Order
The 7th October, 2023
No. SEC/4E-II/2023/1657.— Whereas, the State Election Commission, Haryana vide its Notification No.SEC/E-II/2023/1538, dated 14.08.2023 had denotified the name of Khurshid Ahmed son of Shujauddin as Member Zila Parishad, Nuh, Ward No.17, District Nuh under section 161 (4) of the Haryana Panchayati Raj Act, 1994.
2. Whereas, the Additional Chief Secretary to Government of Haryana, Development and Panchayat Department, Haryana vide his order No. Reader ACSDP-2023/87810-15, dated 04.08.2023 has passed following order in Appeal No. 13 of 2023 titled "Khurshid Ahmed versus Director General, Development and Panchayat Department, Haryana":-
"Heard learned counsel for the Appellant. He argues that his claim has been removed from the post of Member, Zila Parishad, Ward No.17, Nuh on the basis of a report received from the Deputy Commissioner, Nuh on 25th July, 2023. He was not heard before passing of the impunged order nor the report of the Deputy Commissioner, Nuh has shared with him to give his rebuttal/representation against it. He has quoted several judgments of the Hon'ble High Court to support his arguments that opportunity of adequate hearing is required to be granted before taking any adverse action as provided in the proviso to sub-section (2) of Section 177 of the Haryana Panchayati Raj Act, 1994.
It is ordered that notice be issued to respondents including the complainant. Record will also be summoned from the office of Deputy Commissioner, Nuh as well as Director General, Panchayat.
In the meantime, no coercive steps will be taken in pursuance of the impugned order dated 25.07.2023.

And whereas, it has been confirmed from the office of Additional Chief Secretary to Government of Haryana, Development and Panchayat Department, Haryana that order dated 04.08.2023 is still in force and the appeal is fixed for hearing on 18.10.2023.
4. In compliance of the above orders dated 04.08.2023 passed by the Additional Chief Secretary to Government of Haryana, Development and Panchayat Department, Chandigarh, the State Election Commission, Haryana hereby orders to withdraw its Notification No. SEC/4E-II/2023/1538, dated 14.08.2023 with immediate effect.
