हरियाणा परिवार पहचान प्राधिकरण
अधिसूचना

सं. एचपीपीए/आरइजी-6.— हरियाणा परिवार पहचान अधिनियम, 2021 (2021 का अधिनियम संख्या 20) की धारा 31 की उपधारा (6) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हरियाणा परिवार पहचान प्राधिकरण परिवार सूचना डाटा कोष से डेटा या सूचना के आदान-प्रदान के संबंध में निम्नलिखित विनियम बनाता है
1. संक्षिप्त शीर्षक और प्रारंभः
(1) इन विनियमों को हरियाणा परिवार पहचान प्राधिकरण (डेटा साझाकरण) विनियम, 2024 कहा जाएगा। (2) ये हरियाणा परिवार पहचान प्राधिकरण द्वारा इनकी अधिसूचना की तिथि से लागू होंगे।
2. परिभाषाएँः
(1) इन विनियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न होः
(क) 'अधिनियम' का तात्पर्य है हरियाणा परिवार पहचान अधिनियम, 2021 (2021 का 20)।
(ख) 'अभिहित पोर्टल' का तात्पर्य है प्राधिकरण द्वारा इन विनियमों के तहत अधिसूचित पोर्टल। (ग) 'पात्र राज्य संस्था' का तात्पर्य है केंद्र सरकार, राज्य सरकार या राज्य सरकार के स्वामित्व और नियंत्रण वाला कोई बोर्ड, वैधानिक प्राधिकरण, विश्वविद्यालय, निगम या अन्य अभिकरण या राज्य में कोई स्थानीय प्राधिकरण से है।
(2) इन विनियमों में प्रयुक्त, लेकिन परिभाषित नहीं किए गए शब्दों और अभिव्यक्तियों के वही अर्थ होंगे, जो उन्हें अधिनियम में दिए गए हैं।
3. डेटा का प्रकार, जिसे साझा किया जा सकता है :
परिवार सूचना डाटा कोष से डेटा या जानकारी प्राधिकरण द्वारा पात्र राज्य संस्था के साथ केवल निम्नलिखित दो रूपों में साझा की जा सकती हैः
(क) सारांश डेटा : एकत्रित और अनामीकृत और संसाधित डेटा, जो किसी भी व्यक्तिगत परिवार के विशिष्ट विवरण को प्रकट नहीं करता है।

GAZ., JAN. 28, 2025 (MAGH. 8, 1946 SAKA) [PART III (ख) परिवार का डेटा : परिवार-विशिष्ट डेटा जो परिवार या उसके किसी या सभी सदस्यों की पहचान करता है और परिवार सूचना डाटा कोष में उनकी सम्बद्ध जानकारी को प्रकट करता है, लेकिन केवल किसी सरकारी योजना, सब्सिडी, सेवा या लाभ के प्रयोजनों के लिए या हरियाणा लोक सेवा आयोग, हरियाणा कर्मचारी चयन आयोग या केंद्र सरकार या राज्य सरकार की किसी अन्य भर्ती एजेंसी को प्रस्तुत डेटा के सत्यापन के लिए। 4. सारांश डेटा को साझा करनाः
(1) सारांश डेटा को किसी पात्र राज्य संस्था द्वारा अभिहित पोर्टल पर विशिष्ट अनुरोध करने पर साझा किया जाएगा।
बशर्ते कि मुख्य कार्यकारी अधिकारी अपेक्षित सारांश डेटा को, अभिहित पोर्टल के अलावा किसी पात्र राज्य संस्था के साथ उन मामलों में साझा कर सकता है, जहां ऐसी पात्र राज्य संस्था, मुख्य कार्यकारी अधिकारी की संतुष्टि के लिए यह स्थापित करती है कि ऐसे सारांश डेटा की एक आकस्मिक आवश्यकता है। (2) सारांश डेटा के लिए अनुरोध में उस उद्देश्य का उल्लेख किया जाएगा, जिसके लिए डेटा मांगा जा रहा है और परिणाम स्वरूप साझा किए गए डेटा का उपयोग बताए गए उद्देश्य तक ही सीमित होगा।
5. पारिवारिक डेटा साझा करनाः
(1) पारिवारिक डेटा केवल राज्य सरकार या किसी सरकारी एजेंसी या किसी स्थानीय प्राधिकरण द्वारा या उसकी ओर से प्रदान या कार्यान्वित किसी स्कीम, सेवा, सब्सिडी या लाभ के लिए पात्रता या प्रावधान निर्धारित करने या हरियाणा लोक सेवा आयोग, हरियाणा कर्मचारी चयन आयोग या केंद्र सरकार या राज्य सरकार के किसी अन्य भर्ती अभिकरण को प्रस्तुत डेटा के सत्यापन के उद्देश्य से एक पात्र राज्य साधन के साथ साझा किया जाएगा।
(2) पारिवारिक डेटा के लिए अनुरोध में उस योजना, लाभ, सब्सिडी या सेवा को निर्दिष्ट किया जाएगा जिसके लिए डेटा की आवश्यकता है और ऐसी योजना, सेवा, सब्सिडी या लाभ नियंत्रित करने वाले प्रावधानों के अनुसार होना चाहिए।
6. गोपनीयता और डेटा सुरक्षाः
(1) इन विनियमों के तहत साझा किए गए किसी भी डेटा का उपयोग केवल उन्हीं उद्देश्यों के लिए किया जाएगा, जिनके लिए इसका अनुरोध किया गया है और किसी अन्य उद्देश्य के लिए इसका उपयोग नहीं किया जाएगा। (2) डेटा प्राप्त करने वाली सभी संस्थाएं साझा किए गए डेटा को अनधि—त पहुंच, दुरुपयोग या प्रकटीकरण से बचाने के लिए पर्याप्त डेटा सुरक्षा और गोपनीयता सुनिश्चित करेंगी।

The 22nd January, 2025
No. HPPA/Reg.-06.— In exercise of the powers conferred by sub section (6) of Section 31 of the Haryana Parivar Pehchan Act, 2021 (Act No. 20 of 2021), the Haryana Parivar Pehchan Authority hereby enacts the following regulations concerning the sharing of data or information from the Family Information Data Repository:
1. Short Title and Commencement:
(1) These regulations may be called the Haryana Parivar Pehchan Authority (Data Sharing) Regulations, 2024.
(2) They shall come into force on the date of their notification by the Haryana Parivar Pehchan Authority.
2. Definitions:
(1) In these regulations, unless the context otherwise requires:
(a) "Act" means the Haryana Parivar Pehchan Act, 2021 (20 of 2021).
(b) "designated portal" means the portal to notified under these Regulations by the Authority.

GAZ., JAN. 28, 2025 (MAGH. 8, 1946 SAKA) 177(c) "Eligible State Instrumentality" means the Central Government, the State Government or any board, statutory authority, university, corporation or other agency owned and controlled by the State Government, or any local authority in the State.
(2) Words and expressions used but not defined in these regulations shall have the same meanings as assigned to them in the Act.
3. Forms of Data which may be shared:
Data or information from the Family Information Data Repository may be shared by the Authority with an Eligible State Instrumentality only in following two forms:
(a) Summary Data: Aggregated and anonymized and/or processed data that does not reveal specific details of any individual family.
(b) Family Data: Family-specific data that identifies the family or any or all of its members and discloses their associated information in the Family Information Data Repository but only for the purposes of any Government scheme, subsidy, service or benefit or for the verification of data submitted to the Haryana Public Service Commission, Haryana Staff Selection Commission or any other recruitment agency of the Central Government or the State Government.
4. Sharing of Summary Data:
(1) Summary Data shall be shared upon specific request, on the designated portal by an eligible state instrumentality.
Provided that the Chief Executive Officer may share the requisite Summary Data, other than on the designated portal with an eligible state instrumentality in cases where such eligible state instrumentality establishes, to the satisfaction of the Chief Executive Officer, that an emergent requirement of such Summary Data exists.
(2) The request for summary data shall clearly state the purpose for which the data is being sought and the data consequently shared shall be used limited to the stated purpose.
5. Sharing of Family Data:
(1) Family Data shall be shared with an eligible state instrumentality solely for the purpose of determining the eligibility for or provision of any scheme, service, subsidy or benefit provided or implemented by or on behalf of the State Government or any Government Agency or any local authority or for the verification of data submitted to the Haryana Public Service Commission, Haryana Staff Selection Commission or any other recruitment agency of the Central Government or the State Government. (2) The request for Family Data shall specify the scheme, benefit, subsidy or service for which the data is required and must be in accordance with the provisions governing such scheme, service, subsidy or benefit.
6. Confidentiality and Data Protection:
(1) Any data shared under these regulations shall be used strictly for the purposes for which it was requested and shall not be used for any other purpose.
(2) All entities receiving data shall ensure adequate data security and confidentiality to protect the shared data from unauthorised access, misuse or disclosure.
