सामाजिक न्याय, अधिकारिता, अनुसूचित जाति और पिछड़े वर्गों का कल्याण तथा अंत्योदय (सेवा) विभाग

अधिसूचना

दिनांक 31 जनवरी, 2025

संख्या 40/19/2023-4SW.— हरियाणा उभयलिंगी व्यक्ति (अधिकारों का संरक्षण) नियम, 2024 का निम्नलिखित प्रारूप, जिसे हरियाणा के राज्यपाल, उभयलिंगी व्यक्ति (अधिकारों का संरक्षण) अधिनियम, 2019 (2019 का केन्द्रीय अधिनियम 40) की धारा 22 की उप-धारा (1) तथा (2) के अधीन प्रदा शक्तियों का प्रयोग करतेे हुए, बनाने का प्रस्ताव करते है, उक्म उप-धारा (1) द्वारा यथा अपेक्षित इसके द्वारा उन सभी व्यक्तियों की जानकारी के लिए प्रकाषित किया जाता है, जिनके इससे प्रभावित होने की सम्भावना है;

इसके द्वारा नोटिस दिया जाता है कि इस अधिसूचना के राजपत्र में प्रकाशन की तिथि से तीस दिन की समाप्ति अथवा उसके पश्चात्‌ सरकार, नियमों के प्रारूप पर, ऐसे आक्षेपों या सुझावों, यदि कोई हों, के साथ, जो अपर मुख्य सचिव, हरियाणा सरकार, सामाजिक न्याय, अधिकारिता, अनुसूचित जाति और पिछड़े वर्गों का कल्याण तथा अंत्योदय (सेवा) विभाग हरियाणा, चण्डीगढ़ द्वारा किसी व्यक्ति से लिखित में नियमों के प्रारूप को सम्बन्ध में इस प्रकार विनिर्दिष्ट अवधि की समाप्ति से पूर्व प्राप्त किए जाएं, विचार करेगी।

प्रारूप नियम

1. (1) ये नियम हरियाणा उभयलिंगी व्यक्ति (अधिकारों का संरक्षण) नियम, 2024 कहे जा सकते है।

संक्षिप्त नाम और प्रारंभ। (2) ये राजपत्र में इनके प्रकाशन की तिथि से लागू होंगे।

परिभाषाएँ। 2. (1) इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो,-

(क) अधिनियम" से अभिप्राय है, उभयलिंगी व्यक्ति (अधिकारी का संरक्षण) अधिनियम, 2019

(2019 का केन्द्रीय अधिनियम 40);

(ख) "अपीलीय प्राधिकारी" से अभिप्राय है, निदेशक, सामाजिक न्याय, अधिकारिता, अनुसूचित जाति और पिछड़े वर्गों का कल्याण तथा अंत्योदय (एस.ई.डबल्यू.ए.) विभाग;

(ग) "आवेदक" से अभिप्राय है. उभयलिंगी व्यक्ति, जो नियम 3 के अधीन आवेदन प्रस्तुत

करता है;

(घ) आवेदन से अभिप्राय है, इन नियमों से यथा संलग्न आवेदन प्ररूप;

(च) "सरकार" से अभिप्राय है, प्रशासकीय विभाग में हरियाणा राज्य की सरकार;

(छ) "आधिकारिक दस्तावेजों" से अभिप्राय तथा में शामिल हैं अनुबंध में सूचीबद्ध

दस्तावेज;

(ज) "पहचान प्रमाणपत्र" से अभिप्राय है, जिला मजिस्ट्रेट द्वारा अधिनियम की धारा 6 या धारा 7 के अधीन क्रमशः प्ररूप-III अथवा प्ररूप-IV में जारी किया गया कोई इलेक्ट्रॉनिक प्रमाणपत्र;

(झ) "प्ररूप" से अभिप्राय है, इन नियमों से संलग्न प्ररूप;

(ञ) "पहचान पत्र" से अभिप्राय है, जिला मजिस्ट्रेट द्वारा अधिनियम की धारा 6 के अधीन किसी उभयलिंगी व्यक्ति को प्ररूप-V में जारी किया गया फोटो पहचानपत्र या जारी किए गए "पहचान प्रमाणपत्र" के आधार पर अधिनियम की धारा 7 के अधीन लिंग परिवर्तन पर किसी उभयलिंगी व्यक्ति को प्ररूप-VI में जारी किया गया फोटो पहचान पत्र;

(ट) "चिकित्सा संस्थान" से अभिप्राय है, ग्राणीण क्षेत्रों, या शहर क्षेत्रों या विदेश में कोई चिकित्सा संस्थान, चाहे वह अस्पताल हो या क्लिनिक, चाहे निजी हो या सार्वजनिक;

(ठ) "चिकित्सीय हस्तक्षेप" में किसी व्यक्ति द्वारा अपनी स्वतः पहचान वाले लिंग के परिवर्तन को सुकर बनाने के लिए अपने लिंग की पुष्टि करवाने के लिए चिकित्सा हस्तक्षेप शामिल है, इसमें परामर्ष हार्मोनल थेरेपी और सर्जिकल हस्तक्षेप, यदि कोई हों, शामिल हैं, लेकिन यह इन तक ही सीमित नहीं है;

(ड) "धारा" से अभिप्राय है, अधिनियम की कोई धारा;

(ढ) "कल्याण बोर्ड" से अभिप्राय है, हरियाणा उभयलिंगी कल्याण बोर्ड।

(2) इन नियमों में प्रयुक्त किन्तु अपरिभाषित किन्तु अधिनियम में परिभाषित शब्दों और अभिव्यक्तियों का वही अर्थ होगा, जो अधिनियम में उन्हें दिया गया है।

3. (1) कोई भी उभयलिंगी व्यक्ति, जो पहचान प्रमाणपत्र प्राप्त करने का इच्छुक है, यह प्ररूप-1 में जिला मजिस्ट्रेट को आवेदन प्रस्तुत करेगा।

पहचान प्रणाम पत्र जारी करने के लिए आवेदन। धारा 5

(2) आवेदन "सरल पोर्टल" अर्थात्‌ saralharyana.gov.in के माध्यम से जिला मजिस्ट्रेट को प्रस्तुत किया जाएगाः

परन्तु सरकार दूरदराज के क्षेत्रों अथवा वंचित परिस्थितियों में रहने वाले उभयलिंगी व्यक्तियों द्वारा पहचान प्रमाणपत्र के लिए आवेदन प्रस्तुत करने हेतु सुविधाएं उपलब्ध करवाने के लिए ऐसे उपयुक्त प्रयास, जो वह उचित समझे, कर सकती हैः

परन्तु यह और कि नाबालिग बालक की दशा में, ऐसा आवेदन, ऐसे नाबालिग बालक के माता-पिता अथवा अभिभावक द्वारा किया जाएगा और देखभाल और सुरक्षा की आवश्यकता वाले बालक की दशा में, किशोर न्याय (बालकों की देखभाल और संरक्षण) अधिनियम, 2015 (2016 का केन्द्रीय अधिनियम 2) के अधीन सक्षम प्राधिकारी द्वारा किया जाएगा।

(3) इन नियमों में दी गई किसी बात के होते हुए भी, अधिनियम के लागू होने से पूर्व, उभयलिंगी व्यक्तियों जिन्होंने पुरुष, महिला या उभयलिंगी के रूप में आधिकारिक तौर पर अपने लिंग में परिवर्तन दर्ज करवाया है, उन्हें इन नियमों के अधीन पहचान प्रमाणपत्र के लिए कोई आवेदन प्रस्तुत करने की आवश्यकता नहीं होगीः

परन्तु ऐसे सभी व्यक्ति अधिनियम के अधीन उभयलिंगी व्यक्तियों को प्रदत्त सभी अधिकारों और हकदारियों का उपभोग करेंगे।

पहचान प्रणाम पत्र जारी करने की प्रक्रिया। धारा 5

4. (1) जिला मजिस्ट्रेट, आवेदक के विवरणों के सहीपन के अध्यधीन, 10 रुपए के गैर-न्यायिक स्टाम्प पेपर पर मुहर के साथ नोटरी द्वारा प्रमाणित प्ररूप-II में किसी व्यक्ति के लिंग पहचान की घोषणा करने सम्बन्धी प्रस्तुत शपथ-पत्र, के आधार पर, बिना किसी चिकित्सीय या शारीरिक परीक्षण के बिना, आवेदन पर कार्यवाही करेगा और इसके बाद आवेदक को एक पहचान संख्या जारी करेगा, जिसे आवेदन के प्रमाण के रूप में उद्धत किया जा सकता है।PART I] HARYANA GOVT. GAZ., FEB. 11, 2025 (MAGH. 22, 1946 SAKA) 129 (2) निवास स्थान के निर्धारण के प्रयोजन के लिए, आवेदक, आवेदन प्रस्तुत करने की तिथि से ऐसे आवेदक की पारिवारिक आईडी के संबंध में परिवार पहचान डेटा कोष की जानकारी के आधार पर जिला मजिस्ट्रेट की अधिकारिता में आने वालेे क्षेत्र का निवासी होना चाहिए और ऐसे इस आषय का एक शपथ पत्र प्ररूप-II में प्रस्तुत किया जाएगा।

पहचान प्रणाम पत्र जारी करना। धारा 6 5. (1) जिला मजिस्ट्रेट, नियम 4 में निर्धारित प्रक्रिया का पालन करते हुए प्ररूप-III में ऐसे व्यक्ति के लिंग को दर्शाते हुए आवेदक को शपथ-पत्र सहित विधिवत्‌ भरे गए आवेदन की प्राप्ति की तिथि से तीस दिन की अवधि के भीतर पहचान प्रमाण-पत्र जारी करेगा।

(2) उप-नियम (1) के अधीन जारी किया गया पहचान प्रमाणपत्र उक्त पहचान प्रमाण पत्र में विनिर्दिष्ट लिंग के अनुसार अनुबंध में सूचीबद्ध ऐसे सभी आधिकारिक दस्तावेजों में उभयलिंगी व्यक्ति के लिंग के साथ-साथ उसका नाम और फोटो, यदि आवश्यक हो, को बदलने का आधार होगा।

(3) जिला मजिस्ट्रेट उप-नियम (1) के अधीन पहचान प्रमाणपत्र जारी करते समय, आवेदक को प्ररूप-V में एक उभयलिंगी पहचानपत्र जारी करेगा। (4) जिला मजिस्ट्रेट द्वारा इस प्रकार जारी किया गया पहचान प्रमाणपत्र परिवार पहचान डेटा कोष को इलेक्ट्रॉनिक रूप में उपलब्ध करवाया जाएगा और ऐसे आवेदक से सम्बन्धित डेटा ऐसे कोष में स्वचालित रूप से अपडेट किया जाएगा।

(5) नागरिक संसाधन सूचना विभाग, पहचान प्रमाणपत्र और उभयलिंगी पहचान पत्र जारी करने के लिए एक रजिस्टर बनाए रखेगा। (6) नियम 3 के अधीन आवेदक द्वारा किए गए आवेदन पर, प्राधिकारी, जिसने आधिकारिक दस्तावेज़ जारी किया है, ऐसे आवेदन किए जाने के पन्द्रह दिन के भीतर आधिकारिक दस्तावेज़ों में आवेदक का नाम या लिंग या फोटो या इनमें से किसी भी सूचना को परिवर्तित करेगा।

(7) कोई भी आधिकारिक दस्तावेज, जिसमें उभयलिंगी के लिंग, नाम तथा फोटो को उका पहचान प्रमाणपत्र के आधार पर पुनरीक्षित किया जाता है, तो उसमें वही क्रमांक या संदर्भ संख्या होगी, जो मूल आधिकारिक दस्तावेज़ में हैः

परन्तु सभी लाभ, जो कोई उभयलिंगी व्यक्ति केन्द्रीय प्राधिकारी द्वारा जारी किए गए पहचानपत्र, यदि कोई हो, के आधार पर पाने का हकदार था, इन नियमों के अधीन जारी किए गए पहचान प्रमाणपत्र के आधार पर उस उभयलिंगी व्यक्ति द्वारा प्राप्त किए जाते रहेंगे।

लिंग परिवर्तन करने के लिए पहचान प्रमाणपत्र जारी करने की प्रक्रिया। धारा 7 6. (1) यदि कोई उभयलिंगी व्यक्ति, चाहे पुरुष अथवा महिला के रूप में लिंग पुष्टि प्रक्रिया के लिए चिकित्सा हस्तक्षेप करवाता है, तो ऐसा व्यक्ति उस चिकित्सा संस्था, जिसमें उस व्यक्ति ने उक्त चिकित्सा हस्तक्षेप करवाया है, के चिकित्सा अधीक्षक या मुख्य चिकित्सा अधिकारी द्वारा इस आशय के लिए जारी किए गए प्रमाणपत्र के साथ पुनरीक्षित पहचान प्रमाणपत्र जारी करने के लिए जिला मजिस्ट्रेट को प्ररूप-1 में आवेदन कर सकता हैः

परन्तु आवेदक वर्तमान में आवेदन की तिथि को जिला मजिस्ट्रेट की अधिकारिता में निवास कर रहा हो और इस आशय का एक शपथ पत्र, आवेदन के साथ प्ररूप-1 में प्रस्तुत किया जाएगा तथा कोई और अतिरिक्त प्रमाण नहीं मांगा जाएगा।

(2) जिला मजिस्ट्रेट, उप-नियम (1) में विनिर्दिष्ट आवेदन की प्राप्ति पर उक्त चिकित्सा प्रमाणपत्र के सही होने बारे सत्यापन करेगा, जिसमें कोई शारीरिक परीक्षण शामिल नहीं होगा।

7. (1) जिला मजिस्ट्रेट्‌, घारा 7 के अधीन लिंग परिवर्तन चाहने वाले आवेदक को प्ररूप-IV मे पहचान का प्रमाणपत्र जारी करेगा, जिसमें ऐसे व्यक्ति के लिंग को पुरुष अथवा महिला, जैसी भी स्थिति हो, के रूप में दर्शाया जाएगा।

लिंग परिवर्तन के बाद पहचान प्रमाणपत्र जारी करने की प्रक्रिया। धारा 7 (2) जिला मजिस्ट्रेट, आवेदन प्राप्त होने की तिथि से पन्द्रह दिन के भीतर उप-नियम (1) के अधीन प्रमाणपत्र जारी करेगा।

(3) उप-नियम (1) के अधीन जारी किया गया पहचान प्रमाणपत्र, आवेदक को अनुबंध में सूचीबद्ध ऐसे सभी आधिकारिक दस्तावेजों में उभयलिंगी व्यक्ति के लिंग, फोटो के साथ-साथ नाम को रिकॉर्ड करने या उनमें बदलाव करने के लिए पात्र बनाएगा, जो उक्त प्रमाणपत्र में विनिर्दिष्ट पुरुष अथवा महिला, जैसी भी स्थिति हो के अनुसार होगा।

(4) जिला मजिस्ट्रेट, लिंग परिवर्तन के लिए पहचान प्रमाणपत्र जारी करते समय इसके साथ-साथ आवेदक को प्ररूप-VI में एक पहचान पत्र भी जारी करेगा।130 HARYANA GOVT. GAZ., FEB. 11, 2025 (MAGH. 22, 1946 SAKA) [PART I (5) उप-नियम (3) के अधीन किसी आवेदक द्वारा किए गए आवेदन पर अनुबंध में यथा विनिर्दिष्ट आधिकारिक दस्तावेज जारी करने वाला प्राधिकारी, ऐसे आवेदन के पन्द्रह दिन के भीतर आधिकारिक दस्तावेज़ों में आवेदक का नाम या लिंग या फोटो या इनमें से किसी भी जानकारी में बदलाव करेगा। (6) कोई भी आधिकारिक दस्तावेज, जिसमें पहचान के उक्त प्रमाणपत्र के आधार पर उभयलिंगी व्यक्ति के लिंग, नाम या फोटो को पुनरीक्षित किया जाता है. तो उसमें वही क्रमांक या संदर्भ संख्या होगी, जो मूल आधिकारिक दस्तावेज़ में हैः

परन्तु लिंग में ऐसा परिवर्तन और उप-नियम (1) के अधीन पुनरीक्षित प्रमाणपत्र जारी करने से इस अधिनियम के अधीन ऐसे व्यक्ति के अधिकारों और हकदारियों पर कोई प्रभाव नहीं पड़ेगा। आवेदन को अस्वी—त करने सूचना। धारा 22 (2) (ज)

8. (1) नियम 3 के अधीन किए गए आवेदन की अस्वी—त करने के मामले में जिला मजिस्ट्रेट, की ऐसे आवेदन की प्राप्ति की तिथि से तीस दिन के भीतर आवेदक को ऐसी अस्वी—ति के कारण सूचित करेगा। (2) जिला मजिस्ट्रेट, ऐसी अस्वी—ति की तिथि से साठ दिन के भीतर, उप-नियम (1) में सूचित किए गए अस्वी—ति के कारणों के संबंध में आवेदक द्वारा प्रस्तुत उत्तर के आधार पर आवेदन की अस्वी—ति के निर्णय की समीक्षा कर सकता है।

9. आवेदक को आवेदन की अस्वी—त करने की सूचना की तिथि से नब्बे दिन के भीतर अपीलीय प्राधिकारी को अपील करने का अधिकार होगाः

अपील का अधिकार। धारा 22 (2) (ज)

परन्तु अपीलीय प्राधिकारी उक्त अवधि की समाप्ति के बाद किसी अपील पर विचार कर सकता है, यदि उसकी संतुष्टि हो जाती है कि आवेदक को समय पर अपील करने से पर्याप्त कारणों से रोका गया था।

10. जिला मजिस्ट्रेट, उभयलिंगी व्यक्तियों को गलत तरीके से जारी किए गए पहचान प्रमाणपत्र के संबंध में शिकायत की प्राप्ति पर, विस्तृत जांच करने के बाद उक्त प्रमाणपत्र को रद्द कर सकता है। पहचान प्रमाण पत्र रददकरण। धारा 22 (2) (ज)

11. (1) सरकार, उभयलिंगी व्यक्तियों के अधिकारों और हितों की रक्षा करने के लिए कल्याणकारी योजनाएं बनाएगी और कल्याण बोर्ड के माध्यम से कल्याणकारी योजनाओं तक उनकी पहुँच को सुकर बनाएगी।

उभयलिंगी व्यक्तियों के कल्याण संबंधी उपाय। बारा 13, 14, तथा 15 (2) सरकार, उभयलिंगी व्यक्तियों के अधिकारों के संरक्षण के लिए, इन नियमों के लागू होने की तिथि से दो वर्ष के भीतर, संस्थागत और बुनियादी सुविधाएं, पुनर्वास केन्द्र, अस्थायी आश्रय, अल्पावास गृह और आवास, अस्पतालों में अलग वार्ड और प्रतिष्ठानों में शौचालय बनाएगी।

(3) प्रत्येक प्रतिष्ठान, उभयलिंगी व्यक्तियों के प्रति व्यवहार में उचित परिवर्तन विकसित करने के लिए हितधारकों को प्रशिक्षण और शिक्षा प्रदान करेगा।

(4) सभी शैक्षणिक संस्थानों में एक समिति होगी, जो किसी भी उत्पीड़न या भेदभाव के मामले में उभयलिंगी व्यक्तियों के लिए सुगम्य होगी, जिसको यह सुनिश्चित करने की शक्तियां होगी कि उभयलिंगी छात्रों को, अध्यापकों सहित उन्हें उत्पीड़ित करने वाले व्यक्तियों की उपस्थिति से त्रस्त होने की आवश्यकता नहीं है।

भेदभाव के विरूद्ध उपबंध। धारा 3

12. (1) सरकार, शिक्षा, भर्ती, रोजगार, स्वास्थ्य देखभाल को बढ़ावा देने, सार्वजनिक परिवहन, खेल-कूद, विश्राम, मनोरंजन और सार्वजनिक या असार्वजनिक कार्यालय में कार्य करने के अवसर सहित किसी भी सरकारी या निजी संगठन में भेदभाव को रोकने के लिए पर्याप्त कदम उठाएगी।

(2) सरकार, उभयलिंगी व्यक्तियों के विरुद्ध अधिनियम की धारा 18 या किसी अन्य विधि के अधीन अभियोजित किए गए समान अपराधों के लिए व्यक्तियों के पर्यवेक्षण के लिए उत्तरदायी होगी। रोजगार के समान अवसर। धारा 9

13. (1) प्रत्येक प्रतिष्ठान, एक सुरक्षित कामकाजी माहौल प्रदान करने के लिए और यह सुनिश्चित करने के लिए सभी उपायों को लागू करेगा कि समान रोजगार के अवसरों से संबंधित किसी भी मामले में किसी भी उभयलिंगी व्यक्ति के साथ भेदभाव न किया जाए, जिसमें बुनियादी समायोजन, भर्ती, रोजगार लाभ, पदोन्नति और अन्य मामले भी शामिल है, लेकिन यह इन्हीं तक सीमित नहीं हैं।

(2) प्रत्येक प्रतिष्ठान, उभयलिंगी व्यक्तियों के लिए समान अवसर नीति प्रदान करेगा। (3) प्रतिष्ठान, अधिमानतः अपनी वेबसाइट पर शिकायत अधिकारी के विवरण सहित समान अवसर नीति को प्रदर्शित करेगा, ऐसा न कर पाने की स्थिति में, अपने परिसर में, विशिष्ट स्थानों पर इसे प्रदर्शित करेगा।PART I] HARYANA GOVT. GAZ., FEB. 11, 2025 (MAGH. 22, 1946 SAKA) 131 (4) किसी प्रतिष्ठान की समान अवसर नीति में, अन्य बातों के साथ-साथ, निम्नलिखित विवरण भी शामिल होंगे, अर्थात्‌ः- (क) उभयलिंगी व्यक्तियों को बुनियादी ढांचागत सुविधाएं (जैसे कि यूनिसेक्स शौचालय), सुरक्षा और संरक्षा के लिए उपाय (परिवहन और गार्ड) और सुविधाएं (जैसे कि स्वच्छता उत्पाद) प्रदान की जाएंगी, ताकि वे प्रतिष्ठान में अपने कर्तव्यों का प्रभावी रूप से निर्वहन करने में सक्षम हो सकें।

(ख) कर्मचारियों की सेवा शर्ताें के संबंध में प्रतिष्ठान के सभी नियमों और विनियमों की

प्रयोज्यता;

(ग) कर्मचारियों के लिंग की पहचान गोपनीय रखना; (घ) शिकायत अधिकारियों का ब्यौरा। 14. (1) प्रत्येक प्रतिष्ठान, इन नियमों को अधिसूचित करने की तिथि से तीस दिन की अवधि के

भीतर अधिनियम की धारा 11 के अनुसार एक शिकायत अधिकारी पदाभिहित करेगा।

शिकायत निवारण। धारा II (2) शिकायत अधिकारी, शिकायत प्राप्त होने की तिथि से पन्द्रह दिन के भीतर इन शिकायतों

की जांच करेगा।

(3) प्रतिष्ठान का प्रमुख, रिपोर्ट प्रस्तुत करने की तिथि से पन्द्रह दिन के भीतर शिकायत

अधिकारी द्वारा प्रस्तुत की गई जांच रिपोर्ट पर कार्रवाई करेगा।

(4) राज्य स्तर पर, संयुक्त निदेशक, सामाजिक न्याय, अधिकारिता, अनुसूचित जाति और पिछड़ा वर्ग कल्याण और अंत्योदय (सेवा) विभाग और जिला स्तर पर, जिला समाज कल्याण अधिकारी को अधिनियम के अध्याय V, विशेषकर धारा 12 की उपधारा (1) और (2) के संदर्भ में, के उपबंधों के सुकर कार्यान्वयन को सुनिश्चित करने के लिए शिकायत निवारण अधिकारियों के रूप में पदाभिहित किया जाता है।

(5) प्रत्येक शिकायत निवारण अधिकारी, उसके संज्ञान में शिकायत लाए जाने की तिथि से

तीस दिन के भीतर शिकायतों का समाधान सुनिश्चित करेगा।

Notification

The 31st January, 2025

No. 40/19/2023-4SW.— The following draft of the Haryana Transgender Persons (Protection of Rights) Rules, 2024, which the Governor of Haryana proposes to make in exercise of the powers conferred under Sub Section (I) and (2) of Section 22 of the Transgender Persons (Protection of Rights) Act, 2019 (Central Act 40 of 2019), is hereby published as required under Sub Section (I) of the said section for information of persons likely to be affected thereby.

Notice is hereby given that the drat of rules shall be taken into consideration after the expiry of a period of thirty days from the date publication of this notification in the Official Gazette together with objections or suggestions, if any, which may be received by the Additional Chief Secretary to Government Haryana, Social Justice, Empowerment, Welfare of Scheduled Castes and Backward Classes and Antyodaya (SEWA) Department from tany person with respect to the draft of the rules before the expiry of the period so specified.

DRAFT RULES

Short title and commencement

1. (1) These rules may be called the Haryana Transgender Persons (Protection of Rights) Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

Definitions 2. (1) In these rules, unless the context otherwise requires:-

(a) "Act" means the Transgender Persons (Protection of Rights) Act, 2019

(Central Act 40 of 2019);

(b) "Appellate authority" means the Director, Social Justice, Empowerment, Welfare of Scheduled Castes and Backward Classes and Antyodaya (SEWA) Department Haryana;

(c) "Applicant" means a transgender person who submits an application under

rule 3;

(d) "Application" means the application form as annexed with these rules;

(e) "District Magistrate" means the Magistrate of the concerned district; (f) "Government" means the Government of the State of Haryana in the

administration department;

(g) "Official documents" means and include the documents listed in the

Annexure;

(h) "Certificate of Identity" means an electronic certificate issued by the District Magistrate under section 6 or section 7 of the Act in the Form-III or Form-IV respectively;

(i) "Form" means a form annexed to these rules;

(j) "Identity Card" means a photo identity card issued in Form-V to a transgender person under section 6 of the Act or issued in Form-VI to transgender person on change of gender under section 7 of the Act on the basis of certificate of identity issued by the District Magistrate;

(k) "Medical Institution" means any medical institution whether hospital or clinic,

private or public, in rural or urban areas or overseas;

(l) "Medical Intervention" includes any gender affirming medical intervention undertaken by an individual to facilitate the transition to their self-identified gender, including but limited to counselling, hormonal therapy and surgical intervention, if any;

(m) "Section" means a section of the Act;

(n) "Welfare Board" means the Haryana Transgender Welfare Board (2) Words and expressions used herein but not defined and defined in the Act shall have the same meaning as assigned to them in the Act.

3. (1) Any transgender person desirous of obtaining a certificate of identity shall make an application in Form-I to the District Magistrate.

Application for certificate of identity, section 5 (2) The applicant shall be submitted to the District Magistrate through 'saral portal' i.e. saralharyana.gov.in;

Provided that the Government may undertake such measures, as it deems appropriate, to facilitate the submission of applications for transgender persons living in remote areas or disadvantaged conditions.

Provided further that in case of a minor child, such application shall be made by a parent or guardian of such minor child and in the case of a child in need of care and protection, by the competent authority under the Juvenile Justice (Care and Protection of Children) Act, 2015 (Central Act No.2 of 2016).

(3) Notwithstanding anything contained in these rules, Transgender person who has officially recorded his change in gender, whether as male, female or transgender, prior to the coming into force of the Act shall not be required to submit an application for certificate of identity under these rules.

Provided that all such persons shall enjoy all rights and entitlements conferred on transgender persons under the Act.

Procedure for issue of certificate of identity. Section 5 4. (1) The District Magistrate shall, subject to the correctness of the applicant's particulars, get the application processed based on the affidavit on Non-Judicial stamp paper of Rs. 10/- attested by Notary with seal, submitted declaring he gender identity of the person in Form-II, without any medical or physical examination and after there issue an identity number to the applicant, which may be quoted as proof of application.

(2) For the purpose of determination of the place of residence, the applicant shall have to reside in the area based on the information in Family Identification Data Repository in respect of the Family ID of such applicant under the jurisdiction of District Magistrate as on the date of application and an affidavit to this effect shall be submitted in Form-II.

Issue of certificate of identity section 6 5. (1) The District Magistrate shall issue a certificate of identity in Form-III within a period of thirty days from the date or receipt of duly filled in application along with the affidavit to the applicant by following the procedure provided in rule 4 indicating the gender of such person.

(2) The certificate of identity issued under sub-rule (1) shall be the basis to change the gender as well as the name and the photograph, if so necessitated, of the transgender person in all such official documents listed in Annexure, in accordance with gender specified in the said certificate of identity.

(3) The District Magistrate shall, at the time of issuance of the certificate of identity under sub-rule (1), issue a transgender identity card in Form-V to the applicant.

(4) The certificate of identity so issued by the District Magistrate shall be electronically provided to the Family Identity Data Repository and the data in such repository in respect of such applicant shall be automatically updated.

(5) The Citizen Resources Information Department shall maintain a register for the issuance of certificate of identity and the transgender identity card.

(6) The authority issuing the official document as specified in the Annexure, on an application made by an applicant under rule 3, shall change the name or gender or photograph or any of the information of applicant in the official documents within fifteen days of making of such application.

(7) Any official document wherein gender, name or the photograph of transgender are revised based on the said certificate of identity, shall bear the same serial of reference number as in the original official document.

Provided that all benefits that a transgender person was entitled to avail based on the identity card, if any issued by a Central Authority, shall continue to be enjoyed by that transgender person based on the certificate of identify issued under these rules.

Procedure for issue of a certificate of identity for change of gender Section 7

6. (1) If a transgender person undergoes medical intervention towards a gender affirming procedure, either as a male or female, such person may apply in Form-I, along with a certificate issued to that effect by the Medical Superintendent or Chief Medical Officer of the medical institution in which that person has undergone the said medical intervention, to the District Magistrate for the issue of a revised certificate of identity.

Provided that the applicant shall be currently residing in the area under the jurisdiction of the District Magistrate as on the date of application and an affidavit to this effect shall be submitted along with the application in Form-I and no additional evidence shall be called for.

(2) The District Magistrate, on receipt of an application referred to in sub-rule (1), shall verify the genuineness of the said medical certificate, which shall not include any physical examination.

7. (1) The District Magistrate shall issue a certificate of identity in Form-IV to the applicant seeking change in gender, indicating the gender of such a person as male or female, as the case may be.

Issue of certificate of identity after change in gender Section 7

(2) The District Magistrate shall issue the certificate under sub-rule (1) within fifteen days from the date of receipt of the application.

(3) The certificate of identity issued under sub-rule (1), shall entitle the applicant to record or change the gender, as well as the photograph and name, if so necessitated, of transgender person in all such official documents listed in the annexure, in accordance with the gender specified in the said certificate of identity as male or female, as the case may be.

(4) The District Magistrate while issuing the certificate of identity for change of gender shall simultaneously issue an identity card in Form-VI to the applicant.

(5) The authority issuing the official document as specified in the Annexure, on an application made by an applicant under sub-rule (3), shall change the name or gender or photograph or any of this information of the applicant in the official documents within fifteen days of making of such application.

(6) Any official document wherein gender, name or photograph of transgender person is revised based on the said certificate of identity, shall bear the same serial or reference number as in the original official document:

Provided that such change in gender and the issue of revised certificate under sub-rule 1 shall not affect the rights and entitlements of such person under this Act.

8. (1) In case of rejection of application made under rule 3, the District Magistrate shall inform the applicant the reason for such rejection within thirty days from the date of receipt of such application.

Communication in case rejection of application section 22(2) (h)

(2) The District Magistrate may within sixty days from the date of such rejection, review the decision of rejection of the application based on the reply submitted by the applicant regarding the reason for rejection communicated in sub-rule (1).

Right to appeal, section 22(2) (h)

9. The applicant shall have a right to appeal, within ninety days from the date of intimation of the rejection of the application, to the Appellate Authority:

Provided that the Appellate Authority may entertain an appeal after the expiry of the said period, if it is satisfied that the applicant was prevented by sufficient cause from preferring an appeal in time.

10. The District Magistrate, on receipt of complaint in respect of issuance of certificate of identity for transgender persons wrongfully, may cancel the said certificate after conducting a detailed inquiry.

Cancellation of certificate of identity section 22 (2) (h)

11. (1) The Government shall formulate welfare schemes to protect the rights and interests of transgender persons and facilitate their access to the welfare schemes through the Welfare Board.

Welfare measures for transgender persons, section 13, 14 and 15

(2) The Government shall create institutional and infrastructure facilities, rehabilitation centre, temporary shelters, short stay home and accommodation, separate wards in hospitals and wash rooms in establishments, within two years from the date of coming into force of these rules, to protect the rights of transgender persons.

(3) Every establishment shall provide training and education to stakeholders in developing appropriate change in behaviour towards transgender persons.

(4) All educational institutions shall have a committee which shall be accessible for transgender persons in case of any harassment or discrimination, with powers to ensure that transgender students do not have to be affected by the presence of the persons bullying them, including teachers.

Provisions against discrimination, Section 3 12. (1) The Government shall take adequate steps to prohibit discrimination in any Government or private organization including in the areas of educating, recruitment, employment, promotion of health case, public transpiration, sports, leisure, recreation and opportunity to hold public or private office.

(2) The Government shall be responsible for the supervision of timely prosecution of individuals charged under 18 of the Act, or under any other law for similar offences committed against the transgender persons.

Equal opportunity in employment, Section 9 13. (1) Every establishment shall implement all measures for providing a safe working environment and to ensure that no transgender person is discriminated in any matter relating to equal employment opportunities including, but not limited to, infrastructure adjustments, equipment, employment benefits, promotion and other related issues.

(2) Every establishment shall provide an equal opportunity policy for transgender persons.

(3) The establishment shall display the equal opportunity policy, including the details of the complaints officer, preferably on their website, failing which, at conspicuous places in their premises.

(4) The equal opportunity policy of an establishment shall, inter-alia, contain the following details, namely:-

(a) Infrastructural facilities (such as unisex toilets), measures put in for safety security (transportation and guards) and amenities (such as hygiene products) to be provided to the transgender persons so as to enable them to effectively discharge their duties in the establishment;

(b) Applicability of all rules and regulations of the establishment regarding

service conditions of employees:

(c) Confidentiality of the gender identity of the employees:

(d) Complaints of the officers.

14. (1) Every establishment shall designate a complaint officer in accordance with section 11 of the Act, within a period of thirty days from the date of notifying of these rules.

Grievance redressal, Section 11 (2) The complaint officer shall enquire into a complaint received within fifteen days from the date of its receipt.

(3) The head of establishment shall take action on the enquiry report submitted by the complaint officer within fifteen days from the date submission of the report.

(4) The Joint Director, Social Justice, Empowerment, Welfare of Scheduled Castes and Backward Classes and Antyodaya (SEWA) Department at State Level and District Social Welfare Officer in District are designated as Grievance Redressal Officers for ensuring proper implementation of the provisions of Chapter V of the Act with special reference to sub-sections (1) and (2) of section 12.

(5) Every grievance redressal officer shall ensure resolution of grievances within thirty days from the date on which the grievance is brought to his/her notice.

(6) The Government shall put in place a monitoring system for tracking the number of complaints filed, enquired and action taken of all the establishments in their jurisdiction.
