संख्या 6/1/2023-1मंत्रिमंडल.- भारत के संविधान के अनुच्छेद 166 के खण्ड (2) तथा (3) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, मैं, बंडारू दत्तात्रेय, राज्यपाल, हरियाणा, इसके द्वारा, हरियाणा सरकार कार्य (आबंटन) नियम, 1974, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाता हूँ, अर्थात्ः- 1. ये नियम हरियाणा सरकार कार्य (आंबटन) संषोधन नियम, 2023, कहे जा सकते हैं। 2. हरियाणा सरकार कार्य (आंबटन) नियम, 1974 में, अनुसूची में,-
(I) ''(सचिव, अभिलेखागार विभाग हरियाणा सरकार, अभिलेखागार विभाग के माध्यम से)'' शीर्ष तथा उसके नीचे प्रविष्टियों के बाद, निम्नलिखित शीर्ष तथा उसके नीचे प्रविष्टियां रखी जायेेंगी, अर्थात्ः-
"आयुष विभाग (प्रषासकीय सचिव, हरियाणा सरकार, आयुष विभाग के माध्यम से)
1. आयुष महाविद्यालय, आयुष अस्पताल, आयुर्वेदिक प्राथमिक स्वास्थ्य केन्द्र (ए0पी0एस0के0), आयुष औषधालय, पंचकर्मा केन्द्र, योगषाला, व्यायामषाला, योग तथा आयुष केन्द्र, राज्य सरकार आयुर्वेदिक औषधी परीक्षण प्रयोगषाला, राज्य सरकार आयुर्वेदिक फार्मेसी, आयुष विंग तथा राज्य में पॉलीक्लीनिक्स के अन्र्तगत डी०एच०/सी०एच०सी०/पी०एच०सी० में परिचालित आयुष ओ०पी०डी० से सम्बन्धित सभी मामले। 2. आयुष महाविद्यालय, आयुष अस्पताल, आयुर्वेदिक प्राथमिक स्वास्थ्य केन्द्र (ए०पी०एस०के०), आयुष औषधालय, पंचकर्मा केन्द्र, योगषाला, व्यायामषाला, योग तथा आयुष केन्द्र, राज्य सरकार औषधी परीक्षण प्रयोगषाला, राज्य सरकार आयुर्वेदिक फार्मेसी, आयुष विंग तथा राज्य में पॉलीक्लीनिक्स के अन्र्तगत डी०एच०/सी०एच०सी०/ पी०एच०सी० में परिचालित आयुष ओ०पी०डी० के लिए आयुष औषिधियों, मषीनरी और उपकरणों, रसायनों, हर्बल कच्ची औषिधियों और अन्य सामग्रियोें की खरीद और आपूर्ति से सम्बन्धित सभी मामलें।
3. संवर्ग गठन तथा नियंत्रण भर्ती नियम बनाने तथा संषोधन करने, भर्ती, पदोन्नति सहित संवर्ग गठन तथा नियन्त्रण के मामले तथा सरकार के स्तर पर अधिकारियों तथा अन्य कर्मचारीवृन्द से सम्बन्धित अपेक्षित कार्यवाही वाले सभी अन्य सेवा मामले सहित सरकार के स्तर पर कार्यवाही बारे अधिकारियों और अन्य कर्मचारियों से सम्बन्धित भर्ती, भर्ती नियम बनाने और नियमों में संषोधन, पदोन्नति और अन्य सभी सेवा मामले। 4. आयुष विभाग के प्रषासकीय नियंत्रण के अधीन राजकीय आयुष संस्थाओं के अधिकारियों तथा कर्मचारीवृन्द के स्थापना संबंधी मामले।
5. राज्य में आयुर्वेद, योग और प्राकृतिक चिकित्सा, यूनानी, सिद्धा और होम्योपैथी (आयुष) षिक्षा तथा स्वास्थ्य देखभाल वितरण प्रणाली में मानव संसाधन की आवष्यकता अनुसार मानचित्रण तथा योजना।
6. हरियाणा राज्य में आयुष पद्धतियों के विकास और प्रसार के लिए नीतियों और नीतिगत मुद्दों का प्रतिपादन।

(EXTRA.), MAR. 6, 2023 (PHGN. 15, 1944 SAKA) 7. नए आयुष महाविद्यालयों/विष्वविद्यालयों की स्थापना, अध्ययन के नए पाठ्यक्रमों, प्रवेष और फीस की स्वीकृति सहित सरकारी, निजी और सहायताप्राप्त आयुष महाविद्यालयों और विष्वविद्यालयों से संबंधित सभी मामलें। 8. आयुष षिक्षा और स्वास्थ्य देखभाल वितरण प्रणाली में अंतरराज्यिक और राज्यान्तर्गत समन्वय। 9. विदेष में उच्च प्रषिक्षण सहित आयुष चिकित्सा पद्धति के सभी पहलुओं में आयुष षिक्षा, प्रषिक्षण और अनुसंधान से संबधित मामलें।
10. केन्द्रीय सरकार/स्वायत्त संगठन और निजी क्षेत्र में आयुष शैक्षिक संस्थाओं की स्थापना के संबंध में आषय पत्र (एल०ओ०आई०), अनापत्ति प्रमाणपत्र (एन०ओ०सी०) या आवष्यक प्रमाणपत्र जारी करने/नवीनीकरण/रद्द करने से संबधित मामला।
11. आयुर्वेद, सिद्धा, यूनानी, होम्योपैथी, योग और प्राकृतिक चिकित्सा पद्धतियों के विकास और प्रसार के लिए केन्द्रीय क्षेत्र योजनाओं और केन्द्र प्रायोजित योजनाओं सहित कार्यक्रमों का विकास और कार्यान्वयन। 12. सरकार के स्तर पर कार्य और कार्यक्रमों की समीक्षा के लिए राज्य सरकारों, गैर-सरकारी संगठनों और संस्थाओं के साथ परामर्ष और समन्वय।
13. आयुष चिकित्सा पद्धतियों के विभिन्न पहलुओं से संबंधित सांख्यिकी। 14. ओषधि और प्रसाधन सामग्री अधिनियम, 1940 (1940 का केन्द्रीय अधिनियम 23) और इसके अधीन बनाए गए नियम तथा ओषधि और चमत्कारिक उपचार (आक्षेपणीय विज्ञापन) अधिनियम, 1954 (1954 का केन्द्रीय अधिनियम 21) के अधीन अनुज्ञापन, निरीक्षण, गुणवत्ता नियंत्रण और की उल्लंघना मेें अपराधों से सम्बन्धित मामलें सरकार के स्तर पर ऐसे मामलों में आवष्यक कार्यवाही किए जाने की सीमा तक । 15. निम्नलिखित के सम्बन्ध में सरकार के स्तर पर अपेक्षित कार्यवाही वाले सभी मुद्दे और मामले - (क) भारतीय चिकित्सा पद्धति परिषद, हरियाणा । (ख) होम्योपैथिक चिकित्सा पद्धति परिषद्, हरियाणा । (ग) श्री कृष्णा आयुष विष्वविद्यालय, कुरूक्षेत्र । (घ) हरियाणा योग आयोग । (ड.) राज्य औषधिय पादप बोर्ड । (च) राज्य आयुष सोसाईटी । (छ) जिला आयुष सोसाईटी ।
16 निम्नलिखित अधिनियमों का कार्यान्वयन/नियमनः-
(क) भारतीय चिकित्सा केन्द्रीय परिषद् अधिनियम, 1970 (1970 का केन्द्रीय अधिनियम 48) (ख) हरियाणा होम्योपैथी चिकित्सा व्यवसायी अधिनियम, 1965 (1965 का पंजाब अधिनियम 16) (ग) हरियाणा आयुर्वेदिक तथा यूनानी चिकित्सा व्यवसायी अधिनियम, 1963 (1963 का पंजाब अधिनियम 42) (घ) श्री कृष्णा आयुष विष्वविद्यालय कुरू़़़़क्षेत्र अधिनियम, 2016 (2017 का 25) (ड.) हरियाणा योग आयोग अधिनियम, 2021 (2021 का 17) (च) औषध और प्रसाधन सामग्री अधिनियम, 1940 (1940 का केन्द्रीय अधिनियम 23) और इसके अधीन बनाए गए नियम
(छ) ओषधि और चमत्कारिक उपचार (आक्षेपणीय विज्ञापन ) अधिनियम, 1954 (1954 का केन्द्रीय अधिनियम 21) (ज) भारतीय चिकित्सा पद्धति राष्ट्रीय आयोग अधिनियम, 2020 (2020 का केन्द्रीय अधिनियम 14) (झ) राष्ट्रीय होम्योपैथिक आयोग अधिनियम, 2020 (2020 का केन्द्रीय अधिनियम 15)
17 राज्य की आयुष पद्धति से सम्बन्धित विधायी प्रस्ताव, जिनमें सरकार की स्वीकृति और मंत्रणा की आवष्यकता हो।
18 पारम्परिक चिकित्सा से संबंधित सभी मामले। 19 हरियाणा में सरकारी, अर्धसरकारी और सरकारी सहायताप्राप्त, स्वायत्त और निजी आयुष संस्थाओं में प्रवेष, शुल्क तथा परीक्षा मामलों का विनियमन।
20 भारत सरकार/दाता अभिकरणों इत्यादि से निधि की व्यवस्था करना और राज्य में आयुष पद्वतियों के विकास और प्रचार के लिए सार्वजनिक निजी भागीदारी के माध्यम से निवेष को प्रोत्साहित करना। 21 आयुष षिक्षा तथा अनुसंधान में छात्रों और संकाय के कल्याण को बढ़ावा देने के लिए योजनाएं । 22 भारतीय चिकित्सा केन्द्रीय परिषद (सी०सी०आई०एम०) के मानदंडों के अनुसार विभिन्न आयुष संस्थाओं में आयुष षिक्षा का विनियमन और मानकीकरण, पाठयक्रम तैयार करना, विभिन्न पाठ्यक्रमों की अवधि और नए विषयों की शुरूआत, विभिन्न पाठ्यक्रमों में सीटों का आबंटन।
23 राज्य में या राज्य के बाहर किसी भी अधिकृत संबद्ध संगठन/अभिकरण से सहबद्ध राज्य में आयुष पैरामैडिकल और नर्सिंग संस्थाओं/महाविद्यालयों से संबंधित सभी मामलें, राज्य में किसी संस्था की स्थापना के लिए राज्य सरकार से अनापत्ति प्रमाणपत्र (एन०ओ०सी०) लेना।HARYANA GOVT. GAZ. (EXTRA.), MAR. 6, 2023 (PHGN. 15, 1944 SAKA) 559 24 राज्य में आयुष षिक्षा प्रदान करने वाली निजी, स्वायत्त और सरकारी संस्थाओं में शैक्षणिक और लेखा के लेखा परीक्षा से संबंधित सभी मामलें। ''
(II) ''खाद्य, नागरिक आपूर्ति तथा उपभोक्ता मामले विभाग (सचिव, हरियाणा सरकार, खाद्य, नागरिक आपूर्ति तथा उपभोक्ता मामले के माध्यम से)" शीर्ष तथा उसके नीचे प्रविष्टियों के बाद, निम्नलिखित शीर्ष तथा उसके नीचे प्रविष्टियां रखी जायेंगी, अर्थात्ः-
"विदेशी सहकारिता विभाग (प्रषासकीय सचिव, हरियाणा सरकार, विदेशी सहकारिता विभाग के माध्यम से)
1. राज्य में निवेष, रोजगार, षिक्षा तथा कौषल विकास को प्रोन्नत करने और हरियाणवी संस्कृति को बढ़ावा देने और हरियाणवी प्रवासियों के कल्याण के लिए देष-वार रणनीतियाँ बनाना।
2. सार्वजनिक और निजी क्षेत्र संगठनों में सहकारिता वाले राज्य के हित के विषयों को आगे बढ़ाने के उद्देष्य से द्विपक्षीय और बहुपक्षीय मंचों पर भागीदारी करना ।
3. विदेष मंत्रालय, भारत सरकार के परामर्ष से इन-बाउंड और आउट-बाउंड दोनों में व्यापार और निवेष के क्षेत्र में विदेषी देषों में राज्य के हितों को बढ़ावा देने के दृष्टिगत द्विपक्षीय कार्य प्रणाली वाले समूहों में भागीदारी करना ।
4. निवेश, रोजगार, षिक्षा, कौषल विकास, संस्कृति और अनिवासी भारतीय/भारतीय मूल के व्यक्ति के मामलों के संबध में हरियाणा राज्य से संबंधित मामलों में नई दिल्ली में विदेष में भारतीय मिषनों/विदेष मन्त्रालय/विदेष मिषनों के साथ संपर्क करना ।
5. हरियाणवी प्रवासियों के साथ दृढ़ संबंध सुनिष्चित करने के लिए वैष्विक देष-वार विपणन और संचार रणनीतियाँ विकसित करना "।
(III) ''सामान्य प्रषासन विभाग (मुख्य सचिव के माध्यम से)'' शीर्ष के नीचे, ''(छ) विदेषी सहकारिता'' उपषीर्ष तथा उसके नीचे विद्यमान प्रविष्टियों का लोप कर दिया जाएगा । (IV) "स्वास्थ्य विभाग (सचिव, हरियाणा सरकार, स्वास्थ्य विभाग के माध्यम से)" शीर्ष के नीचे, -
(i) क्रम संख्या 8 के सामने, "आयुर्वेदिक औषधालय" शब्दों का लोप कर दिया जाएगा; (ii) क्रम संख्या 23 तथा 24 और उसके सामने प्रविष्टयों का लोप कर दिया जाएगा ।
(V) "चिकित्सा षिक्षा तथा अनुसंधान विभाग (प्रषासकीय सचिव, हरियाणा सरकार, चिकित्सा षिक्षा तथा अनुसंधान विभाग के माध्यम से)" शीर्ष के नीचे,-
(i) क्रम संख्या 7 के सामने "भारतीय चिकित्सा-पद्धति" शब्दों का लोप कर दिया जाएगा; (ii) क्रम संख्या 11 की मद (ख) तथा उसके सामने प्रविष्टियों का लोप कर दिया जाएगा; (iii) क्रम संख्या 12 की मदों (छ) तथा (ज) तथा उनके सामने प्रविष्टियों का लोप कर दिया जाएगा; (iv) क्रम संख्या 13 की मदों (ड.) तथा (च) तथा उनके सामने प्रविष्टियों का लोप कर दिया जाएगा। चण्डीगढ़ः दिनांक 2 मार्च, 2023.

No 6/1/2023- 1Cabinet— In exercise of the powers conferred under clauses (2) and (3) of article 166 of the Constitution of India, I, Bandaru Dattatraya, Governor of Haryana, hereby make the following rules further to amend the Business of the Haryana Government (Allocation) Rules, 1974, namely:-
1. These rules may be called the Business of the Haryana Government (Allocation) Amendment Rules, 2023.
2. In the Business of the Haryana Government (Allocation) Rules, 1974, in the Schedule,-
(I) after the heading "ARCHIVES DEPARTMENT (Through the Secretary to Government, Haryana, Archives Department)" and entries thereunder, the following heading and entries thereunder shall be inserted, namely:-
"AYUSH DEPARTMENT
(Through the Administrative Secretary to Government, Haryana, Ayush Department) 1. All matters relating to AYUSH Colleges, AYUSH Hospitals, Ayurvedic Prathmik Swasth Kendra (APSK), AYUSH Dispensaries, Panchkarma Centres, Yogshala, Vyayamshala, Yog and AYUSH Center, State Govt. Ayurvedic Drug Testing Laboratory, State Govt. Ayurvedic Pharmacy, AYUSH Wings and AYUSH OPDs running in DH/CHC/PHC/ Polyclincs in the State.
2. Matters relating to procurement and supply of ayush Medicines, Machinery and Equipments, Chemicals, Herbal Raw Drugs and other materials for AYUSH Colleges, AYUSH Hospitals, Ayurvedic Prathmik Swasth Kendra (APSK), AYUSH Dispensaries, Panchkarma Centres, Yogshala, Vyayamshala, Yog and AYUSH Center, State Govt. Drug Testing Laboratory, State Govt. Ayurvedic Pharmacy, AYUSH Wings and AYUSH OPDs running in DH/CHC/PHC/ Polyclinics in the state.
3. Matters of cadre formation and control including formation and amendment of recruitment rules, recruitment, promotion and all other service matters relating to officers and others staff requiring action at Government level.
4. Establishment matters relating to officers and staff of Govt. AYUSH Institutions under the administrative control of department of AYUSH.
5. Mapping and planning of human resource needs in Ayurveda, Yoga and Naturopathy, Unani, Siddha and Homeopathy (AYUSH) Education and Healthcare delivery system in the state.
6. Formulation of policies and policy issues for development and propagation of AYUSH system in the state of Haryana.
7. All matters relating to Government, Private and Aided AYUSH colleges and Universities, including Setting up of new colleges/Universities, sanctioning of new courses of studies, admission and fees.
8. Inter-state and intra-state co-ordination in AYUSH education and health care delivery system.
9. Matters related to AYUSH education, training and research in all aspects of AYUSH Systems of Medicine including higher training abroad.
10. Matter relating to issuance/renewal/cancellation of Letter of Intent (LOI), NOC or Essential Certificate regarding establishment of AYUSH educational institutions under Central Govt./Autonomous organization and in private sector.
11. Development and implementation of programmes including Central Sector Schemes and Centrally sponsored schemes for development and propagation of Ayurveda, Siddha, Unani, Homoeopathy, Yoga and Naturopathy systems.
12. Consultation and Co-ordination with State Governments, Non-Government organizations and institutions for review of work and programmes at the level of Government.
13. Statistics relating to various aspects of AYUSH Systems of Medicine.
14. Matters relating to Licensing, inspection, quality control and prosecution of offences in violation of Drugs and Cosmetics Act, 1940 and rules made thereunder for ASU&H drugs and Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 (Central Act 21 of 1954) to the extent such matters require action at the level of Government.
15. All issues and matters requiring action at the level of Government in regard to-HARYANA GOVT. GAZ. (EXTRA.), MAR. 6, 2023 (PHGN. 15, 1944 SAKA) 561 (a) Council of Indian Systems of Medicine Haryana.
(b) Council of Homoeopathic Systems of Medicine Haryana.
(c) Shri Krishna AYUSH University, Kurukshetra.
(d) Haryana Yog Aayog.
(e) State Medicinal Plant Board.
(f) State AYUSH Society
(g) District AYUSH Societies.
16. Implementation/Regulation of the following acts:-
(a) the Indian Medicine Central Council Act, 1970 (Central Act 48 of 1970)
(b) the Haryana Homeopathic Practitioners Act, 1965 (Punjab Act 16 of 1965)
(c) the Haryana Ayurvedic and Unani Practitioners Act, 1963 (Punjab Act 42 of 1963) (d) Shri Krishna AYUSH University Kurukshetra Act, 2016 (25 of 2017)
(e) Haryana Yog Aayog Act, 2021(17 of 2021)
(f) Drugs and Cosmetics Act, 1940 (Central Act 23 of 1940) and rules made thereunder (g) Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 (Central Act 21 of 1954) (h) National Commission for Indian System of Medicine Act, 2020 (Central Act 14 of 2020) (i) National Commission for Homoeopathy Act, 2020 (Central Act 15 of 2020)
(17) Legislative proposals pertaining to AYUSH Systems of Medicine of individual states requiring sanction and concurrence of Government.
(18) All matters relating to Traditional Medicines.
(19) Regulation of admissions, fee and examination matters in government, semi-government and government aided, autonomous and private AYUSH institutions functioning in Haryana.
(20) Arranging funds from Government of India/donor agencies etc. and encouraging investment through public private partnership (PPP) for development and propagation of AYUSH systems in the State.
(21) Schemes for promoting welfare of students and faculty in AYUSH education and research.
(22) Regulation and standardization of AYUSH education, designing of syllabus, duration of various courses and introduction of new subjects, allocation of seats in various courses in different AYUSH institutions as per Central Council of Indian Medicine (CCIM) norms.
(23) All matters relating to AYUSH Paramedical & Nursing institutions/colleges in the state affiliated to any authorized affiliating body/agency within the state or out of the state, take NOC from the State Government for establishing an institution in the state.
(24) All matters relating to the audit of academic and accounts in Private, Autonomous and Government institutions imparting AYUSH education in the state.
(II) after the heading "Food, Civil Supplies and Consumer Affairs, Department (Through the Secretary to Government, Haryana, Food, Civil Supplies and Consumer Affairs, Department)" and entries thereunder, the following heading and entries thereunder shall be inserted, namely:-
"FOREIGN COOPERATION DEPARTMENT
(Through the Administrative Secretary to Government, Haryana, Foreign Cooperation Department) 1. Formulation of Country-wise strategies for promotion of investment, employment in the State education and skill development and promotion of Haryanvi culture and welfare of Haryanvi diaspora.
2. Participation at bilateral and multilateral fora with the objective pursuing issues of interest of the State involving cooperation in public and private sector organization.
3. Participation in bilateral working groups with a view of promote State's interest in foreign countries in the area of trade and investment both in-bound and out-bound in Consultation with the Ministry of External Affairs, Government of India.
4. Liaison with Indian Mission aborad/Ministry of External Affairs/Foreign Missions at New Delhi on matters pertaining to the State of Haryana with regard to investments, employment, education, skill development, culture and NRI/PIO affairs.
5. Development of global Country-wise marketing and communication strategies to ensure strong links with Haryanvi diaspora".
562 HARYANA GOVT. GAZ. (EXTRA.), MAR. 6, 2023 (PHGN. 15, 1944 SAKA)(III) under the heading "GENERAL ADMINISTRATION DEPARTMENT (Through the Chief Secretary)" sub head "(G) Foreign Cooperation" and existing entries thereunder shall be omitted.
(IV) under the heading "HEALTH DEPARTMENT (Through the Secretary to Government, Haryana, Health Department)"-
(i) against serial number 8, the words "Ayurvedic Aushdhaliyas" shall be omitted;
(ii) serial numbers 23 and 24 and entries thereagainst shall be omitted.
(5) under the heading "MEDICAL EDUCATION AND RESEARCH DEPARTMENT (Through the Secretary to Government, Haryana, Medical Education and Research Department)",-
(i) against serial number 7, the words "Indian System of Medicine", shall be omitted;
(ii) item (b) of serial numbers 11 and entries thereagainst shall be omitted;
(iii) items (g) and (h) of serial number 12 and entries thereagainst shall be omitted;
(iv) items (e) and (f) of serial number 13 and entreis thereagainst shall be omitted.
