शिमला-2, 25 फरवरी, 2010 संख्यासंख्यासंख्यासंख्याःःःः पीएलजी-एफसी पीएलजी-एफसी पीएलजी-एफसी पीएलजी-एफसी((((एफएफएफएफ))))1-9/94-540-1-9/94-540-1-9/94-540-1-9/94-540-VIII.—यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि केन्द्रीय सरकार रेलवे विभाग के द्वारा अपने व्यय पर सार्वजनिक प्रयोजन हेतु नामतः गांव शिवपुर तहसील अम्ब, जिला ऊना में नंगल डैम से तलवाडा़ ब्रॉडगेज रेलवे लाईन (अम्ब अन्दौरा से दौलतपुर अनुभाग) के निर्माण हेतू भूमि अर्जित करनी अपेक्षित है। अतएव एतदद्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है। 2. यह अधिसूचना ऐसे सभी व्यक्तियों को जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन अधिनियम 1894 की धारा-4 के उपबन्धों के अन्तर्गत जारी की जाती है। 3. पूर्वोक्त धारा द्वारा प्रदत शक्तियों का प्रयोग करते हुए राज्यपाल, हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों, उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उस धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यो को करने के लिए सहर्ष प्राधिकार देते है। 4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपति हो तो वह इस अधिसूचना के प्रकाशित होने के तीस (30) दिन की अवधि के भीतर लिखित रूप में भू-अर्जन समाहर्ता, जिला ऊना (सहायक उपायुक्त ऊना) हि0प्र0 के समक्ष अपनी आपति दायर कर सकता है ।

(ii) बीस प्रतिशत सीमित सीधी भर्ती द्वारा दस जमा दो अर्हता रखने वाले वर्ग-IV कर्मचारियों में से प्रतियोगिता परीक्षा द्वारा, जोकि हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर द्वारा आयोजित की जाएगी, ऐसा न होने पर, यथा स्थिति, सीधी भर्ती द्वारा या संविदा आधार पर। संविदा पर नियुक्त व्यक्ति स्तम्भ संख्या 15-ए में दिए गए परिलाभ प्राप्त करेगा तथा उक्त स्तम्भ में विहित सेवा शर्तों से शासित होगा ।
(iii) यथा स्थिति, दस प्रतिशत प्रोन्नति द्वारा, ऐसा न होने पर नियमित आधार पर सीधी भर्ती द्वारा या संविदा आधार पर। संविदा पर नियुक्त व्यक्ति स्तम्भ संख्या 15-ए में दिए गए परिलाभ प्राप्त करेगा तथा उक्त स्तम्भ में विहित सेवा शर्तों से शासित होगा ।
(2) स्तम्भ संख्या-11 के सामने विद्यमान प्रविष्टियों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः- (i) बीस प्रतिशत सीमित सीधी भर्ती द्वारा दसजमा दो अर्हता रखने वाले वर्ग-IV कर्मचारियों में स,े प्रतियोगिता परीक्षा द्वारा, जोकि हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर द्धारा आयोजित की जाएगी । पात्र वर्ग-IV कर्मचारियों को अंग्रेजी टंकण में कम से कम तीस शब्द प्रति मिनट की गति से या हन्दी टंकण में पच्चीस शब्द प्रति मिनट की गति से टंकण परीक्षा पास करनी होगी जो हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर द्वारा संचालित की जाएगी, जैसा कि सीधी के मामले मे लागू है ।
(ii) दस प्रतिशत वर्ग-IV कर्मचारियों में से प्रोन्नति द्वारा, जो दस जमा दो या इसके समकक्ष किसी मान्यता प्राप्त स्कूल शिक्षा बोर्ड/विश्वविद्यालय से पास हों और जिनका पाचं वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो को सम्मिलित करके संयुक्त नियमित सेवाकाल हो :
परन्तु यदि वर्ग-IV का कोई कर्मचारी मैट्रिक या मैट्रिक (अंग्रेजी विषय) सहित हिन्दी रत्न की अर्हता के साथ लिपिक के पद पर प्रोन्नति के लिए अन्यथा पात्र है तो उसे प्रोन्नत कर दिया जाएगा परन्तु उसे तीन वर्ष के भीतर दस जमा दो स्तर की अर्हता प्राप्त करनी होगी। यदि वह 31-12-2011 तक दस जमा दो की अर्हता प्राप्त करने में असफल रहता है तो उसे लिपिक से वर्ग-IV के पद पर प्रत्यावृत (पदावनत) कर दिया जाएगा : परन्तु यह और कि लिपिक के रूप में इस प्रकार प्रोन्नत सभी ऐसे वर्ग-IV कर्मचारियों को, परिवीक्षा अवधि के दौरान अंग्रेजी टंकण में कम से कम तीस शब्द प्रति मिनट की गति से या हिन्दी टंकण में पच्चीस शब्द प्रति मिनट की गति से टंकण परीक्षा पास करनी होगी, जो सम्बद्ध विभाग द्वारा संचालित की जाएगी और पदधारियों को परिवीक्षा अवधि के दौरान तीन अवसर प्रदान किए जाएंगे । यदि अभ्यर्थी विहित अवधि के भीतर टंकण परीक्षा को उत्तीर्ण करने में असफल रहते हैं तो, उनकी परिवीक्षा अवधि बढ़ा दी जाएगी। इस अवधि के दौरान पदधारी को एक और अवसर दिया जाएगा। यदि अभ्यर्थी बढ़ाई गई अवधि में भी टंकण परीक्षा पास न कर सकें तो वे लिपिक से वर्ग-IV कर्मचारी के पद पर प्रत्यावृत (पदावनत) कर दिए जाएंगे। प्रोन्नति के प्रयोजन के लिए वर्ग-IV के कर्मचारियों की, उनके सेवाकाल के आधार पर, उनकी संवर्गवार पारस्परिक वरिष्ठता को छेडे़ बिना एक संयुक्त वरिष्ठता सूची विहित की जाएगी। (1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार, चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात् की गई थीः
परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई तदर्थ सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/काडर में उससे वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगे : परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी :
परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे। स्पष्टीकरणस्पष्टीकरणस्पष्टीकरणस्पष्टीकरण....-----अंंितम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा, यदि वरिष्ठ अपात्र व्यक्ति भूतपर्व सैनिक है, जिसे डिमोबीलाइज्ड आमर्ड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन हिमाचल स्टेट नॉन 6922 राजपत्र, हिमाचल प्रदेश, 27 फरवरी, 2010/8 फाल्गुन, 1931 टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हैे और इनके अन्तर्गत वरीयता लाभ दिए गए हों या जिसे, एक्स सर्विसमैंन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और इनके अन्तर्गत वरीयता लाभ दिए गए हों। (2) इसी प्रकार स्थाईकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात् और भर्ती आरै प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थी : परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात् जो स्थाईकरण होगा, उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

No. Per(AP.B) B(2)-7/99-II (Clerk).—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Subordinate Services Selection Board, Clerk, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2002 notified vide this Department Notification of even number dated 05-01-2002, namely:— 1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Subordinate Services Selection Board, Clerk, Class-III (Non-Gazetted) Recruitment and Promotion (First Amendment) Rules, 2010.
(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh. 2. Amendment of Annexure "A".—(1) In Annexure "A" to the Himachal Pradesh Subordinate Services Selection Board, Clerk, Class-III(Non-Gazetted) Recruitment and Promotion Rules, 2002,—
(1) For the existing entries against Col. No. 10, he following shall be substituted, namely:—
(i) 70% by direct recruitment on a regular basis or by recruitment on contract basis, as the case may be. The contract employees will get emoluments as given in Col. 15-A and will be governed by service conditions as specified in the said column.
(ii) 20% by limited direct recruitment from amongst the Class-IV officials possessing the 10+2 qualification through competitive examination to be conducted by the H.P. Subordinate Services Selection Board, Hamirpur, failing which by direct recruitment on a regular basis or by recruitment on contract basis as the case may be. The contract employees will get emoluments as given in Col. 15-A and willbe governed by service conditions as specified in the said column. (iii) 10% by promotion failing which by direct recruitment on a regular basis or by recruitment on contract basis as the case may be. The contract employees will get emoluments as given in Col. 15-A and will be governed by service conditions as specified in the said column.
(2) For the existing entries against Col. No. 11, the following shall be substituted, namely:—
(i) 20% by limited direct recruitment from amongst the Class-IV officials possessing 10+2 qualification through competitive examination to be conducted by the H.P. Subordinate Services Selection Board, Hamirpur. The eligible Class-IV employees will also qualify the typing test with the minimum speed of 30 words per minute in English typewriting or 25 words per minute in Hindi typewriting to be conducted by the H.P. Subordinate Services Selection Board, Hamirpur as is applicable in case of direct recruitment. (ii) 10% by promotion from amongst the Class-IV officials who have passed 10+2 examination or its equivalent from a recognized Board of School Education/University and possess five years regular service or regular combined with continuous adhoc service rendered, if any, in the grade. Provided that if a Class-IV official is otherwise eligible to be promoted to the post of Clerk with the qualification Matric or Hindi Rattan with Matric (English) then he will be so promotedbut shall have to acquire the qualification of 10+2 standard within 03 years. If the candidate fails to acquire the 10+2 qualification by 31-12-2011, then he shall be reverted from Clerk to the Class-IV post. Provided further that all the Class-IV officials so promoted as Clerks will qualify the typing test with a minimum speed of 30 words per minute in English Typewriting or 25 words per minute in Hindi Typewriting within the probation period which will be conducted by the concerned Departments and the incumbents will get three chances during the probation period. If the candidate fails to qualify the typing test within the prescribed period, their probation period will be extended. During this period the incumbents will get one more chance. If the candidate still fails to qualify the typing test in the extended period, they will be reverted from Clerk to Class-IV post.
राजपत्र, हिमाचल प्रदेश, 27 फरवरी, 2010/8 फाल्गुन, 1931 6923For the purpose of promotion a combined seniority of eligible Class-IV officials on the basis of length of service without disturbing their cadre wise inter-se-seniority shall be prescribed. (1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment / promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules ; (i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration : Provided further that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the R & P Rules for the post, whichever is less : Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion. Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible persons happened to be Ex-Servicemen recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisionsof Rule-3 of Ex-servicemen (Reservation of vacancies in Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder. (ii) Similarly, in all cases of confirmation, continuous adhoc service rendered in the feeder post, if any, prior to the regular appointment against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provisions of the Recruitment & Promotion Rules ;
Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

AGREEMENT UNDER SECTION 41 OF THE LAND ACQUISITION ACT, 1894
THIS AGREEMENT made this 27th day of February, Two Thousand Ten between the Ambuja Cements Limited, A Company registered under the Company's Act, 1956 and having its registered office at P.O. Ambuja Nagar, Taluka Kodinar, District Junagarh, Gujarat State, through Shri Sunil Duggal, Joint President, appointed by the Company as its Attorney (hereinafter called "the Company" which expression shall include its heirs, successors and assigns) of the one part and the Government of Himachal Pradesh through the Deputy Secretary (Industries) to the Government of Himachal Pradesh (hereinafter called the "Government" which expression shall include his successors in office and assigns) of the other part.
Whereas, upon the application of the Company for acquisition of land for the purpose of mining, the Government of Himachal Pradesh have agreed to acquire on behalf of the company under provisions of the Land Acquisition Act, 1894 (1 of 1894) the pieces or parcels of land described and delineated in the Schedule hereto annexed and situated in villages Mangoo, Ghamaru, Gyana & Badog, Tehsil Arki, District Solan, Himachal Pradesh, measuring 1325.01Bighas, having been shown to the satisfaction of the said Government that the proposed acquisition is needed for the purpose of mining.
And whereas the said Government have called upon the Company under the provisions of section 41 of the said Act to enter into the agreement with the "Government" hereafter contained.
Now, these presents witness and it is hereby agreed and declared as follows :
1. On demand, the Company shall and will pay to the Government of Himachal Pradesh all and every compensation in respect of the said land tendered, paid or awarded to be tendered, paid or awarded by the Collector under the Land Acquisition Act 1894, or by Court or Courts to which an appeal from the award of the said Court may be preferred and all costs, charges and expenses of the proceedings in the aforesaid Courts or otherwise incidental to the proposed acquisition or payable in respect thereof under the provisions of the Act ibid.
2. On demand, made by the said Collector the obligation of the Company under the last preceding clause not being thereby limited the Company shall and will deposit with the said Collector such sum or sums of money as in his discretion the said Collector may in anticipation estimate to be necessary for the purpose mentioned in the last preceding clause.
3. On payment by the Company of all demands under the foregoing first clause, or, in the discretion of the said Government of Himachal Pradesh (on deposit by the Company of all estimated amount as provided in the second clause) but not before possession shall have been taken under the provisions of the Land Acquisition Act 1894 the said land to the Company and shall execute and do all such acts and deeds as may be necessary and proper for effectually vesting the same in the Company.
4. In case, the Company has offered the land and construction etc. in it as security with the previous sanction of the Government for raising loans from Financial Institutions/Banks etc. within India and6924 राजपत्र, हिमाचल प्रदेश, 27 फरवरी, 2010/8 फाल्गुन, 1931 outside, the Government shall not have recourse to its right or resumption of the lands under this clause, during the period such loan is outstanding.
5. The said land shall be held by the Company for the purpose for which it is acquired or purpose legitimately connected as is hereinbefore mentioned and without the sanction in writing of the said Government of Himachal Pradesh first had and obtained for no other purpose whatsoever.
6. Should the said land held by the Company is not used for the purpose for which it is acquired legitimately connected as is hereinbefore mentioned within a period of three years from the date on which possession of the said land shall have been given to the Company within such further period as in its discretion may be prescribed or allowed by the State Government of Himachal Pradesh or should the lands at any time thereafter cease for a period of 36 consecutive months or ceased to be required for the purpose or purposes provided for in the foregoing 4th clause and in any such case the said Government may summarily re-enter upon and take possession of the said land together with all buildings thereon whether such buildings were erected before or after transfer of the land to the Company and thereupon the interest of the Company in the said land and buildings shall cease and determine.
7. The approval is subject to the condition that R & R Plan and other environmental issues shall be implemented in letter and spirit by the Company. IN WITNESS whereof the seal of the Company has been affixed and the Government of the State of Himachal Pradesh hereinto set his hand and seal, the day month and year hereinabove mentioned.
