संख्या 11/25/2023-एफ.आर./15995.- भारत के संविधान के अनुच्छेद 283 के खण्ड (2) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, विभागीय वित्तीय नियम, हरियाणा राज्यार्थ, को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. ये नियम विभागीय वित्तीय (हरियाणा द्वितीय संषोधित) नियम, 2023 कहे जा सकते हैं।
2. ये नियम राजपत्र में इनके प्रकाषन की तिथि से लागू होंगे।
3. विभागीय वित्तीय नियम में, नियम 10.6 में, सारणी में, क्रम संख्या 1, 2, 3, 4, 5, 6 तथा 7 और उसके सामने प्रविष्टियों के स्थान पर, निम्नलिखित क्रम संख्याएं तथा उनके सामने प्रविष्टियां प्रतिस्थापित की जाएंगी, अर्थात्ः-

| 7. | संविदा द्वारा सभी प्रकार के संकर्मों के निष्पादन हेतु निविदाएं स्वीकार करना | मुख्य मन्त्री, षिक्षा मंत्री, कृषि मंत्री, सहकारिता मंत्री, विकास एवं पंचायत मंत्री से मिलकर बनने वाला मन्त्रीं समुह तथा इसके सदस्यों के रुप मे ं सम्बन्धित प्रषासकीय सचिव, प ्रषासकीय सचिव वित्त विभाग, महानिदेषक, आपूर्ति एवं निपटान, हरियाणा तथा विभागाध्यक्ष/प्रमुख अभियन्ता (सम्बन्धित) | जारी निविदा की अनुमानित लागत के अनुसार प्रत्येक कार्य के लिए पन्द्रह करोड़ रूपए से अधिक |
टिप्पणः- 1. मंत्रीे समूह की दषा में, यदि मुख्यमंत्री उपस्थित हैं, तो किसी एक मंत्री की उपस्थिति गणपूर्ति पूरा करेगी अन्यथा गणपूर्ति पूरा करने के लिए किन्हीं दो मंत्रियों की उपस्थिति अनिवार्य होगी।
टिप्पणः- 2. जहां तक क्रम संख्या 1, 2, 3, 4, 5 और 6 (i) का संबंध है, समझौता वार्ता निम्नानुसार लागू होगीः- अनुबंध द्वारा कार्यों की खरीद से संबंधित मामलों के लिए मूल्य निर्धारण एल-1 बोलीदाता द्वारा और केवल सबसे कम बोली लगाने वाले के साथ समझौता वार्ता, यदि कोई हो, के अनुसार उद्धृत दरों के आधार पर निर्धारित किया जाएगा यदि उद्धृत दरें इंडेंटिंग विभाग/संगठन द्वारा उचित पाई जाती हैं। सक्षम प्राधिकारी खरीद को अंतिम रूप देते समय दरों की तर्कसंगतता सुनिश्चित करेगा। हालाँकि, यदि मंत्रियों के समूह केPART I] HARYANA GOVT. GAZ., AUG. 22, 2023 (SRVN. 31, 1945 SAKA) 719 अलावा कोई सक्षम प्राधिकारी एल-1 की वित्तीय बोली को अस्वीकार करने का निर्णय लेता है, तो उसे अगले उच्च प्राधिकारी से अनुमोदन लेना आवश्यक होगा।
टिप्पणः- 3 क्रम संख्या 6 (ii) तथा 7 के लिए, समझौता वार्ता निम्नानुसार लागू होगीः-
अनुबंध द्वारा कार्यों की खरीद से संबंधित मामलों के लिए मूल्य निर्धारण आमतौर पर एल-1 बोलीदाता द्वारा और केवल सबसे कम बोली लगाने वाले के साथ समझौता वार्ता, यदि कोई हो, के अनुसार उद्धृत दरों के आधार पर निर्धारित किया जा सकता है यदि उद्धृत दरें इंडेंटिंग विभाग/संगठन द्वारा उचित पाई जाती हैं। क तथापि, ऐसे मामलों में जहां एल-1 बोलीदाता के 5 प्रतिषत के भीतर आने वाले बोलीदाता हैं, एल-1 बोलीदाता के अलावा, ऐसे बोलीदाताओं की चार संख्या तक समझौता वार्ता की जा सकती है। ऐसे मामलों में जहां एल-1 बोलीदाता अपनी प्रस्तावित कीमत को और कम करने से इन्कार कर देता है और चार बोलीदाताओं में से कोई भी ऐसी कीमत की पेशकश करने के लिए आगे आता है जो एल-1 बोलीदाता द्वारा प्रस्तावित कीमत से बेहतर है, तो जिस बोलीदाता की कीमत स्वीकार कर ली जाती है वह एल-1 बोलीदाता बन जाता है।
तथापि, ऐसी स्थिति में, मूल एल-1 बोली लगाने वाले को निर्धारित मूल्य में सुधार करने का एक और अवसर दिया जा सकता है। यदि मूल एल-1 बोलीदाता समझौता वार्ता के दौरान पता चली कीमत में और सुधार करता है तो उसे एल-1 बोलीदाता माना जाएगा।
ख ऐसे मामलों में जहां एल-1 बोलीदाता के 5 प्रतिषत के भीतर कोई बोलीदाता नहीं हैः- (i) एल-2 बोली लगाने वाले को हमेशा एल-1 बोली लगाने वाले के अलावा समझौता वार्ता के लिए बुलाया जाएगा।
(ii) यदि मन्त्रीे समूह द्वारा निर्णय लिया जाता है, तो एल-1, एल-2 बोलीदाताओं के अलावा, एल-3 बोलीदाताओं को भी बुलाया जाएगा।
टिप्पणः- 4. उपरोक्त सारणी के अनुसार, प्रत्यायोजन सभी सरकारी विभागों पर लागू होगा। सभी स्थानीय निकायों अर्थात् शहरी स्थानीय निकाय और पंचायती राज संस्थाआेंं के अपने अलग-अलग प्रत्यायोजन होंगे जैसा कि उनके संबंधित विभागों द्वारा अधिसूचित किया गया है।
टिप्पणः- 5. वैधानिक निकायों, बोर्डों और निगमों (विद्युत उपयोगिताओं को छोड़कर) के मामले में, निविदाओं को स्वीकार करने के लिए सक्षम प्राधिकारी 10 करोड़ रूपये तक की निविदाओं के लिए मौजूदा प्रत्यायोजन के अनुसार होगा। 10 करोड़ रूपये से अधिक की अनुमानित लागत वाले संक्रमों के लिए अध्यक्ष के रूप में मुख्यमंत्री, कार्यभारी मंत्री, प्रषासकीय सचिव तथा संबंधित वैधानिक निकाय, बोर्ड या निगम (सीए, सीईओ या एमडी, जैसी भी स्थिति हो) से मिलकर बनने वाली समिति, निविदाओं को स्वीकार करने के लिए सक्षम प्राधिकारी होगी।''।

No.11/25/2023-FR/15995.— In exercise of the powers conferred under clause (2) of article 283 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Departmental Financial Rules in their application to the State of Haryana, namely:-
1. (1) These rules may be called the Departmental Financial (Haryana Second Amendment) Rules, 2023.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. In the Departmental Financial Rules, in rule 10.6 in the Table, for serial numbers 1, 2, 3, 4, 5, 6 and 7 and entries there against, the following serial numbers and entries there against shall be substituted, namely:-

Note 1.ؙ— In case of Group of Ministers, if Chief Minister is present, then presence of any one Minister will complete the quorum otherwise presence of any two Ministers shall be obligatory to complete the quorum.
Note 2.— So far as Sr.No.1, 2, 3, 4, 5 and 6(i) are concerned, the negotiation shall be applicable as under:-The price discovery for cases related to procurement of Works by Contract be determined based on the rates quoted by the L1 bidder, if the quoted rates are found to be reasonable by the Indenting Department/Organization, and negotiations, if any, held with the lowest bidder (L1) only. The competent authority will ensure the reasonability of rates while finalizing the procurement. However, in case of any competent authority, other than the Group of Ministers, decides to reject financial bid of L- I, then it will be required to take approval of the next higher authority.
Note 3.— For Sr. No. 6 (ii) and 7, the negotiation shall be applicable as under:- The price discovery for cases related to procurement of Works by Contract may be generally determined based on the rates quoted by the L1 bidder If the quoted rates are found to be reasonable by the Indenting Department/Organization, and negotiations, if any, held with the lowest bidder.
A. However, negotiation could be held upto four number of such bidder(s), in addition to L1 bidder in cases where there are bidders falling within 5% of the LI bidder. In cases where the L1 bidder refuses to further reduce his offered price and any of the four bidders come forward to offer a price which is better than the price offered by L1 bidder, the bidder whose price is accepted becomes the L1 bidder.
However, in such a situation, the original L1 bidder may be given one more opportunity to improve upon the discovered price. In case, the original L1 bidder further improve upon the price discovered during the negotiations, he would be treated as the L1 bidder.
B. In cases where there is no bidder within 5% of the L1 bidder:-
(i) L2 bidder will be invariably called for negotiation in addition to the L1 bidder. (ii) L3 bidder will also be called, if it is so decided by the Group of Ministers, In addition to L1, L2 bidders.
Note-4. The delegation, as per the table above, shall apply to all Government Departments. All Local Bodies, i.e., Urban Local Bodies and Panchayati Raj Institutions shall have their separate delegations as notified by their respective departments.
Note-5. In the case of Statutory Bodies, Boards and Corporations (except Power Utilities), the Competent Authority for acceptance tenders shall be as per the existing delegation for tenders upto Rs.10 Crore. For works having estimated cost of more than Rs.10 Crore, a Committee consisting of Chief Minister as Chairman, Minister-in-charge, Administrative Secretary and Head (CA, CEO or MD, as the case may be) of concerned Statutory Body, Board or Corporation, shall be the Competent Authority for accepting the tenders.".
