संख्या 36/89/2019-1जे.जे.-II.— हरियाणा की कारागारों में परिरूद्ध बन्दियों की मृत्यु के कारण प्रतिकर के भुगतान के लिए हरियाणा के राज्यपाल, इसके द्वारा हरियाणा सरकार कारागार विभाग, अधिसूचना संख्या 36/89/2019-1जे.जे-।।, दिनांक 29 जून, 2021 द्वारा जारी पॉलिसी को संशोधित करते है। 2. प्रतिकर, बीमारी के कारण मृत्यु सहित, प्राकृतिक मृत्यु के मामलों में स्वीकार्य नहीं होगा। 3. प्रतिकर अप्राकृतिक मृत्यु के निम्नलिखत मामलों में भी स्वीकार्य नहीं होगाः-

(i) यदि मृत्यु कारागार से या कारागारों के बाहर कानूनी अभिरक्षा से भाग निकलने के दौरान घटित होती है; (ii) यदि मृत्यु किसी प्रा—तिक आपदा/संकट के कारण घटित होती है।

4. निम्नलिखित मामलों में प्रतिकर अप्रा—तिक मृत्यु के कारण बन्दियों के अगले सम्बन्धी या कानूनी वारिस (वारिसों) को भुगतान किया जाएगाः-

(i) बन्दियों में झगड़े के कारण - 7.5 लाख रुपये (ii) कारागार अमले द्वारा उत्पीड़न/पीटने के कारण - 7.5 लाख रुपये (iii) बन्दी द्वारा की गई आत्महत्या के कारण - 7.5 लाख रुपये (iv) कारागार अधिकारियों/कर्मचारियों द्वारा डयूटी में लापरवाही के कारण (दण्ड प्रक्रिया संहिता की धारा 176 के अधीन न्यायिक मजिस्ट्रेट द्वारा की गई जांच में लापरवाही साबित होने के बाद स्वीकार्य किया जाना है) - 7.5 लाख रुपये (v) चिकित्सा/पैरा चिकित्सा अधिकारी (अधिकारियों)/कर्मचारी (कर्मचारियों)

की लापरवाही के कारण (केवल दण्ड प्रक्रिया संहिता की धारा 176 के अधीन न्यायिक मजिस्ट्रेट द्वारा की गई जांच में लापरवाही साबित होने के बाद स्वीकार्य किया जाना है) - 7.5 लाख रुपये5. सम्बन्धित जेल अधीक्षक दण्डाधिकारीय जांच रिपोर्ट, पोस्टमार्टम रिर्पोट, मृत्यु के अंतिम कारण, कारागार में प्रवेश के समय पर चिकित्सा इतिवृत तथा बन्दी को दिये गये चिकित्सा उपचार, यदि कोई हो, के ब्योंरों, उसकी हिरासत मृत्यु से पूर्व ब्योंरों की प्रति सहित विस्तृत रिपोंर्ट उपरोक्त कथित पैरा-4 के उपबन्धों के अनुसार उचित प्रतिकर प्रदान करने के लिऐ राज्य सरकार को आगे भेजने हेतू महानिदेषक कारागार, हरियाणा को भेजेगा । 6. कारागार अमले द्वारा उत्पीड़न/पीटने के मामलो में भुगतान प्रतिकर का कम-से-कम 50 प्रतिशत गल्ती करने वाले अधिकारी (अधिकारियों)/कर्मचारी (कर्मचारियों) के वेतन से काटा जा सकता है। दोषी व्यक्तिगत अधिकारी (अधिकारियों)/ कर्मचारी (कर्मचारियों) (यदि वे एक से अधिक हैं) पर लागू होने वाली कटौती तथा अनुपात का सही प्रतिषत महानिदेशक कारागार द्वारा अवधारित किया जाएगा। 7. यह पॉलिसी केवल उन बन्दी (बन्दियों) के सम्बन्ध में लागू होगी, जिनकी अप्रा—तिक मृत्य इस पॉलिसी की अधिसूचना की तिथि को या इसके बाद हरियाणा की कारागारों में हुई है। (455) 456 HARYANA GOVT. GAZ., MAY 9, 2023 (VYSK. 19, 1945 SAKA) [PART I 8. सचिव/विशेष सचिव, कारागार उपरोक्त कथित प्रतिकर की स्वी—ति के लिए प्राधिकृत होगा। 9. यह वित्त विभाग, हरियाणा के अषाः क्रमांक 03/10/2013-1एसएस/18465, दिनांक 08.12.2022 द्वारा सूचित उनकी सहमति से जारी की जाती है।

No. 36/89/2019-1JJ-II – The Governor of Haryana is pleased to amend the policy issued by Jails Department, Haryana vide notification No. 36/89/2019-1JJ-II dated 29th June, 2021 for payment of compensation on account of death of prisoners confined in the jails of Haryana. 2. Compensation will not be admissible in cases of natural deaths including death due to illness. 3. Compensation will also not be admissible in the following cases of unnatural deaths:-

(i) If the death occurs during escape from jails or from lawful custody outside the jails. (ii) If the death occurs due to any natural disaster/calamity

4. Compensation will be paid to the next of kin or legal heir (s) of prisoners on account of unnatural deaths, in the following cases:-

(i) Due to quarrel among prisoners - Rs.7.5 lakhs (ii) Due to torture/beating by prison staff - Rs.7.5 lakhs (iii) Due to suicide committed by prisoner - Rs.7.5 lakhs (iv) Due to negligence in duty by prison - Rs.7.5 lakhs

officers/officials (To be admissible only after the negligence is proved in the inquiry conducted by a Judicial Magistrate u/s 176 Cr.P.C.)

(v) Due to negligence of Medical/para medical - Rs.7.5 lakhs

5. The Superintendent Jail concerned shall send detailed report alongwith copy of the Magisterial inquiry report, post-mortem report, final cause of death, medical history at the time of admission in jail and details of medical treatment, if any, given to the prisoner, prior to his custodial death, to the Director General of Prisons, Haryana, for onward submission to the State Government for grant of appropriate compensation, as per the provisions of Para-4 stated above. 6. At least 50 percent of the compensation paid in cases of torture/beating by prison staff may be deducted from the salary of the erring officer(s)/official(s). Exact percentage of deduction and the ratio to be applied on the delinquent individual officer (s)/official(s) (if they are more than one) will be determined by the Director General of Prisons. 7. This policy shall be applicable only in respect of those prisoner (s) who suffer unnatural death in the Jails of Haryana, on or after the date of notification of this policy 8. Secretary/Special Secretary, Jails shall be authorized to sanction the above said Compensation. 9. This issues with the concurrence of Finance Department, Haryana conveyed vide their U.O.No. 03/10/2013- 1SS/18465 dated 08.12.2022.
