क्रमांक डी०एफ०ए०-3/2024/21059.— हरियाणा के राज्यपाल, हरियाणा विकास एवं पंचायत विभाग हरियाणा विकास कार्यों के लिए मिलान अनुदान नियम, 1979 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :- 1. इन नियमों को हरियाणा विकास कार्यों के लिए मिलान अनुदान, नियम, 2024 कहा जा सकता है। 2. हरियाणा विकास कार्य के लिए मिलान अनुदान नियम, 1979 (जिसे इसके बाद उक्त नियम कहा गया है) नियम 2 में :-

(i) खंड (क) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात :-

(क) ''योगदान'' का अर्थ सार्वजनिक प्रयोजनों के लिए अपने स्वयं के स्रोतों से किसी भी कार्य के लिए किसी व्यक्ति या व्यक्तियों के समूह या पंजी—त संस्था द्वारा स्वेच्छा से पेश की गई और बैंक खाते में जमा की गई राशि है।

(ii) खंड (ग) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्‌ः-

(ग) ''पंचायत या ग्राम पंचायत'' का अर्थ हरियाणा पंचायती राज अधिनियम, 1994 के तहत ग्राम स्तर पर गठित पंचायत है।

(iii) खंड (घ) हटाया जाएगा। (iv) खंड (च) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्‌ः-

(च) ''परियोजना प्रबंधन समिति'' का अर्थ है एक समिति जिसमें उपायुक्त, मुख्य कार्यकारी अधिकारी (जिला परिषद), कार्यकारी अभियंता पंचायती राज या कार्यकारी अभियंता पीडब्ल्यूडी (बी एंड आर), दाता इकाई के अध्यक्ष और सचिव या इससे जुड़े किसी अन्य सदस्य योगदान देने वाली इकाई में शामिल हों। 3. उक्त नियमो में नियम 3 में :-

(i) खंड (क) व (ख) के स्थान पर निम्नलिखित खंड रखे जाएंगे, अर्थात्‌ः-

(क) मिलान अनुदान की घोषणा हरियाणा सरकार के मुख्यमंत्री, मंत्रियों, राज्य मंत्रियों, अध्यक्ष/ उपाध्यक्ष, विधानसभा, उपाध्यक्ष, योजना बोर्ड, उप मंत्रियों, मुख्य संसदीय सचिव और संसदीय सचिव द्वारा की जा सकती है। राज्य के विभिन्न स्थानों की यात्रा के अवसर पर उन्हें योगदान प्रदान किया गया। (ख) अनुदान मिलान के आधार पर होगा यानी, यह लोगों द्वारा प्रस्तुत राशि के बराबर होगा। स्वास्थ्य, शिक्षा एवं स्वच्छता से संबंधित कार्यों के मामले में अनुदान की राशि अंशदान की राशि से दोगुनी होगी। स्वी—त राशि में अंशदान की राशि शामिल होगी।

(ii) खंड (ड़) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्‌ः-

(ड़) योगदान किसी व्यक्ति या व्यक्तियों के समूह या पंजी—त इकाई द्वारा अपने स्रोतों से स्वैच्छिक होना चाहिए।

(i) खंड (क) के परन्तुक को हटाया जाएगा।

(ii) खंड (घ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्‌ः-

(घ) सार्वजनिक उद्देश्यों के लिए हरियाणा राज्य के भीतर निष्पादित किए जाने वाले कार्यों के लिए अनुदान दिया जाएगा।

5. उक्त नियमो में नियम 5 में :-

(i) खंड (क) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्‌ः-

(क) ग्रामीण विकास विभाग इस योजना के लिए प्रशासनिक विभाग होगा और बजट आवंटन उचित बजट शीर्ष के तहत किया जाएगा। मुख्यमंत्री, मंत्री, राज्य मंत्री, अध्यक्ष/उपाध्यक्ष, विधान सभा, उपाध्यक्ष, योजना बोर्ड, उप मंत्री, मुख्य संसदीय सचिव और संसदीय सचिव ग्रामीण विकास विभाग को उनके द्वारा घोषित योगदान की राशि के बारे में सूचित करेंगे। गांव/कस्बे का दौरा और ग्रामीण विकास विभाग को धन आवंटित किया जाएगा और नियमों के अनुसार आगे की कार्रवाई के लिए संबंधित जिले के निपटान में रखा जाएगा।

(ii) खंड (ग) व (घ) के स्थान पर निम्नलिखित खंडों को रखा जाएगा, अर्थात्‌ः-

(ग) मुख्य कार्यकारी अधिकारी, जिला परिषद इस योजना के तहत आहरण एवं संवितरण अधिकारी होंगे। (घ) समतुल्य अनुदान की घोषणा की सूचना मुख्यमंत्री, मंत्रियों, राज्य मंत्रियों, अध्यक्षध्उपाध्यक्ष, विधानसभा, उपाध्यक्ष, योजना बोर्ड, उप मंत्रियों, मुख्य संसदीय सचिव और संसदीय सचिव द्वारा विधानसभा उपाध्यक्ष को दी जाएगी। आयुक्त निर्धारित प्रोफार्मा (अनुलग्नक ''ए'') में। इसकी एक प्रति ग्रामीण विकास विभाग को भी भेजी जायेगी।

(iii) खंड (ड) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्‌ः-

(ड़) इस सूचना के प्राप्त होने पर, उपायुक्त सार्वजनिक कार्यों के लिए लाभार्थियों द्वारा उचित बजट शीर्ष के तहत सरकारी खजाने में योगदान जमा कराने के लिए कदम उठाएंगे।

(iv) खंड (छ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्‌ः-

(छ) जब निदेशक ग्रामीण विकास संतुष्ट हो जाते हैं कि जमा की गई योगदान राशि नियम 3 (बी) में निर्धारित अनुपात में है और अनुदान इन नियमों के अनुसार स्वीकार्य है, तो निदेशक ग्रामीण विकास अनुदान को सरकार से अनुमोदन उपरान्त उपायुक्त को जारी कर देगा।

(v) खंड (ज) हटाया जाएगा।

6. उक्त नियमो में नियम 6 में निम्नलिखित खंड रखा जाएगा, अर्थात्‌ः-

6. सभी कार्य योगदानकर्ता इकाई की पसंद के अनुसार और संबंधित विभाग के प्रचलित नियमों और निर्देशों के अनुसार निष्पादित किए जाएंगे। ऐसे सभी कार्यों की निगरानी परियोजना प्रबंधन समिति द्वारा की जाएगी। परियोजना प्रबंधन समिति के अध्यक्ष यानी संबंधित उपायुक्त काम की दिन-प्रतिदिन की निगरानी और पर्यवेक्षण के लिए या तो पंचायती राज या पीडब्ल्यूडी (बी एंड आर) से एक अधिकारी को नामित करेंगे।

7. उक्त नियमो में नियम 7 हटाया जाएगा।

8. उक्त नियमो में नियम 8 में खंड (i) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थातः-

(i) मौजूदा इमारतों में निर्मित/अतिरिक्त संपत्ति/इमारतें सरकारी नियमों के अनुसार मालिक के पास निहित होंगी। 9. उक्त नियमो में अनुलंग्नक ए, में "निदेषक पंचायत" के स्थान पर "निदेषक ग्रामीण विकास" रखा जाएगा। 10. उक्त नियमो में अनुलंग्नक बी, बी I, बी II, बी III व बी IV हटाया जाएगा।

Notification

The 28th February, 2024

No. DFA-3/2024/21059.— The Governor of Haryana hereby makes the following rules further to amend the Haryana Matching Grants for Development Works Rules, 1979 namely:-

1. These rules may be called the Haryana Matching Grants for Development Works Amendment Rules, 2024.

2. In the HARYANA MATCHING GRANTS FOR DEVELOPMENT WORKS RULES, 1979 (hereinafter called the said rules), in rule 2 –

(i) for clause (a) the following clause shall be substituted, namely:-

"(a) "Contribution" means the amount voluntarily offered and deposited in bank account by an individual or group of individuals or registered entity for any work from their own sources for public purposes.".

(ii) for clause (c) the following clause shall be substituted, namely:-

"(c) "Panchayat or Gram Panchayat" means the Panchayat constituted at village level under the Haryana Panchayati Raj Act, 1994.".

(iii) clause (d) shall be omitted.

(iv) for clause (f) the following clause shall be substituted, namely:-

"(f) "Project Management Committee" means a committee comprising of Deputy Commissioner, Chief Executive Officer (Zila Parishad), Executive Engineer Panchayati Raj or Executive Engineer PWD(B&R), President & Secretary of the donor entity or any other member associated with the contributing entity.".

3. In the said rules, in rule 3 –

(i) for clauses (a) and (b), the following clauses shall be substituted, namely:-

"(a) The matching grant may be announced by the Chief Minister, Ministers, State Ministers, Speaker/Deputy Speaker, Vidhan Sabha, Deputy Chairman, Planning Board, Deputy Ministers, Chief Parliamentary Secretary and Parliamentary Secretary of the Haryana Government when the proof of contributions presented to him on the occasion of his visit to different places in the State.

(b) The grant will be on matching basis i.e., it will be equal to the amount presented by the people. In case of works related to Health, Education and Sanitation the amount of grant will be twice the amount of contribution. The sanctioned amount will include the amount of contribution.".

(ii) for clause (e) the following clause shall be substituted, namely:-

"(e) The contribution has to be voluntary from any individual or group of individuals or registered entity from their own sources.".

4. In the said rules, in rule 4 –

(i) in clause (a), the proviso shall be omitted.

(ii) for clause (d), the following clause shall be substituted, namely:-

"(d) The grant will be given for works to be executed within the State of Haryana for public purposes.".

5. In the said rules, in rule 5 –

(i) for clause (a), the following clause shall be substituted, namely:-

(a) The Rural Development Department will be the administrative department for this scheme and the budget allocation will be made under appropriate budget head. The Chief Ministers, Ministers, State Ministers, Speaker/Deputy Speaker, Vidhan Sabha, Deputy Chairman, Planning Board, Deputy Ministers, Chief Parliamentary Secretary and Parliamentary Secretary would communicate to the Rural Development Department, the amount of matching contribution announced by him on his visit to the village/town and the Rural Development Department would get the funds allocated and placed at the disposal of the respective District for further action as provided in the rules.

(ii) for clauses (c) and (d), the following clauses shall be substituted, namely:-

"(c) Chief Executive Officer, Zila Parishad will be the Drawing and Disbursing Officer under this scheme.

(d) Intimation of the announcement of the matching grant will be conveyed by the Chief Minister, Ministers, State Ministers, Speaker/Deputy Speaker, Vidhan Sabha, Deputy Chairman, Planning Board, Deputy Ministers, Chief Parliamentary Secretary and Parliamentary Secretary to the Deputy Commissioner in the prescribed proforma (Annexure 'A'). A copy of this will also be sent to the Rural Development Department.".

(iii) for clause (e), the following clause shall be substituted, namely:-

"(e) On receipt of this intimation, the Deputy Commissioner will take steps to have the contribution deposited in the Government treasury under the appropriate budget head by beneficiaries for public works"."

(iv) for clause (g), the following clause shall be substituted, namely:-

"(g) When the Director Rural Development is satisfied that the deposited amount of contribution is in the ratio as prescribed in rule 3(b) and that the grant is admissible as per these rules, Director Rural Development would release the grant to the Deputy Commissioner concerned after approval from the Government.

(v) clause (h) shall be omitted.

6. In the said rules, for rule 6, the following rule shall be substituted, namely:-

"6. All the works shall be executed as per the choice of the contributing entity and as per the prevalent rules and instructions of the department concerned. All such works will be monitored by the Project Management Committee.

The Chairman of the Project Management Committee i.e. the Deputy Commissioner concerned will designate an officer either from Panchayati Raj or from PWD (B&R) for day to day monitoring and supervision of the work.".

7. In the said rules, rule 7 shall be omitted.

8. In the said rules, in rule 8, for item (i), the following item shall be substituted, namely:-

"(i) Property/buildings constructed/additions to the existing buildings will vest with the owner as per the government rules;".

9. In the said rules, in annexure 'A', for the words, "Director Panchayats", the words "Director Rural Development" shall be substituted.

10. In the said rules, annexures "B", "B I", "B II", "B III" and "B IV" shall be omitted.
