संख्या 09/59/2022-4कII .- हरियाणा नगरपालिका संकर्म नियम, 1976 को आगे संषोधित करने के लिए नियमों का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल, हरियाणा नगरपालिका अधिनियम, 1973 (1973 का 24) की धारा 257 की उप-धारा (1) के खण्ड (त) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुये, बनाने का प्रस्ताव करते हैं तथा उक्त अधिनियम की धारा 257 की उप-धारा (5) द्वारा यथा अपेक्षित/ऐसे सभी व्यक्तियों की जानकारी के लिये, इसके द्वारा, प्रकाषित किया जाता है, जिनके इससे प्रभावित होने की सम्भावना है;
इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाषन की तिथि से दस दिन की अवधि समाप्ति पर या उसके पश्चात् राज्य सरकार, नियमों के प्रारूप पर, आक्षेपों या सुझावों सहित, यदि कोई हों, जो अतिरिक्त मुख्य सचिव, हरियाणा सरकार, शहरी स्थानीय निकाय विभाग द्वारा प्रारूप नियमों के सम्बन्ध में किसी व्यक्ति से इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किये जायें, विचार करेगी।
प्रारूप नियम
1. ये नियम हरियाणा नगरपालिका संकर्म (संषोधन) नियम, 2022 कहे जा सकते हैं। 2. हरियाणा नगरपालिका संकर्म नियम, 1976 में, नियम 8 में, उप-नियम (1) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, अर्थात :-
''(1) यदि किसी परियोजना का अनुमान, जब प्रषासकीय अनुमोदिन राषि से अधिक है या यदि किसी कार्य के निष्पादन के दौरान यह स्पष्ट होता है कि प्रषासकीय रूप से अनुमोदित राषि, निम्नलिखित किन्हीं कारणों से अधिक होगी :-
(क) आबंटित दरों से अनुमानित दरें अधिक होने पर; (ख) करार में वृद्धि शर्त के अनुसार; (ग) प्रषासकीय रूप से अनुमोदित राषि के अधिकतम दस प्रतिषत के अध्याधीन निम्नलिखित किन्हीं कारणों से संकर्म क्षेत्र में वृद्धि; (i) वैध तकनीकी कारण (कारणों) से संरेखन में परिवर्तन; (ii) किसी सरकारी संस्थान से विधीक्षित रूपरेखा के आधार पर किन्तु निविदा प्रक्रिया के दौरान ऐसी मदों के मूल्यों को प्रकट किया जाना चाहिए।
सक्षम प्राधिकारी से अविलंब पुनरीक्षित प्रषासकीय अनुमोदन प्राप्त किया जाएगा।''

Notification
The 10th January, 2023
No. 09/59/2022-4CII.— The following draft of rules further to amend the Haryana Municipal Works Rules, 1976, which the Governor of Haryana proposes to make in exercise of the powers conferred under clause (p) of Sub-section (1) of Section 257 of the Haryana Municipal Act, 1973 (24 of 1973), is hereby published as required by Sub-section (5) of Section 257 of the said Act, for the information of persons likely to be affected thereby.
Notice is hereby given that the draft of rules shall be taken into consideration by the State Government on or after the expiry of a period of ten days from the date of publication of this notification in the Official Gazette, together with objections or suggestions, if any, which may be received by the Additional Chief Secretary to Government, Haryana, Urban Local Bodies Department, from any person with respect to the draft of rules before the expiry of the period so specified.
DRAFT RULES
1. These rules may be called the Haryana Municipal Works (Amendment) Rules, 2022.
2. In the Haryana Municipal Work Rules, 1976, in rule 8, for sub-rule (i), the following sub-rule shall be substituted, namely:-
"(1) if an estimate of any project when prepared exceeds the amount administratively approved or if it becomes apparent during execution of any work that the administratively approved shall be exceeded owing to any of the following reasons:-
(a) allotted rates being higher then estimated rates;
(b) as per the escalation clause in the agreement;
(c) enhancement of scope of work subject to a maximum of ten percent of the amount administratively approved owing to any of the following reasons;
(i) change in alignment on valid technical reason(s);
(ii) on the basis of vetted design from a Government Institute but prices of such items should have been discovered during tendering process.
The revised administrative approval shall be obtained from competent authority without delay."
