संख्या 10/16/2022-2एच0जी0-IV.- हरियाणा राज्य में पुलिस थाना/चौकी/वाहन सहित किसी अन्य स्थान पर हरियाणा पुलिस की पुलिस हिरासत के दौरान व्यक्ति की मृत्यु होने पर मृतक के कानूनी उत्तराधिकारियों/निकटतम परिजनों को मुआवजे के भुगतान के लिए हरियाणा के राज्यपाल, इस नीति को बनाने हेतु सहमत हैं।
2. बीमारी के कारण हुई मृत्यु सहित प्राकृतिक मृत्यु के मामलों में मुआवजा स्वीकार्य नहीं होगा।
3. अप्राकृतिक मृत्यु के निम्नलिखित मामलों में भी मुआवजा स्वीकार्य नहीं होगाः-
(i) यदि मृत्यु पुलिस हिरासत से भागने के दौरान हुई हो ;
(ii) यदि व्यक्ति के पुलिस हिरासत में होते हुए, मृत्यु किसी प्राकृतिक आपदा/संकट के कारण हुई हो। 4. निम्नलिखित मामलों में अप्राकृतिक मृत्यु होने पर मृतक व्यक्ति के कानूनी उत्तराधिकारी/निकटतम परिजन को मामलों के प्रत्येक प्रवर्ग के सामने वर्णित निम्न राषि के बराबर मुआवजे का भुगतान किया जाएगा :-
(i) पुलिस हिरासत में रखे गए/गिरफ्तार व्यक्तियों के बीच झगड़ा - रू. 7.5 लाख होने के कारण
(ii) पुलिस अमले द्वारा की गई यातना/पिटाई के कारण - रू. 7.5 लाख (iii) पुलिस हिरासत में आत्महत्या करने पर - रू. 7.5 लाख (iv) पुलिस अमले, अधिकारियों/कर्मचारियों द्वारा कर्तव्य में की गई - रू. 7.5 लाख लापरवाही के कारण (भारतीय नागरिक सुरक्षा संहिता 2023 की धारा 196 के तहत मजिस्ट्रेट द्वारा की गई जाँच में लापरवाही साबित होने के बाद ही स्वीकार्य की जानी होगी)।
(V) चिकित्सा अधिकारियों/पैरा मेडिकल स्टाफ की लापरवाही - रू. 7.5 लाख के कारण (भारतीय नागरिक सुरक्षा संहिता 2023 की धारा 196 के तहत मजिस्ट्रेट द्वारा की गई जाँच में लापरवाही साबित होने के बाद ही स्वीकार्य की जानी होगी)।

GAZ., AUG. 7, 2026 (SRVN. 16, 1948 SAKA) [PART I 5. सम्बन्धित पुलिस अधीक्षक पुलिस हिरासत में रखे व्यक्ति की मृत्यु की विस्तृत रिपोर्ट, न्यायिक जाँच रिपोर्ट, पोस्टमार्टम रिपोर्ट, मृत्यु का मुख्य कारण, पुलिस हिरासत में प्रवेष के समय पर चिकित्सा इतिवृत तथा पुलिस हिरासत में व्यक्ति को उसकी पुलिस हिरासत मृत्यु से पूर्व दिये गये चिकित्सा उपचार, (यदि कोई हो), के ब्यौरों की प्रति सहित विस्तृृृृृृृृत रिपोर्ट उपरोक्त कथित पैरा-4 के उपबन्धों के अनुसार उचित मुआवजा प्रदान करने के लिए राज्य सरकार को आगे भेजने हेतु महानिदेषक पुलिस, हरियाणा को भेजेगा।
6. पुलिस कार्मिक द्वारा उत्पीडन/पीटने के मामलों में मुआवजा का कम-से-कम 50 प्रतिषत गलती करने वाले अधिकारी/कर्मचारी के वेतन से काटा जायेगा। अगर दोषी व्यक्तिगत अधिकारी (अधिकारियों)/कर्मचारी (कर्मचारियों) (यदि वे एक से अधिक है), पर लागू होने वाली कटौती तथा अनुपात सही प्रतिषत महानिदेषक पुलिस, हरियाणा द्वारा अवधारित किया जाएगा।
7. यह नीति केवल पुलिस हिरासत में रखे गए/गिरफ्तार किए गए उन व्यक्ति (व्यक्तियों) के सम्बन्ध में लागू होगी, जिनकी अप्राकृतिक मृत्यु इस नीति की अधिसूचना की तिथि को या इसके बाद पुलिस हिरासत में हुई है।
8. इस नीति के तहत अतिरिक्त सचिव/विषेष सचिव/सचिव, गृह मुआवजा स्वीकृति के लिए प्राधिकृत होंगे। 9. यह वित्त विभाग, हरियाणा के अषाः क्रमांक 03/06/2025-5एफजी-1/11946, दिनांक 18.06.2026 द्वारा सूचित उनकी सहमति से जारी की जाती है।

No. 10/16/2022-2HG-IV.— The Governor of Haryana is pleased to formulate the following policy for payment of compensation to the legal heir(s)/next of kin of deceased on account of deaths of persons while being confined in police custody of Haryana Police in any police station or police post or any other place including a vehicle:-
2. Compensation shall not be admissible in cases of natural deaths including deaths due to illness.
3. Compensation shall also not be admissible in the following cases of unnatural deaths:-
(i) If the death occurs during escape from police custody.
(ii) If the death occurs due to any natural disaster/calamity while the person was in police custody.
4. Compensation shall be paid to the legal heir(s) or next of kin of the deceased person on account of unnatural deaths in the following cases equal to the amount mentioned against each category of cases:-
(i) Due to quarrel among the detained/arrested persons while being in - Rs. 7.5 Lakhs police custody
(ii) Due to torture/beating by police staff
- Rs. 7.5 Lakhs (iii) Due to suicide committed in police custody
- Rs. 7.5 Lakhs
- Rs. 7.5 Lakhs (iv) Due to negligence in duty by police staff, Officer(s)/official(s) (to be admissible only after the negligence is proved in an inquiry conducted by a Magistrate under section 196 of the Bharatiya Nagarik Suraksha Sanhita, 2023)

The Superintendent of Police concerned shall send detailed report along with copy of the Magisterial Inquiry Report, post-mortem report, final cause of death, medical history at the time of admission in police custody and details of medical treatment, if any, given to the person detained in custody prior to his/her custodial death to the Director General of Police, Haryana for onward submission to the State Government for grant of appropriate compensation, as per the provisions of Para-4 stated above.
6. At least 50 percent of the compensation paid in case of torture/beating by police staff shall be deducted from the salary of the erring officer(s)/official(s). Exact percentage of deduction and the ratio to be apply on the delinquent individual officer(s)/official(s) (if they are more than one) will be determined by the Director General of Police, Haryana.
7. This policy shall be applicable only in respect of those person(s), who suffer unnatural death in policy custody, on or after the date of notification of this policy.
8. The Additional Secretary/Special Secretary/Secretary, Home Department shall be competent to sanction the compensation under this policy.
9. This issues with the concurrence of the Finance Department, Haryana conveyed vide their U.O. No. 03/06/2025- 5FG-1/11946 dated 18.06.2026.
