संख्यासंख्यासंख्यासंख्या गृ गृ गृ गृह (क)क (1)-7/ह (क)क (1)-7/ह (क)क (1)-7/ह (क)क (1)-7/2007200720072007....--------हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश पुलिस अधिनियम, 2007 (2007 का अधिनियम संख्या 17) की धारा 141 के साथ पठित धारा 17 की उपधारा(3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पूर्वोक्त अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाना प्रस्तावित करती हैं और एतद्‌द्वारा पूर्वोक्त अधिनियम की धारा 117 के अधीन यथा अपेक्षित के अनुसार इन नियमों के द्वारा संभाव्यतः प्रभावित होने वाले जनसाधारण की जानकारी हेतु इन्हें राजपत्र, हिमाचल प्रदेश में प्रकाशित करती हैंः-

प्रस्तावित नियमों द्वारा संभाव्यतः प्रभावित होने वाले व्यक्ति ने, यदि इन नियमों के विषय में कोई आक्षेप या सुझाव करना/देना हो तो वह उसे इन नियमों के राजपत्र में प्रकाशन की तारीख से पन्द्रह दिन के भीतर, सचिव (गृह) हिमाचल प्रदेश सरकार, शिमला-2 को भेज सकेगाः-

39-राजपत्र/2010-29-5-2010 (939) 940 राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 उक्त नियत अवधि के भीतर, यदि कोई आक्षेप या सुझाव प्राप्त होते हैं, तो उन पर उक्त नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ः-

8888.... निरर्हताएंनिरर्हताएंनिरर्हताएंनिरर्हताएं....--------कोई भी व्यक्ति-(क) जिसने ऐसे व्यक्ति के साथ विवाह करार पाया है या किया है, जिसके एक जीवित पति/पत्नी है या

(ख) जिसने जीवित पति/पत्नी के रहते हुए किसी व्यक्ति से विवाह करार पाया है या किया है, सेवा में नियुक्ति के लिए पात्र नहीं होगाः

परन्तु यदि, सरकार का यह समाधान हो जाता है कि ऐसे व्यक्ति को लागू स्वीय विधि के अधीन ऐसा विवाह करना अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो यह किसी व्यक्ति को इस नियम के प्रवर्तन (लागू होने ) से छूट दे सकेगी ।

9999.... स्थानान्तरण का दायित्व स्थानान्तरण का दायित्व स्थानान्तरण का दायित्व स्थानान्तरण का दायित्व....--------सेवा का प्रत्येक सदस्य हिमाचल प्रदेश राज्य के किसी भी स्थान पर सेवा करने के लिए बाध्य/दायी होगा । राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 941 10101010.... आरक्षणआरक्षणआरक्षणआरक्षण....--------सीधी भर्ती के साथ-साथ प्रोन्नति में अनुसूचित जाति/अनुसूचित जनजाति/अन्य पिछडे़ वर्ग/भूतपूर्व सैनिक इत्यादि के लिए पदों में आरक्षण, सरकार द्वारा उक्त विषय पर समय-समय पर जारी अनुदेशों के अनुसार होगा ।

11111111.... एक पंक्ति(रैंक) से अन्य प्रोन्नतिएक पंक्ति(रैंक) से अन्य प्रोन्नतिएक पंक्ति(रैंक) से अन्य प्रोन्नतिएक पंक्ति(रैंक) से अन्य प्रोन्नति....--------पुलिस संचार एवं तकनीकी सेवाएं निदेशालय का कोई भी कर्मचारी, एक पंक्ति (रैंक) से अन्य में प्रोन्नति हेतु पात्र नहीं होगा, यदिः--

(क) उसने पिछले तीन वर्षों (विभागीय प्रोन्नति समिति की बैठक की तारीख से संगणित किए जाने वाले) के दौरान मुख्य दण्ड पाया है; या

(ख) उसने पिछले छह मास (विभागीय प्रोन्नति समिति की बैठक की तारीख से संगणित किए जाने वाले) के दौरान परिनिंदा का दण्ड पाया हैः

परन्तु पुलिस महानिदेशक किसी भी कर्मचारी को विशिष्ट सेवा और कर्मचारी के अनुकरणीय आचरण की दषा में इस नियम के प्रवर्तन से छूट दे सकेगा ।

12121212.... आरक्षियोंआरक्षियोंआरक्षियोंआरक्षियों (कॉंस्टेबलों) की भर्ती (कॉंस्टेबलों) की भर्ती (i) सीधी भर्ती के लिए आयुसीधी भर्ती के लिए आयुसीधी भर्ती के लिए आयुसीधी भर्ती के लिए आयु....-----(क) आरक्षी (कॉंस्टेबल) के पद (कॉंस्टेबलों) की भर्ती (कॉंस्टेबलों) की भर्ती पर भर्ती के लिए आयु सीमा बीस से पच्चीस वर्ष होगीः

परन्तु अनुसूचित जाति/अनुसूचित जनजाति और अन्य पिछडे़ वर्ग के अभ्यर्थियों के लिए ऊपरी आयु सीमा सताईस वर्ष होगी।

(ख) सीधी भर्ती के लिए आयु सीमा की गणना उस मास के प्रथम दिवस से की जाएगी जिसमें पद (पदों) को आवेदन आमंत्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है ।

(ख) वांछवांछवांछवांछनीयनीयनीयनीय :ःःः हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान।

(iii) श्श्श्शारीरिक मापदण्डाारीरिक मापदण्डाारीरिक मापदण्डाारीरिक मापदण्ड....--------(क) ऊंचाई (1) अन्य पिछड़ा वर्ग (ओ.बी.सी.) सहित सामान्य वर्ग के अभ्यर्थियों के लिए । पुरुष : 5'-6'' महिला ः 5'-2''

(2) अनुसूचित जाति/अनुसूचित जनजाति के अभ्यर्थियों के लिए। पुरुष : 5'-6'' महिला ः 5'-2''

(ख) छाती : केवल पुरुष अभ्यर्थियों के लिए। (1) सामान्य और अन्य पिछड़ा वर्ग (ओ.बी.सी.) 31'' X 32''

(2) अनुसूचित जाति/अनुसूचित जनजाति 29'' X 30''

(iv) भर्ती की पद्धतिभर्ती की पद्धतिभर्ती की पद्धतिभर्ती की पद्धति....--------शतप्रतिशत सीधी भर्ती द्वारा : भर्ती बोर्ड द्वारा भर्ती की जाएगी, जिसका प्रमुख उप महानिरीक्षक पुलिस, हिमाचल प्रदेश से नीचे की पंक्ति का अधिकारी नहीं होगा । बोर्ड के अन्य सदस्य महानिरीक्षक पुलिस, हिमाचल प्रदेश द्वारा नाम निर्दिश्ट किए जाएंगे ।

प्रथमतः, अभ्यर्थियों का ऊपर यथावर्णित शारीरिक माप लिया जाएगा । अपेक्षित शारीरिक मापदण्ड के अनुरूप पाया गए अभ्यर्थियों की भर्ती की भर्ती परीक्षा ली जाएगी, जो निम्नलिखित होगीः- 942 राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 1. लिखित परीक्षा 70 अंक 2. शारीरिक दक्षता परीक्षा 20 अंक 3. व्यक्तित्व परीक्षा 10 अंक

कुल 100 अंक

ाारीरिक दक्षता परीक्षा....--------शारीरिक दक्षता परीक्षा निम्नलिखित विषयों में से गठित होगी, अर्थातः- (v) श्श्श्शारीरिक दक्षता परीक्षा ाारीरिक दक्षता परीक्षा ाारीरिक दक्षता परीक्षा

(vi) नियुक्ति और अनुश्नियुक्ति और अनुश्नियुक्ति और अनुश्नियुक्ति और अनुशासनाासनाासनाासन अधिकारीअधिकारीअधिकारीअधिकारी....-----(क) पुलिस अधीक्षक (सी. टी. एस.) आरक्षी (कॉंस्टेबल) का नियुक्ति और अनुशासन प्राधिकारी (सी. टी. एस.) होगा। भर्ती बोर्ड द्वारा चयनित अभ्यर्थियों को नियुक्ति प्राधिकारी द्वारा, उनको आरक्षी (कॉंस्टेबल) के पद के लिए चिकित्सक दृष्टया योग्य घोषित किए जाने के पश्चात्‌ तथा सत्यापन पर, उनके चरित्र और पूर्ववृत्त के संतोषजनक पाए जाने पर नियुक्ति अस्थायी रूप से प्रस्थापित की जाएगी। नियुक्त किए गए कर्मचारी को बुनियादी रंगरूट प्रशिक्षण सफलतापूर्वक पूर्ण करना होगा। यदि नियुक्त किया गया कोई कर्मचारी बुनियादी रंगरूट प्रशिक्षण को पास न कर सके, तो उसकी सेवा समाप्त की जाएगी।

(ख) बुनियादी रंगरूट प्रशिक्षण को सफलतापूर्वक पूर्ण करने के पश्चात्‌, नियुक्त कर्मचारियों को ग्रेड-III तकनीकी पाठ्‌यक्रम करना होगा। राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 943 13131313.... मुख्य आरक्षी की पंक्ति कीमुख्य आरक्षी की पंक्ति कीमुख्य आरक्षी की पंक्ति कीमुख्य आरक्षी की पंक्ति की प्रोन्नति (सूची 'सी' के लिएप्रोन्नति (सूची 'सी' के लिएप्रोन्नति (सूची 'सी' के लिएप्रोन्नति (सूची 'सी' के लिए प्रवेश) प्रवेश) प्रवेश) प्रवेश)....--------(1) मुख्य आरक्षी की पंक्ति (रैंक) में प्रोन्नति निम्नलिखित रीति में की जाएगीः-

बुनियादी (बेसिक) भर्ती प्रशिक्षण के सफलतापूर्वक पूर्ण होने के तुरन्त पश्चात्‌, नियुक्त व्यक्तियों को पुलिस संचार एंव तकनीकी सेवाएं निदेशालय द्वारा संचालित किए जाने वाले ग्रेड-III (तकनीकी पाठ्‌यक्रम) में रखा जाएगा। ग्रेड-III पाठ्‌यक्रम के लिए अभ्यर्थियों के लिए नामनिर्देशन, उनके चयन के समय पर, भर्ती बोर्ड द्वारा, उनको समनुदेशित सूची के गुणागुण के अनुसार किया जाएगा। उन आरक्षियों के नामों को, जो ग्रेड-III तकनीकी पाठ्‌यक्रम अर्हित करते हैं, पुलिस अधीक्षक, पुलिस संचार एवं तकनीकी सेवाएं निदेशालय द्वारा बनाई जाने वाली सूची 'सी' में प्रविष्ट किया जाएगा। अभ्यर्थियों के नाम, जिन्हाेंने सफलतापूर्वक ग्रेड- III पाठ्‌यक्रम अर्हित किया है, उनके गुणागुण के क्रम में, जिस में उन्होंने ग्रेड-III पाठ्‌यक्रम अर्हित किया है, के अनुसार सूची 'सी' में प्रविष्ट किए जाएंगे और विशेष भत्ता, यदि पद के साथ कोई है, अनुज्ञात किया जाएगाः परन्तु आरक्षी जो प्रथम प्रयास में ग्रेड-III पाठ्‌यक्रम अर्हित करने में असफल रहते हैं, को छह मास के पश्चात्‌ ग्रेड-III की सम्पूर्ण परीक्षा में प्रवेश का और अवसर दिया जाएगा।

अभ्यर्थी जो पश्चात्‌वर्ती बैच में ग्रेड-III पाठ्‌यक्रम अर्हित करते हैं को, उन अभ्यर्थियों से जिन्होंने पूर्वत्तर बैच में ग्रेड-III पाठ्‌यक्रम अर्हित किया है, के नीचे रखा आएगा।

(2) सूची 'सी' में उन आरक्षियों के नामों को प्रविष्ट करने के पश्चात्‌ और जिन्होंने लाइव सर्किट/ नेटवर्क/वर्कशाप/भण्डार इत्यादि में आठ वर्ष कार्य किया है, रिक्तियों की उपलब्धता के अध्यधीन वे मुख्य आरक्षियों की पंक्ति (रैंक) में प्रोन्नति के लिए पात्र होंगे।

(3) सूचि 'सी' में आरक्षियों की मुख्य आरक्षियों की पंक्ति की उनकी आगामी प्रोन्नति के लिए उपयुक्तता, उप महानिरीक्षक द्वारा गठित विभागीय प्रोन्नति समिति द्वारा न्यायनिर्र्णीत की जाएगी । विभागीय प्रोन्नति, विचारणीय क्षेत्र में आरक्षियों के सेवा अभिलेख का निर्धारण करेगी तथा अयोग्य को अस्वीकृति के अध्यधीन, वरिष्ठता के सिद्धांत के आधार पर सिफारिश करेगी ।

14141414.... प्रोन्नति सूचि 'डी', सहायक उपप्रोन्नति सूचि 'डी', सहायक उपप्रोन्नति सूचि 'डी', सहायक उपप्रोन्नति सूचि 'डी', सहायक उप निरनिरनिरनिरीीीीक्षक की पंक्ति में ग्रेड-क्षक की पंक्ति में ग्रेड-क्षक की पंक्ति में ग्रेड-क्षक की पंक्ति में ग्रेड- II प्रोन्नति में प्रवेश प्रोन्नति में प्रवेश प्रोन्नति में प्रवेश प्रोन्नति में प्रवेश....-----(1) मुख्य आरक्षियों की बाबत जिनके लिए सहायक उप निरीक्षक की पंक्ति में प्रोन्नति के लिए विचार किया जाना है, प्रोन्नति सूचि 'डी' उप महानिरीक्षक द्वारा अनुरक्षित की जाएगी । समस्त मुख्य आरक्षी-

(क) जिन्होंने मुख्य आरक्षी की पंक्ति में कम से कम पांच वर्ष की सेवा पूर्ण कर ली हो; और (ख) जिन्होंने समाधानपूर्वक लाइव सर्किट/ नैटवर्क/ वर्कशाप/भण्डार इत्यादि में कार्य किया हो, सूचि 'डी' में प्रोन्नति पर अपने नामों की प्रवृष्टि के लिए पात्र होंगे ।

(2) प्रोन्नति सूचि 'डी' में प्रवेश के लिए चयन, विभागीय प्रोन्नति समिति द्वारा पात्र मुख्य आरक्षियों में से वर्ष में एक बार किया जाएगा । विभागीय प्रोन्नति समिति, सेवा अभिलेखों/वार्षिक गोपनीय रिर्पोटों के परीक्षण के आधार पर प्रोन्नति सूचि 'डी' में प्रवेश के लिए मुख्य आरक्षियों की उपयुक्तता का निर्णय करेगी । विभागीय प्रोन्नति समिति का संचालन करते समय, पुलिस मुख्यालय द्वारा कार्यकारी पुलिस (एक्जीक्यूटिव पुलिस) में समानान्तर पंक्ति के लिए विरचित नियमों और मानकों का अनुसरण किया जाएगा । प्रोन्नति सूचि 'डी' में नाम प्रविष्ट करते समय पुलिस अधीक्षक, उनकी पारस्परिक वरिष्टता बनाए रखेगा ।

(3) प्रोन्नति सूचि 'डी' में रखे गए मुख्य आरक्षी को रिक्तियों की उपलब्धता के अध्यधीन समय-समय पर ग्रेड- II पाठ्‌यक्रम में प्रशिक्षण दिया जाएगा और इस प्रशिक्षण पाठ्‌यक्रम को अर्हित करने के पश्चात्‌, उसे सेवा अभिलेख/ वार्षिक गोपनीय रिर्पोटों के परीक्षण के पश्चात्‌ सूचि 'डी' की वरिष्ठता के क्रम में, सहायक उप निरीक्षक की पंक्ति में प्रोन्नत किया जाएगा । विभागीय प्रोन्नति समिति संचालित करते समय पुलिस मुख्यालय द्वारा कार्यकारी पुलिस में समानान्तर पंक्तियों के लिए बनाए नियमों और मानकों का अनुसरण किया जाएगा । 944 राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 (4) प्रोन्नति सूचि 'डी' मुख्य आरक्षी, जो ग्रेड- II पाठ्‌यक्रम को अर्हित करने में असफल रहता है, को छह मास के पश्चात्‌ परीक्षा पास करने के लिए दूसरा अवसर दिया जाएगा और इस पाठ्‌यक्रम को अर्हित करने के पश्चात्‌ ही उन्हें सहायक उप निरीक्षक की पंक्ति में प्रोन्नत किया जाएगा, यदि ऐसा मुख्य आरक्षी ग्रेड- II पाठ्‌यक्रम अर्हित करने में पुनः असफल रहता है, तो उसका नाम प्रोन्नति सूचि 'डी' से हटा दिया जाएगा ।

15151515.... प्रोन्नति सूचि 'ई' उप निरीक्षकप्रोन्नति सूचि 'ई' उप निरीक्षकप्रोन्नति सूचि 'ई' उप निरीक्षकप्रोन्नति सूचि 'ई' उप निरीक्षक की पंक्ति की प्रोन्नति के ग्रेड-।की पंक्ति की प्रोन्नति के ग्रेड-।की पंक्ति की प्रोन्नति के ग्रेड-।की पंक्ति की प्रोन्नति के ग्रेड-। के पाठ्‌यक्रम के लिए प्रवेश के पाठ्‌यक्रम के लिए प्रवेश के पाठ्‌यक्रम के लिए प्रवेश के पाठ्‌यक्रम के लिए प्रवेश....-------- (1) उप निरीक्षक की पंक्ति (रैंक) में साठ प्रतिशत्‌ पद, पात्र सहायक उप-निरीक्षकों में से प्रोन्नति द्वारा भरे जाएंगे ।

(2) सहायक उप-निरीक्षकों की बाबत, जिन पर उप-निरीक्षक की पंक्ति की प्रोन्नति के लिए विचार किया जाना है प्रोन्नति सूचि 'ई' उप महानिरीक्षक द्वारा बनाई रखी जाएगी । समस्त सहायक उप-निरीक्षकों- (क) जिन्होंने ग्रेड-I पाठ्‌यक्रम उर्तीण करने के पश्चात्‌ प्रोन्नति पर सहायक उप निरीक्षक की पंक्ति में कम से कम पांच वर्श की सेवा पूर्ण कर ली हो, पर प्रोन्नति के लिए विचार किया जाएगा ।

(ख) प्रोन्नति सूचि 'ई' में प्रवेश के लिए चयन, उप-महानिरीक्षक द्वारा गठित विभागीय प्रोन्नति समिति द्वारा, पात्र सहायक उप-निरीक्षकों में से वर्ष में एक बार किया जाएगा । विभागीय प्रोन्नति समिति, सेवा अभिलेखों/वार्षिक गोपनीय रिर्पोटों के परीक्षण के पश्चात्‌ प्रोन्नति सूचि 'ई' के प्रवेश के लिए पात्र सहायक उप-निरीक्षक की उपयुक्तता को देखेगी । विभागीय प्रोन्नति समिति का संचालन करते समय पुलिस मुख्यालय द्वारा कार्यकारी पुलिस में समानांतर पंक्ति के लिए विरचित नियमों और मानकों का अनुसरण किया जाएगा । (3) सूचि 'ई' में रखे गए सहायक उप-निरीक्षक को ग्रेड-। पाठ्‌यक्रम में परीक्षण दिया जाएगा और इस पाठ्‌यक्रम को अर्हित करने के पश्चात्‌ सेवा अभिलेख/वार्षिक गोपनीय रिर्पोटों के परीक्षण के पश्चात्‌ सूचि 'ई' में वरिष्टता के आधार पर उप-निरीक्षक की पंक्ति में प्रोन्नत किया जाएगा । विभागीय प्रोन्नति समिति का संचालन करते समय पुलिस मुख्यालय द्वारा कार्यकारी पुलिस में समानान्तर पंक्ति के लिए विरचित नियमों और मानकों का अनुसरण किया जाएगा ।

(4) प्रोन्नति सूचि 'ई' पर सहायक उप-निरीक्षक, जो ग्रेड-। पाठ्‌यक्रम अर्हित करने में असफल रहते हैं, तो छह मास की अवधि के पश्चात्‌ परीक्षा पास करने के लिए दूसरा अवसर दिया जाएगा और उन्हें यह पाठ्‌यक्रम अर्हित करने के पश्चात्‌ ही उप-निरीक्षक की पंक्ति (रैंक) में प्रोन्नत किया जाएगा। यदि ऐसा सहायक उप-निरीक्षक पुनः ग्रेड-I पाठ्‌यक्रम को अर्हित करने में असफल रहता है, तो उसका नाम प्रोन्नति सूचि 'ई' से हटा दिया जाएगा ।

(5) उप-निरीक्षकों के पदों के शेष चालीस प्रतिशत्‌ पद, भर्ती की दो पद्धतियों अर्थात्‌ बीस प्रतिशत्‌ सीधी भर्ती के माध्यम से और बीस प्रतिशत सीमित विभागीय प्रतियोगी परीक्षाओं के संचालन द्वारा भरे जाएंगे । इन पदाें के लिए शेैक्षिक अर्हता, किसी मान्यता प्राप्त संस्थान(ओं) से इंजीनियरिंग स्नातक/टैक्नोलोजी (प्रौद्योगिकी) स्नातक/इंजीनियर्स संस्थान (इलैक्ट्रोनिकस और दूरसंचार इंजीनियरिंग/कम्पयूटर विज्ञान/ सूचना प्रोैद्योगिकी) के सहयुक्त सदस्य या कम्पयूटर एप्लीकेशन में स्नातकोतर/इलैक्ट्रोनिक एक्रीडीटेशन सर्टिफिकेट कोर्स विभाग (डीओईएसीसी) से ''बी'' स्तर प्रमाण पत्र या इसके समतुल्य होगी ।

(6) बीस प्रतिशत्‌ पदोें की सीधी भर्ती, हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड के माध्यम से की जाएंगी । इन पदों के लिए शैक्षिक अर्हता, किसी मान्यता प्राप्त संस्थान(ओं) से इंजीनियरिंग स्नातक/प्रोद्योगिकी स्नातक/इंजीनियर्स संस्थान (इलैक्ट्रोनिकस और दूरसंचार इंजीनियरिंग/कम्पयूटर विज्ञान/सूचना प्रोद्योगिकी) के सहयुक्त सदस्य या कम्पयूटर एप्लीकेशन में स्नातकोतर/इलैक्ट्रोनिक एक्रीडीटेशन सर्टिफिकेट कोर्स विभाग(डी ओईएसीसी) से ''बी'' स्तर प्रमाण पत्र या इसके समतुल्य होगी । सीधे भर्ती किए गए उप-निरीक्षकों को, पुलिस प्रशिक्षण महाविद्यालय में नौ मास का भर्ती प्रशिक्षण पाठ्‌यक्रम करना पडे़गा । भर्ती प्रशिक्षण पाठ्‌यक्रम को उतीर्ण करने के पश्चात्‌, उन्हें पुलिस संचार एवं तकनीकी सेवा प्रशिक्षण स्कूल में एक मास की अवधि के लिए तकनीकी पाठ्‌यक्रम भी करना पड़ेगा । राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 945 (7) शेष बीस प्रतिशत्‌ पद मान्यता प्राप्त संस्थान(ओं) से शैक्षिक अर्हता अर्थात्‌ इंजीनियरिंग स्नातक/ प्रोद्योगिकी स्नातक/इंजीनियर्स संस्थान (इलैक्ट्रोनिकस और दूरसंचार इंजीनियरिंग/कम्पयूटर विज्ञान/सूचना प्रोद्योगिकी) के सहयुक्त सदस्य या कम्पयूटर एप्लीकेशन में स्नातकोतर/इलैक्ट्रोनिक एक्रीडीटेशन सर्टिफिकेट कोर्स विभाग(डी ओईएसीसी) से ''बी'' स्तर प्रमाण पत्र या इसके समतुल्य अर्हता रखने वाले कर्मचारियों में से हिमाचल प्रदेश अधीनस्थ सेवाएं चयन बोर्ड, हमीरपुर द्वारा संचालित विभागीय प्रतियोगी परीक्षा द्वारा भरे जाएंगे। निदेशालय में न्यूनतम सात वर्ष की सेवा वाले तथा पन्तालीस (45) वर्ष से अनधिक आयु वाले कर्मचारी, सीमित विभागीय प्रतियोगी परीक्षा में प्रवेश होने हेतु पात्र होंगे, ऐसा न होने पर पद(पदों) की सीधी भर्ती को कोटे से भरा जाएगा । जो कर्मचारी विभागीय प्रतियोगी परीक्षाओं में अर्हता प्राप्त करते हैं, वे पुलिस संचार एवं तकनीकी सेवाएं प्रशिक्षण स्कूल में ग्रेड-I पाठ्‌यक्रम करेंगे ।

(8) उप- निरीक्षक के पद पर भर्ती के लिए शारीरिक मापदण्ड सीधी भर्ती और विभागीय अभ्यर्थियों के लिए वही होंगे, जो इन नियमों के नियम 12 के खण्ड (v) में यथावर्णित हैं ।

(9) प्रोन्नत किए गए कर्मचारियों और सीधे भर्ती किए गए कर्मचारियों की पारस्परिक वरीयता, प्रोन्नति और सीधी भर्ती के लिए नियत अनुपात के आधार पर नियत की जाएगी ।

16161616.... प्रोन्नति सूचि 'एफ', निरीक्षक केप्रोन्नति सूचि 'एफ', निरीक्षक केप्रोन्नति सूचि 'एफ', निरीक्षक केप्रोन्नति सूचि 'एफ', निरीक्षक के पद पपद पपद पपद पर प्रर प्रर प्रर प्रोन्नतिोन्नतिोन्नतिोन्नति....-----(1) प्रोन्नति सूचि 'एफ' वर्ष में एक बार उप-महानिरीक्षक पुलिस द्वारा तैयार की जाएगी । इस सूचि के लिए चयन, महानिदेशक, पुलिस, हिमाचल प्रदेश द्वारा इस प्रयोजन के लिए बुलाई गई विभागीय प्रोन्नति समिति की सहायता से किया जाएगा । प्रोन्नति सूचि 'एफ' में अपने नामों को सम्मिलित करवाने के लिए केवल वही अधिकारी पात्र होंगे, जो उप-निरीक्षक की पंक्ति में कम से कम पांच वर्ष की सेवा के साथ अधिष्ठायी उप निरीक्षक हैं ।

(2) निरीक्षक की पंक्ति हेतु प्रोन्नति, वरिष्ठता सूचि 'एफ' के अनुसार की जाएगी । पुलिस महानिरीक्षक की अध्यक्षता वाली विभागीय प्रोन्नति समिति, सेवा विशिष्टियों/वार्षिक गोपनीय रिर्पोंटों की जांच-पड़ताल करेगी और निरीक्षक की पंक्ति के लिए प्रोन्नति हेतु पात्र उप-निरीक्षकों के नामों की सिफारिश करेगी । विभागीय प्रोन्नति समिति के संचालन के समय, पुलिस मुख्यालय द्वारा कार्यकारी पुलिस में समानांतर पंक्तियों के लिए बनाए गए नियमों और मानकों का अनुसरण किया जाएगा ।

(2) ऐसे निरसन के होते हुए भी, उपर्युक्त नियम 2 (1) के अधीन इस प्रकार निरसित नियमों या स्थायी आदेश के अधीन की गई कोई नियुक्ति या कोई बात या कोई कार्रवाई, इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी ।

No. Home (A) A (1) -7/2007.—In exercise of powers conferred by section sub-section (3) of section 17 read with section 141 of the Himachal Pradesh Police Act, 2007,(Act No.17 of 2007) the Governor of Himachal Pradesh proposes to make the following rules to carry out the purposes of the Act ibid and the same are hereby published in the Rajpatra, Himachal Pradesh for the general information of the public likely to be affected by these rules as required under section 117 of the Act ibid;-

If any person (s) likely to be affected by the proposed rules has any objection or suggestions to make with regard to these rules, he may send the same to the Secretary (Home) to the Government of Himachal Pradesh, Shimla-2 within a period of 15 days from the date of publication of these rules in the Rajpatra , Himachal Pradesh;-

The objection(s) or suggestion(s), if any, received within the above stipulated period shall be taken into consideration before finalizing the above rules, namely:-

DRAFT RULES

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Directorate of Police Communication and Technical Services, Non Gazetted Officers, Grade - I and Grade-II, Recruitment and Promotion Rules, 2010.

(2) These rules shall come into force from the date of their final publication in the Rajpatra, Himachal Pradesh.

2. Names of the posts.— (a) Constable (b) Head Constable (c) Assistant Sub- Inspector (d) Sub Inspector (e) Inspector

3. Number of Posts.— (a) Constable = 212 (b) Head Constable = 136 (c) Assistant Sub-Inspector = 139 (d) Sub Inspector = 63 (e) Inspector = 23

5. Classification of posts.—C lass III (Non –Gazetted)राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 947 6. Nationality, domicile and character of persons to be appointed to a service.—A candidate for appointment to any post must be a citizen of India.

7. Probation.—A person appointed to any post in a service shall remain on probation for a period of two years.

8. Disqualification.—No person- (a) who has entered into or contracted a marriage with a person having a spouse living or

(b) who, having a spouse living has entered into or contracted a marriage with any person shall be eligible for appointment to a service:

Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other grounds for so doing, exempt any person from operation of this rule.

9. Liability to transfer.—A member of the service shall be liable to serve at any place in the State of Himachal Pradesh.

10. Reservation.—Reservation of posts for SC/ST/OBC/Ex-serviceman etc. in direct recruitment as well as in promotions shall be as per instructions of Government on the subject from time to time.

11. Promotion from one rank to another.—No employee of the Directorate of Police Communication and Technical Services shall be eligible for promotion from one rank to another, if-

(a) he has earned a major punishment during the last three years (to be reckoned from the date of meeting of DPC); or

(b) he has been awarded punishment of censure during the last six months to be reckoned from the date of meeting of DPC:

Provided that the Director General of Police may exempt any employee from the operation of this rule in the event of distinguished service and exemplary conduct of the employee.

12. Recruitment of Constables.— (i) Age for Direct Recruitment.—(a) The age limit for recruitment to the post of Constable shall be between 20 to 25 years:

Provided that the upper age limit for the candidates belonging to Scheduled Castes/ Scheduled Tribe and other Backward Classes (OBC) shall be 27 years.

(b) Age limit for direct recruitment shall be reckoned on the first day of the month in which the post (s) is /are advertised for inviting applications or notified to the Employment Exchange as the case may be.

(ii) Minimum Education and other qualifications required for direct recruitment.— (a) Essential.—Should be a Matriculate with Engineering Diploma courses of 3 years duration in Computer Science /Electronic and Telecommunication/Information Technology from a recognized Board /Institute.

(b) Desirable.—Knowledge of customs, manners and dialects of Himachal Pradesh.

(iii) Physical Standard : (a) Height: For candidates Male 5'-6" belonging to Female 5'-2" General Category including OBC. For candidates Male 5'-4" belonging to Female 5'-0" SC/ST (b) Chest: For male candidates only:- (a) General and OBC 31"x32" (b) SC/ST 29"x30"

(iv) Method of Recruitment.—100% by direct recruitment:

The recruitment shall be made by a Recruitment Board headed by an officer not below the rank of Deputy Inspector General of Police. Other members of Board shall be nominated by the Director General of Police, Himachal Pradesh.

In the first instance, the candidates shall be subjected to physical measurements as mentioned above. Those candidates who conform to the required Physical standard shall be put to a Recruitment Test consisting of following :—

1. Written Test 70 Marks 2. Physical Efficiency Test 20 Marks 3. Personality Test 10 Marks

Total 100 Marks

(v) Physical efficiency test.—The physical efficiency test shall consist of the following events, namely :—

(vi) Appointing and Disciplinary authority.—(a) The Superintendent of Police (CTS) shall be the Appointing and Disciplinary authority of Constable (CTS).

The candidates selected by the Recruitment Board shall be offered appointment temporarily by the appointing authority after they are declared medically fit for the post of Constable (CTS) and their character and antecedent found satisfactory on verification. The appointees shall successfully complete the Basic Recruits Training. In case, an appointee is unable to pass the Basic Recruits Training, his services shall be terminated.

(b) After Successful completion of Basic Recruit's Training, the appointees shall be subjected to Grade-III Technical course.

13. Promotion to the rank of Head Constable (Admission to list C).—(1) The promotions to the rank of Head Constable shall be made in the following manner:-

Immediately after successful completion of Basic Recruit Training, the appointees shall be put to Grade –III (Technical course) to be conducted by Directorate of Police Communication and Technical Services. The nomination of candidates for Grade-III course shall be made as per the merit assigned to them by the Recruitment Board at the time of their selection. The names of the constables who qualify in the Grade-III Technical Course shall be entered in the list "C" which shall be maintained by the Superintendent of Police, Directorate of Police Communication and Technical Services.

The names of the candidates who successfully qualify Grade-III course shall be entered in list "C" in order of their merit in which they have qualified Grade-III course and shall be allowed special allowance, if any, attach to the post:

Provided that those constables who failed to qualify the Grade-III course in first attempt shall be given another chance after six months to appear in the whole of the Grade- III examination.

The candidates who qualify the Grade-III course in subsequent batches shall be placed below the candidates who have qualified the same in earlier batch.

(2) After the names of the Constables are entered in list "C" and they have worked on live circuits/networks/ workshop/ stores etc. for eight years, they shall be eligible for the promotion to the rank of Head Constables subject to the availability of vacancies.

(3) The suitability of Constables on list "C" for their further promotion to the rank of Head Constable shall be adjudged by the Departmental Promotional Committee (D.P.C.) to be constituted by DIG. D.P.C. shall assess the service record of the Constables in the Zone of consideration and make recommendation on the basis of the principle of seniority subject to rejection of unfit.

14. Promotion List-D admission to Grade-II Promotion to the rank of Assistant Sub- Inspector.— (1) Promotion List "D" shall be maintained by the DIG in respect of Head Constables who are considered for promotion to the rank of Assistant Sub- Inspector.

All Head Constables-

(a) who have completed at least five years of services in the rank of Head Constable; and (b) who have satisfactorily worked on live circuits/networks/ workshop/stores etc. shall be eligible for entry of their names on promotion in List "D".

(2) Selection for admission to promotion List "D" shall be made once a year from amongst the eligible Head Constables by the Departmental Promotional Committee shall judge the suitability of eligible Head Constables for admission to the promotion List "D" on the basis of examination of service records/ACRs. While conducting the DPC, the rules and norms framed for the parallel ranks in the executive police by the Police Headquarter shall be followed. While entering the name on promotion List "D", the Superintendent of Police shall maintain their inter-se- seniority.

(3) The Head Constable brought on promotion List "D" shall be given training in Grade-II course from time to time subject to the availability of vacancies and after qualifying this training course he shall be promoted to the rank of Assistant –Sub- Inspector in order of seniority of List "D" after examination of service records /ACRs. While conducting the DPC, the rules and norms framed for the parallel ranks in the executive police by the Police Headquarter shall be followed.

(4) Head Constable on promotion List-D who fails to qualify the Grade-II course shall be given second chance for clearing test after six months and promoted to the rank of Assistant Sub Inspector only after they qualify this course, if such a Head Constable again fails to qualify Grade- II course, his name shall be removed from the promotion List "D".

15. Promotion List-E admission to Grade-I Course Promotion to the rank of Sub- Inspector.—(1) In the rank of Sub Inspector, 60% posts shall be filled up by way of promotion amongst the eligible Assistant Sub Inspectors.

(2) Promotion list "E" shall be maintained by the DIG in respect of Assistant Sub Inspectors who are considered for promotion to the rank of Sub Inspector. All Assistant Sub- Inspectors-

(a) who have completed at least five years of services in the rank of Assistant Sub Inspector on promotion after passing the Grade-I course will be considered for promotion.

(b) selection for admission to promotion List-E shall be made once in a year amongst the eligible Assistant Sub-Inspectors by Departmental Promotion Committee constituted by DIG. The Departmental Promotion Committee shall judge the suitability of eligible Assistant Sub Inspector for admission to the promotion List "E" after examination of the service records/ACRs. While conducting the D.P.C., the rules and norms framed for the parallel ranks in the executive police by the Police Headquarter shall be followed.

(3) The Assistant Sub-Inspector brought on List "E" shall be given training in Grade-I course and after qualifying this course, they shall be promoted to the rank of Sub -Inspectors in order of seniority on List "E" after examination of the service records /ACRs. While conducting the D.P.C., the rules and norms framed for the parallel ranks in the executive police by the Police Headquarter shall be followed.

(4) Assistant Sub-Inspectors on promotion List "E" who fails to qualify the Grade-I course shall be given second chance for clearing test after six months duration and promoted to the rank of Sub Inspector only after they qualify this course. If such a Assistant Sub Inspector again fails to qualify Grade-I course, his name shall be removed from the promotion list "E".

(5) The remaining 40% of the posts of Sub -Inspectors shall be filled up by two modes of recruitments i.e. 20% through direct recruitment and 20% by conducting Limited Departmentalराजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 951 Competitive Examinations. The educational qualification for these posts shall be Bachelor of Engineering /Bachelor of Technology/Associate Members of Institution of Engineers (Electronics and Telecommunication Engineering./Computer Science / Information Technology) or Master of Computer Application /Department of Electronics Accreditation Certificate Course (DOEACC) "B" Level or equivalent from recognized institution(s).

(6) The direct recruitment of 20% posts shall be made through Subordinate Services Selection Board, Himachal Pradesh. The educational qualification for these posts shall be Bachelor of Engineering/Bachelor of Technology/Associate Members of Institution of Engineers (Electronics and Telecommunication Engineering./Computer Science / Information Technology) or Master of Computer Application /Department of Electronics Accreditation Certificate Course (DOEACC) "B" Level or equivalent from recognized institution(s). The directly recruited Sub Inspectors shall undergo recruitment training course for nine months at Police Training College. After passing the Recruit Training Course, they shall undergo a technical course for the duration of one month at Police Communication & Technical Services Training School.

(7) The remaining 20% posts shall be filled up by way of conducting Limited Departmental Competitive Examinations by the Himachal Pradesh Subordinate Service Selection Board, Hamirpur from amongst the officials having educational qualification i.e. Bachelor of Engineering /Bachelor of Technology/Associate Members of Institution of Engineers (Electronics and Telecommunication Engineering./Computer Science/Information Technology) or Master of Computer Application/Department of Electronics Accreditation Certificate Course (DOEACC) "B" Level or equivalent from recognized institution(s). The officials with minimum service of seven years and age not exceeding 45 years in the directorate shall be eligible to appear in the Limited Departmental Competitive Examinations, failing which the post(s) shall be filled up from direct recruitment quota.

The officials who qualify Limited Departmental Competitive Examinations shall undergo Grade-I course at Police Communication and Technical Services Training School.

(8) The physical standard for recruitment to the post of Sub Inspector for direct recruitment as well as for departmental candidates shall be the same as mentioned in clause (v) of rule 12 of these rules.

(9) The inter- se seniority of promotee and directly recruited officials shall be fixed on the basis of ratio fixed for promotion and direct recruitment.

16. Promotion List-F Promotion to the rank of Inspector.—(1) Promotion List "F" shall be prepared once in a year by the Deputy Inspector General of Police. Selection to this List shall be made by the Director General of Police, Himachal Pradesh with the assistance of a Departmental Promotion Committee to be convened for the purpose. Only those officers shall be eligible for the inclusion of their names in promotion List "F" who are substantive Sub- Inspector(s) with at least 5 years service in the rank of Sub- Inspector.

(2) Promotion to the rank of Inspector shall be made in accordance with the seniority List "F". Departmental Promotion Committee headed by Inspector General of Police shall check service particulars/ACRs and recommend the names of eligible Sub- Inspectors for promotion to the rank of Inspector. While conducting the D.P.C., the rules and norms framed for the parallel ranks in the executive police by the Police Headquarter shall be followed.

17. Power to Relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may by order for reasons to be recorded in writing, relax any of the provision of these rules with respect to any class or category of persons.

18. Interpretation.—If any doubt arises relating to the interpretation of these rules, it shall be referred to the State Government whose decision thereon shall be final.

19. Repeals and savings.— (1) The Standing Order No. 1 of 1999 for Himachal Pradesh Police Wireless Organization as approved by the Government of Himachal Pradesh vide letter No. Home (A) B (12) 1/99 dated nil and Standing Order No. P-1 (5) Comp.(SCRB)/93-02 -10454-55 Dated 22-07-2002 and the provisions of Punjab Police Rules, 1934 in their application to the State of Himachal Pradesh are hereby repealed to the extent these are applicable to the posts included in these rules.

(2) Notwithstanding such repeal, any appointment made or any thing done or any action taken under the rules or Standing Orders so repealed shall be deemed to have been validly made, done or taken under these rules.

2. विधित अवधि के भीतर उक्त प्रारूप नियमों से सम्बन्धित जन साधारण से कोई भी आक्षेप और सुझाव प्राप्त नहीं हुए हैं।

3. अतः हिमाचल प्रदेश के राज्यपाल, मोटरयान अधिनियम, 1988 की धारा 212 (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश मोटरयान नियम, 1999 में और संशोधन करने के लिए, निम्नलिखित नियम बनाते हैंः-

''(2) यदि मोटरयान का स्वामी, उप नियम (1) में विनिर्दिष्ट अनुज्ञापत्र को नियत तारीख तक नवीकृत या प्रतिहस्ताक्षरित करवाने में असफल रहता है तो वह उप नियम (1) के अधीन संदेय फीस के अतिरिक्त निम्नलिखित विलम्ब फीस संदत करने का दायी होगा, अर्थात :-

राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 953 हल्के मोटरयानों के लियेहल्के मोटरयानों के लियेहल्के मोटरयानों के लियेहल्के मोटरयानों के लिये

(1) 15 दिन तक के विलम्ब के लिये 10 रू0 प्रतिदिन (2) 16वें दिन से 30 दिन तक के विलम्ब के लिए 15 रू0 प्रतिदिन (3) 31वें दिन से आगे के विलम्ब के लिये 20 रू0 प्रतिदिन

परन्तु इस प्रकार प्रभारित विलम्ब फीस ऐसे स्वामी से देय नवीनीकरण/प्रतिहस्ताक्षरित फीस की राशि के दूगने से अधिक नहीं होगी । यदि स्वामी तीन मास की अवधि के भीतर अनुज्ञापत्र नवीकृत/प्रति हस्ताक्षरित नहीं करवाता है तो सक्षम प्राधिकारी अनुज्ञापत्र धारक के विरूद्ध मोटरयान अधिनियम, 1988/ केन्द्रीय मोटरयान नियम 1989 के उपबन्धों के अधीन आवश्यक कार्यवाही आरम्भ करेगा ।''

No. TPT-F(6)2/2000-I.—Whereas the draft Himachal Pradesh Motor Vehicles (First Amendment) Rules, 2010 were published in the Rajpatra, Himachal Pradesh on dated 19/04/2010, vide notification of even number dated 13/04/2010 in pursuance of the provision of section 212 of the Motor Vehicles Act, 1988 (Act No. 59 of 1988) for inviting objections and suggestion from person(s) likely to be affected thereby, within a period of 30 days from the date of publication;

2. And, whereas no objection has been received to the Government on the said draft rules within the stipulated period;

3. Now, therefore, in exercise of the powers conferred by section (1) of section 212 of the Motor Vehicles Act, 1988, (Act No. 59 of 1988), the Governor of Himachal Pradesh is pleased to make the following rules, further to amend the Himachal Pradesh Motor Vehicles Rules, 1999, namely:-

1. Short title.—These rules may be called the Himachal Pradesh Motor Vehicles (First Amendment) Rules, 2010.

2. Amendment of rule-68.—(1) For sub rule (2) of rule 68 of the Himachal Pradesh Motor Vehicles Rules, 1999, the following shall be substituted, namely:-

(2) If the owner of the motor vehicles specified in sub-rule (1) fails to get the permit renewed or countersigned by the due date, he shall be liable to pay the following late fee in addition to the fee payable under sub-rule (1), namely:-

FOR LIGHT MOTOR VEHICLES

(1) Delay upto 15 days Rs. 10/- per day (2) Delay from 16th days to 30 days Rs. 15 per day (3) Delay from 31st day onward Rs. 20 per day

FOR HEAVY MOTOR VEHICLES

(1) Delay upto 15 days Rs. 15/- per day (2) Delay from 16th days to 30 days Rs. 20 per day (3) Delay from 31st day onward Rs.25/- per day.

Provided that the late fee so charged shall not exceed double the amount of renewal fee/ countersignature fee due from such owner. In case the owner does not get the permit renewed/ countersigned within a period of three months, the competent authority shall initiate necessary action under the provisions of the Motor Vehicles Act, 1988/ Central Motor Vehicles Rules, 1989 against the permit holder.

यह प्रकरण प्रार्थिया ने स्वयं उप मण्डल दण्डाधिकारी करसोग के न्यायालय में प्रस्तुत किया है जो उप-मण्डल दण्डाधिकारी करसोग के न्यायालय से उनके न्यायालय पत्र संख्या रीडर 4889 दिनांक 20-11-08 द्वारा इस न्यायालय को स्थानान्तरित हुआ है। प्रार्थिया ने प्रकरण के साथ एक शपथ-पत्र जो दिनांक 1-7-08 को नोटरी पब्लिक द्वारा तस्दीक शुद्धा है, नकल परिवार रजिस्टर जो पंचायत सचिव द्वारा दिनांक 7-6-2008 को जारी की है संलग्न करते हुए निवेदन किया है कि प्रार्थिनी के बेटों तथा बेटियों का नाम व जन्म तिथियां ग्राम पंचायत सराहन के परिवार रजिस्टर में उसके पति मोहम्मद अली पुत्र श्री करीम वक्श के परिवार मंंें दर्ज नहीं है जो कि किसी कारणवश दर्ज नहीं करवा सकी और अब प्रार्थिनी अपने बेटों तथा बेटियों का नाम व जन्म तिथियां ग्राम पंचायत सराहन के परिवार रजिस्टर में अपने पति मोहम्मद अली पुत्र करीम वक्श के परिवार में दर्ज करवाना चाहती है जिस बारे प्रार्थिया ने जिला पंजीयन अधिकारी (जन्म एवं मृत्यु) मुख्य चिकित्सा अधिकारी के कार्यालय में उक्त नाम व जन्म तिथियां दर्ज करने बारे आवेदन किया था जिसकी संस्तुती उनके कार्यालय पत्र संख्या एफ0एफ0डब्ल्यू एमएनडी/जन्म एवं मृत्यु/2006-1154 दिनांक 17-4-10 को इस न्यायालय में प्राप्त हो चुकी है जिसके अनुसार निम्न रूप में नाम दर्ज किए जाने हैः--

Shimla, the 13th May, 2010

No. HPERC/428.—In exercise of the powers conferred by sub-section (1) of section 181, sub-section (1) of section 62, clauses (a), (b) and (e) of subsection (1) of section 86 of the Electricity Act, 2003 (36 of 2003) read with section 21 of the General Clauses Act, 1897 (10 of 1897) and all other powers enabling it in this behalf, the Himachal Pradesh Electricity Regulatory Commission after previous publications makes the following regulations further to amend the Himachal Pradesh Electricity Regulatory Commission (Power Procurement from Renewable Sources and Co-generation by Distribution Licensee) Regulations, 2007, published in Rajpatra, Himachal Pradesh (Extra- ordinary) dated 21st June, 2007,namely:-

REGULATIONS

1. Short title and commencement.- (1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Power Procurement from Renewable Sources and Co- generation by Distribution Licensee) (Third Amendment) Regulations, 2010.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of regulation 4.- In regulation 4 of the Himachal Pradesh Electricity Regulatory Commission (Power Procurement from Renewable Sources and Co-generation by Distribution Licensee) Regulations, 2007 (hereinafter called "the said regulations") for subregulations (1) and (2), the following shall be substituted, namely:-

"(1) For the purposes of regulation 3, the Commission shall constitute an Empowered Committee comprising of one representative each from -

(i) the Commission; (ii) the State Transmission Utility; (iii) the distribution licensee; (iv) the Himachal Pradesh Power Transmission Corporation Limited (HPPTCL); (v) the Himachal Pradesh Energy Development Agency (HIMURJA).

(1-A) The Commission, whenever it considers expedient and necessary to do so, may appoint any other person to be the member of the Empowered Committee.

(2) The Commission shall appoint one member of the Empowered Committee to be its Convener and one officer of the Commission, as may be designated by the Commission, shall be the Secretary to the Committee."

3. Omission of regulation 5.- Regulation 5 of the said regulations shall be omitted.

4. Substitution of regulation 7.- For regulation 7 of the said regulations, the following regulation shall be substituted, namely.-

"7. Overriding effect.- The provisions of these regulations shall have effect notwithstanding anything inconsistent therewith contained in any other regulations, framed by the Commission, relating to the determination of tariff and/or making provisions for open access under the Act."

No. HPERC/438.- In exercise of the powers conferred by sub-section (1) of section 181 read with sub-section (1) of section 62, section 66, clauses (a), (b) and (e) of section 86 and clause (zi) of sub-section (2) of section 181 of the Electricity Act, 2003 (36 of 2003) and also read with section 21 of the General Clauses Act, 1897 (10 of 1897) and all other powers enabling it in this behalf, and after previous publications, the Himachal Pradesh Electricity Regulatory Commission hereby makes the following regulations:-

1. Short title and commencement.- (1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Renewable Power Purchase Obligation and its Compliance) Regulations, 2010.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Definitions: In these regulations, unless the context otherwise requires,-

(a) "Act" means the Electricity Act, 2003 (36 of 2003);

(b) "Central Agency" means the agency as may be designated by the Central Commission under clause (1) of regulation 3 of the Central Electricity Regulatory Commission (Terms and Conditions for recognition and issuance of Renewable Energy Certificate for Renewable Energy Generation) Regulations, 2010;

(c) "Central Commission" means the Central Electricity Regulatory Commission referred to in sub-section (1) of section 76 of the Act;

(d) "Certificate" means the renewable energy certificate issued by the Central Agency in accordance with the procedures prescribed by it and under the provisions specified in the Central Electricity Regulatory Commission (Terms and Conditions for recognition and issuance of Renewable Energy Certificate for Renewable Energy Generation) Regulations, 2010";

(e) "Commission" means the Himachal Pradesh Electricity Regulatory Commission;

(f) "obligated entity" means the distribution licensee, consumer owning the captive power plants and open access consumers in the State of Himachal Pradesh, which is mandated to fulfill renewable purchase obligation under these regulations;

(g) "renewable energy sources" means non-conventional renewable electricity generating sources such as mini/micro/small hydro power projects upto and including 25 MW capacity, wind, solar including its integration with combined cycle, biomass, bio-fuel cogeneration, urban or municipal waste and such other sources as recognized or approved by the Central Government;

(h) "State agency" means the agency in the State of Himachal Pradesh as may be designated by the Commission to act as the agency for accreditation and recommending the renewable energy projects for registration and to undertake such functions as may be specified under clause (e) of sub-section (1) of section 86 of the Act; and

(i) the words and expressions used in these regulations and not defined herein but defined in the Act or the regulations issued by the Central Commission or any other regulations issued by the Commission, shall have the same meaning assigned to them respectively in the Act or such regulations issued by the Central Commission or such other regulations issued by the Commission.

3. Applicability of Renewable Power Purchase Obligation (RPPO) .- These regulations shall apply to -राजपत्र, हिमाचल प्रदेश, 29 मई, 2010/8 ज्येष्ठ, 1932 979 (1) the distribution licensee; (2) any other person consuming electricity-

(i) generated from conventional Captive Generating Plant having capacity of 1 MW and above for his own use; and/or

(ii) procured from conventional generation through open access third party sale.

4. Quantum of Renewable Power Purchase Obligation (RPPO).- (1)(a) The distribution licensee shall purchase electricity (in kWh) from renewable sources, at a defined minimum percentage of the total consumption including transmission and distribution losses, within the area of the distribution licensee, during a year.

(b) The Captive and Open Access User(s)/ Consumer(s), shall purchase electricity (in kWh) from renewable sources, at a defined minimum percentage of his total consumption.

Explanation.- For the purpose of this regulation "the defined minimum percentage" shall be as given in the table below:-

Provided that the solar power purchase obligation shall be fulfilled from the generation based on solar sources only:

Provided further that such obligation to purchase renewable energy shall be inclusive of .- (i) purchases from generating stations based on renewable energy sources, (ii) purchases from any other distribution licensee, which would arise from renewable sources,

(iii) the energy generated from its own renewable sources, if any, by the obligated entity:

Provided further that the power purchases under the power purchase agreements for the purchase of renewable energy sources already entered into by the distribution licensees shall continue to be made till their present validity, even if the total purchases under such agreements exceeds the percentage as specified hereinbefore.

(2 ) Keeping in view supply constraints or other factors beyond the control of the licensee, the Commission may, suo-motu or at the request of a licensee, revise the percentage targets for a year as per sub-regulation (1) of this regulation.

(3) The RPPO specified for the Financial Year 2012-13 shall be continued beyond 2012- 13 till any revision is affected by the Commission in this regard.

5. Certificates under the regulations of the Central Commission.-(1) Subject to the terms and conditions contained in these regulations the Certificates issued under the Central Electricity Regulatory Commission (Terms and Conditions for recognition and issuance of Renewable Energy Certificate for Renewable Energy Generation) Regulations, 2010 shall be the valid instruments for the discharge of the mandatory obligations set out in these regulations for the obligated entities to purchase electricity from renewable energy sources:

Provided that in the event of the obligated entity fulfilling the renewable purchase obligation by purchase of certificates, the obligation to purchase electricity from generation based solar as renewable energy source can be fulfilled by purchase of solar certificates only and the obligation to purchase electricity from generation based on renewable energy other than solar can be fulfilled by purchase of non-solar certificates.

(2) Subject to such direction as the Commission may give, from time to time, the obligated entity shall act consistent with the Central Electricity Regulatory Commission (Terms and Conditions for recognition and issuance of Renewable Energy Certificate for Renewable Energy Generation) Regulations, 2010 notified by the Central Commission in regard to the procurement of the certificates for fulfillment of the Renewable Power Purchase Obligation under these regulations.

(3) The Certificates purchased by the obligated entities from the power exchange in terms of the regulation of the Central Commission mentioned in sub-regulation (1) shall be deposited by the obligated entities with the Commission in accordance with the detailed procedure issued by the Central Agency.

6. State Agency.- (1) The Commission shall designate an agency as the State Agency for accreditation and recommending the renewable energy projects for registration and to undertake functions under these regulations.

(2) The State Agency shall function in accordance with the directions issued by the Commission and shall act in accordance with the provisions of the Central Electricity Regulatory Commission (Terms and Conditions for recognition and issuance of Renewable Energy Certificate for Renewable Energy Generation) Regulations, 2010.

(3) The State Agency shall submit quarterly status to the Commission in respect of compliance of renewable power purchase obligation by the obligated entities in the format as stipulated by the Commission and may suggest appropriate action to the Commission, if required, for compliance of the renewable purchase obligation.

(4) The Commission may from time to time fix the remuneration and charges payable to the State Agency for discharge of its functions under these regulations.

7. Distribution Licensee.- (1) Each distribution licensee shall indicate, along with sufficient proof thereof, the estimated quantum of purchase from renewable sources for the ensuing year in tariff/annual performance review petition in accordance with regulations notified by the Commission. The estimated quantum of purchase shall be in accordance with sub- regulation (1) of regulation 4 of these regulations. If the distribution licensee is unable to fulfil the obligation, the shortfall of the specified quantum of that year would be added to the specified quantum for the next year. However, credit for excess renewable power purchase would not be adjusted in the ensuing year.

(2) Despite availability of energy from renewable sources under the Power Purchase Agreements or the power exchange mechanism or from its own renewable sources, if the distribution licensee fails to fulfil the minimum quantum of purchase from renewable sources, it shall be liable to pay compensation as per regulation 9 of these regulations.

8. Captive and Open Access User(s)/ Consumer(s).- (1)The quantum of RPPO inclusive of transmission and distribution losses mentioned in sub-regulation(1) of regulation 4, shall be applicable to captive and open access user(s)/consumer(s) from the date as would be notified by the Commission in the Official Gazette.

(2) Every Captive and Open access consumer(s)/ user(s) shall have to submit necessary details regarding total consumption of electricity and power purchase from Renewable Energy sources for fulfillment of RPPO on yearly basis on or before the 30th April to the State Agency.

(3) Captive and Open Access Consumer(s)/ User(s) shall purchase renewable energy as stated in the Table below regulation 4. If the Captive user(s) and Open Access consumer(s) are unable to fulfill the criteria, the shortfall of the targeted quantum would attract payment of compensation as per regulation 9 of these regulations.

(4) Captive/Open Access consumer(s)/ User(s) may fulfill its RPPO through the renewable energy certificate as provided in regulation 5 of these regulations.

9. Consequences of default.- (1) Where the obligated entity does not fulfil the renewable purchase obligation as provided in these regulations during any year and also does not purchase the certificates, the Commission may direct the obligated entity to deposit into a separate fund, to be created and maintained by such obligated entity, such amount as the Commission may determine on the basis of the shortfall in units of RPPO and the forbearance price decided by the Central Commission:

Provided that the fund so created shall be utilised, as may be directed by the Commission partly for purchase of the certificates and partly for development of transmission/ sub transmission infrastructure for evacuation of power from generating stations based on renewable energy sources:

Provided further that the obligated entities shall not be authorized to use the fund created in pursuance of regulation without prior approval of the Commission:

Provided further that the Commission may empower an officer of the State Agency to procure from the Power Exchange the required number of certificates to the extent of the shortfall in the fulfillment of the obligations, out of the amount in the fund:

Provided further that the distribution licensee shall be in breach of its licence conditions if it fails to deposit the amount directed by the Commission within 15 days of the communication of the direction.

(2) Where any obligated entity fails to comply with the obligation to purchase the required percentage of power from renewable energy sources or the renewable energy certificates, it shall also be liable for penalty as may be imposed by the Commission under section 142 of the Act:

Provided that in case of genuine difficulty in complying with the renewable power purchase obligation because of non-availability of certificates, the obligated entity can approach the Commission to carry forward the compliance requirement to the next year:

Provided further that where the Commission has consented to carry forward of compliance requirement, the provision of sub-regulation (1) or the provision of section 142 of the Act shall not be invoked.

10. Overriding effect.-The provisions of these regulations shall have effect notwithstanding anything inconsistent therewith contained in any other regulations, framed by the Commission, relating to the determination of tariff, and/or making provisions for open access under the Act.

11. Power to remove difficulties.–If any difficulty arises in giving effect to any of the provisions of these regulations, the Commission may, either suo motu or on an application made to it, by general or special order, direct the licensee/generator or any other person to take suitable action, not being inconsistent with the Act, which appears to the Commission to be necessary or expedient for the purpose of removing the difficulty.

12. Issue of orders and directions.–Subject to the provisions of the Act and these regulations, the Commission may, from time to time, issue orders and practice directions with regard to the implementation of these regulations and procedure to be followed for such implementation and matters incidental or ancillary thereto.

13. Saving of Inherent Powers of the Commission.-Nothing contained in these Regulations shall limit or otherwise affect the inherent powers of the Commission to adopt a procedure, which is at variance with any of the provisions of these regulations, if the Commission, in view of the special circumstances of the matter or class of matters and for reasons to be recorded in writing, deems it necessary or expedient to depart from the procedure specified in these regulations.

14. Interpretation.–All issues arising in relation to interpretation of these regulations shall be determined by the Commission and the decision of the Commission on such issues shall be final.

No. PBW (B&R)(B)14(8)/2004.— In partial modification of this department Notification No.PBW (B&R)(B)17(3)6/96 dated 10-1-2001 it has been decided that henceforth in the case, of works costing over Rs.1,00,000/-Notice Inviting Tender shall be published in the Giriraj and Tender Notices in respect of works upto Rs.1,00,000/- shall be displayed on the Notice Boards of the Offices of Superintendent Engineers, Executive Engineers and Assistant Engineers in PWD Circles concerned. Hence, the figure of "Rs 50,000/-" appearing in the said Notification is substituted with the figure of "Rs.1,00,000/-". The other terms and condition will remain the same.

The existing powers for inviting tenders without going to press and acceptance of lowest tender for award of work by negotiation with the lowest tenderor, delegated to EE and AE are also revised with immediate effect from Rs.50,000/- and Rs. 30,000/-to Rs.1,00,000/-and Rs.50,000/- respectively with the annual limit upto Rs. 25.00 lac in respect of EE and Rs.10.00 lacs in respect of AE . Other conditions will remain the same.

This issue with the prior concurrence of F.D. (Regulation) dated 12-5-2010.
