अधिसूचना

संख्या 9/124/2025-4CII.— हरियाणा नगरपालिका अधिनियम, 1973 (1973 का 24) की धारा 200 के खण्ड (त) के साथ पठित धारा 70 की उप-धारा (1) के खण्ड (xv) तथा हरियाणा नगर निगम अधिनियम, 1994 (1994 का 16) की धारा 392छ के खण्ड (16) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए तथा हरियाणा सरकार, षहरी स्थानीय निकाय विभाग, अधिसूचना संख्या 9/100/2025-4CII, दिनांक 25 जुलाई, 2025, के प्रतिनिर्देष से, हरियाणा के राज्यपाल, इसके द्वारा, हरियाणा नगरपालिका विज्ञापन उप-विधियां, 2022 को आगे संषोधित करने के लिए, निम्नलिखित उप-विधियां बनाते हैं, अर्थात्‌ः-

उप-विधियां

1. ये उप-विधियां हरियाणा नगरपालिका विज्ञापन (संषोधन) उप-विधियां, 2025 कही जा सकती हैं।

2. हरियाणा नगरपालिका विज्ञापन उप-विधियां, 2022 (जिन्हें, इसमें, इसके बाद उक्त उप-विधियां कहा गया है) में, उप-नियम 2 मेें, खंड (1) में,-

(i) उप-खंड (vii) के पश्चात्‌, निम्नलिखित उप-खंड रखा जाएगा, अर्थात्‌ः-

'(vii क) ''ओ.एम.डी का समूह'' से अभिप्राय है, विभिन्न अवस्थितियों पर एक से अधिक ओएमडी के समूह बनाना;';

(ii) उप-खंड (xxiii) के स्थान पर, निम्नलिखित उप-खंड प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

'(xxiii) ''ओ.एम.डी'' से अभिप्राय है, बाहरी मीडिया यन्त्र, जिसमें बाहरी मीडिया यन्त्र और संरचना शामिल है;';

(iii) उप-खंड (xxix) के स्थान पर, निम्नलिखित उप-खंड प्रतिस्थापित किया जाएगा, अर्थात्‌,ः-

"(xxix) ''आरक्षित कीमत'' से अभिप्राय है, नीलामी के प्रयोजन के लिए ओ.एम.डी की न्यूनतम कीमत, जो समय-समय पर, सरकार द्वारा जारी दिषानिर्देषों के अनुसार नगरपालिका द्वारा विनिर्दिष्ट की जाएगी;"

(3659)3660 HARYANA GOVT. GAZ. (EXTRA.), DEC. 18, 2025 (AGHN. 27, 1947 SAKA) 3. उक्त उप-विधियों में उप-विधि (3) में खंड (2) में, उप खंड (vi) के स्थान पर, निम्नलिखित उप-खंड प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"(vi) किस्म छः मामला दर मामला आधार पर यथा विनिर्दिष्ट, अधिकतम पांच वर्ष तक (अग्रिम त्रैमासिक भुगतान सहित);"

4. उक्त उप-विधियों में, उप-विधि 8 में, खंड (1) में, उपखंड (ii) और (iii) के स्थान पर, निम्नलिखित उपखंड प्रतिस्थापित किए जाएंगे, अर्थात्‌ः-

"(ii) यदि किसी भवन की खिड़की के भीतर प्रदर्षित किया गया है, विज्ञापन उस भवन में चलाए जा रहे व्यापार, व्यवसाय या कारबार से सम्बन्घित है (अनुसूची-I के पैरा 11 में यथा विनिर्दिष्ट ब्योरे की सीमा तक);

(iii) भूमि या भवन, जिस पर ऐसा विज्ञापन प्रदर्षित किया जाता है, के भीतर व्यापार, व्यवसाय या कारबार या ऐसी भूमि या भवन या उसके किसी भाग का विक्रय या किराए पर देने या उस पर या उसमें विष्लेषण, मनाेंरजन या बैठक बुलाने से सम्बन्धित है (अनुसूची-I के खंड 11 में यथा विनिर्दिष्ट ब्योरे की सीमा तक);"

5. उक्त उप-विधियों में, उप-विधि 9 में, खंड (4) में,-

(i) अन्त में विद्यमान "।" चिह्‌न के स्थान पर, "ः" चिह्‌न प्रतिस्थापित किया जाएगा; तथा

(ii) निम्नलिखित परन्तुक जोड़ा जाएगा, अर्थात्‌ः-

"परन्तु नीलामी केवल तभी निर्धारित की जाएगी यदि प्रत्येक विज्ञापन स्थल के लिए तीन विशिष्ट बोलीदाता हों। यदि, लगातार दो नीलामियों में तीन विशिष्ट बोलीदाता उपलब्ध नहीं होते हैं, तो ओ.एम.डी की नीलामी दो विशिष्ट बोलीदाताओं के साथ भी की जा सकती है और इसी प्रकार दो और असफल नीलामियों के बाद, एक बोलीदाता को भी अनुमति दी जा सकती है।"।श्

6. उक्त उप-विधियों में, उप-विधि 12 में, खंड (6) के स्थान पर, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थात्‌ः- "(6) नगरपालिका संवीक्षा पर तथा सम्यक्‌ प्र्रक्रिया का पालन करने के बाद, आवेदन की तिथि से तीस दिन के भीतर अनुमोदन पर अपना निर्णय ऑनलाइन सूचित करेगी तथा तद्‌नुसार अगले तीन दिन में नगरपालिका नीलामी करने के लिए ऑनलाइन पोर्टल पर सम्पति सूचीबद्ध करेगी। नगरपालिका आरक्षित कीमत के दस प्रतिशत के समतुल्य बयाना राशि जमा (ईएमडी) करवाने की मांग करेगी। बयाना राशि जमा प्रस्तुत करने पर, स्थल की नीलामी की जाएगी। केवल सफल बोली प्रक्रिया, विजेता संस्था के चयन और विजेता संस्था को निर्धारित अवधि के लिए विज्ञापन अधिकारों के अन्तरण के बाद ही असफल बोलीदाताओं को बयाना राशि जमा वापस की जाएगी। यदि सफल बोली के बाद, विजेता संस्था नीलाम किए गए स्थल पर विज्ञापन के अधिकारों के लिए नगरपालिका के प्रस्ताव को अस्वीकार कर देती है, तो विजेता संस्था की बयाना जमा राशि समपहृत कर ली जाएगी।"।श्

7. उक्त उप-विधियों में, उप-विधि 13 में, खंड (1) के स्थान पर, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थात्‌ः- "(1) अनुमोदित सूचीबद्ध ओ.एम.डी स्थल वैध रजिस्ट्रेषन सहित केवल पंजीकृत संस्था को नीलाम किया जाएगा। अवार्डिड पंजीकृत संस्था के पास सम्पूर्ण विज्ञापन अवधि के लिए वैध पंजीकरण होगा। प्रत्येक पंजीकृत संस्था केवल अपने रजिस्ट्रेषन की समाप्ति तिथि से पहले न्यूनतम छह मास की वैधता के भीतर ही नीलामी में भाग ले सकती है।"।श्

8. उक्त उप-विधियों में, उप-विधि 22 में,-

(1) खंड (2) के स्थान पर, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"(2) पंजीकृत संस्था या सूचीबद्ध स्वामी (केवल स्वतः-विज्ञापन के लिए) सुनिष्चित करेगा कि नगरपालिका द्वारा यथापेक्षित नगरपालिका केे अनुमोदन के ब्योरे तथा ओ.एम.डी के ब्योरे मुहैया करवाने के लिए नगरपालिका के उत्कीर्ण लोगो सहित एक धातु प्लेट (कम से कम एक फुट x एक फुट के आकार की) ओ.एम.डी के किनारे प्लेट को लटकाकर हर समय अच्छी स्थिति में प्रदर्षित तथा अनुरक्षित की गई है। ऐसा करने में असफल रहना उप-विधियों की उल्लंघना के रूप में माना जाएगा, जिसके परिणामस्वरूप उपविधियों में कथित शास्ति का उद्‌ग्रहण और इसके बाद दी गई अनुमति का रद्‌दकरण होगा।";श्

(2) खंड (9) के स्थान पर, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, अर्थात्‌,-

"(9) किसी सार्वजनिक संपत्ति पर या सार्वजनिक –श्य में कोई भी अप्राधि—त बाहरी विज्ञापन, जिसमें उसकी संरचना या केवल विज्ञापन संरचना शामिल है, को नगरपालिका द्वारा, जैसा-है जहां-है, के आधार पर शीघ्रता से हटा दिया जाएगा और तुरंत उसका निपटान किया जाएगा।"।श्HARYANA GOVT. (EXTRA.), DEC. 18, 2025 (AGHN. 27, 1947 SAKA) 3661 9. उक्त उप-विधियों में, अनुबन्ध 5 में, प्रविष्टि क.5 के सामने, विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी, अर्थात्‌ः-

"पुलिस बूथ, पार्किंग बूथ, टेलीफोन बूथ, पूर्व-भुगतान टैक्सी बूथ, बस/रेल बुकिंग सूचना बूथ, पेयजल सुविधा, लोक उपयोगिता कीयॉस्क, बहुउपयोगी उत्पादन सूचना पैनल (एमयूआईपी)/ ध्वज चि]्‌न, लॉलीपॉप चि]्‌न इत्यादि।"श् 10. उक्त उप-विधियों में, अनुसूची-1 में,-

(1) पैरा (2) में, उप-पैरा (4) के स्थान पर, निम्नलिखित उप-पैरा प्रतिस्थापित किया जाएगा, अर्थात्‌ः- "(4) पाष्र्वीय तथा देषान्तरीय-स्थल चयन मानदण्ड

(i) पाष्र्वीय मापदण्ड

(क) पार्ष्विक दूरी मानदण्ड अनुबन्ध-5 में वर्गीकरण ''क'' में परिभाषित ओ.एम.डी के सिवाय

सभी प्रकार की ओ.एम.डी को लागू हैं;

(ख) राष्ट्रीय राजमार्गाें और राज्य राजमार्गाें की दषा में, उप-विधि (2) के खंड (1) में, मद (xxxiv) में परिभाषित अनुसार पाष्र्वीय दूरी आर.ओ.डब्लयू के किनारे से एक मीटर मापी जाएगी; और किसी भी स्थिति में, राष्ट्रीय राजमार्ग के आर.ओ.डब्लयू के भीतर ओ.एम.डी की अनुमति नहीं दी जाएगी।

(ग) हरियाणा अनुसूचित सड़क तथा नियन्त्रित क्षेत्र अनियमित विकास निर्बन्धन अधिनियम, 1963 (1963 का पंजाब अधिनियम 41) के अधीन राज्य सरकार द्वारा घोषित अनुसूचित सड़कों की दषा में, पाष्र्वीय दूरी को उप-विधि 2 के खण्ड (1) की मद (xxxiv) यथा पारिभाषित आर.ओ.डब्लयू के किनारे से मापा जाएगा। अनुज्ञेय पाष्र्व दूरी आर.ओ.डब्ल्यू के किनारे से (अर्थात्‌ सड़क के पक्के किनारे से) पांच मीटर होगी।

(घ) सेक्टर सड़काें, नगरपालिका सड़कों और अनुसूचित सड़कों से भिन्न अन्य सड़कों की दषा में, पाष्र्व दूरी को उप-विधि 2 के खण्ड (1) की मद (xxxiv) में यथा परिभाषित आर.ओ.डब्लयू के किनारे से मापा जाएगा। यह दूरी सड़क के किनारे से (अर्थात्‌ सड़क के पक्के किनारे से) पांच मीटर होगी।

(ङ) पाष्र्व दूरी मानदंड इन उप-विधियाें के अनुसार नगरपालिका के अनुमोदन के अध्यधीन, टोल प्लाजा के पास स्थित सार्वजनिक शौचालयों, बस स्टाप, टोल प्लाजा संरचनाओं पर ओ.एम.डी लागू नहीं होगी।

(च) किसी भी स्थिति में, ओ.एम.डी को आर.ओ.डब्लयू के भीतर स्थापित करने की अनुमति नही दी जाएगी।

(छ) यदि नगरपालिका सड़क का आर.ओ.डब्लयू बीस मीटर से कम हो, तो ओ.एम.डी परिवहन मार्ग के समानांतर आर.ओ.डब्लयू के किनारे पर स्थापित किया जाएगा और इसका आकार 4.6 x 3.05 मीटर तक सीमित है।

(ज) आर.ओ.डब्लयू के किनारे से ओ.एम.डी की दूरी ओ.एम.डी संरचना के आधार से मापी

जाएगी। ओ.एम.डी का कोई भी भाग आर.ओ.डब्लयू से बाहर नहीं निकलेगा। (ii) देषान्तरीय मानदण्डः सड़क के किनारे दो ओएमडी के बीच न्यूनतम देषान्तरीय सीधी स्पष्ट दूरी 75 मीटर से कम नहीं होगी।

टिप्पणः देषान्तरीय दूरी मानदण्ड अनुबन्ध 5 में वर्गीकरण ''क'' में परिभाषित ओ.एम.डी के सिवाय किसी सड़क के साथ ओ.एम.डी या सार्वजनिक भूमि पर ओ.एम.डी को लागू होगी। (iii) किसी सड़क संयोजन (जंक्षन), यातायात चौराहे या अन्य क्रॉसिंग (चौराहे) के पचहत्तर मीटर के भीतर ओ.एम.डी अनुमत नहीं हैं। किसी सड़क संयोजन (जंक्षन), यातायात चौराहे या अन्य क्रॉसिंग (चौराहे) से निकलने वाले यातायात की दिषा में किसी अन्य सड़क क्रॉसिंग के पचास मीटर के भीतर ओ.एम.डी की अनुमति नहीं होगी। दूरी यातायात चौराहे के किनारे से मापी जाएगी न कि सड़क जंक्षन या क्रॉसिंग से।

(iv) ओ.एम.डी यातायात के विनियमन के लिए निर्मित किसी यातायात संकेत या यातायात चिह्‌न या किसी अन्य संरचना को बाधित नहीं करेगा।3662 HARYANA GOVT. GAZ. (EXTRA.), DEC. 18, 2025 (AGHN. 27, 1947 SAKA) (v) अभिस्वीकृति ओ.एम.डी के सिवाय और जब तक सरकार द्वारा विषेष रूप से अनुमति न दी जाए,

सामान्यतः गोलचक्कर (राउंडअबाउट) पर ओ.एम.डी अनुमत नहीं है।श्

(vi) किसी यूनिपोल ओ.एम.डी या किसी अन्य यूनिपोल ओ.एम.डी से दीवार आवरण ओ.एम.डी के किनारे के बीच अनुज्ञेय दूरी सामने के अग्रभाग से कम से कम पचास मीटर होगी। टिप्पणः प्रत्येक परिसर में एक ओ.एम.डी को स्थापित करने की अनुमति है, भले ही सामने का अग्रभाग पचास मीटर से कम हो, किन्तु एकल आधार पर एक से अधिक ओ.एम.डी स्थापित किए जाने के मामले में, प्रत्येक अन्य ओ.एम.डी केवल तभी अनुमत है जब सामने का अग्रभाग कम से कम पचास मीटर हो। एक ही परिसर के भीतर प्रत्येक ओ.एम.डी के बीच की दूरी पचास मीटर होगी।";

(vii) यदि कोई ओ.एम.डी एक सड़क या सड़क की किस्म से अधिक दृष्यमान है, (जैसे कि मोटर मार्ग या मोटर मार्ग मानक सड़क तथा रैम्प या अन्य सड़क) तो प्रतिबन्ध, प्रत्येक सड़क या सड़क से दृृष्यमान ओ.एम.डी को लागू होगा।

(2) पैरा 10 के स्थान पर, निम्नलिखित पैरा प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"(10) वर्गीकरण 'ख' तथा 'ग' ओ.एम.डी के लिए प्ररूपी विज्ञापन यन्त्र परिमाण (दीवार आवरण के सिवाय)

(1) नगरपालिका सुनिष्चित करेगा की पूर्वोक्त आकार, शहर में अधिक सौन्दर्य लाने के लिए, अधिकाधिक प्रयुक्त किए जाते हैं।

(2) ऐसे मामलों में, जहां कोई निर्माण नहीं किया गया है या थोड़ा निर्माण किया गया है, तो केवल उपरोक्त विनिर्दिष्ट आकार के यूनिपोल तथा सूचना-पट्‌ट अनुमत किए जाएंगे।

(3) नगरपालिका द्वारा स्वागत संकेत तथा सामाजिक संदेष देने के लिए ढांचे केवल विभक्त परिवहन मार्ग सहित नगरपालिका सड़क पर ही अनुमत होंगे। प्रवर्तक ओ.एम.डी ढांचे के दूसरी ओर अर्थात्‌्‌ आने वाले यातायात की विपरीत दिषा पर प्रदर्षित किए जाएंगे। सड़क तथा ढांचे की निम्नतम सतह के बीच स्पष्ट दूरी आठ मीटर से कम नहीं होगी। गैंट्री पर अधिकतम ओ.एम.डी की अनुमति एक मीटर तक सीमित है। (4) रिक्त ओ.एम.डी पर, सम्पूर्ण स्थान को कवर करने के लिए मोबाइल संख्याएं अनुमत नहीं होंगी। मोबाइल संख्याएं ओ.एम.डी के कुल स्थान के 1/10 वें भाग में दी जाएंगी।"

(3) पैरा 11 में, उप-पैरा (1) के स्थान पर, निम्नलिखित उप-पैरा प्रतिस्थापित किया जाएगा, अर्थात्‌ः- "(1) भवन के प्रत्येक अग्रभाग पर विज्ञापन परिसरों (भवन तथा भूमि सहित) पर उपलब्ध अधिकतम अनुमत क्षेत्र, सार्वजनिक गली/सड़क से दृष्यमान क्षेत्र नीचे दी गई तालिका के अनुसार होगाः-HARYANA GOVT. GAZ. (EXTRA.), DEC. 18, 2025 (AGHN. 27, 1947 SAKA) 3663 तालिका

(i) दीवार आवरण, पचहत्तर प्रतिषत की पारदर्षिता सहित सामग्री वाले भवन में प्राकृतिक रोषनी (प्रकाष) अनुज्ञात करेंगे।

(ii) ओ.एम.डी की ऊँचाई, भवन की ऊँचाई के अनुसार प्रतिबन्धित है, जो निम्न अनुसार हैः-

परन्तु कोई खुलने वाला दरवाज़ा/खिड़की कवर नहीं किया जाएगा। इसके अतिरिक्त, विज्ञापन, इमारत के बुनियादी वास्तु गुण, विषेषताएं (जैसे मेहराब, स्तम्भ, आले, प्रक्षेप, इत्यादि), मानक अग्रभाग (प्राधिकारी द्वारा अनुमोदित) और आकार को खराब नहीं करेगा।";

(4) पैरा 12 में, उप-पैरा (6) के स्थान पर, निम्नलिखित उप-पैरे प्रतिस्थापित किए जाएंगे, अर्थात्‌ः- "(6) उप-विधि के उपबन्धों के उल्लंघन तथा कार्यक्रम को समाप्त होने के बाद ओ.एम.डी नहीं हटाने के लिए षास्तिक प्रभार वर्गीकरण-घ में वर्णित सभी ओ.एम.डी पर लागू होंगे तथा नगरपालिका द्वारा यथा विनिष्चित दैनिक आधार पर प्रभारित किए जाएंगे।श्

(7) नगरपालिकाएं, वर्गीकरण-घ ओ.एम.डी के प्रदर्शन के अनुज्ञात करने के लिए प्रत्येक वार्ड में अधिकतम पांच स्थल अवस्थित करेंगी और स्थलों की पहचान केवल नगरपालिका सड़क और अन्य सड़कों पर ही की जाएगी। ऐसा प्रत्येक स्थल एक दूसरे से कम से कम 75 मीटर की दूरी पर होगा।";

(5) पैरा 15 में,-

(क) उप-पैरा (1) के स्थान पर, निम्नलिखित उप-पैरा प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"(1) प्रयोज्यता के अनुसार, नागरिक उड्डयन विभाग से अनापत्ति प्रमाण पत्र के अध्यधीन, एलईडी, एलसीडी, 3डी स्क्रीन, इन्फ्लेटेबल या गैस बैलून और ऐसे अन्य मीडिया जैसे नवीन ओएमडी के लिए, विषेष अनुमति प्राप्त की जानी अपेक्षित होगी।";श्

(ख) उप-पैरा (4) के स्थान पर, निम्नलिखित उप-पैरा प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"(4) एलसीडी/एलईडी/3डी स्क्रीन, जो विषिष्ट रूप से लेखा-चित्रकला तथा दृष्य प्रकृति की हैं, बाज़ार क्षेत्रों, पार्किंग स्थलों, पार्कों, भ्रमण मार्गों, सार्वजनिक शौचालयों इत्यादि मेें प्रतिबन्धित होंगी। डिजिटल स्क्रीन, यातायात के यानीय संचलन के सीधे/लंबवत्‌ रूप से सामने नहीं लगाया जाएगा, अर्थात्‌ मुख्य रूप से यातायात के यानीय संचलन के सामने नहीं होना चाहिएः (i) एलईडी/ एलसीडी/ 3डी स्क्रीन केवल उन जंक्शनों पर अनुज्ञात की जा सकती है, जहाँ यातायात लाइटें हों। इसके अतिरिक्त, स्क्रीन पर विज्ञापन उस ओर भी दिखाए जाएँगे, जहाँ यातायात लाल बत्ती के कारण रुका हुआ है। स्क्रीन को यातायात सिग्नल के साथ इस तरह सिंक्रोनाइज किया जाएगा कि विज्ञापन लाल बत्ती के 5 सेकंड बाद ही शुरू हो और पीली बत्ती के जलने से 5 सेकंड पहले बंद हो जाए;

(ii) एलईडी/ एलसीडी/ 3डी आधारित ओएमडी को टोल प्लाजा पर आने वाले यातायात की ओर टोल संग्रह बूथ के पास के स्थान पर भी अनुमति दी जा सकती है, जहां वाहन की गति 10 किमी/ घंटा से कम है।";

(ग) उप-पैरा (4) के पश्चात्‌, निम्नलिखित उप-पैरा रखा जाएगा, अर्थात्‌ः-

"(4क) सड़क और यातायात के आवागमन के दौरान यूनिपोल या बिलबोर्ड या किसी अन्य प्रकार के स्थान पर एलईडी/ एलसीडी ओएमडी लगाने की भी अनुमति दी जा सकती है, इस षर्त के अध्यधीन कि यह केवल स्लाइड रूप में स्थिर विज्ञापन प्रदर्शित करे और किसी भी प्रकार का वीडियो या चलता-फिरता विज्ञापन नहीं। स्लाइड लगातार नहीं चलेगी और प्रत्येक स्लाइड के बीच का समय अंतराल एक मिनट से कम नहीं होगा।";

(घ) उप-पैरा (8) के स्थान पर, निम्नलिखित उप-पैरा प्रतिस्थापित किया जाएगा, अर्थात्‌ः-

"(8) पॉलिसी नई प्रौद्योगिकियों को अपनाने के लिए खुली होगी बषर्ते कि वे किसी सामान्य अनुमति मानदण्ड के उल्लंघन में न हों। किसी भी ऐसे माध्यम को लागू करने से पूर्व राज्य सरकार से अनुमति लेनी होगी।

(9) अनुमति के बाद, नगरपालिका इसे नीलामी के लिए नीलामी पोर्टल पर, इस शर्त के अध्यधीन रखेगी कि नवप्रवर्तक अभिकरण जो नवप्रवर्तक ओ.एम.डी लाई है, के पास पहला "अस्वीकार करने का अधिकार" है, अर्थात्‌ यदि नीलाम की गई कीमत नवप्रवर्तक अभिकरण की प्रस्तावित दरों से अधिक है, तो उक्त अभिकरण को नीलाम की गई कीमत से मेल खाने के लिए कहा जाएगा और केवल अगर वह मना करता है, तो इसे उच्चतम बोली लगाने वाले को आबंटित किया जाएगा।";

(6) पैरा 17 में,-

(i) उपपैरा (29) में, मद (iv) के स्थान पर, निम्नलिखित मद प्रतिस्थापित की जाएगी, अर्थात्‌,- "(iv) किसी भी स्थिति में, ओ.एम.डी आर.ओ.डब्ल्यू से आगे प्रक्षेपित नहीं होगी।"

(ii) उपपैरा (30) के बाद, निम्नलिखित उपपैरा जोडा जाएगा, अर्थात्‌ः-.

"(31) नगरपालिका सार्वजनिक संपत्ति(यों) पर विज्ञापन अधिकार प्रदान करने के लिए ई-नीलामी को हमेशा एक अधिमानित समाधान के रूप में प्राथमिकता देगी। तथापि, यदि ई-नीलामी का एक प्रयास कोई प्रतिक्रिया प्राप्त करने में विफल रहता है, तो नगरपालिका के पास शहरी स्थानीय निकाय विभाग के निदेशक की विशिष्ट स्वी—ति के बाद ही सार्वजनिक संपत्ति(यों) पर विज्ञापन अधिकार प्रदान करने के लिए ई-निविदा आमंत्रित करने का विकल्प होगा।"

No. 9/124/2025-4CII.— In exercise of the powers conferred under clause (xv) of sub-section (1) of section 70 read with clause (p) of section 200 of the Haryana Municipal Act, 1973 (24 of 1973), clause (16) of section 392 G of the Haryana Municipal Corporation Act, 1994 (16 of 1994) and with reference to Haryana Government, Urban Local Bodies Department, notification No. 9/100/2025-4CII., dated the 25th September, 2025, the Governor of Haryana hereby makes the following bye-laws, further to emend the Haryana Municipal Advertisement Byelaws, 2022, namely:-

Bye-laws

1 These bye-laws may be called the Haryana Municipal Advertisement (Amendment) Bye-laws, 2025. 2 In the Haryana Municipal Advertisement Bye-laws, 2022, (hereinafter called the said bye-laws), in bye-law 2, in clause (1),-

(i) after sub-clause (vii), the following sub-clause shall be inserted, namely:-

'(vii a) "Cluster of OMDs" means clustering of more than one OMD at different locations;';

(ii) for sub-clause (xxiii), the following sub-clause shall be substituted, namely:-

'(xxiii) "OMD" means an Outdoor Media Device including the advertisement material and structure;' (iii) for sub-clause (xxix), the following sub-clause shall be substituted, namely:-

'(xxix) "reserve price" means minimum price of an OMD or "cluster of OMDs" for the purpose of auction, which shall be specified by the municipality as per the guidelines issued by the Government from time to time;'.

3 In the said bye-laws, in bye-law 3, in clause (2), for sub-clause (vi), the following sub-clause shall be substituted, namely:-

"(vi) Type G: As specified on case to case basis, with maximum upto five years (with advance quarterly payments).".

4 In the said bye-laws, in bye-law 8, in clause (1), for sub-clauses (ii) and (iii), the following sub-clauses shall be substituted, namely:-

"(ii) if exhibited within the window of any building, the advertisement relates to the trade, profession or business carried in that building (to the extent of details as specified in para 11 of Schedule-I);

(iii) relating to the trade, profession or business carried on within the land or building upon or over which such advertisement is exhibited or to any sale or letting of such land or building or any effects therein or to analyze, entertainment or meeting to be held on or upon or in the same (to the extent of details as specified in para 11 of Schedule-I);".

5 In the said bye-laws, in bye-law 9, in clause (4),-

(i) for the sign "." existing at the end, the ":" sign shall be substituted;

(ii) the following proviso shall be added, namely,-

"Provided that the auction shall be scheduled only if there are three unique bidders for each advertisement site. In case, three unique bidders are not available in two consecutive auctions, then auction of the OMD may be allowed with even two unique bidders and similarly after two more unsuccessful auctions, then one bidder may also be allowed.".

6 In the said bye-laws, in bye-law 12, for clause (6), the following clause shall be substituted, namely,- "(6) The municipality on scrutiny and after following due process, shall within thirty days from date of application, shall convey its decision online and accordingly, within three following days, the municipality shall list the property on the Online Advertisement Portal for auctioning. The municipality shall raise demand of an earnest money deposit (EMD) amount equivalent to ten percent of the reserve price. Upon submission of earnest money deposit, the site shall be put on auction. Only after the successful bidding process, selection of winning entity and transferring of advertisement rights for the decided tenure to the winning entity, the Earnest Money Deposit amount shall be refunded to unsuccessful bidders. In case, upon successful bidding, the winning entity declines the offer of the municipality for the rights of the advertisement on the auctioned site, the Earnest Money Deposit amount of the winning entity shall be forfeited.".

7 In the said bye-laws, in bye-law 13, for clause (1), the following clause shall be substituted, namely:-

"(1) The approved listed OMD sites shall be auctioned only to the registered entity with the valid registration. The awarded registered entity shall have a valid registration throughout the advertisement tenure. All registered entity can only participate in an auction with minimum six months of validity before the expiration date of their registration.".

8 In the said bye-laws, in bye-law 22,-

(1) for clause (2), the following clause shall be substituted, namely:-

"(2) The registered entity or listed owner (for self-advertisement only) shall ensure that a metallic plate (minimum size of one feet by one feet) with the embossed logo of municipality providing details of approval of municipality and details of the OMD, as required by municipality, are displayed and maintained in good condition at all times, by way of hanging the plate at the edge of OMD. Failure to do so shall be treated as violation of the byelaws, resulting in levy of penalty followed by cancellation of the given permission.";

(2) for clause (9), the following clause shall be substituted, namely:-

"(9) Any unauthorized outdoor advertisement including its structure or only advertisement structure on a public property or in public view shall be removed promptly by the municipality and shall be immediately disposed-off on as-is where-is basis."

9 In the said bye-laws, in Annexure 5, against entry A5, for the existing entries, the following entries shall be substituted, namely:-

"Police booth, parking booth, telephone booth, pre- paid taxi booth, bus/ rail booking information booth, drinking water facility, public utility kiosks, Multi utility Production Information Panel (MUPI)/ Flag sign, Lolli pop signs etc."

10 In the said bye-laws, in Schedule-1,-

(1) in para (2), for sub-para (4), the following sub-para shall be substituted, namely:-

"(4) Lateral and Longitudinal- Site selection criteria

(i) Lateral Criteria

(a) The lateral distance criteria are applicable to all type of OMDs, except OMDs defined under Typology "A" in Annexure-5.

(b) In case of National Highways and State Highways the lateral distance shall be one meter measured from the edge of the ROW as defined in item (xxxiv) of clause (1) of bye-law 2; and in no case OMDs, shall be permitted within ROW of the National Highway.

(c) In case of scheduled roads declared by the State Government under the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 (Punjab Act 41 of 1963), the lateral distance shall be measured from the edge of the ROW as defined in item (xxxiv) of clause (1) of bye-law 2. The permissible lateral distance shall be five meters from the edge of the ROW (i.e. from the metalled edge of the road).

(d) In case of sector roads, municipal roads and roads other than scheduled roads, the lateral distance shall be measured from the edge of the ROW as defined in item (xxxiv) of clause (1) of bye-law 2. The distance shall be five meters from the edge of the ROW. (i.e. from the metalled edge of the road).

(e) The lateral distance criteria shall not apply to OMDs on public toilets, Bus stops, toll plaza structures located near toll plaza, subject to approval of the Municipal Corporation in accordance with these bye-laws.

(f) In no case, the OMD shall be allowed to install within the ROW.

(g) In case the ROW of municipal road is less than twenty meters, OMD shall be installed at edge of ROW parallel to carriageway and its size is restricted to 4.6 x 3.05 meters.

(h) The distance of OMD from the edge of ROW shall be measured from the base of the OMD structure. No part of the OMD shall project over the ROW.

(ii) Longitudinal Criteria: The minimum longitudinal straight clear distance between two OMDs along the road shall not be less than 75 metres.

Note: The longitudinal distance criteria shall be applicable to OMDs along any road or OMDs on public land, except wall wraps and OMDs defined in Typology "A" in Annexure-5.

(iii) OMDs are not permitted within seventy five meters of any road junction, traffic intersection or another road crossing in the direction of traffic entering the crossing. OMDs shall not be permitted within fifty meters of any road junction, traffic intersection or another road crossing in the direction of traffic exiting the crossing. The distance shall be measured from the edge of traffic inter-section not road junction or road crossing.

(iv) OMDs shall not block any traffic signage or traffic signal or any other structure erected for the regulation of traffic.

(v) OMDs are not permitted in general on a roundabout except acknowledgement OMDs and unless specifically allowed by the Government.

(vi) The permissible distance between the edges of any Unipole OMD or Wall wrap OMD to any other Unipole OMD or Wallwrap OMD on private property shall be at least fifty metres of frontal façade.

Note: One OMD is permitted to install on each premises even if it frontal façade is less than fifty metres, but in case of more than one OMDs are to be installed at single premise, then for every additional OMD frontal façade of at least fifty metres is required. The distance between each OMD within same premises shall be fifty metres.

(vii) An OMD visible from more than one road or type of road (such as motor way or motorway standard road and a ramp or other road) the restriction shall be applied to each road or type of road from which the OMD is visible.";

(2) for para 10, the following para shall be substituted, namely:-

"(10) Typical advertising device dimensions for typology 'B' and 'C' OMD (except wall wrap)

(1) Municipality shall ensure that aforesaid sizes are used increasingly to bring more aesthetics in the City.

(2) Where no or little construction has happened in such cases only the unipoles and billboards of sizes specified above shall be permitted.

(3) Gantries shall be permitted only on municipal road with divided carriageway for welcome signs and social messaging by municipality. The sponsor OMD shall be put up on other side of the gantry i.e. opposite side of the incoming traffic. The clear distance between the road and lowest surface of gantries shall not be less than eight meters. The maximum height of OMD permitted on gantry is restricted to one meter.

(4) On vacant OMDs, mobile numbers covering the whole space shall not be permitted. Mobile numbers shall be provided in 1/10th of total space of OMD.";

(3) in para 11, for sub-para (1), the following sub-para shall be substituted, namely,-

"(1) The maximum permissible area available for on premises (including buildings and land) advertisement on each face of the building, visible from public street/ road shall be as per table given below:

(i) Wall wraps shall allow natural light in the building by having material with seventy five percent transparency.

Provided that no openable door/ window shall be covered. Further, the advertisement shall not disturb the basic architectural character, features (i.e. arches, columns, niches, projections, etc.), standard façade (approved by authority) and shape of building.";

(4) in para 12, for sub-para 6, the following sub-paras shall be substituted, namely:-

"(6) Penal charges for violating provision of bye-law and not removing OMD after finishing of event shall be applicable on all OMDs defined under Typology-D and shall be charged on daily basis as decided by Municipality.

(7) The municipality shall locate maximum five sites in every ward for allowing display of Typology D OMDs and such sites shall be identified on municipal roads and other roads only leaving at least distance of 75 meters from each other."

(5) in para 15,-

(a) for sub-para (1), the following sub-para shall be substituted, namely:-

"(1) Specific permission shall be required to be obtained for Innovative OMDs such as LED, LCD, 3D screens, inflatable or Gas Balloon and other such media, subject to no objection certificate from Civil Aviation Department, as per the applicability.";

(b) for sub-para (4), the following sub-para shall be substituted, namely:-

"(4) LCD/ LED/ 3D screens which typically contain high graphic and visual images shall be restricted to market areas, parking places, parks, walkways, public toilets etc. Digital screens shall not face directly/ perpendicularly to the vehicular movement of traffic i.e. primarily not facing vehicular movement of traffic.

(i) LED/ LCD/ 3D screens may be allowed at junction only where there are traffic lights. Further, the screen shall be allowed to display advertisement to the side of traffic which is stationary due to red light. The screen shall be synchronized with the traffic signals such so that the advertisement shall start only after 5 seconds of the red light and shall be stopped 5 seconds before the yellow lights to be turned on.

(ii) LED/ LCD/ 3D based OMDs may also be permitted at toll plazas, at the location near the toll collection booth towards incoming traffic, where speed of vehicle is less than 10 km/ hr.";

(c) after sub-para (4), the following sub-para shall be inserted, namely:-

"(4A) LED/ LCD OMDs may also be permitted at unipoles or billboards or any other type along the road and movement of traffic, subject to the condition that it shall only display static advertisement in slide format and not any kind video or moving advertisement. The slide shall not continuously run and the time difference between each slide shall not be less than one minute.";

(d) for sub-para (8), the following sub-paras shall be substituted, namely:-

"(8) The policy shall be open for adopting new technologies provided they do not contravene any general permission criteria. The permission shall be taken from the Government before implementing any such mediums.

(9) After permission, the municipality shall put up the same on auction portal for auction, subject to the condition that the innovator agency who brought the innovative OMD, has the first "Right to Refusal" i.e. if the auctioned price is above the proposed rates of the innovator agency, then the said agency shall be asked to match the auctioned price and only if he refuses, it shall be allotted to the highest bidder.";

(6) in para 17,

(i) in sub-para (29), for item (iv), the following item shall be substituted, namely:-

"(iv) In no case, any part of the OMD shall project over the ROW";

(ii) after sub-para (30), the following sub-para shall be inserted, namely:-

"(31) The municipality shall always prefer e-auction as a preferred solution for granting advertisement rights on public property(s). However, if one attempt of e-auction fails to elicit any response, the municipality has the option to call upon e-tender for granting advertisement rights on public property(s) only after specific approval of the Director, Urban Local Bodies Department.".
