संख्या सा०का०नि०25/संवि०/अनु० 234 तथा 309/2023.— भारत के संविधान के अनुच्छेद 309 के परन्तुक के साथ पठित अनुच्छेद 234 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तथा हरियाणा लोक सेवा आयोग तथा पंजाब तथा हरियाणा उच्च न्यायालय से परामर्ष के बाद, हरियाणा के राज्यपाल, इसके द्वारा, पूर्व पंजाब सरकार, अधिसूचना संख्या 3010-जी-51/1/6094, दिनांक 26 अक्तूबर, 1951 द्वारा प्रकाषित नियमों को आगे हरियाणा राज्यार्थ संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः-
1. ये नियम पंजाब सिविल सेवा (न्यायिक शाखा) हरियाणा संषोधन नियम, 2023 कहे जा सकते हैं।
2. पंजाब सिविल सेवा (न्यायिक शाखा) नियम, 1951 (जिन्हें, इसमें, इसके बाद उक्त नियम निर्दिष्ट किया गया है) में, भाग क में, नियम 7 ख के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्ः-
―7.ख (1) इन नियमों में दी गई किसी बात के प्रतिकूल होते हुए भी, सिविल न्यायाधीषों (जूनियर डिवीजन) के वर्तमान में रिक्त पड़े एक सौ उनतीस (वास्तविक) तथा पैंतालीस (अनपेक्षित) पदों पर नियुक्ति इसमें, इसके बाद अधिकथित रीति में प्रयोजन के लिए गठित चयन समिति की सिफारिषों पर विषेष भर्ती के माध्यम से राज्य सरकार द्वारा की जाएगी।
(2) उप-नियम (1) में निर्दिष्ट चयन समिति निम्नलिखित सदस्यों से मिलकर बनेगी, अर्थात्ः- (i) मुख्य न्यायमूर्ति द्वारा मनोनीत पंजाब तथा हरियाणा उच्च न्यायालय के तीन न्यायाधीष, जिसमें वरिष्ठतम अध्यक्ष होगा;
(ii) महाधिवक्ता, हरियाणा;
(iii) मुख्य सचिव, हरियाणा सरकार; तथा
(iv) अध्यक्ष, हरियाणा लोक सेवा आयोग। ‖।
3. उक्त नियमों में, ―भाग-ग प्रतियोगी परीक्षा‖ के स्थान पर, निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थात््ः-
"भाग ग-प्रतियोगी परीक्षा
1. परीक्षा तीन स्तरों में संचालित की जायेगी, अर्थात्ः-
(i) प्रारम्भिक परीक्षा;
(ii) मुख्य परीक्षा; तथा
(iii) मौखिक परीक्षा।
2. चयन समिति प्रारम्भिक परीक्षा आयोजित करेगी, जिसके आधार पर विज्ञापित पदों के दस गुणा से अनधिक उम्मीदवारों को मुख्य लिखित परीक्षा में उपस्थित होने के लिए योग्यता के अनुसार चयनित सूची में रखेगी। उम्मीदवार, जो प्रारम्भिक परीक्षा में 500 अंकों में से कम से कम 150 अंक (सभी आरक्षित प्रवर्ग के उम्मीदवारों के लिए 100 अंक पढ़ें) प्राप्त नहीं करता है, का चयन मुख्य परीक्षा हेतु चयनित सूची में नहीं किया जाएगा। प्रारम्भिक परीक्षा में प्राप्त अंकों को अन्तिम परिणाम के लिए नहीं गिना जाएगा। व़िज्ञापित रिक्तियों की दस गुणा संख्या के बराबर अपने - अपने प्रवर्गों में अपनी योग्यता के अनुसार चयनित उम्मीदवार मुख्य परीक्षा में बैठने के पात्र हाेंगे।
तथापि, मुख्य परीक्षा के लिए उम्मीदवारों की संख्या परिवर्तन के अध्यधीन होगी। यदि अन्तिम स्थान (अन्तिम संख्या) पर रहने वाले दो या से अधिक उम्मीदवार बराबर अंक प्राप्त करते हैं, तब उन सभी उम्मीदवारों को नियत अनुपात में समरूपी वृद्धि प्राधिकृत करते हुए मुख्य परीक्षा हेतु बैठने के लिए पात्र समझा जाएगा। 3. मुख्य लिखित परीक्षा ऐसे स्थान पर तथा ऐसी तिथि को आयोजित की जाएगी, जो राजपत्र में अधिसूचित की जाए।
4. परीक्षा में प्रवेष के लिए फीस ऐसी होगी, जो राज्य सरकार, समय-समय पर, राजपत्र में अधिसूचित करे, जो सचिव, हरियाणा लोक सेवा आयोग द्वारा उपलब्ध करवाई वैबसाइट/लिंक पर ऑनलाइन भुगतानयोग्य होगी।740 HARYANA GOVT. (EXTRA.), NOV. 7, 2023 (KRTK. 16, 1945 SAKA) 5. चयन समिति प्रष्न-पत्रों को तैयार, उत्तर पुस्तिकाओं का मूल्यांकन करेगी, मौखिक परीक्षा सचांलित करेगी और प्रष्न-पत्र तैयार करने तथा उत्तर पुस्तिकाओं के मूल्यांकन के सम्बन्ध में सभी सहायक/आकस्मिक कदम उठाएगी। भर्ती प्रक्रिया जैसे आवेदन मांगने तथा छानबीन करने, उम्मीदवारों को रोल नम्बर तथा प्रवेष पत्र जारी करने के उत्तरदायित्व का निर्वहन हरियाणा लोक सेवा आयोग द्वारा किया जाएगा।
6. उम्मीदवार परीक्षा के समय पर प्रवेष प्रमाण-पत्र प्रस्तुत करेगा।
7. मुख्य लिखित परीक्षा छह पेपरों (पांच लिखित तथा एक मौखिक परीक्षा) की होगी। पेपर की किस्म तथा पाठ्यक्रम निम्न अनुसार होगा :-
पेपर I सिविल लॉ- I सिविल प्रक्रिया संहिता, पंजाब न्यायालय अधिनियम, 200 अंक भारतीय संविदा अधिनियम, भारतीय भागीदारी अधिनियम, माल विक्रय अधिनियम, विनिर्दिष्ट अनुतोष अधिनियम, हरियाणा नगरीय (किराया और बेदखली नियंत्रण) अधिनियम, 1973 तथा भारतीय साक्ष्य अधिनियम।
पेपर- II सिविल लॉ- II हिन्दू लॉ, मोहम्मडन लॉ तथा कस्टमरी लॉ, 200 अंक रजिस्टे्रषन तथा लिमिटेषन लॉ।
पेपर- III क्रिमिनल लॉ भारतीय दंड संहिता, दंड प्रक्रिया संहिता 200 अंक तथा भारतीय साक्ष्य अधिनियम।
पेपर- IV अंग्रेजी अंग्रेजी पेपर 200 अंकों का होगा तथा इसमें निम्नलिखित होगाः-
1. अंग्रेजी निबन्ध (1000-1100 शब्द) 100 अंक 2. सार-लेखन (प्रेसी) 25 अंक 3. शब्द तथा वाक्यांष (दिए गए शब्दाें तथा 25 अंक
वाक्यांषों के वाक्य बनाना)
4. बौद्धिक 25 अंक 5. शुद्धि 25 अंक पेपर- V भाषा हिन्दी (देवनागरी लिपि में) 100 अंक पेपर- VI मौखिक उम्मीदवार के व्यक्तिगत गुणों को आंकने। 200 अंक मौखिक परीक्षा साधारण रूचि के मामलों से सम्बन्धित होगी तथा उम्मीदवार की जागरूकता, बुद्धि तथा सामान्य दृष्टिकोण की परीक्षा के लिए आषयित है। यह अंग्रेजी में सचांलित की जाएगी।
टिप्पणः-
(i) केवल विधायी अधिनियमितियों की अनावृत्त प्रतियां दी जाएंगी;
(ii) प्रत्येक लिखित पेपर तीन घंटे की अवधि का होगा; तथा
(iii) भाषा पेपर का मानक हरियाणा विद्यालय षिक्षा बोर्ड की मैट्रिक परीक्षा
जैसा होगा। भाषा पेपर (V) में निम्नलिखित शामिल होगाः-
(क) अंग्रेजी लेखांष का हिन्दी में अनुवाद ः 20 अंक (ख) हिन्दी लेखांष की गद्य में तथा उसी ः 30 अंक भाषा में पद्य की व्याख्या
(ग) संयोजन (निबन्ध, मुहावरे तथा शुद्धियां ः 50 अंक इत्यादि)

8. किसी भी उम्मीदवार को किसी लिखित पेपर में किसी अंक से तब तक आंकलित नहीं किया जाएगा जब तक वह उसमें कम से कम तैंतीस प्रतिषत अंक प्राप्त नहीं करता है।HARYANA GOVT. GAZ. (EXTRA.), NOV. 7, 2023 (KRTK. 16, 1945 SAKA) 741 9. मौखिक परीक्षा में उपस्थिति अनिवार्य है। किसी भी उम्मीदवार को मौखिक परीक्षा के लिए तब तक नहीं बुलाया जाएगा जब तक वह सभी लिखित पेपरों के पूर्णयोग में कम से कम पचास प्रतिषत अर्हक अंक प्राप्त नहीं करता है। तथापि, अनुसूचित जाति, पिछड़े वर्गाें, दिव्यांग तथा केवल भूतपूर्व सैनिक उम्मीदवारों (परन्तु भूतपूर्व सैनिकों के आश्रितों को नहीं) के प्रवर्गों से सम्बन्धित उम्मीदवार के लिए अर्हक अंक पैंतालीस प्रतिषत होंगे :
परन्तु लिखित परीक्षा में प्राप्त अंकों के अनुसार मौखिक परीक्षा के लिए बुलाए जाने वाले उम्मीदवारों की संख्या विज्ञापित रिक्तियों की संख्या के तीन गुणा से अधिक नहीं होगी। तथापि, यदि साक्षात्कार के लिए बुलाए जाने वाला अन्तिम उम्मीदवार समान अंक प्राप्त करने वाले बराबर उम्मीदवारों से तीन गुणा अधिक हैं, तो सभी समान अंकाें वाले उम्मीदवार साक्षात्कार के लिए बुलाए जाएंगे, इस तथ्य के बावजूद कि साक्षात्कार के लिए बुलाए जाने वाले उम्मीदवारों की संख्या तीन गुणा से अधिक हैः
परन्तु यह और कि केवल वे ही उम्मीदवार सिविल न्यायाधीषों/न्यायिक मजिस्टे्रटों के रूप में भर्ती के लिए पात्र हाेंगे जिन्हाेंने मुख्य लिखित परीक्षा तथा मौखिक परीक्षा में प्राप्त अंकों के पूर्णयोग में पचास प्रतिषत या से अधिक अंक (केवल अनुसूचित जाति, पिछड़े वर्गाें, दिव्यांग तथा भूतपूर्व सैनिक उम्मीदवारों, परन्तु भूतपूर्व सैनिकों के आश्रित उम्मीदवारों को नहीं, के लिए पैंतालीस प्रतिषत) प्राप्त किए हैं।
10. परीक्षा का परिणाम राजपत्र में प्रकाषित किया जाएगा।
11. उम्मीदवार असल में नियुक्ति के लिए उसी क्रम में चयनित किए जाएंगे जिसमें वे चयन समिति द्वारा रखे गए हैंः
परन्तु अनुसूचित जातियों तथा पिछड़े वर्गाें से सम्बन्धित उम्मीदवारों की दषा में, ऐसा उम्मीदवार, जो मात्र परीक्षा में उस द्वारा प्राप्त स्थान को विचार में लाए बिना अर्हित हो, योग्यता के अनुसार चयन का अधिकार चयन समिति के पास होगाः
परन्तु यह और कि परस्पर योग्यता के अनुसार अनुसूचित जातियों तथा पिछड़े वर्गोंे से सम्बन्धित उम्मीदवारों का चयन उनके लिए आरक्षित रिक्तियों के विरुद्ध तथा चयन समिति द्वारा अपनाई गई रीति में किया जाएगा।
12. परीक्षा के बाद, प्रत्येक चयनित उम्मीदवार ऐसे स्थायी चिकित्सा बोर्ड, जो महानिदेषक, स्वास्थ्य सेवाएं, हरियाणा द्वारा निष्चित किया जाए, से सरकारी सेवा के लिए चिकित्सा उपयुक्तता का प्रमाण-पत्र प्रस्तुत करेगा। उम्मीदवारों का अपेक्षित चिकित्सा उपयुक्तता का मानक इन नियमों के परिषिष्ट ग में दिया गया है। ‖।

Notification
The 7th November, 2023
No. G.S.R.25/Const./Art.234 and 309/2023.— In exercise of the powers conferred by article 234 read with the proviso to article 309 of the Constitution of India, the Governor of Haryana after consultation with the Haryana Public Service Commission and the High Court of Punjab and Haryana, hereby makes the following rules to further amend the rules published by erstwhile Punjab Government, notification No. 3010-G-51/1/6094, dated the 26th October, 1951, in their application to the State of Haryana, namely:-
1. These rules may be called the Punjab Civil Service (Judicial Branch) Haryana Amendment Rules, 2023.
2. In the Punjab Civil Service (Judicial Branch) Rules, 1951 (hereinafter referred to as the said rules), in Part A, for rule 7B, the following rule shall be substituted, namely:-
―7B (1) Notwithstanding anything to the contrary contained in these rules, appointment of One Hundred Twenty Nine (Actual) and Forty-Five (unforeseen) presently lying vacant posts of Civil Judges (Junior Division) shall be made by the State Government through Special recruitment on the recommendations of a Selection Committee constituted for the purpose in the manner hereinafter laid down.
(2) The Selection Committee referred to in sub-rule (1) shall comprise of the following members, namely:-
(i) three Judges of the High Court of Punjab and Haryana nominated by the Chief Justice, of whom the senior-most shall be the Chairman;
(ii) the Advocate General, Haryana;
(iii) the Chief Secretary to Government, Haryana; and
(iv) the Chairman of the Haryana Public Service Commission.‖.
3. In the said rules, for ―PART C–COMPETITIVE EXAMINATION‖, the following shall be substituted, namely:-
―PART C-COMPETITIVE EXAMINATION
1. The examination shall be conducted in three stages, namely:-
(i) Preliminary examination;
(ii) Main examination; and
(iii) Viva-Voce.
2. The Selection Committee shall hold a preliminary examination on the basis of which candidates not more than ten times of the advertised posts shall be shortlisted in order of merit for appearing in the main written examination.
The candidate who does not secure minimum 150 marks (read 100 marks for all reserved category candidates) out of total 500 marks in the preliminary examination shall not be short-listed for the main examination. The marks obtained in the preliminary examination shall not be counted towards final result. Candidate equal to ten times the number of vacancies advertised, selected in order of their merit in the respective categories shall become eligible to sit in the Main Examination.
However, the number of the candidates for the main examination shall be subject to variation. If two or more candidates at the last number (the number at the end) get the equal marks, then all of them shall be considered eligible to sit for the Main Examination, warranting the corresponding increase in the stipulated ratio.
3. The main written examination shall be held at such place and on such date, as may be notified in the Official Gazette.
4. Fee for admission to the examination shall be such, as the State Government may, from time to time, notify in the Official Gazette, which shall be payable online on website/link provided by the Secretary, Haryana Public Service Commission.
5. The Selection Committee shall set up the Question Papers, evaluate the Answer Sheets, conduct the Viva Voce and take all the ancillary/incidental steps in respect of setting up of the Question Papers and evaluation of Answer Sheets. The recruitment process such as inviting and screening the applications,HARYANA GOVT. GAZ. (EXTRA.), NOV. 7, 2023 (KRTK. 16, 1945 SAKA) 743 issuing the roll numbers and admit cards to the candidates shall be undertaken by the Haryana Public Service Commission.
6. The candidate shall produce the admission certificate at the time of the examination.
7. The main written examination shall consist of six papers (five written and one viva-voce test). The description of papers and syllabi shall be as under:-
200 Marks Paper-I Civil Law-I Code of Civil Procedure, Punjab Courts Act, Indian Contract Act, Indian Partnership Act, Sale of Goods Act, Specific Relief Act, Haryana Urban (Control of Rent and Eviction) Act, 1973 and Indian Evidence Act.
Paper-II Civil Law-II Hindu Law, Mohammadan Law and Customary Law, Law of
200 Marks Registration and Limitation.
200 Marks Paper-III–Criminal Law
Indian Penal Code, Code of Criminal Procedure and Indian Evidence Act.
Paper-IV English The English paper shall be of 200 marks and will consist of the
following :-
1. English Essays (1000-1100 words)
100 Marks 2. Precis
25 Marks 3. Words and Phrases (make sentences of the given words and
25 Marks phrases)
4. Comprehension
25 Marks 5. Corrections
25 Marks Paper-V Language Hindi [in Devnagri Script]
100 Marks Paper-VI
200 marks.
Viva-Voce
To judge the personal qualities of the candidates. The viva-voce test shall relate to the matters of general interest and is intended to test the candidates' alertness, intelligence and general outlook. It shall be conducted in English.
Note:-
[i] Only bare copies of legislative enactments shall be supplied.
[ii] Each written paper shall be of three hours duration.
[iii] The standard of the language paper shall be that of Matriculation
Examination of the Board of School Education, Haryana. Language paper (V) shall comprise the following:-
[a] Translation of an English passage into Hindi : 20 Marks [b] Explanation of Hindi passage in prose and : 30 Marks Poetry in the same language.
[c] Composition [Essay, idioms and : 50 Marks correction etc.]
____________ Total : 100 Marks ____________ 8. No candidate shall be credited with any marks in any written paper unless he obtains at least thirty three percent marks in it.
9. Appearance in viva-voce is mandatory. No candidate shall be called for the viva-voce test unless he obtains at least fifty percent qualifying marks in the aggregate of all the written papers. However, for the candidate belonging to the categories of Scheduled Caste, Backward Classes, Physically Handicapped and Ex-Serviceman candidates only (but not dependents of ESM) the qualifying marks shall be forty-five percent:
Provided that the number of candidates to be called for viva-voce test in order of the marks obtained in the written examination shall not exceed three times the number of vacancies advertised. However, if the last candidate to be called for interview is bracketed with the candidates exceeding744 HARYANA GOVT. GAZ. (EXTRA.), NOV. 7, 2023 (KRTK. 16, 1945 SAKA) three times by obtaining equal marks then all the bracketed candidates shall be called for interview, inspite of the fact that the number of candidates to be called for interview exceeds three times:
Provided further that only those candidates shall be eligible to be recruited as Civil Judges/Judicial Magistrates who secure fifty percent or more marks (forty-five percent for the Scheduled Caste, Backward Classes, Physically Handicapped and Ex-Serviceman candidates only but not dependents of ESM candidates) in aggregate of the marks secured in the main written examination and the viva-voce.
10. The result of the examination shall be published in the Official Gazette.
11. Candidates shall be selected for appointment strictly in the order in which they have been placed by the Selection Committee:
Provided that in the case of candidates belonging to the Scheduled Castes and Backward Classes, Selection Committee shall have a right to select in order of merit a candidate who has merely qualified irrespective of the position obtained by him in the examination:
Provided further that the selection of candidates belonging to the Scheduled Castes and Backward Classes in the order of merit inter-se shall be made against the vacancies reserved for them and in the manner to be adopted by the Selection Committee.
12. After the examination, each selected candidate shall produce a certificate of medical fitness for the Government service from such Standing Medical Board, as may be arranged by the Director General, Health Services, Haryana.
The standard of medical fitness required of the candidates is given in Appendix C to these rules.‖
