Order under Section 13G of the Haryana Municipal Act, 1973
Subject : Petition against the order of disqualification passed by Deputy Commissioner, Jind under Section
13F of the Haryana Municipal Act, 1973.

1. Whereas, the General Elections of Municipal Council, Nuh were held on 19.06.2022 and the result of the candidates was declared on 22.06.2022. Sh. Kamal Goyal, son of Sh. Trilok Chand, contested the election for post of Chairman, Municipal Council, Nuh and was not elected. As per the provisions of Section 13H of the Haryana Municipal Act, 1973, it was mandatory for Sh. Kamal Goyal to deposit his election expenditure account in the office of the Deputy Commissioner, Nuh within thirty days from the date of declaration of the election result. As per record, he failed to submit the election expenditure account within the prescribed period.
2. And whereas, for failure to submit the election expenditure register within the prescribed time, the Deputy Commissioner, Nuh, who was authorised vide order dated 06.03.2023 by the State Election Commission, Haryana, to decide cases of disqualification of contesting candidates under Section 13F of the Act, 1973, disqualified Sh. Kamal Goyal from contesting elections for a period of five years under Section 13F of the Haryana Municipal Act, 1973, vide order dated 10.04.2024.
PART I] HARYANA GOVT. GAZ., AUG. 7, 2026 (SRVN. 16, 1948 SAKA) 17553. In view of the aforesaid disqualification, Sh. Kamal Goyal filed petition before the State Election Commission Haryana on 05.06.2026 seeking removal of the disqualification imposed vide order dated 10.04.2024 passed by the Deputy Commissioner, Nuh. The petitioner was afforded opportunities of personal hearing on 15.07.2026 and 29.07.2026, which he duly availed and his written submissions along with the documents placed in support thereof have been taken on record.
4. Whereas, upon consideration of the petition, the explanation furnished by the petitioner, the material placed on record and the facts and circumstances of the case, I, Devinder Singh Kalyan, State Election Commissioner Haryana, consider it appropriate to exercise the powers conferred Under Section 13G of the Haryana Municipal Act, 1973. Accordingly, Sh. Kamal Goyal S/o Sh. Trilok Chand shall not incur the disqualification Under Section 13F of the Act. Panchkula: The 4th August, 2026.
