संख्या Misc-387-Vol-III/36679.— पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन नियम, 1965 को, हरियाणा राज्यार्थ आगे संशोधित करने के लिए नियमों का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल, हरियाणा अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन अधिनियम, 1963 (1963 का पंजाब अधिनियम 41) की धारा 25 की उपधारा (2) के साथ पठित उपधारा (1) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बनाने का प्रस्ताव करते हैं, इसके द्वारा, उक्त धारा की उपधारा (1) द्वारा यथा अपेक्षित उन व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है, जिनके इससे प्रभावित होने की सम्भावना है।

इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाशन की तिथि से तीस दिन की अवधि की समाप्ति पर अथवा उसके पश्चात्‌ सरकार, नियमों के प्रारूप पर, ऐसे आक्षेपों या सुझावों, यदि कोई हों, के साथ, जो अपर मुख्य सचिव, हरियाणा सरकार, नगर तथा ग्राम आयोजना विभाग, चण्डीगढ़ द्वारा किसी व्यक्ति से लिखित में नियमों के प्रारूप के सम्बन्ध में इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किए जाए, विचार करेगी।

प्रारूप नियम

1. ये नियम पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन (हरियाणा द्वितीय संशोधन) नियम, 2024 कहे जा सकते हैं।

2. पंजाब अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन नियम, 1965 (जिन्हें, इसमें, इसके बाद उक्त नियम कहा गया है) में, नियम 3 में, उप-नियम (4) के स्थान पर, निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ः- "(4) निदेशक, किसी व्यक्ति के आवेदन पर, उप-नियम (1) में निर्दिष्ट नक्शा और उप-नियम (2) में निर्दिष्ट रजिस्टर निरीक्षण के लिए निःशुल्क उपलब्ध करवाएगा।"।

3. उक्त नियमों में, नियम 4 में, उप-नियम (1) में, खंड (क) में, अंत में विद्यमान "।" चिह्‌न के स्थान पर, ";" चिह्‌न प्रतिस्थापित किया जाएगा।

(3803)3804 HARYANA GOVT. GAZ. (EXTRA.), NOV. 27, 2024 (AGHN. 6, 1946 SAKA) 4. उक्त नियमों में, नियम 6 में, "आवेदक" शब्द के स्थान पर, "पंजी—त डाक/स्पीड पोस्ट/ई-मेल द्वारा आवेदक" शब्द और चिह्‌न प्रतिस्थापित किए जाएंगे।

5. उक्त नियमों में, नियम 8 में, खंड (ii) में, उप-खंड (ग) में, "जल निकासी और बिजली और गैस प्रतिष्ठानों का निपटान" शब्दों के स्थान पर, "जल निकासी और कूड़े का निस्तारण तथा बिजली और गैस प्रतिष्ठापन" शब्द प्रतिस्थापित किए जाएंगे। 6. उक्त नियमों में, नियम 10 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ः -

''10. अंतिम विकास योजनाओं का प्रकाषन {धारा 5 (7) तथा 25(2)(ख)}़़़.-धारा 5 की उप-धारा (7) के अधीन सरकार द्वारा यथा अधिसूचित विकास योजना राजपत्र में इसके प्रकाषन के अतिरिक्त, निम्नलिखित प्रत्येक के कार्यालय में किसी सहजदृष्य स्थान पर उसकी एक प्रति प्रदर्षित करते हुए प्रचारित की जाएगी-

(i) निदेषक;

(ii) संपदा अधिकारी, यदि कोई हो, जिसकी अधिकारिता नियंत्रित क्षेत्र में हो; (iii) उस जिले का उपायुक्त जिसमें नियंत्रित क्षेत्र स्थित है;

(iv) पंचायत समिति या समितियां जिनमें नियंत्रित क्षेत्र स्थित है; और

(v) नगरपालिका समिति, नगर परिषद्‌ या नगर निगम जिसमें नियन्त्रित क्षेत्र स्थित है।''

7. उक्त नियमों में, नियम 11 से 26 का लोप कर दिया जाएगा।

8. उक्त नियमों में, नियम 26क में, उप-नियम (1) में, '1" से चालीस फीटˈ अंक, चिह्‌न तथा शब्दों के स्थान पर, 'एक सेंटीमीटर = दस मीटर ' शब्द तथा चिह्‌न प्रतिस्थापित किए जाएंगे।

9. उक्त नियमों में, नियम 27 में, उप-नियम (2) में, "1" से 40' " अंक, चिह्‌न तथा शब्द के स्थान पर, "एक सेंटीमीटर = दस मीटर" शब्द तथा चिह्‌न प्रतिस्थापित किए जाएंगे। 10. उक्त नियमों में, नियम 35 में, "देने से इन्‌कार करेगा" शब्दों के स्थान पर, 'लिखित में ऐसे इन्‌कार के लिए कारणों को विनिर्दिष्ट करते हुए उसे देने से इन्‌कार करेगा" शब्द प्रतिस्थापित किए जाएंगे। 11. उक्त नियमों में, नियम 127 के स्थान पर, निम्नलिखित नियम प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"127. प्रतियां तथा फीस {धारा 8(2) तथा 25 (2) (च)}.- इस अधिनियम के अधीन तैयार किए गए सर्वेक्षण अभिलेख, फील्ड बुक, योजनाओं, आदेशों और अन्य दस्तावेजों की प्रतियां नीचे दी गई तालिका में यथा वर्णित फीस के भुगतान पर उपलब्ध होंगीः-

तालिका

1.	नियम 3 के अधीन तैयार किए गए रजिस्टर की प्रविष्टियों या रेखीय नक्शे की प्रतियों हेतुः-
	(क) रजिस्टर की प्रविष्टियों	10.00 रूपए प्रति प्रविष्टि
	(ख) रेखीय नक्शा	100 रूपए नक्शे में दर्शाई गई सड़क या उसके भाग के प्रत्येक एक किलोमीटर के लिए
2.	नियम 126 में वर्णित रजिस्टरों की प्रविष्टियों की प्रतियां	10.00 रूपए प्रति प्रविष्टि
3.	अधिनियम की धारा 8 के अधीन निदेशक के अनुमति देने या अस्वी—त करने के आदेशों की प्रति	20.00 रूपए प्रति आदेश
4.	नियन्त्रित क्षेत्र की विकास योजना की ड्राइंग की प्रति	100.00 रूपए प्रति आदेश
5.	सभी संलग्नकों सहित विकास योजना की प्रति	300.00 रूपए
6.	अनुलिपि अनुज्ञप्ति	100.00 रूपए
7.	अन्य अभिलेख	1.00 रूपए प्रति पेज

टिप्पणः- 1 दस्तावेजों की प्रतियां तब तक तैयार नहीं की जाएंगी जब तक आवेदक द्वारा विहित फीस संबंधित कार्यालय में अग्रिम में जमा न करवा दी गई हो।

2 एक बार भुगतान की गई प्रतिलिपि फीस का प्रतिदाय नहीं किया जाएगा।"

12. उक्त नियमों में, प्ररूप एस.आर.-II में, "फर्लांग पत्थर" शब्दों के स्थान पर, "किलोमीटर पत्थर" शब्द प्रतिस्थापित किए जाएंगे।HARYANA GOVT. GAZ. (EXTRA.), NOV. 27, 2024 (AGHN. 6, 1946 SAKA) 3805 13. उक्त नियमों में, प्ररूप एस.आर.-IV में,-

(i) खंड घ में, क्रम संख्या 2 में, "दूरभाष संख्या तथा ई-मेल आई.डी." शब्दों के बाद अंत में, ",यदि कोई हो" चिह्‌न तथा शब्द जोडे़ जाएंगे;

(ii) अन्त में विद्यमान मोहर में, "ई-मेल आई.डी." शब्दों के बाद, ",यदि कोई हो" चिह्‌न तथा शब्द जोडे़ जाएंगे। 14. उक्त नियमों में, प्ररूप सी.एल.-I से सी.एल.-VII का लोप कर दिया जाएगा।

15. उक्त नियमों में, प्ररूप सी.एल.यू.- II में, "उन्नीस सौ साठ" शब्दों के स्थान पर, "दो हजार" शब्द प्रतिस्थापित किए जाएंगे। 16. उक्त नियमों में, प्ररूप बी.के.-II में, क्रम संख्या 3 में, चार बार आने वाले "31 दिसम्बर, 19" अंकों, शब्द तथा चिह्‌न के स्थान पर, 31 दिसम्बर, 20 "अंक, शब्द तथा चिह्‌न प्रतिस्थापित किए जाएंगे।

17. उक्त नियमों में, अनुसूची- I से अनुसूची-III का लोप कर दिया जाएगा।

No. Misc-387-Vol-III/36679.— The following draft of rules further to amend the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Rules, 1965, in their application to the State of Haryana, which the Governor of Haryana proposes to make in exercise of the powers conferred under sub-section (1) read with sub-section (2) of section 25 of the Haryana Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 (Punjab Act 41 of 1963), is hereby published as required by sub-section (1) of the said section for the information of persons likely to be affected thereby.

Notice is hereby given that the draft of rules shall be taken into consideration by the Government on or after the expiry of a period of thirty days from the date of publication of this notification in the Official Gazette, together with objections or suggestions, if any, which may be received in writing by the Additional Chief Secretary to Government Haryana, Town and Country Planning Department, Chandigarh from any person with respect to the draft of rules, before the expiry of the period so specified.

Draft Rules

1. These rules may be called the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development (Haryana Second Amendment) Rules, 2024.

2. In the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Rules, 1965 (hereinafter called the said rules), in rule 3, for sub-rule (4), the following sub-rule shall be substituted, namely:-

"(4) The Director shall, on application by any person, make available the map referred to in sub-rule (1) and the register referred to in sub-rule (2), for inspection free of cost."

3. In the said rules, in rule 3A, in sub-rule (1), in the last line, for the word "form", the word "from", shall be substituted.

4. In the said rules, in rule 4, in sub-rule (1), in clause (a), for the sign "." existing at the end, the sign";" shall be substituted.

5. In the said rules, in rule 6, for the word "applicant", the words and signs "applicant by registered post/ speed post/e-mail" shall be substituted.

6. In the said rules, in rule 8, in sub-clause (c) of clause (ii), for the words "disposal of drainage and electricity and gas installations", the words and signs "disposal of drainage and garbage, and installation of electricity and gas " shall be substituted.

7. In the said rules, for rule 10, the following rule shall be substituted, namely:-

"10. Publication of final development plans, [Sections 5(7) and 25(2) (b)]- The development plan as notified by the Government under sub-section (7) of section 5 shall in addition to its publication in the Official Gazette be published by displaying a copy thereof at a conspicuous place at the each office of the- (i) Director;

(ii) Estate Officer, if any, having jurisdiction in the controlled area;

(iii) Deputy Commissioner of the district in which the controlled area is situated;

(iv) Panchayat Samiti or Samitis in which the controlled area is situated; and

(v) Municipal Committee, Municipal Council or Municipal Corporation in which the controlled area is situated."

8. In the said rules, rules 11 to 26 shall be omitted.

9. In the said rules, in rule 26A, in clause (1), for the digit, sign and words "1" to forty feet", the words and sign "one centimeter = ten meters" shall be substituted.

10. In the said rules, in rule 27, in sub-rule (2), for the digit, sign and word "1" to 40' ", the words and sign "one centimeter = ten meters" shall be substituted.

11. In the said rules, in rule 35, for the words "refuse to grant the same", existing at the end, the words "refuses to grant the same specifying reasons for such refusal in writing" shall be substituted.

12. In the said rules, for rule 127, the following rule shall be substituted, namely:-

"127. Copies and fees [sections 8(2) and 25 (2) (f)].- Copies of survey record, field books, plans, orders and other documents prepared under the Act shall be available on payment of the fees as mentioned in the table given below:-

1.	For copies of entries in the register or linear map prepared under rule 3-
	(a) Entries in register	Rs. 10.00 per entry
	( b) Linear map	Rs. 100 for every one kilometre of the road or part thereof indicated in the map.
2.	Copies of entries in the registers mentioned in rule 126	Rs. 10.00 per entry
3.	Copy of orders of the Director granting or refusing permission under section 8 of the Act.	Rs. 20.00 per order
4.	Copy of development plan drawing of a controlled area.	Rs. 100.00 per order.
5.	Copy of development plan including all enclosures	Rs. 300.00
6.	Duplicate licence	Rs. 100.00
7.	Other records	Rs. 1.00 per page

Note.- (1) Preparation of copies of documents shall not be undertaken unless the prescribed fee has been deposited by the applicant in advance in the office concerned.

(2) Copying fee once paid shall not be refunded.".

13. In the said rules, in Form SR-II, for the words "furlong stone", the words "Kilometer stone" shall be substituted.

14. In the said rules, in Form SR-IV,-

(i) in clause D, in serial number 2, after the words and signs. "telephone number and e-mail ID", the sign and words ", if any" shall be added at the end;

(ii) in the stamp existing at the end, after the words and sign "e- mail ID", the sign and words, ", if any" shall be added.

15. In the said rules, Forms CL-I to CL-VII shall be omitted.

16. In the said rules, in Form CLU-II, in the first line, for the words and sign "one thousand, nine hundred and sixty", the words "two thousand" shall be substituted.

17. In the said rules, in Form BK-II, in serial number 3, for the word, figures and sign "31st December, 19" occurring four times, the word, figures and sign "31st December, 20" shall respectively be substituted.

18. In the said rules, Schedule-I to Schedule-III shall be omitted.
