सं0 318/1/2010 (1)सं0 318/1/2010 (1)सं0 318/1/2010 (1)सं0 318/1/2010 (1)....-----यतः, भारत के राष्ट्रपति ने लोक प्रतिनिधित्व अधिनियम, 1951 (1951 का 43) की धारा 12 के अधीन ज़ारी और भारत के राजपत्र में 9 मार्च, 2010 को प्रकाशित अधिसूचना द्वारा नीचे की सारणी के स्तम्भ (1) में विनिर्दिष्ट राज्यों की विधान सभा के प्रत्येक सदस्य से यह अपेक्षा की है कि उक्त सारणी के स्तम्भ (2) में राज्यों के सामने विनिर्दिष्ट संख्या में सदस्य निर्वाचित कर दें ।

अतः अब, उक्त अधिनियम की धारा 39 की उपधारा (1) और धारा 56 के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्वारा :--

(अ) उक्त वर्णित राज्यों में प्रत्येक निर्वाचन के सम्बंध में :--

(क) नाम निर्देशन करने की अन्तिम तारीख - 16 मार्च, 2010 (मंगलवार) (ख) नाम निर्देशन की संवीक्षा की तारीख - 17 मार्च, 2010 (बुधवार) (ग) अभ्यर्थिताएं वापस लेने की अंतिम तारीख- 19 मार्च, 2010 (शुक्रवार) (घ) वह तारीख, जिसको यदि आवश्यक हुआ तो मतदान होगा, और 26 मार्च, 2010 (शुक्रवार) 7030 राजपत्र, हिमाचल प्रदेश, 9 मार्च, 2010/18 फाल्गुन, 1931 (ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा 29 मार्च, 2010 (सोमवार) नियत करता है; और,

(इ) 9.00 बजे पूर्वाहन्‌ से 4.00 बजे अपराह्‌न तक का समय, उस समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ है तो, निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को, मतदान होगा।

No. 318/1/2010 (1).—Whereas, the President of India has, by notification issued under section 12 of the Representation of the People Act, 1951(43 of 1951) and published in the Gazette of India on 9th March, 2010, been pleased to call upon the elected members of each of the Legislative Assemblies of the States, specified in column (1) of the TABLE below, to elect to the Council of States, the number of members specified against that State in column (2) of the said TABLE:

Now, therefore, in pursuance of sub-section (1) of section 39 and section 56 of the said Act, the Election Commission of India hereby—

(A) appoints, with respect to the said election; , (a) the 16th March, 2010 (Tuesday), as the last date for making nominations; (b) the 17th March, 2010 (Wednesday), as the date for the scrutiny of the nominations; (c) the 19th March, 2010 (Friday), as the last date for the withdrawal of candidatures; (d) the 26th March, 2010 (Friday), as the date on which a poll shall, if necessary, be taken; and

(e) the 29th March, 2010 (Monday), as the date before which the election shall be completed; and

(B) fixes the hours from 9:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken in all the above mentioned States on the date specified above for the election.

Notice is hereby given that:—

1. An election is to be held of a Member to the Council of States by the elected members of the Himachal Pradesh Legislative Assembly;

2. nomination papers may be delivered by a candidate or any of his proposer to the Returning Officer (Secretary, Himachal Pradesh Vidhan Sabha) or Assistant Returning Officer Under Secretary, Himachal Pradesh Vidhan Sabha in the room of Secretary, Himachal Pradesh Vidhan Sabha (Administrative Block), Shimla-171004, between 11.00 A.M. and 3.00 P.M. on any day (other than public holiday) not later than the 16th March 2010 (Tuesday).

3. Forms of nomination paper may be obtained at the place and times aforesaid;

4. Nomination papers will be taken up for scrutiny in the room of the Secretary, Himachal Pradesh Vidhan Sabha (Administrative Block), Shimla-171004 on the 17th March, 2010 (Wednesday) at 11.00 A.M.

5. Notice of withdrawal of candidature may be delivered either by a candidate or his proposer or his election agent (who has been authorized in writing by the candidate to deliver it) to either of the officers specified in paragraph (2) above at his office before 3.00 P.M. on the 19th March, 2010 (Friday);

6. In the event of the election being contested, the poll will be taken on the 26th March, 2010 (Friday) between the hours 9.00 A.M. and 4.00 P.M.

No. LLR-E(9)-21/2005-Leg.— WHEREAS, Shri Vidya Sagar, Advocate, Jawali has applied for appointment as Public Notary under the Notaries Act, 1952 (53 of 1952) and the Notaries Rules, 1956 made thereunder, within the territorial limits of Sub-Division Jawali of District Kangra;

AND WHEREAS, all the formalities required under the said Act and Rules have been completed;

NOW, therefore, the Governor, Himachal Pradesh, on the recommendations of the Interview Board, constituted under sub-rule (2) of rule 7A of the said rules, and in exercise of the powers conferred by section 3 of the said Act, read with rule 8 of the said rules, is pleased to appoint Shri Vidya Sagar, Advocate as Public Notary within the limits of Sub-Division Jawali of District Kangra, Himachal Pradesh with immediate effect with the direction that his name may be entered in the Register of Notaries maintained by the Government.

अतः हिमाचल प्रदेश के राज्यपाल, उक्त नियमों के नियम 7क के उप-नियम (2) के अन्तर्गत गठित साक्षातकार बोर्ड की सिफारिश पर उक्त नियमों के नियम 8 के साथ पठित उक्त अधिनियम की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, श्रीमती रमिता कुमारी, अधिवक्ता को उप-मण्डल जोगिन्दरनगर, जिला मण्डी की सीमाओं के भीतर तुरन्त प्रभाव से पब्लिक नोटरी नियुक्त करते हैं तथा यह भी निदेश देते हैं कि इनका नाम सरकार द्वारा इस निमित बनाए गए रजिस्टर में दर्ज कर लिया जाए।

ORDER

Shimla-171002, the 3rd March, 2010

No. GAD(A)-F(4)-42/80-II.—WHEREAS, Capt.(Retd.) Virinder Singh, Deputy Director, Sainik Welfare Department was charge-sheeted vide this department Memorandum No. GAD(A)- F(4)-42/80 dated 6-6-1997 for imposition of major penalty under Rule 14 of the Central Civil Services (Classification, Control and Appeal ) Rules, 1965.

2. WHEREAS, the Commissioner Departmental Enquiries, H.P. was appointed as Inquiry Officer to inquire in to the charges framed against Capt.(Retd.) Virinder Singh under Sub- rule 2 of Rule 14 ibid.

3. WHEREAS, the Inquiry Officer submitted his enquiry report vide his letter No. Conf.

E.O.-28/97 –Inq.-CDE, dated 14th February, 2000.

4. WHEREAS Capt. (Retd.) Virinder Singh, Deputy Director, was afforded an opportunity to make representation on the enquiry report as required under Rule 15 of CCS (CCA) Rules 1965.

5. WHEREAS the said Capt.(Retd.) Virinder Singh availed of the opportunity of, personal hearing which was also duly considered.

6. WHEREAS after taking in account the finding of the Inquiry Officer and on careful consideration of the facts and circumstances, the finding of the Inquiry Officer were accepted in toto,

WHEREAS the Governor, Himachal Pradesh in exercise of the power conferred by Rule 11 (viii) of CCS(CCA) Rules 1965 ordered the imposition of major penalty of removal from service upon the said Capt.(Retd.) Virinder Singh with effect from 22-11-2000 vide order No. GAD(A)F(4)-42/80-II dated 22nd November, 2000.

8. WHEREAS, the above Sh. Virinder Singh filed O.A.NO. /TA No. 3995/2000 in the Administrative Tribunal (now scrapped) in which the Administrative Tribunal dismissed the said OA on 5-4-2005 and Capt. (Retd.) Virinder Singh filed CWP-537/2005 titled as Captain Virinder Singh VS State of HP in the Hon'ble High Court HP for quashing and setting aside the orders of his removal from service.

9. WHEREAS the Hon'ble High Court H.P. in its judgment dated 31-3-2009 passed in above CWP has set aside the impugned order of Himachal Pradesh Administrative Tribunal and also the impugned order No. GAD(A)F(4) -42/80-II dated 22nd November, 2000 imposing penalty of removal from service upon said Shri Virinder Singh.

10. AND NOW THEREFORE, the Governor, Himachal Pradesh after reconsidering the points again is pleased to cancel the order passed vide letter No.GAD (A)F(4)42/80-II dated 22-11-2000 i.e. removal from service and in exercise of the power under rule 11(iii) CCS (CCA) Rules,1965 do hereby impose the penalty of recovery of the deemed salary for the period of 15-1-1995 to 5-3-1995 and also 19-8-1995 to 5-9-1995 total period of 68 days from the amount payable to above Capt. (Retd) Virinder Singh, Deputy Director. The Governor, Himachal Pradesh is further pleased to order that the intervening period between the date of removal from service w.e.f 22-11-2000 to 31-1-2008 the date of superannuation of Capt. (Retd) Virinder Singh above be treated as period spent on duty and the arrears of pay and other retiral benefits be released to him as per rules in public interest.
