संख्या 10/40/2023-2जे.जे.-1.- भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदा शक्तियों का प्रयोग करते हुए, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा राज्य अभियोजन विभाग विधिक सेवा (ग्रुप क) नियम, 2013 को आगे संषोधित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्ः- 1. (1) ये नियम हरियाणा राज्य अभियोजन विभाग विधिक सेवा (ग्रुप क) संषोधन नियम, 2025 कहे जा सकते हैं। (2) ये नियम राजपत्र में इनके प्रकाषन की तिथि से लागू होंगे।
2. हरियाणा राज्य अभियोजन विभाग विधिक सेवा (ग्रुप क) नियम, 2013 (जिन्हें, इसमें, इसके बाद, उक्त नियम कहा गया है) में, नियम 9 में, उप-नियम (1),-
I. खण्ड (ख) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किए जाएंगे, अर्थात् :-
''(ख) अपर निदेषक की दषा में,-
(i) उप निदेषक अभियोजन में से पदोन्नति द्वारा; या
(ii) किसी राज्य सरकार या भारत सरकार के अभियोजन विभाग में समकक्ष पद पर नियमित सेवा में पहले से लगे हुए किसी अधिकारी के स्थानांतरण या प्रतिनियुक्ति द्वारा;
(खक) उप निदेषक अभियोजन की दषा में,-
(i) सहायक निदेषक अभियोजन में से पदोन्नति द्वारा; या
(ii) किसी राज्य सरकार या भारत सरकार के अभियोजन विभाग में समकक्ष पद पर नियमित सेवा में पहले से लगे हुए किसी अधिकारी के स्थानांतरण या प्रतिनियुक्ति द्वारा;
टिप्पणः- प्रथम दृष्टांत, यदि अपेक्षित अनुभव के साथ सहायक निदेषक अभियोजन उपलब्ध नहीं है, नए पद का सृजन होते हुए, पद ज्येष्ठता एवं मेरीट के आधार पर जिला न्यायवादियों में से भरे जाएंगे, जो भारतीय नागरिक सुरक्षा संहिता, 2023 (2023 का केन्द्रीय अधिनियम 45) की धारा 18(9) के साथ

(EXTRA.), DEC. 18, 2025 (AGHN. 27, 1947 SAKA) 3671 पठित धारा 20 की उपधारा (2) की अपेक्षाओं के अनुसार हरियाणा राज्य अभियोजन विभाग विधिक सेवा (ग्रुप क) सेवा तथा/अथवा हरियाणा राज्य अभियोजन विभाग विधिक सेवा (ग्रुप ख) सेवा के सदस्य और अधिवक्ता के रूप में पन्द्रह वर्ष का संयुक्त अनुभव रखते हाें;
(खख) सहायक निदेषक अभियोजन की दषा में,-
(i) जिला न्यायवादियों में से पदोन्नति द्वारा; या
(ii) किसी राज्य सरकार या भारत सरकार के अभियोजन विभाग में समकक्ष पद पर नियमित सेवा में पहले से लगे हुए किसी अधिकारी के स्थानांतरण या प्रतिनियुक्ति द्वारा; "; तथा
II. खण्ड (घ) के स्थान पर, निम्नलिखित खण्ड प्रतिस्थापित किया जाएगा, अर्थात्ः-
"(घ) उप जिला न्यायवादी की दषा में,-
(i) 25 प्रतिषत सीधी भर्ती द्वारा ; तथा
(ii) 75 प्रतिषत सहायक जिला न्यायवादियों में से पदोन्नति द्वारा; या
(iii) किसी राज्य सरकार या भारत सरकार के अभियोजन विभाग में समकक्ष पद पर नियमित सेवा में पहले से लगे हुए किसी अधिकारी के स्थानांतरण या प्रतिनियुक्ति द्वारा;"।
3. उक्त नियमों में, परिषिष्ट क, ख, ग तथा घ के स्थान पर, निम्नलिखित परिषिष्ट प्रतिस्थापित किए जाएंगे, अर्थात्ः-

The 18th December, 2025
No. 10/40/2023-2JJ(I).— In exercise of the powers conferred under the proviso to Article 309 of the Constitution of India, the Governor of Haryana hereby makes the following rules further to amend the Haryana State Prosecution Department Legal Service (Group A) Rules, 2013, namely:-
1. (i) These r ules may be called the Haryana State Prosecution Department Legal Services (Group A) Amendment Rules, 2025.
(ii) They shall come into force from the date of their publication in Official Gazette.
2. In the Haryana State Prosecution Department Legal Service (Group A) Rules, 2013, (hereinafter called the said rules), in rule-9, in sub-rule (1),-
1. for clause (b), the following clause shall be substituted, namely:-
"(b) In the case of Additional Director of Prosecution–
(i) by promotion from amongst the Deputy Director of Prosecution;
(ii) by transfer or deputation of an officer already in regular service on an equivalent post in Prosecution Department of any State Government or the Government of India.
(ba) in the case of Deputy Director of Prosecution –
(i) by promotion from amongst the Assistant Director of Prosecution; or
(ii) by transfer or deputation of an officer already in regular service on an equivalent post in Prosecution Department of any State Government or the Government of India.
Note:- In the first instance, if no Assistant Director of Prosecution with requisite experience is available, being newly created post, then the post may be filled up on seniority-cum-merit basis from amongst District Attorney, having combined experience of 15 years as a member of the Haryana Prosecution Department (Group-A) Legal Service and/or Haryana Prosecution Department (Group-B) Legal Service and an Advocate as per the requirement of section 20(2) read with section 18(9) of Bhartiya Nagrik Suraksha Sanhita, 2023 (Central Act of 2023).
(bb) in the case of Assistant Director of Prosecution-
(i) by promotion from amongst the District Attorney;
(ii) by transfer or deputation of an officer already in regular service on an equivalent post in Prosecution Department of any State Government or the Government of India." (II) for clause (d), the following clause shall be substituted, namely:-
"(d) In the case of Deputy District Attorney –
(i) 25% by direct recruitment; and
(ii) 75% by Promotion from amongst Assistant District Attorney; or
(iii) by transfer or deputation of an officer already in regular service on an equivalent post in Prosecution Department of any State Government or the Government of India." 3. In the said rules, for Appendices A, B, C and D, the following Appendices shall be substituted, namely:-
