संख्या 9/21/2023-4क ाा.- हरियाणा नगर पालिका अधिनियम, 1973 (1973 का 24) की धारा 257 की उपधारा (1) के खण्ड (ग) से (छ), उपधारा (2), (4) तथा (7) तथा धारा 276 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए तथा राज्य निर्वाचन आयोग के परामर्ष से, हरियाणा सरकार, षहरी स्थानीय निकाय विभाग, अधिसूचना संख्या 9/21/2023-4क ाा, दिनांक 26 मई, 2023 के प्रतिनिर्देष से, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा नगरपालिका निर्वाचन नियम, 1978 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :- 1. ये नियम हरियाणा नगरपालिका निर्वाचन (द्वितीय संषोधन) नियम, 2023 कहे जा सकते हैं। 2. हरियाणा नगरपालिका निर्वाचन नियम, 1978, (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, ''पिछड़े वर्गोंं'' या ''पिछड़े वर्ग'' शब्द, जहां कहीं भी आंए, के स्थान पर ''पिछड़े वर्गों 'क' '' शब्द, अक्षर और चिह्न प्रतिस्थापित किए जाएंगे। 3. उक्त नियमों में, नियम 70क के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात् :-
''70d- v/;{k ds in dk vkj{k.k-& uxjikfydkvksa esa v/;{k के पद सामान्य श्रेणी, अनुसूचित जातियों, पिछड़े वर्गों 'क' से सम्बन्धित व्यक्तियों तथा महिलाओं में से निर्वाचकों द्वारा प्रत्यक्ष निर्वाचन द्वारा चक्रानुक्रम द्वारा भरे जाएंगे, जो निम्नानुसार अवधारित किए जाएंगे :- (क) राज्य में अनुसूचित जातियों के लिए आरक्षित अध्यक्ष के पदों की संख्या, नगरपालिकाओं के ऐसे पदों की कुल संख्या के यथाषक्य निकटतम समरूप अनुपात में होगी, जो राज्य की कुल जनसंख्या में राज्य में अनुसूचित जातियों की जनसंख्या का अनुपात है जो कि ऐसी नगरपालिकाओं की कुल जनसंख्या में इस वर्ग की जनसंख्या की सर्वाधिक प्रतिषतता के आधार पर अवधारित किए जाएंगे तथा इसी तरह उनकी अगली अधिकतम जनसंख्या वाली नगरपालिकाओं के पदों की उत्तरवर्ती अवधि में चØkuqØe से होगा और इसी प्रकारः परन्तु, यदि दो नगरपालिकाओं में अनुसूचित जातियों के सम्बन्ध में, जनसंख्या की प्रतिषतता एक समान है, तो आरक्षण, खण्ड (ख) के अधीन निर्दिष्ट किसी समिति द्वारा संचालित किए जाने वालेे ड्रा ऑफ लॉटस द्वारा अवधारित किया जाएगा(
(ख) राज्य में अध्यक्ष के पदों की कुल संख्या का आठ प्रतिषत, पिछड़े वर्गों 'क' के लिए आरक्षित होगा तथा यदि दषमलव मान 0.5 अथवा उससे अधिक है, तो आगामी उच्चतर पूर्णांक में पूर्णांकित किया जाएगा( तथा ऐसे पद, उन नगरपालिकाओं जहां अध्यक्ष का पद अनुसूचित जातियों के लिए पहले से ही आरक्षित है, को निकालने के बाद, पिछड़े वर्गों 'क', जिनमें पिछड़े वर्गों 'क' की जनसंख्या की अधिकतम प्रतिषतता है, के लिए आरक्षण हेतु प्रस्तावित नगरपालिकाओं की अधिकतम तीन गुणा संख्या में से, निदेषक, शहरी स्थानीय निकाय विभाग, सम्बन्धित आयुक्त अथवा उनके नामनिर्देषित से मिलकर बनी समिति द्वारा ड्रा ऑफ लॉटस द्वारा तथा उत्तरवर्ती चुनावों में चक्रानुक्रम द्वारा भी आबंटित किए जाएंगेः

(EXTRA.), JUNE 14, 2023 (JYST. 24, 1945 SAKA) 1559 परन्तु जहां इस खण्ड के अधीन पिछड़े वर्गों 'क' के लिए इस प्रकार आरक्षित अध्यक्ष के पदों की संख्या, अनुसूचित जातियों के लिए आरक्षित अध्यक्ष के पदों की संख्या जोड़े जाने पर, राज्य में अध्यक्ष के पदों की कुल संख्या से पचास प्रतिषत से अधिक है, तब पिछड़े वर्गों 'क' के लिए आरक्षित अध्यक्ष के पदों की संख्या ऐसी अधिकतम संख्या तक निर्बन्धित की जाएगी, जो पिछड़े वर्गों 'क' तथा अनुसूचित जातियों के लिए आरक्षित अध्यक्ष के पदों की कुल संख्या को राज्य में अध्यक्ष के कुल पदों के पचास प्रतिषत से अधिक नहीं होने देगी। व्याख्या.- (1) इस खण्ड के अधीन पिछड़े वर्गों 'क' के आरक्षण के प्रयोजन के लिए, नगरपालिका क्षेत्र की जनसंख्या तथा उस नगरपालिका में पिछड़े वर्गों 'क' की जनसंख्या, ऐसी होगी, जो ऐसी तिथि, जो सरकार द्वारा अधिसूचित की जाए, को हरियाणा परिवार पहचान अधिनियम, 2021 (2021 का 20) के उपबन्धों के अधीन स्थापित परिवार सूचना डाटा कोष से प्राप्त की जाए।
व्याख्या.- (2) इस खण्ड के अधीन पचास प्रतिषत के प्रयोजन के लिए राज्य में कुल सीटों का पचास प्रतिषत, राज्य की कुल सीटों के आधे के रूप में लिया जाएगा, जहां दषमलव मान 0.5 अथवा उससे अधिक है, तो आगामी उच्चतर पूर्णांक में तथा जहां दषमलव मान 0.5 से कम है, तो आगामी निम्नतर पूर्णांक में पूर्णांकित किया जाएगा।
(ग) नगरपालिकाओं में अध्यक्ष के पदों की कुल संख्या का कम से कम एक-तिहाई, अनुसूचित जातियों और पिछड़े वर्गों 'क' की महिलाओं के लिए आरक्षित पदों सहित, महिलाओं के लिए आरक्षित होगा। महिलाओें के लिए पदों का आरक्षण अलग-अलग नगरपालिकाओं में बारी-बारी से होगा, जो खण्ड (ख) के अधीन गठित समिति द्वारा ड्रा ऑफ लॉटस द्वारा अवधारित किया जाएगा।''।

Notification

No. 9/21/2023-4CII.— In exercise of the powers conferred under clauses (c) to (g) of sub-section (1), sub-section (2), (4) and (7) of section 257 and section 276 of the Haryana Municipal Act, 1973 (24 of 1973) and in consultation with State Election Commission, with reference to Haryana Government, Haryana Local Bodies Department, notification No. 9/21/2023-4CII, dated the 26th May, 2023, the Governor of Haryana, hereby makes the following rules further to amend the Haryana Municipal Election Rules, 1978, namely :-
1. These rules may be called the Haryana Municipal Election (Second Amendment) Rules, 2023.
2. In the Haryana Municipal Election Rules, 1978 (hereinafter called the said rules), for the words "Backward Classes" or "Backward Class" wherever occurring, the words, alphabet and signs "Backward Classes 'A' " shall be substituted.
3. In the said rules, for rule 70A, the following rule shall be substituted, namely:-
"70A. Reservation of office of President.- The offices of the President in the municipalities shall be filled through direct election by the electors from amongst the persons belonging to the General Category, Scheduled Castes, Backward Classes 'A' and women by rotation, which shall be determined as under-
(a) the number of offices of President reserved for Scheduled Castes in the State shall bear, as nearly as may be the same proportion to the total number of such offices of the municipalities as the population of Scheduled Castes in the State bears to the total population of the State, which shall be determined on the basis of having largest percentage of population to the total population of such municipalities and shall rotate in the subsequent terms of offices of the municipalities having their next largest population and so on:
Provided that in case percentage of population of two municipalities as regards Scheduled Castes is the same, the reservation shall be determined by draw of lots to be conducted by a Committee referred under clause (b);

(EXTRA.), JUNE 14, 2023 (JYST. 24, 1945 SAKA)(b) eight percent of the total number of offices of President in the State shall be reserved for the Backward Classes 'A' and rounded off to the next higher integer in case the decimal value is 0.5 or more; and such offices shall be allotted by draw of lots by a committee consisting of Director, Urban Local Bodies Department and Deputy Commissioner of district concerned or their nominee among the highest three times of the number of municipalities proposed for reservation of Backward Classes 'A' which are having the largest percentage population of Backward Classes 'A' after excluding those municipalities already reserved for Scheduled Castes and also by rotation in the subsequent elections:
Provided that where the number of offices of President in the State so reserved for Backward Classes 'A' under this clause added to the number of offices of President reserved for the Scheduled Castes in the State exceeds fifty per centum of the total number of offices of President in the State, then the number of offices of President reserved for the Backward Classes 'A' shall be restricted to such largest number that shall lead to the total of the offices of President reserved for the Backward Classes 'A' and Scheduled Castes not exceeding fifty per centum of the total offices of President in the State.
Explanation.- (1) For the purposes of reservation of Backward Classes 'A' under this clause, the population of the municipal area and the population of Backward Classes 'A' in that municipality shall be such as drawn from the Family Information Data Repository established under the provisions of the Haryana Parivar Pehchan Act, 2021 (20 of 2021) on such date, as may be notified by the Government. Explanation.- (2) For the purposes of fifty per centum under the clause, fifty per centum of the total seats in the State shall be taken as one-half of the total seats of the State rounded up to the next higher integer where the decimal value is 0.5 or more or rounded down to the next lower integer where the decimal value is less than 0.5.
(c) not less than one-third of the total number of offices of the Presidents in the municipalities shall be reserved for women including the offices reserved for Scheduled Castes and Backward Classes 'A' women. The reservation of offices for women shall rotate to different municipalities, which shall be determined by draw of lots by the committee constituted under clause (b).".
