संख्या 9/22/2023-4क ाा.- हरियाणा नगरपालिका अधिनियम, 1973 (1973 का 24) की धारा 257 की उपधारा (1) के खण्ड (ख) और (ग) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए तथा राज्य निर्वाचन आयोग के परामर्ष से, हरियाणा सरकार, षहरी स्थानीय निकाय विभाग, अधिसूचना संख्या 9/22/2023-4क ाा, दिनांक 26 मई, 2023 के प्रतिनिर्देष से, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा नगरपालिका वार्ड परिसीमन नियम, 1977, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :-

1. ये नियम हरियाणा नगरपालिका वार्ड परिसीमन (संषोधन) नियम, 2023 कहे जा सकते हैं।

2. हरियाणा नगरपालिका वार्ड परिसीमन नियम, 1977, (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, ''पिछड़े वर्गों'' शब्द जहां कहीं भी आएं, के स्थान पर ^^पिछड़े वर्गों 'क' '' शब्द, अक्षर तथा चिह्‌न प्रतिस्थापित किए जाएंगे। 3. उक्त नियमों में, नियम 3 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ :-

''3- lfefr;ksa dh lhVksa dk fu/kkZj.k-& (1) प्रत्येक समिति की कुल सीटों की संख्या, सरकार द्वारा, हरियाणा परिवार पहचान अधिनियम, 2021 (2021 का 20) के उपबन्धों के अधीन स्थापित परिवार सूचना डाटा कोष से प्राप्त की गई जनसंख्या, ऐसी तिथि को, जो राज्य सरकार द्वारा अधिसूचित की जाए, के आधार पर निर्धारित की जाएगी :

परन्तु जहां परिवार सूचना डाटा कोष से प्राप्त की गई जनसंख्या, अन्तिम प्रकाषित मतदाता सूची के अनुसार ऐसे क्षेत्रों में पंजीकृत मतदाताओं की संख्या के 140 प्रतिषत से कम हो, तो क्षेत्र की मतदाता सूची में मतदाताओं की संख्या के 140 प्रतिषत के बराबर जनसंख्या पर विचार किया जाएगा।

उदाहरण.- (i) जहां परिवार सूचना डाटा कोष के अनुसार जनसंख्या 150 है और अन्तिम प्रकाषित मतदाता सूची के अनुसार किसी वार्ड में मतदाताओं की संख्या 100 है, तो 140 प्रतिषत करने के बाद जनसंख्या 140 हो जाती है। इस दषा में, परिवार सूचना डाटा कोष के अनुसार जनसंख्या अधिक होने के कारण विचार में ली जाएगी।

(ii) जहां परिवार सूचना डाटा कोष के अनुसार जनसंख्या 125 है और अन्तिम प्रकाषित मतदाता सूची के अनुसार किसी वार्ड में मतदाताओं की संख्या 100 है, तो 140 प्रतिषत करने के बाद जनसंख्या 140 हो जाती है। इस दषा में, अन्तिम प्रकाषित मतदाता सूची के अनुसार जनसंख्या अधिक होने के कारण विचार में ली जाएगी।

(3) अनुसूचित जाति से सम्बन्धित सदस्यों की सीटों की संख्या प्रत्येक समिति में उनकी जनसंख्या के अनुपात में निम्नलिखित सूत्र के अनुसार निर्धारित की जाएगी :-

कुल सीटों की संख्या X अनुसूचित जाति की जनसंख्या -------------------------------- ''।

कुल जनसंख्या 4. उक्त नियमों में, नियम 3-क का लोप कर दिया जाएगा। 5. उक्त नियमों में, नियम 7 में,-

(i) खण्ड (ख) में, अंक ^^10^^ के स्थान पर अंक ^^20^^ प्रतिस्थापित किया जाएगा। (ii) अन्त में विद्यमान व्याख्या का लोप कर दिया जाएगा।''।

No. 9/22/2023-4CII.— In exercise of the powers conferred under clauses (b) and (c) of sub-section (1) of section 257 of the Haryana Municipal Act, 1973 (24 of 1973) and in consultation with State Election Commission, with reference to Haryana Government, Urban Local Bodies Department, notification No. 9/22/2023-4CII, dated the 26th May, 2023, the Governor of Haryana, hereby makes the following rules further to amend the Haryana Municipal Delimitation of Ward Rules, 1977, namely:-

1. These rules may be called the Haryana Municipal Delimitation Ward (Amendment) Rules, 2023.

2. In the Haryana Municipal Delimitation of Ward Rules, 1977, (hereinafter called the said rules), for the words "Backward Classes" wherever occurring, the words, alphabet and signs "Backward Classes 'A' " shall be substituted.

3. In the said rules, for rule 3, the following rule shall be substituted, namely:-

"3. Fixation of seats of Committees.- (1) The total number of seats for each committee shall be fixed by the Government on the basis of the population drawn from the Family Information Data Repository established under the provisions of the Haryana Parivar Pehchan Act, 2021 (20 of 2021) on such date, as may be notified by the Government.

Provided that where the population as drawn from Family Information Data Repository is less than 140 per centum of the number of electors registered in such areas as per the last published Electoral Roll, then the population equal to 140 per centum of the number of voters in the electoral roll of the area shall be considered.

Illustration.- (i) Where the population as per Family Information Data Repository is 150 and the number of voters in a ward as per the last published electoral roll is 100, the population after 140 per centum comes to 140. In this case, the population as per Family Information Data Repository shall be considered being higher.

(ii) Where the population as per Family Information Data Repository is 125 and the number of voters in a ward as per the last published electoral roll is 100, the population after 140 per centum comes to 140. In this case, the population as per last published electoral roll shall be considered being higher.

(2) The number of seats to be filled by election on each committee shall be fixed or re-fixed in accordance

(3) The number of seats for members belonging to the Scheduled Castes shall be fixed in proportion to their population in each committee in accordance with the following formula:-

Total number of seats X Population of Scheduled Castes ."

4. In the said rules, rule 3-A shall be omitted.

5. In the said rules, in rule 7,-

(i) in clause (b), for the figure "10", the figure "20" shall be substituted.

(ii) explanation existing at the end shall be omitted.
