Notifications, Orders and Declarations by Haryana Government
(1815)1816 HARYANA GOVT.
PART I] HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) 18171.
1818 HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) [PART I

FOOD AND DRUGS ADMINISTRATION DEPARTMENT
Notification
The 17th August, 2026
No. 3/14-3Food-II-2026/6027.—
Subject: Prohibition on manufacture, storage, distribution (including transportation) and sale of any product labelled, described, offered or sold as "Ghee" — with or without any prefix, suffix or other qualifying usage — unless such product conforms to the Standard for Ghee prescribed under Regulation 2.1.8 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, in the State of Haryana for a period of one year under Section 30(2)(a) of the Food Safety and Standards Act, 2006; and directions for compliance with labelling requirements applicable to pre-packaged sweets, in the interest of public health and consumer protection.
****
WHEREAS, the availability of safe and wholesome food, and of accurate information relating thereto, is an integral facet of the right to life guaranteed under Article 21 of the Constitution of India, and Article 47 of the Constitution enjoins upon the State, as a primary duty, the raising of the level of nutrition and the standard of living of its people and the improvement of public health; and the Hon'ble Supreme Court of India has held that there is a paramount duty cast upon the State and its authorities to ensure an appropriate level of protection of human life and health, the same being a fundamental right under Article 21 read with Article 47 of the Constitution;
AND WHEREAS, Section 18(1) of the Food Safety and Standards Act, 2006 (hereinafter referred to as "the Act") sets out the general principles to be followed in the administration thereof, including the achievement of an appropriate level of protection of human life and health and the protection of consumers' interests, including fair practices in all kinds of food trade, and the requirement that regulatory measures be proportionate and no more restrictive of trade than is required to achieve the appropriate level of health protection;
AND WHEREAS, Section 30(2)(a) of the Act empowers the Commissioner of Food Safety of the State, in the interest of public health and for reasons to be recorded in writing, by notification in the Official Gazette, to prohibit the manufacture, storage, distribution or sale of any article of food in the whole of the State or any area thereof for such period not exceeding one year as may be specified, where there exist reasonable grounds for believing that such article of food is likely to be unsafe or injurious to health;
AND WHEREAS, the Standard for Ghee is prescribed under Regulation 2.1.8 (Standard for Milk Fat Products) of the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, which provides that milk fat, ghee, butter oil, anhydrous milk fat and anhydrous butter oil are fatty products derived exclusively from milk or products obtained from milk, and that Ghee shall conform to prescribed limits of moisture (maximum 0.5%), milk fat (minimum 99.5%), Butyrorefractometer reading, Reichert Meissl value, Polenske value, free fatty acids, iodine value, saponification value, fatty acid composition and absence of β-sitosterol, these parameters being specifically designed to detect and exclude the presence of vegetable oil or any other non-milk fat;
PART I] HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) 1819AND WHEREAS, as per Regulation 2.1.1(3)(f) of the said Regulations (General Standards for Milk and Milk Products), dairy terms — which include the word "Ghee", being both a defined milk product under Regulation 2.1.1(1)(f) and a name specified for a milk product under Regulation 2.1.8 — shall not be used, whether alone or in combination with any other word, in the name, label, commercial document, publicity material or point-of-sale presentation of any product which is not milk, a milk product or a composite milk product; and where a product is intended to substitute a milk product, dairy terms shall not be used at all, irrespective of any accompanying disclaimer, qualification, prefix or suffix;
AND WHEREAS, it has been observed that products prepared wholly or partly from vegetable oil, vegetable fat, vanaspati or other non-milk-derived fat are, in numerous instances, being manufactured, packed, distributed and sold in the State under names, descriptions or labels bearing the word "Ghee" together with various prefixes, suffixes or qualifying usages — including, illustratively, "Ghee for Pooja", "Ghee for Diya", "Vanaspati Ghee", "Cooking Ghee", "Table Ghee" and "Ghee for Havan" — notwithstanding that such products do not conform to, and make no claim to conform to, the compositional Standard for Ghee prescribed under Regulation 2.1.8;
AND WHEREAS, it has further been observed that certain Food Business Operators are preparing a substance from vegetable oils and plant fats, admixed with chemical agents, essences and granulating agents so as to artificially replicate the granular appearance, aroma and organoleptic characteristics of genuine Ghee, and are packing, storing, distributing, offering for sale and selling such substance under deceptive misnomers such as "Ghee for Diya" or "Ghee for Pooja", while, in truth, storing and passing off the same, and selling the same to unsuspecting and gullible consumers, as genuine Ghee, and using the same in the preparation of sweets in the manner of, and in substitution for, genuine Ghee; and such practice, being a deliberate and calculated deception as to the true nature, composition and origin of the product, is gravely injurious to the health and economic interests of consumers and constitutes a fraud upon the public; and accordingly no such chemically prepared, non-milk-fat substance shall be named, described, labelled, marketed, advertised, stored or sold as "Ghee", or by any name, mark, device, appearance or representation suggestive of "Ghee", whether explicitly or implicitly, and in whatever form or context, including under the guise of "Ghee for Diya", "Ghee for Pooja" or any similar expression;
AND WHEREAS, such use of the word "Ghee", in any form, for a product not derived exclusively from milk fat deceives the consumer as to the true nature and substance of the product, is not capable of being reliably distinguished from genuine Ghee by the consumer at the point of sale without laboratory analysis, provides no assurance of the nutritional and compositional characteristics of genuine milk fat, and is inherently prone to being passed off as, and to facilitating adulteration of, genuine Ghee, in a manner directly analogous to the practices observed in respect of analogue/non-dairy paneer;
AND WHEREAS, it has similarly been observed that margarine or plant fat spread, being a product prepared from vegetable oils and fats and not derived from milk, is being manufactured, stored, distributed and sold unpacked or loose, without any label, mark or declaration disclosing its true nature, at retail outlets, sweet shops, dhabas and catering establishments, and is being represented, offered, served and passed off to unsuspecting consumers as "butter" or "Makkhan", (particularly with paranthas) notwithstanding that such product does not conform to, and makes no claim to conform to, the compositional standard prescribed for butter under the said Regulations; and such practice, being a deliberate misrepresentation as to the true nature and composition of the product, is gravely injurious to the health and economic interests of consumers and constitutes a fraud upon the public, in a manner directly analogous to the practices observed in respect of Ghee;
AND WHEREAS, it has been observed that the labelling of pre-packaged foods, particularly sweets of all kinds including ladoo and Ghewar offered for sale, may sometimes not adequately reflect the ingredients or medium used in their preparation, such sweets being sold to consumers as prepared in Desi Ghee when they are, in fact, prepared with other types of fats including refined oil, vegetable oil or otherwise;
AND WHEREAS, as per Regulation 2.5.1 of the Food Safety and Standards (Labelling and Display) Regulations, 2020, where ingredients such as Desi Ghee, Vegetable Fat or Vegetable Oil are used in the preparation of sweets including ladoo or Ghewar, the package is required to prominently indicate the appropriate statement regarding the medium of preparation, namely "Prepared in Desi Ghee" or "Prepared in Vegetable Fat/Vegetable Oil", as applicable, together with the corresponding Hindi declaration prescribed under the said Regulation; [be re-inserted in correct Unicode Devanagari by the department before Gazette publication]
AND WHEREAS, such declaration is required to be displayed prominently on at least two sides of the box/package, in a manner that is clearly visible and easily readable by consumers, and shall occupy not less than 25% of the area of the respective side of the loose & sealed box on which it is displayed;
1820 HARYANA GOVT. GAZ., AUG. 21, 2026 (SRVN. 30, 1948 SAKA) [PART IAND WHEREAS, it has further been observed that certain sweets and other food articles are being prepared using permitted artificial sweeteners in place of, or in addition to, sugar, without any declaration thereof on the package, thereby depriving consumers — including diabetics and other persons who monitor or restrict their intake of artificial sweeteners — of information material to an informed choice, and it is necessary, in the interest of public health and consumer protection, that the use of any artificial sweetener in the preparation of any sweet or other food article be clearly declared on the package thereof;
AND WHEREAS, upon consideration of the material placed before the undersigned, I am satisfied that products bearing the word "Ghee", in any form, which do not conform to the Standard prescribed under Regulation 2.1.8, present a risk to the interests and health of consumers of the State by reason of deception as to the true nature of the product, the absence of any assurance of compositional and nutritional integrity, and the facilitation of adulteration and passing-off; and that a prohibition on the manufacture, storage, distribution and sale of any such non-conforming product under the name or description "Ghee", in whatever form, throughout the State for a period not exceeding one year, in exercise of the powers under Section 30(2)(a) of the Act, is necessary and proportionate; and that directions for strict compliance with the labelling requirements applicable to sweets are further necessary in the interest of public health and consumer protection;
