****

यहकि सुरक्षित एवं पौष्टिक खाद्य की उपलब्धता जीवन के उस अधिकार का अभिन्न अंग है जिसकी प्रत्याभूति भारत के संविधान के अनुच्छे द 21 में निहित है, और संविधान का अनुच्छे द 47 राज्य को यह प्राथमिक कर्तव्य सौंपता है कि वह अपने नागरिकों के पोषण एवं जीवन स्तर को ऊपर उठाए तथा लोक स्वास्थ्य में सुधार लाए। भारत के माननीय उच्चतम न्यायालय ने भी स्पष्ट किया है कि मानव जीवन एवं स्वास्थ्य की समुचित सुरक्षा सुनिश्चित करना राज्य एवं उसके प्राधिकारियों का सर्वोपरि कर्तव्य है, और यह अनुच्छे द 21 तथा 47 के संयुक्त वाचन से उपजा एक मौलिक अधिकार भी है;

(क) मानव जीवन एवं स्वास्थ्य की समुचित सुरक्षा तथा खाद्य व्यापार में उपभोक्ताओं के हितों एवं निष्पक्ष व्यवहार का संरक्षण;

(ख) जोखिम आकलन पर आधारित जोखिम प्रबंधन;

(घ) यह अपेक्षा कि कोई भी नियामक उपाय आनुपातिक हो और आवश्यकता से अधिक व्यापार-अवरोधक न हो;

(1822)PART I] HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) 1823 और यहकि अधिनियम की धारा 30(2)(क) राज्य के खाद्य सुरक्षा आयुक्त को यह अधिकार देती है कि यदि किसी खाद्य पदार्थ के स्वास्थ्य के लिए असुरक्षित अथवा हानिकारक होने के युक्तियुक्त आधार विद्यमान हों, तो वह लोकहित में, कारण लेखबद्ध करते हुए, राजपत्र में अधिसूचना जारी कर राज्य के किसी भाग या संपूर्ण राज्य में उस खाद्य पदार्थ के विनिर्माण, भंडारण, वितरण अथवा विक्रय को एक वर्ष तक की अवधि के लिए प्रतिषिद्ध कर सकता है;

और यहकि भारत के माननीय उच्चतम न्यायालय ने स्वामी अच्युतानंद तीर्थ एवं अन्य बनाम भारत संघ एवं अन्य (रिट याचिका सिविल संख्या 159/2012, दिनांक 5 अगस्त 2016, (2016) 9 एससीसी 699) में दू ध एवं दुग्ध उत्पादों में हो रही व्यापक अपमिश्रण जिसमें दुग्ध वसा के स्थान पर परिष्कृ त या वनस्पति तेल का उपयोग सम्मिलित है का संज्ञान लेते हुए भारत संघ एवं राज्य सरकारों को अधिनियम के अधिक प्रभावी क्रियान्वयन का निदेश दिया था। न्यायालय ने विशेष रूप से यह निर्देश दिया कि राज्य खाद्य सुरक्षा प्राधिकारी उच्च-जोखिम क्षेत्रों एवं समयों (जैसे त्योहारी मौसम) की पहचान कर वहां नमूनाकरण तीव्र करें , पर्याप्त एनएबीएल-प्रत्यायित परीक्षण अवसंरचना एवं मोबाइल खाद्य-परीक्षण सुविधाएं सुनिश्चित करें , अपमिश्रण-रोधी कार्य की समीक्षा हेतु राज्य एवं जिला स्तर पर समितियां गठित करें (जैसा हरियाणा में पहले से किया जा रहा है), और धारा 18(1)(च) के अनुरूप जनता को स्वास्थ्य जोखिम की प्रकृ ति से अवगत कराएं । इन निदेशों से इस प्राधिकारी पर दू ध एवं दुग्ध उत्पादों की अपमिश्रण रोकने हेतु सतत एवं प्रभावी उपाय करने का दायित्व बना रहता है;

और यहकि खाद्य सुरक्षा और मानक अधिनियम, 2006 के अधीन गठित कें द्रीय सलाहकार समिति ने अपनी 48वीं बैठक (दिनांक 14 अक्टू बर 2025) में "डेयरी प्रसंग में एनालॉग" विषय पर विचार करते हुए पाया कि इसके लिए कोई गुणवत्ता मानक निर्धारित नहीं हैं, जिसके कारण क्षेत्रीय स्तर पर इसका प्रवर्तन कठिन हो जाता है। समिति ने यह भी रे खांकित किया कि एनालॉग पनीर अनिवार्यतः अपने डेयरी समकक्ष की तुलना में निम्नस्तरीय है, जानबूझकर की जाने वाली अपमिश्रण को बढ़ावा देता है, पैक किए जाने पर भी खोलकर खुले रूप में बेचा जाता है जिससे प्रवर्तन असंभव हो जाता है, और विशेषकर उन शाकाहारियों को कोई पोषणिक लाभ नहीं देता जो प्रोटीन हेतु पनीर पर निर्भर हैं। जागरूकता के मौजूदा स्तर को देखते हुए समिति की राय थी कि एनालॉग एवं वास्तविक पनीर के बीच चयन उपभोक्ता के विवेक पर नहीं छोड़ा जा सकता, और तदनुसार उसने पनीर के एनालॉग जैसे अमानकीकृ त तथा पोषणिक दृष्टि से अलाभकारी उत्पादों की अनुमति न देने की संस्तुति करते हुए सभी राज्यों के आयुक्तों से इस पर सहमति एवं सुझाव आमंत्रित किए;

और यहकि दिनांक 1 अप्रैल 2025 से 31 मार्च 2026 के दौरान राज्यभर से लिए गए पनीर/डेयरी एनालॉग के नमूनों में से अद्यतन 285 नमूनों का विश्लेषण हो चुका है। इनमें से प्राथमिक प्रयोगशाला द्वारा 200 नमूने यानी लगभग 70% गैर अनुरूप पाए गए, जिनमें 171 निम्नस्तरीय तथा 29 असुरक्षित श्रेणी में थे। निष्कर्षित वसा के विश्लेषण में एक बड़े अनुपात ने दुग्ध वसा हेतु निर्धारित सीमाओं से परे ब्यूटिरोरिफ्रै क्टोमीटर रीडिंग तथा आयोडीन मान दर्शाया, जो दू ध में स्वाभाविक रूप से अनुपस्थित वनस्पति (बाह्य) वसा के मिश्रण अथवा प्रतिस्थापन का स्पष्ट संके त है;

और यहकि सरकारी/अधिसूचित प्रयोगशालाओं की रिपोर्टों के अनुसार ऐसे पनीर में दू ध में स्वाभाविक रूप से न पाई जाने वाली गैर-दुग्ध अथवा बाह्य वसा विद्यमान थी, जिसके फलस्वरूप यह खाद्य पदार्थ अधिनियम के उपबंधों के अंतर्गत असुरक्षित एवं मिथ्या छाप वाला दोनों बन जाता है;

और यहकि एनालॉग/गैर-डेयरी पनीर को वास्तविक पनीर के रूप में अथवा उसकी आड़ में विनिर्मित एवं विक्रय करना उपभोक्ता को खाद्य की वास्तविक प्रकृ ति के संबंध में भ्रमित करता है, और यह डेयरी एनालॉग पर लागू लेबलिंग अपेक्षाओं जिनमें विनियम 2.1.1(5)(ख) के अंतर्गत गैर-दुग्ध घटकों तथा प्रतिस्थापित दुग्ध घटकों की विहित घोषणा सम्मिलित है के साथ-साथ खाद्य सुरक्षा और मानक (विक्रय पर प्रतिषेध और निर्बंधन) विनियम, 2011 का भी उल्लंघन है;

और यहकि पनीर की विधिक स्थिति पूर्णतः स्पष्ट है। विनियम 2.1.16 के अंतर्गत पनीर एक मानकीकृ त खाद्य है जो दू ध (किसी भी प्रभेद) में, दुग्ध ठोस मिलाए या बिना मिलाए, अनुज्ञेय अम्लजनकों (लैक्टिक अम्ल, साइट्रि क अम्ल, मैलिक अम्ल, सिरका, ग्लूकोनो डेल्टा लैक्टोन अथवा खट्टी छाछ) द्वारा अवक्षेपण एवं तापन से प्राप्त उत्पाद है। दुग्ध वसा इसका अनिवार्य घटक है, और वनस्पति तेल, वनस्पति वसा अथवा किसी अन्य गैर-दुग्ध वसा का प्रतिस्थापन या मिश्रण अनुज्ञेय नहीं है। ऐसा कोई भी उत्पाद, जिसमें दुग्ध वसा या दुग्ध ठोस पूर्णतः अथवा आंशिक रूप से गैर-दुग्ध घटकों से प्रतिस्थापित हों, विनियम 2.1.1(3)(च) एवं 2.1.1(5)(ख) के अंतर्गत "डेयरी प्रसंग में एनालॉग" कहलाता है तथा यह पनीर नहीं है, और न ही इसे "पनीर" नाम से बेचा या परोसा जा सकता है, क्योंकि डेयरी शब्द किसी दुग्ध1824 HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) [PART I उत्पाद के प्रतिस्थापन हेतु बने उत्पाद पर लागू नहीं होते। ऐसे उत्पाद के नाम के निकट, विनियम 2.1.1(5)(ख) में विहित रीति से, दुग्ध घटकों के गैर-दुग्ध घटकों द्वारा प्रतिस्थापन की स्पष्ट घोषणा की जानी आवश्यक है "उदाहरणार्थ इसमें वनस्पति वसा है" तथा "इसमें दुग्ध वसा नहीं है" अनिवार्य है।" पनीर के रूप में बेचा या परोसा गया कोई भी एनालॉग/गैर-डेयरी उत्पाद मिथ्या छाप वाला माना जाएगा, और यदि वह गैर-खाद्य-श्रेणी सामग्री से बना हो अथवा अन्यथा गैर अनुरूप हो, तो वह अधिनियम की दृष्टि से असुरक्षित भी है;

और यहकि विनियम 2.1.16 के अंतर्गत छे ना एवं पनीर हेतु मानक जिसे खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य संकलक) पंचम संशोधन विनियम, 2019 द्वारा संशोधित किया गया है दुग्ध-वसा तत्व के आधार पर पनीर की तीन श्रेणियां निर्धारित करता है: पनीर (सामान्य/पूर्ण वसा), मध्यम वसा पनीर एवं कम वसा पनीर। इनके संघटनात्मक मानक तथा पैके जिंग-लेबलिंग अपेक्षाएं नीचे दी गई सारणी में उपवर्णित हैं। इस मानक के अनुसार कम वसा एवं मध्यम वसा पनीर/छे ना के वल सीलबंद पैके जों में, विहित लेबल घोषणाओं सहित, विक्रय किए जा सकते हैं, जबकि सामान्य (पूर्ण वसा) पनीर खुले रूप में भी बेचा जा सकता है। इस मानक के अनुरूप न होने वाला कोई भी उत्पाद विशेषतः कोई भी एनालॉग/गैर-डेयरी पनीर "पनीर" के नाम से न तो बेचा जा सकता है और न ही परोसा जा सकता है;

और यहकि विनियम 2.1.16(1) के अनुसार छे ना या पनीर दू ध के किसी भी प्रभेद से, दुग्ध ठोस मिलाए या बिना मिलाए, अनुज्ञेय अम्लजनकों द्वारा अवक्षेपण एवं तापन से प्राप्त उत्पाद है, किं तु यह देखा गया है कि अधिकांश निर्माता कच्चे दू ध के बजाय दुग्ध पाउडर पाउडर या वनस्पति तेलों से छे ना या पनीर तैयार कर रहे हैं;

और यहकि यह भी देखा गया है कि होटल, रे स्तरां, के टरर, भोजनालय एवं अन्य खाद्य सेवा प्रतिष्ठान अक्सर उपभोक्ताओं को परोसे जाने वाले व्यंजनों में बिना इसे मेनू कार्ड, चालान अथवा प्रदर्शन बोर्ड पर दर्शाए वास्तविक पनीर के स्थान पर एनालॉग/गैर-डेयरी पनीर का उपयोग करते हैं । इससे उपभोक्ता यह मानकर भ्रमित होते हैं कि परोसे गए व्यंजन में वास्तविक डेयरी पनीर है, और वे एक सूचित विकल्प से वंचित रह जाते हैं जो अधिनियम तथा खाद्य सुरक्षा और मानक (लेबलिंग और प्रदर्शन) विनियम, 2020 दोनों का उल्लंघन है;

और यहकि ऐसा खुला एनालॉग पनीर प्रायः बिना मूल पैके जिंग, अनिवार्य लेबल घोषणाओं, चालान, बैच पहचान विवरण अथवा पर्याप्त अनुशोध्यता दस्तावेजों के परिवहित, भंडारित एवं विक्रय किया जाता है, जिससे स्रोत की पहचान बाधित होती है और जनस्वास्थ्य के समक्ष गंभीर जोखिम उत्पन्न होता है;

और यहकि एक वर्ष तक निरं तर प्रवर्तन, निगरानी एवं नमूनाकरण के बावजूद, और पहले से लागू जागरूकता तथा लेबलिंग उपायों के होते हुए भी, गैर अनुरूप पनीर की घटना तथा वास्तविक पनीर के वनस्पति-वसा एनालॉग द्वारा प्रतिस्थापन में कोई सारवान सुधार नहीं आया है गैर अनुरूप नमूनों का अनुपात अब भी 70% पर स्थिर बना हुआ है। यह स्पष्ट करता है कि नियमित नमूनाकरण एवं विद्यमान लेबलिंग ढांचे के माध्यम से प्रवर्तन अके ले इस प्रथा को रोकने तथा जनस्वास्थ्य की रक्षा करने में अपर्याप्त सिद्ध हुआ है;

और यहकि निरीक्षण रिपोर्टों, अभिग्रहण कार्यवाहियों, प्रयोगशाला निष्कर्षों, गैर-खाद्य-श्रेणी सामग्री के उपयोग, विनिर्माण एवं खाद्य-सेवा क्षेत्र में वास्तविक पनीर के व्यवस्थित प्रतिस्थापन, एनालॉग पनीर हेतु किसी विहित गुणवत्ता मानक के अभाव तथा तत्संबंधी क्षेत्रीय प्रवर्तन की असंभवता, और कें द्रीय सलाहकार समिति की सुविचारित राय इन सभी पर विचार करने के पश्चात, मैं इस निष्कर्ष पर पहुंचा हूं कि एनालॉग/गैर-डेयरी पनीर, एक वर्ग के रूप में, अमानकीकृ त एवं पोषणिक दृष्टि से अलाभकारी होने के साथ-साथ इंद्रियगोचर रूप सेPART I] HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) 1825 वास्तविक पनीर से अभेद्य भी है, और स्वाभाविक रूप से जानबूझकर अपमिश्रण तथा वास्तविक पनीर के रूप में प्रस्तुत किए जाने की प्रवृत्ति रखता है। यह आदेश के वल उन अमानकीकृ त डेयरी एनालॉग को संबोधित करता है जिनके लिए खाद्य प्राधिकरण द्वारा कोई गुणवत्ता प्राचल विहित नहीं है जैसा स्वयं कें द्रीय सलाहकार समिति ने रे खांकित किया है तथा यह फ्रोजन डेजर्ट, प्रोसेस्ड चीज़ एवं मिश्रित वसा स्प्रेड जैसे मानकीकृ त उत्पादों पर लागू नहीं होता, जिनके मानक विधिवत अधिसूचित हैं। तदनुसार, जनस्वास्थ्य के हित में, उक्त खाद्य पदार्थ के विनिर्माण, दुग्ध पाउडर से पनीर तैयार करने, तथा उपभोक्ताओं को बिना प्रकटीकरण के परोसे जाने वाले व्यंजनों में वास्तविक पनीर के स्थान पर एनालॉग/गैर-डेयरी पनीर के उपयोग को, राज्यभर में एक वर्ष तक की अवधि के लिए, अधिनियम की धारा 30(2)(क) के अंतर्गत प्रतिषिद्ध करना आवश्यक एवं आनुपातिक प्रतीत होता है;

HARYANA GOVERNMENT

FOOD AND DRUGS ADMINISTRATION DEPARTMENT

Notification

The 17th August, 2026

No. 3/14-3Food-II-2026/6026.—

Subject: Prohibition on manufacture, storage, distribution (including transportation) and sale of analogue/non-dairy paneer represented, offered or sold as "Paneer" in the State of Haryana for a period of one year under Section 30(2)(a) of the Food Safety and Standards Act, 2006, and issuance of directions for compliance with prescribed food standards and labelling requirements in the interest of public health.

****

WHEREAS, the availability of safe and wholesome food is an integral facet of the right to life guaranteed under Article 21 of the Constitution of India, and Article 47 of the Constitution enjoins upon the State, as a primary duty, the raising of the level of nutrition and the standard of living of its people and the improvement of public health; and the Hon'ble Supreme Court of India has held that there is a paramount duty cast upon the State and its authorities to ensure an appropriate level of protection of human life and health, the same being a fundamental right under Article 21 read with Article 47 of the Constitution;

AND WHEREAS, Section 18(1) of the Food Safety and Standards Act, 2006 (hereinafter referred to as "the Act") sets out the general principles to be followed in the administration thereof, including —

(a) the achievement of an appropriate level of protection of human life and health and the protection of consumers' interests, including fair practices in all kinds of food trade;

(b) risk management taking into account the results of risk assessment;

(c) the precautionary principle, permitting provisional risk-management measures where, on an assessment of available information, the possibility of harmful effects on health is identified though scientific uncertainty may persist; and

(d) the requirement that such measures be proportionate and no more restrictive of trade than is required to achieve the appropriate level of health protection;

AND WHEREAS, Section 30(2)(a) of the Act empowers the Commissioner of Food Safety of the State, in the interest of public health and for reasons to be recorded in writing, by notification in the Official Gazette, to prohibit the manufacture, storage, distribution or sale of any article of food in the whole of the State or any area thereof for such period not exceeding one year as may be specified, where there exist reasonable grounds for believing that such article of food is likely to be unsafe or injurious to health;

AND WHEREAS, the Hon'ble Supreme Court of India, in Swami Achyutanand Tirth & Ors. v/s Union of India & Ors., Writ Petition (Civil) No. 159 of 2012, decided on 5th August 2016 [(2016) 9 SCC 699], taking note of the large-scale adulteration of milk and milk products including the use of refined/vegetable oil as a substitute for milk fat, directed the Union of India and the State Governments to implement the Food Safety and Standards Act, 2006 in a more effective manner, and in particular directed that the State Food Safety Authorities identify high-risk areas and high-risk times (such as festival seasons) and intensify sampling therein, that adequate NABL-accredited testing infrastructure and mobile food-testing facilities be ensured, that State-level and District-level committees be constituted to review the work of curbing adulteration (as is done in the State of Haryana by constitution of SLAC and DLAC in this regard), and that the general public be informed of the nature of the risk to health in terms of Section 18(1)(f) of the Act; and the said directions cast a continuing obligation upon this authority to take effective preventive measures against the adulteration of milk and milk products;

AND WHEREAS, the Central Advisory Committee constituted under the Food Safety and Standards Act, 2006, in its 48th meeting held on 14th October 2025, while deliberating upon the provisions relating to "Analogue in Dairy Context", recorded that no quality parameters stand defined for analogue in the dairy context, that in the absence of such standards analogue paneer is difficult to enforce at field level and is essentially a sub-standard product of its dairy counterpart which only increases deliberate adulteration, that even when packed it is opened and sold in loose form rendering enforcement infeasible, that it provides no nutritional benefit particularly to vegetarians who depend on paneer as a source of protein, and that the choice between analogue and genuine paneer cannot be left to the discretion of the consumer given the prevailing level of awareness; and the said Committee accordingly opined and recommendedPART I] HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) 1827 that non-standardized and nutritionally non-beneficial dairy analogues such as analogue of paneer should not be permitted, and invited the Commissioners of States to concur and furnish inputs thereon;

AND WHEREAS, during the period 1st April 2025 to 31st March 2026, samples of paneer/dairy analogue drawn from across the State were sent for analysis to government/notified Food Laboratories, of which 285 samples stood analysed as on date, and of the analysed samples 200 samples (about 70% of the analysed samples) from primary laboratory were reported to be non-conforming, namely 171 sub-standard and 29 unsafe; and on analysis of the extracted fat a significant proportion thereof showed a Butyrorefractometer (BR) reading and an Iodine Value outside the limits prescribed for milk fat, indicating the addition or substitution of vegetable (foreign) fat, not naturally present in milk;

AND WHEREAS, reports received from government/notified laboratories indicate that such paneer contained non-milk fat or foreign fat not naturally present in milk and milk products, rendering the article of food unsafe and misbranded under the provisions of the Act;

AND WHEREAS, the manufacture and sale of such analogue/non-dairy paneer, and the sale thereof as, or in the guise of, genuine paneer, deceives the consumer as to the nature and substance of the food, and contravenes the labelling requirements applicable to dairy analogues including the declarations prescribed under Regulation 2.1.1(5) (b) as to the non-milk constituents used and the milk constituents replaced, as also the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011;

AND WHEREAS, the legal position of paneer is well-settled: paneer is a standardised food under Regulation 2.1.16 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, defined as the product obtained from milk (of any variant), with or without added milk solids, by precipitation with permitted acidulants (lactic acid, citric acid, malic acid, vinegar, glucono delta lactone or sour whey) and heating; milk fat is an essential constituent of paneer, and the substitution or addition of vegetable oil, vegetable fat or any non-milk fat is not permitted; and accordingly a product resembling paneer in which milk fat or milk solids are replaced wholly or partly by non-milk constituents is, in law, an "analogue in dairy context" governed by Regulations 2.1.1(3)(f) and 2.1.1(5)(b), which is not paneer and cannot be named, sold or served as "Paneer", dairy terms not being available to a product intended to substitute a milk product, and which is required to declare, in close proximity to the name of the product, the substitution of milk constituents by non-milk constituents — for example, "Contains Vegetable Fat" and "Contains no milk fat" — in the manner prescribed under Regulation 2.1.1(5)(b); and any analogue/non-dairy product offered, sold or served as paneer is misbranded, and where prepared from non-food-grade ingredients or otherwise non-conforming, is unsafe within the meaning of the Act;

AND WHEREAS, the Standard for Chhana and Paneer under Regulation 2.1.16, as amended by the Food Safety and Standards (Food Products Standards and Food Additives) Fifth Amendment Regulations, 2019, prescribes three categories of paneer according to milk-fat content, namely Paneer (regular/full-fat), Medium Fat Paneer and Low Fat Paneer, together with their compositional standards and packaging-and-labelling requirements, as set out in the Table below; and in terms of the said Standard, Low Fat and Medium Fat Paneer/Chhana shall be sold in sealed packages only and shall bear the prescribed label declarations, whereas regular (full-fat) Paneer may be sold loose subject to the Act and the Regulations; and no product not conforming to the said Standard, and in particular no analogue/non-dairy paneer, may be named, sold or served as "Paneer";

STANDARDS, PACKAGING & LABELLING OF PANEER / CHHANA UNDER REGULATION 2.1.16

Category Moisture (max.) Milk Fat (on dry matter basis) Sale / Packaging Naming & Label
Paneer / Chhana (regular / full-fat) 65% (Chhana) / 60% (Paneer) Not less than 50% May be sold loose or pre-packed "Paneer" / "Chhana"; general label declarations if prepacked
Medium Fat Paneer / Chhana 65% (Chhana) / 60% (Paneer) More than 20% and less than 50% Sealed package ONLY "Medium Fat Paneer / Chhana"+ prescribed declaration
Low Fat Paneer / Chhana 70% (Chhana and Paneer) Not more than 20% Sealed package ONLY "Low Fat Paneer / Chhana" + prescribed declaration

AND WHEREAS, as per Regulation 2.1.16(1), Chhana or Paneer means the product obtained from any variant of milk, with or without added milk solids, by precipitation with permitted acidulants and heating; and it has been observed that most Chhana or Paneer manufacturers are manufacturing Chhana or Paneer from milk powder, Food Business Operators not using raw whole milk;

1828 HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) [PART I

AND WHEREAS, it has further been observed that hotels, restaurants, caterers, eateries and other food service establishments are, in numerous instances, using analogue/non-dairy paneer in place of genuine paneer in dishes and preparations served to consumers, without disclosing the same on menu cards, invoices or display boards, thereby causing such preparations to be understood as containing genuine dairy paneer and misleading consumers and depriving them of an informed choice, in contravention of the Act and the Food Safety and Standards (Labelling and Display) Regulations, 2020;

AND WHEREAS, it has further been observed that such loose analogue paneer is frequently transported, stored and sold without original packaging, mandatory label declarations, invoices, batch identification details or adequate traceability documents, thereby frustrating effective source identification and posing a significant risk to public health;

AND WHEREAS, notwithstanding sustained enforcement, surveillance and sampling carried out over a period of one year and the awareness and labelling measures already in force, the incidence of non-conforming paneer and of the substitution of genuine paneer by vegetable-fat analogue has shown no appreciable improvement, the proportion of non-conforming samples remaining persistently high at 70% of the samples analysed, thereby demonstrating that enforcement through routine sampling and the existing labelling framework has, by itself, proved insufficient to arrest the said practice and to protect public health;

AND WHEREAS, upon consideration of the material placed before the undersigned, including inspection reports, seizure proceedings, laboratory findings, the use of non-food-grade ingredients, the systematic substitution of genuine paneer by analogue/non-dairy paneer in manufacture and in the food-service sector, the absence of any prescribed quality standards for analogue paneer and the consequent infeasibility of field-level enforcement, and the considered opinion of the Central Advisory Committee, I am satisfied that analogue/non-dairy paneer, as a class, being non- standardized, nutritionally non-beneficial, organoleptically indistinguishable from genuine paneer and inherently prone to deliberate adulteration and to being passed off as genuine paneer, presents a risk to human health and to the interests of consumers; and that this Order is directed at non-standardized dairy analogues, for which no quality parameters stand prescribed by the Food Authority, and does not extend to standardized products such as frozen dessert, processed cheese and mixed fat spread, for which standards stand duly notified, the said distinction being that drawn by the Central Advisory Committee itself; and that, in the interest of public health, a prohibition of the said article of food, of the manufacture of paneer from milk powder, and of the use of analogue/non-dairy paneer in place of genuine paneer in dishes and preparations served to consumers without disclosure on menu cards, invoices or display boards, throughout the State for a period not exceeding one year, in exercise of the powers under Section 30(2)(a) of the Act, is necessary and proportionate;

NOW, THEREFORE, in exercise of the powers conferred under Section 30(2)(a) read with Sections 18 and 29 of the Food Safety and Standards Act, 2006, and all other powers enabling the undersigned in this behalf, I, Dr Manoj Kumar, I.A.S., Commissioner, Food Safety, Haryana, do hereby issue this Order, binding upon all Food Business Operators engaged in the manufacture, storage, distribution (including transport) and sale of analogue/non-dairy paneer throughout the State of Haryana, as follows:

1. DEFINITIONS

For the purpose of this Order, "analogue/non-dairy paneer" shall mean any product resembling paneer in which milk fat or milk solids are replaced wholly or partly by vegetable oil, vegetable fat or other non-milk-derived constituents.

2. PROHIBITION OF ANALOGUE / NON-DAIRY PANEER

The manufacture, processing, preparation, packing, storage, distribution (including transportation), wholesale sale, retail sale, offering or exposing for sale, and sale by any means whatsoever, within the State of Haryana, of analogue/non-dairy paneer (by whatever name called or described), is hereby prohibited throughout the State of Haryana for a period of one year from the date of publication of this Order in the Official Gazette.

3. FOOD SERVICE ESTABLISHMENTS (HOTELS, RESTAURANTS, CATERERS)

No hotel, restaurant, caterer, eatery, cloud kitchen or other food service establishment shall use, prepare, serve, store, stock, sell or keep analogue/non-dairy paneer in any dish, preparation or article of food whatsoever. The use or service of analogue/non-dairy paneer, including in the guise of genuine paneer, is misleading to consumers and constitutes an unfair trade practice within the meaning of Section 24 of the Act, and a contravention of the responsibilities cast upon Food Business Operators under Section 26 of the Act, and is hereby prohibited.

PART I] HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) 1829

4. PENALTIES AND CONSEQUENCES

Any contravention of this Order shall be punishable under the applicable penal provisions of the Food Safety and Standards Act, 2006, including Sections 24, 50, 51, 52, 53, 55 and 59, and shall render the offending article liable to seizure and destruction in accordance with law.

5. COMMENCEMENT AND DURATION

This Order shall come into force on the date of its publication in the Official Gazette and shall remain in force for a period of one year from that date, unless earlier rescinded, modified or extended in accordance with law.

This Order is hereby issued in the interest of protecting public health and ensuring the availability of safe food to consumers of Haryana State. In stage of any conflict in translation, the English version of this prohibition order shall be final.

DR MANOJ KUMAR, Commissioner, Food Safety, Haryana.
