NOTIFICATION

Shimla, the 20th October, 2009

No. HHC/Admn. 3(87)/75-III.—Hon'ble the Acting Chief Justice, in exercise of the powers vesting in him under Article 229 of the Constitution of India and all other powers enabling him in this behalf, is pleased to grant extension in service for one month and one day on and w.e.f. 1-11-2009 to 1-12-2009 in favour of Shri B.M. Negi, Court Secretary, High Court of Himachal Pradesh, in public interest.

As a consequence of the extension in service so granted to Shri B.M. Negi, aforesaid due for retirement from service on attaining the age of superannuation on 31-10-2009 (A.N.), he shall now retire on 1-12-2009 (A.N.).

NOTIFICATION

Shimla-2, the 8th February, 2010

No. TPT-A(3)4/2009.—Whereas at present there is no mechanism for inquiry/in-depth study on causes and analysis of motor vehicles accidents and generally road accidents inquiry is entrusted by the District Administration to different officers who are not conversant with technicalities necessary for conducting such inquiries;

And whereas in the absence of any set mechanism, the inquiry report is generally finalized after consuming a considerable long time, which on the one hand deprived the department to initiate action against the offenders/guilty persons and on the other hand accidents victims have also to confront numerous problems on account of delay;

And whereas the State Government is of the view that a set mechanism is to be formulated for in-depth investigation/ inquiry of road accidents, research of the factors which contribute to accidents and to develop countermeasures to reduce accidents, under the provisions of the Motor Vehicle Act, 1988 (59 of 1988).

Now, therefore in exercise of the powers conferred by section-135 of the Motor Vehicles Act, 1988, the Governor, Himachal Pradesh is pleased to make the following scheme to make in- depth study on causes and analysis of motor vehicles accidents, namely:—

SCHEME

1. Short title, commencement and application.—(1) This scheme may be called the Himachal Pradesh in-depth study of road accidents scheme, 2010.

(2) This scheme shall come into force from the date of its publication in the Rajpatra, Himachal Pradesh.

(3) It shall apply to accidents of all transport vehicles including transport vehicles of other States occurring within the territory of Himachal Pradesh.

2. Road Accident Committee.—There shall be a Road Accident committee consisting of following officers to undertake an immediate in depth study/inquiry and analysis of the causes of road accident, namely:—

(a) Sub Divisional Magistrate of the area where the accident occurs Chairman (b) Assistant Engineer (Mechanical) Himachal Pradesh Public Works Department of the area where the accident occurs Member (c) Inspector/ Sub Inspector of Police of the area where the accident Member occurs.

3. Time frame for conducting inquiry.—The Road Accident Committee shall finalize the inquiry/indepth study and analysis on the accidents within fifteen days from the date of occurrence of such accidents and shall submit its report to the concerned Regional Transport Officer who shall take follow up action on the report as envisaged in the Central Motor Vehicles Act, 1988 and rules framed thereunder within a period of two months.

4. Procedure for conducting inquiry.—The Road Accident Committee shall conduct inquiry on the format as specified in the Schedule appended to this Scheme.

C-A(3)-4/2001.—It is announced for general information that during the year 2009-2010, accumulations to the credit of subscribers to the General Provident Fund and other similar funds shall carry interest @ 8% (Eight Percent) per annum. This rate will be in force during the financial year beginning on 01-04-2009.
