवं अभियांत्रिकी विभाग और भारत सरकार/ राज्य सरकार द्धारा शुरू किए गए जल अभियानों में समुदाय को शामिल करना।

(10) कार्यषील घरेलू नल कनेक्षन (एफएचटीसी) की सेवा वितरण के आंकलन में सहायता करना और 100% एफएचटीसी सुनिष्चित करना।

(11) पानी की गुणवता परीक्षण और प्रबंधन और आईएमआईएस पोर्टल पर अपलोड करने में वीडब्ल्यूएससी/ पानी समिति की सहायता करना।

(12) फील्ड टेस्टिंग किट (एफटीके) या प्रयोगषाला में परीक्षण नमूनों का उपयोग करके गांव में उपलब्ध सभी पेयजल स्रोतों की नियमित जल गुणवत्ता निगरानी करना।

(13) समुदाय को जल के विभिन्न पहलुओं जैसे वर्षा जल संचयन, कृत्रिम पुनर्भरण, जल गुणवत्ता, जल जनित रोग, जल की बचत, जल प्रबंधन, पेयजल स्रोत में वृद्धि/ निरंतरता आदि पहलुओं के बारे में जागरूक करना।

(14) स्कूली बच्चों सहित सभी हितधारकों के लिए प्रषिक्षण और जागरूकता अभियान में सहायता करना। (15) जल जीवन मिषन से संबंधित सभी गतिविधियों का रिकॉर्ड और रिपोर्ट बनाने के लिए वीडब्ल्यूएससी/ पानी समिति को सहायता प्रदान करना।

(16) गांव में 100% वैध पानी का कनेक्षन सुनिष्चित करने के लिए वीडब्ल्यूएससी/ पानी समिति को सहायता प्रदान करना।

Notification

The 26th October, 2022

Village Water & Sewerage Committee (VWSC)

No. 22/57/2022-3PH.— In partial modification of the Government Notification No.19/01/2019-3PH dated 13.12.2019 the provisions contained in the said or dearer revised with a view to improve in grand achieving greater participation of rural habitants and to improve drinking water and sewerage services and to strengthen service delivery in all villages of Haryana State.

Whereas the functions and duties of Gram Panchayat have been defined in the section 21of the Haryana Panchayati Raj Act 1994,which includes drinking water and control of water pollution.

Whereas the sub committees can be constituted in every Gram Panchayat under section22 of the Haryana Panchayati Raj Act, 1994 to perform the duties and functions as defined in section 21of the said Act.

1. Constitution of VWSC

Every Gram Panchayat shall constitute a VWSC consisting of not more than 3 Panches excluding the Sarpanch and such other members from amongst the village community selected by the Gram Sabha in accordance with the composition of the VWSC as defined in the clause 2 below. The Gram Panchayat shall pass a resolution recognizing the constitution of VWSC and approve the Rules and Regulations for conduct of business of the VWSC.

3. Office Bearers of VWSC

(a) The Sarpanch shall be the ex-officio chairperson of the VWSC.

(b) The Junior Engineer or any other official deputed for the purpose from Public Health Engineering Department shall be the Technical Member of the VWSC.

4. Tenure of membership

(a) The tenure of all ex-officio members i.e. Sarpanch and Panches, in the VWSC shall be co-terminus with their holding of office of Sarpanch or Panch.

(b) All members of VWSC shall also stand dissolved on dissolution of Gram Panchayat, the Sarpanch being suspended or removed and the office of the chairperson of the VWSC falling vacant, an officer (BDPO)/Panch appointed as Acting Sarpanch/ Administrator shall perform the functions of chairperson and on the reinstatement of the Sarpanch, Acting Sarpanch/Administrator will hand over the charge of chairperson to the Sarpanch and in case of dissolution of Gram Panchayat the person appointed as Administrator shall perform the functions of Chairperson. The officer appointed shall hand over the office of chairperson as soon as the Gram Panchayat is reconstituted.

(c) Individual members can resign from VWSC or be appointed to the VWSC after approval bythe Gram Sabha during the term.

(d) In the event of the VWSC failing to meet and transact business for three consecutive months,not undertaking its roles and responsibilities in an effective manner as prescribed in this notification, mis- utilization, embezzlement of funds or office bearers acting in manners benefiting themselves or close relatives, the Gram Sabha can request the Public Health Engineering Department to take over the functions of the VWSC with approval of District Water and Sewerage Mission (DWSM). In the event of such takeover, the Public Health Engineering Department must initiate activities through the Gram Panchayat, help in re-constituting a VWSC.

5. Paani Samiti:

In case the tenure of elected members of Panchayat in the sub-committee i.e. VWSC has ended due to any reason then Paani Samiti will be constituted to act as committee for improving Rural Water Supply and Sewerage Service delivery. The constitution of Paani Samiti shall be as under:

5.1 Constitution of Paani Samiti:

Every Gram Panchayat shall constitute a Paani Samiti consisting of Block Development and Panchayat Officer (Chairperson) from amongst the village community selected by the Gram Sabha in accordance with the composition of the Paani Samitias defined below.

The composition of Paani Samiti shall be as under:

5.3 Roles and Responsibilities of VWSC/ Paani Samiti:

The VWSC / Paani Samiti shall perform all functions in respect of providing water supply and sewerage facilities and services to the village community. These include:

I. Planning, implementation, supervision, monitoring, operation and maintenance, contracting etc. relating to the creation, acquisition, hiring, rehabilitating, rejuvenating, taking over or otherwise acquiring intra-village infrastructure such as tubewell, canal-based water works, boosters, pipeline, valves etc., utilities, systems and other services for providing water supply and sewerage related service to the village community;

II. Deciding on feasible and cost effective technology choices and schemes for providing water supply and sewerage services in the villages;

III. To obtain Administrative Approval and Technical Sanction of detailed scheme reports from PHED for solving water supply or sewerage related problems in the village;

IV. To act as a link and liaison between Gram Panchayat, Public Health Engineering Department, other departments and Institutions involved in the water supply and sewerage sector;

V. Dissemination of information, creation of awareness and education of village community on all aspects of water supply and sewerage including health and hygiene and water resource management;

VI. Opening and operation of bank accounts, receipt and expenditure of funds for performance of its roles and responsibilities, maintain up to date accurate books of accounts and make available records for audit/inspections;

VII. Receipt of funds from Public Health Engineering Department and spend the same for approved Water Supply and Sewerage Schemes in the village;

VIII. Enter into MOU or other forms of agreement with District Level Institutions and Public Health Engineering Department;

IX. Procurement of works, goods or services for carrying out its role and responsibilities in accordance with the guidelines issued by the Public Health Engineering Department;

X. Entering into contracts with the contractors, support organizations or other service providers for executing water supply and sewerage activities in the village;

XI. Mobilization of villagers for community action to solve the water supply sewerage problems among the village community;

XII. Mobilization of users share of capital cost of setting-up of water supply and sewerage facilities among the village community;

XIII. Provision of connections for households in respect of water supply and sewerage schemes as per Government policy;

XIV. Prescription and collection from users of water supply and sewerage facilities suchcharges, fees, tariffs or deposits as it may deem fit for recovering the operation and maintenance cost of water supply & sewerage infrastructure, facilities and services;

XV. Collaboration with VWSCs/Paani Samiti of other villages by nominating representatives, signing of MOUs, sharing of responsibilities, contributing financial resources or otherwise for undertaking water supply and sewerage related services to the village by sharing services from multi-village, inter-village water supply and sewerage infrastructure or facilities;

XVI. The VWSC/ PaaniSamiti shall remain accountable to the Gram Sabha for all itsactivities.

XVII. The VWSC/Paani Samiti shall undertake all its activities using participatory methodologies so as to include all sections of the village community.

XVIII. The VWSC/Paani Samiti shall ensure that there is equity of benefits to everyone in the village from its activities.

XIX. The activities of the VWSC /Paani Samiti shall be done in a transparent manner by providing key information to all members in village community.

XX. Prevent obstruction or hindrance to any works of water supply and sewerage being implemented in the village(s) under the Mahagram Yojana, NABARD or any other program by PHED.

XXI. All moveable and immovable assets shall remain in the name of Gram Panchayat or Public Health Engineering Department and VWSC/ Paani Samiti shall have no powers to transfer the title of ownership to any other individuals or institutions or create any charge on the assets.VWSC / Paani Samiti shall keep a record of inventory of all assets including materials and machinery.

XXII. All technical activities shall be undertaken with the guidance and supervision of the Public Health Engineering Department and in compliance with the guidelines issued by Public Health Engineering Department from time to time.

XXIII. The VWSC/Paani Samiti shall submit periodic progress reports and such other reports as may be prescribed from time to time by Public Health Engineering Department, Haryana.

XXIV. Arranging community contributions towards capital costs, both in cash and kind (labour, land or material), if any.

XXV. Commissioning and takeover of completed water supply and sewerage works also record of consumers and their Accounts.

XXVI. For Multi Village Scheme, the Scheme Level Committee (MVSLC) could perform a similar role.

Comprising of members from participating VWSC/ Paani Samiti of each village.

XXVII. Sanction of new water supply and sewerage connection to the consumers. XXVIII. To ensure potable water supply, regular checking of the quality of the water from the authorized Laboratory.

XXIX. To submit utilization certificates of the funds received from Public Health Engineering Department. XXX. VWSC/Paani Samiti will play major role and carryout contingency plan at the time of natural calamities like drought, flood and epidemics etc.

XXXI. VWSC/Paani Samiti may appoint volunteers as per the requirements for effectively carrying out various activities at village level. Maximum of 7 volunteers can beengaged.

XXXII. VWSC/Paani Samiti shall have the right to disconnect any illegal connection/ insanitary connection or may levy penalty and regularize the connection.

XXXIII. VWSC/Paani Samiti shall have the right to increase water tariff to meet the Operation & Maintenance expenses by passing are solution in the meeting of VWSC as notified by Notification No.19/01/2017- 3PH, dated 13/12/2019or as amended from time to time.

If at any time, it is observed that the VWSC/Paani Samiti is not performing its functions, then it can be dissolved and reconstituted as per the provisions given in this notification. 6. Voluntary Committee Voluntary Committee may be formed at every Gram Panchayat where Village Water and Sewerage Committees (VWSC)/Paani Samiti are constituted. The member of the committee shall be the resident of the Village or Gram Panchayat actively working for the development of the village, willing to offer their time, service and expertise to serve for the benefits of community and public interests with out any personnel financial benefits.

6.1 Objective of the formation of Voluntary Committee

➢ Voluntary Committee will support the VWSC /PaaniSamitito achieve the target of self-sustained and equaldistribution of sufficient potable drinking water to all the households on long term sustainablebasis.

➢ Formation of Voluntary Committee is to promote awareness and to instill larger ownership among local community by way of contribution in cash, kind and/or voluntary labour.

➢ It will support the VWSC/Paani Samiti in operation and maintenance of water supply system to achieve sustainable, equitable, consistent, economic safe and adequate water & operation of system in general means ensuring effective routine running of system timely and daily.

6.2 Formation of Voluntary Committee: The Voluntary Committee will consist of maximum 7 members and may comprise of Pump operator, Electrician, Fitter, Plumber, skilled labour and any other community member from the village willing to work as volunteer of the Committee. Only residents of the villages and habitations with in the Gram Panchayat can becomevolunteer.

The committee shall be formed during the Gram Sabha. A prior intimation of minimum 7 days shall be given regarding formation of Voluntary Committee to the local community members by the concerned Gram Panchayat. All the interested members can apply/request through Gram Panchayat in Gram Sabha meeting to become the volunteer member of Village Water and Sewerage Committee / PaaniSamiti.

Or If, in any case, Gram Panchayat is dissolved or defunct the concerned Block Development and Panchayat Officer (BDPO) shall have the power to recommend the volunteers in Consultation with Junior Engineer Public Health & Engineer Department Haryana.

This committee shall remain in to existence irrespective of existence of village Panchayat. All members selected by Gram Sabha shall have tenure of three years and will be eligible for reselection (maximum two term) by the recommendation of VWSC/ Paani Samiti during Gram Sabha session.

If, at any time, it is observed that any Volunteer is inactive or misusing his/her roles and responsibilities, not performing its functions then he/she may be relived at any time through VWSC/ Paani Samiti resolution. Individual members can resign anytime during the Term. The voluntary committee may be dissolved in case it is inactive and not performing its functions, then it can be dissolved and reconstituted as per the provisions given in this notification.

6.3 Composition of the Voluntary Committee.

(1) To manage, support and carry out all community activities related to water supply schemes as per operational guidelines of JJM in coordination with VWSC/GP/PHED.

(2) To create awareness among rural communities in villages about the importance of safe and piped drinking water, grey water management and water conservation.

(3) Community engagement to create adequate stake and ownership in the scheme through operation and maintenance.

(4) Mobilize community to take new tap connection (if any one left out/ not opted).

(5) Motivate household to deposit water connection charges and security deposit.

(6) Motivate rural household to pay 5%-10% contribution of capital cost of village infrastructure and pay water tariff regularly.

(7) Increase overall awareness among community on water & sanitation and hygiene issues.

(8) To provide handholding support to Gram Panchayat (GP)/ Village Water and Sewerage Committees (VWSCs) for implementation of Jal Jeevan Missionin the village.

(9) To engage the community in water campaigns initiated by Public Health & Engineering Department and GoI/State Government.

(10) To support in Assessment of service delivery of Functional Household Tap Connections (FHTCs) and ensuring 100% FHTCs.

(11) To support VWSC/ Paani Samiti in water quality testing and management and uploading on IMIS Portal.

(12) Regular water quality monitoring of all the drinking sources available in village using Field Testing Kits (FTKs) orlabtesting samples.

(13) To aware the community on various aspects of water such as rainwater harvesting, artificial recharge, water quality, water borne disease, water saving, water handling, drinking water source augmentation/sustainability aspects etc.

(14) To support in training and awareness generation campaign for all the stakeholders including school children.

(15) Handholding support to VWSC / PaaniSamiti for preparation of records and reports and all the activities pertaining to Jal Jeevan Mission.

(16) To support VWSC/ Paani Samiti forensuring 100% legal Tap Connections in the village.

6.5 Financial Incentives: The participants of VWSC or water committee will not be entitled for any financial incentives in the said committee.
