हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का 4) का और

भारत गणराज्य के इकसठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा
निम्नलिखित रूप में यह अधिनियमित हो :-
संक्षिप्त नाम। 1.1.1.1.1. इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज
(संशोधन) अधिनियम, 2010 है।

धारा 2 का संशोधन । 2.2.2.2.2. हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (जिसे इसमें इसके पश्चात् "मूल अधिनियम" कहा गया है), की धारा 2 के खण्ड (13-ख) में "(राजस्व)" कोष्ठक और शब्द के स्थान पर "(अपील)" कोष्ठक और शब्द रखे जाएंगे।
3. 3. 3. 3. 3. मूल अधिनियम की धारा 4 की उपधारा (3) में, विद्यमान परंतुक के धारा 4 का संशोधन । पश्चात् निम्नलिखित द्वितीय परंतुक अंतःस्थापित किया जाएगा, अर्थात् :-
"परन्तु यह और कि यदि कोई व्यक्ति पहले से किसी नगरपालिका में मतदाता के रूप में रजिस्ट्रीकृत है तो वह किसी सभा क्षेत्र में मतदाताओं की सूची में रजिस्ट्रीकृत होने का हकदार नहीं होगा।"।
धारा 5 का संशोधन । 4.4.4.4.4. मूल अधिनियम की धारा 5 की उपधारा (1) में "तथा अक्तूबर मास के प्रथम रविवार" शब्दों के स्थान पर "के प्रथम रविवार तथा द्वितीय अक्तूबर" शब्द रखे जाएंगे।
5.5.5.5.5. मूल अधिनियम की धारा 7 की उपधारा (4) के पश्चात् निम्नलिखित धारा 7 का संशोधन । परंतुक अन्तःस्थापित किया जाएगा, अर्थात् :-

"परन्तु कोई व्यक्ति सतर्कता समिति के सदस्य के रूप मेंं चयनित होने, और सदस्य होने के लिए निरर्हित हो जाएगा यदि उसने, खण्ड (छ) के अधीन वर्णित निरर्हता के सिवाए, धारा 122 की उपधारा (1) में वर्णित कोई भी निरर्हता उपगत की हो।"।
धारा 7-क का संशोधन ।
6.6.6.6.6. मूल अधिनियम की धारा 7-क की उपधारा (5) में "15 प्रतिशत" और "एक तिहाई" अंकों और शब्दों के स्थान पर क्रमशः "50 प्रतिशत" और "आधा" अंक और शब्द रखे जाएंगे।
7.7.7.7.7. मूल अधिनियम की धारा 115 के स्थान पर निम्नलिखित धारा रखी
धारा 115 का प्रतिस्थापन । जाएगी, अर्थात् :-
"115. बकाया की वसूली.-115. बकाया की वसूली.-115. बकाया की वसूली.-115. बकाया की वसूली.-115. बकाया की वसूली.-इस अधिनियम द्वारा उपबंधित किसी अन्य रीति में वसूलीय होने के अतिरिक्त, इस अधिनियम के अधीन किसी कर, जल दर, किराया, फीस के बकाया के रूप में कोई रकम या पंचायत द्वारा दावा योग्य कोई अन्य धन, कलक्टर द्वारा भू-राजस्व के बकाया के रूप में वसूल किया जा सकेगा :
परन्तु राज्य सरकार, हिमाचल प्रदेश भू-राजस्व अधिनियम, 1953 के अधीन किसी अन्य अधिकारी को कलक्टर की शक्तियों का प्रयोग करने के लिए नियुक्त कर सकेगी।"।
8.8.8.8.8. मूल अधिनियम की धारा 118 की उपधारा (3) के पश्चात् निम्नलिखित
धारा 118 का संशोधन । उपधारा अंतःस्थापित की जाएगी, अर्थात् :-
"(4) उपधारा (1) में अंतर्विष्ट किसी बात के होते हुए भी, पंचायत के लेखे महालेखाकार, हिमाचल प्रदेश द्वारा संपरीक्षित किए जा सकेंगे और उसकी पहुंच पंचायतों की सुसंगत सूचना और अभिलेखों तक होगी।"।
9.9.9.9.9. मूल अधिनियम की धारा 138 की उपधारा (1) में "किसी पंचायत

10.10.10.10.10. मूल अधिनियम की धारा 144 में,--
1483 धारा 144 का संशोधन । (क) शीर्षक में ", वस्तुएं तथा धन" चिन्ह और शब्दों के स्थान पर "तथा
वस्तुएं" शब्द रखे जाएंगे;
(ख) उपधारा (1) में "या धन" शब्द जहां-जहां आते हैं, का लोप किया
जाएगा; और
(ग) उपधारा (3) में खण्ड (क) का लोप किया जाएगा।
11.11.11.11.11. मूल अधिनियम की धारा 181 के स्थान पर निम्नलिखित धारा रखी धारा 181 का प्रतिस्थापन । जाएगी, अर्थात् :--
"181. अपीलें.-181. अपीलें.-181. अपीलें.-181. अपीलें.-181. अपीलें.--इस अधिनियम में किसी बात के होते हुए भी, इस अध्याय के अधीन प्राधिकृत अधिकारी द्वारा किए गए किसी आदेश से व्यथित कोई व्यक्ति विहित समय के भीतर और विहित रीति में,--
(i) उप-मण्डल अधिकारी द्वारा आदेश पारित किए जाने की दशा में
उपायुक्त को;
(ii) उपायुक्त द्वारा आदेश पारित किए जाने की दशा में मण्डलायुक्त
को; और
(iii) मण्डलायुक्त द्वारा आदेश पारित किए जाने की दशा में वित्तायुक्त
(अपील) को;

THE HIMACHAL PRADESH PANCHAYATI RAJ
(AMENDMENT) ACT, 2010
(AS ASSENTED TO BY THE GOVERNOR ON 11TH JUNE, 2010)
AN
ACT
further to amend the Himachal Pradesh Panchayati Raj Act,
1994 (4 of 1994).
BE it enacted by the Legislative Assembly of the Himachal Pradesh
in the Sixty-first Year of the Republic of India as follows:—
Short title.
1. This Act may be called the Himachal Pradesh Panchayati Raj
(Amendment) Act, 2010.
4 of 1994 Amendment of Section 2.
2. In section 2 of the Himachal Pradesh Panchayati Raj Act, 1994 (hereinafter referred to as the 'principal Act'), in clause (13-B), for the brackets and word "(Revenue)", the brackets and word "(Appeals)" shall be substituted.
3. In section 4 of the principal Act, in sub-section (3), after existing
proviso, the following second proviso shall be inserted, namely:—
Amendment of Section 4.
"Provided further that no person shall be entitled to be registered in the list of voters of a Sabha area if he is already registered as a voter in a Municipality.".
Amendment of Section 5.
4. In section 5 of the principal Act, in sub-section (1), for the words "October and it", the words and sign "on second October. It" shall be substituted.
5. In section 7 of the principal Act, after sub-section (4), the
following proviso shall be inserted, namely:—

1485 राजपत्र, हिमाचल प्रदेश, 18 जून, 2010/28 ज्येष्ठ, 1932 "Provided that a person shall be disqualified for being chosen as, and for being a member of the vigilance committee if he has incurred any of the disqualification mentioned in sub-section (1) of section 122, except the disqualification mentioned under clause (g).".
Amendment of Section 7-A.
6. In section 7-A of the principal Act, in sub-section (5), for the figures, sign and words "15%" and "one-third", the figures, signs and words "50%" and "one-half" shall respectively be substituted.
7. For section 115 of the principal Act, the following section shall
be substituted, namely:—
Substitution of Section 115.
"115. Recovery of arrears.— Any amount on account of arrears of any tax, water rate, rent, fee or any other money claimable by a Panchayat under this Act besides being recoverable in any other manner provided by this Act, may be recovered by the Collector, as arrear of land revenue:
Provided that the State Government may appoint any other officer to exercise the powers of the Collector under the Himachal Pradesh Land Revenue Act, 1953 (6 of 1954).".
8. In section 118 of the principal Act, after sub-section (3), the
following sub-section shall be inserted, namely:—
Amendment of Section 118.
"(4) Notwithstanding anything contained in sub-section (1), the accounts of Panchayat may be audited by the Accountant General, Himachal Pradesh and shall have access to relevant information and records of the Panchayats.".
9. In section 138 of the principal Act, in sub-section (1), after the
words "by a Panchayat", the words "or Gram Sabha" shall be inserted.
Amendment of Section 138.
10. In section 144 of the principal Act,—
Amendment of Section 144.
(a) in the heading, for the sign and words ",articles and money",
the words "and articles" shall be substituted.;

(b) in sub-section (1), the words "or money" wherever these occur,
shall be omitted.; and
(c) in sub-section (3), clause (a) shall be omitted.
11. For section 181 of the principal Act, the following section shall
be substituted, namely:—
Substitution of Section 181.
"181. Appeals.—Notwithstanding anything contained in this Act, any person aggrieved by an order made by the authorised officer under this chapter may, within the prescribed time and in the prescribed manner, appeal—
(i) in case the order is passed by the Sub-Divisional Officer, to the
Deputy Commissioner;
(ii) in case the order is passed by the Deputy Commissioner, to the
Divisional Commissioner; and
(iii) in case the order is passed by the Divisional Commissioner, to
the Financial Commissioner (Appeals);
and he shall hear and dispose of the appeal within period of 90 days and his decision shall be final.".

नस्ति सं रैव-डी (जी)7-9-2010.--नस्ति सं रैव-डी (जी)7-9-2010.--नस्ति सं रैव-डी (जी)7-9-2010.--नस्ति सं रैव-डी (जी)7-9-2010.--नस्ति सं रैव-डी (जी)7-9-2010.-- यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि मैसर्ज हरीश सीमटें लिमिटड सुन्दरनगर, जिला मण्डी के द्वारा उक्त उद्योग हेतू अधिग्रहित भूमि के फलस्वरुप मकानहीन होने वाले व्यक्तियों के लिए आवासीय कलौनी हेतू भूमि अर्जन अधिनियम 1894 की धारा 4 के अन्र्तगत कम्पनी अपने व्यय पर सार्वजनिक प्रयोजन हेतू नामतः गांव मुहाल जुगाहन व मुहाल चौक तहसील सुन्दरनगर जिला मण्डी हि0 प्र0 में सीमेंट प्लांट में विस्थापितों के लिए कलौनी की स्थापना हेतू भूमि अर्जित की जानी अपेक्षित है । अतः एतद द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया जाता है, उपरोक्त परियोजन के लिए भूमि का अर्जन अपेक्षित है । जोकि उक्त उद्देश्य हेतू अधिग्रहण के उपरान्त राजस्व विभाग हि0 प्र0 को हस्तांतरित होगी ।
यह अधिसूचना ऐसे सभी व्यक्तियों को जो कि इससे सम्बन्धित हो सकते है की जानकारी केे लिए भू-अर्जन अधिनियम 1894 की धारा-4 के उपबन्धों के अन्र्तगत जारी की जाती है ।
पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये, राज्यपाल, हि0 प्र0 इस समय इस उपक्र्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों के इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने और उक्त धारा द्वारा अपेक्षित या अनुमतः अन्य सभी कार्यो को करने के लिए सहर्ष प्राधिकार देते है।

No. Rev.1-4 (Stamp)1/78-Loose.—In exercise of the powers conferred by Clause (a) of sub-section (1) of Section 9 of the Indian Stamp Act, 1899 (Act No. II of 1899) as applicable to the State of Himachal Pradesh and in continuation to this department notification no. Rev. 1- 4(Stamp)-1/78-loose, dated 29th September, 2009, as published in the Rajpatra (Extra-Ordinary), Himachal Pradesh, dated 3rd October, 2009, the Governor of Himachal Pradesh is pleased to add the words "and Banks" after the words "Financial Institutions" appeared in the 5th line of the above notification dated 29th September, 2009.

Rev. 1-4(Stamp)-1/78- loose, dated 29th September, 2009, as published in the Rajpatra (Extra-Ordinary), Himachal Pradesh, dated 3rd October, 2009, the Governor of Himachal Pradesh is pleased to add the 1495 राजपत्र, हिमाचल प्रदेश, 18 जून, 2010/28 ज्येष्ठ, 1932
words "and Banks" after the words "Financial Institutions" appeared in the 10th line of the above notification dated 29th September, 2009.

No. GAD-(F) 9-6/2009.— In continuation of this Department notification of even number dated 9th September, 2009, the Governor, Himachal Pradesh is pleased to declare 26th June, 2010 as Gazetted Holiday in place of 28th June,2010 on account of Sant Guru Kabir Jayanti(Prakat Diwas) to the employees working in all Government offices/Boards/ Corporations/Educational Institutions in Himachal Pradesh. This will not be a holiday under Section 25 of Negotiable Instrument Act. of 1881 and also to daily wage employees.
