संख्संख्संख्संख्याःयाःयाःयाः ई0 ई0 ई0 ई0एक्स0एन0-एफ(10)-1/2एक्स0एन0-एफ(10)-1/2एक्स0एन0-एफ(10)-1/2एक्स0एन0-एफ(10)-1/2006-006-006-006-II....—हिमाचल प्रदेश की राज्यपाल, हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) की धारा 10 द्वारा प्रदा शक्तियों का प्रयोग करते हुए, पूर्वोक्त अधिनियम से संलग्न अनुसूची "क" के भाग-3 में निम्नलिखित संशोधन करने का प्रस्ताव करती हैं जो 15 जुलाई 2010 से प्रभावी होगी और इन्हें जनसाधारण की सूचना के लिए एतद्‌द्वारा राजपत्र, हिमाचल प्रदेश में प्रकाशित किया जाता है ;

इस संशोधन की बाबत यदि किसी हितबद्ध व्यक्ति के कोई आक्षेप(पों) या सुझाव(वों) हैं ; तो वह उसे/उन्हें इस अधिसूचना के प्रकाशन की तारीख से दस दिन की अवधि के भीतर आयुक्त, आबकारी एवं कराधान, हिमाचल प्रदेश, शिमला-171009 को भेज सकेगा :

NOTIFICATION

File No. EXN- F(10)-1/2006-II.— In exercise of the powers conferred by Section 10 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005), the Governor of Himachal Pradesh proposes to make the following amendment in PART-III of Schedule 'A' appended to the aforesaid Act which shall be effective from 15th day of July, 2010 and the same is hereby published in the Rajpatra, Himachal Pradesh for the information of the general public;

If any interested person likely to be affected has any objection(s) or suggestion(s) with regard to this amendment, he may send the same to the Excise and Taxation Commissioner, Himachal Pradesh, Shimla-171009 within a period of 10 days from the date of publication of this notification; Objection(s)/suggestion(s), if any, received within the above stipulated period shall be taken into consideration by the Government before finalizing the same, namely:—

DRAFT AMENDMENTS

The existing Part-III in Schedule 'A' shall be substituted by the following, namely:-

"Part-III

GOODS TAXABLE @ 13.75 PERCENTUM

All goods other than those specified in Part-I, Part-II, Part-II 'A' of Schedule 'A' and Schedule 'B', Schedule 'C' and Schedule 'D'.".

NOTIFICATION

No. FDS-34/690.—In supersession of all previous notifications and in exercise of the powers conferred upon me under Clause-3 (i) (e) of the H.P. Hoarding and Profiteering Prevention Order, 1977 I, Padam Singh Chauhan, IAS, District Magistrate, Sirmour do hereby fix the retail prices including all taxes and other incidental charges in respect of the following essential commodities that may be charged by the dealers or a retailer in Sirmour district with immediate effect:—

Note.— Every dealer/shopkeeper will issue cash memo to each consumer and keep duplicate copy of the same for inspection purpose.

The dealer/shopkeeper shall display the price list of these commodities at the entrance of the business premises which will be signed and dated by the Owner/Partner/Manager.

This notification shall be valid for a period of one month from the date of publication in the official Gazette.

NOTIFICATION

No. CS-34-690/77-VI.—In supersession of all previous notifications issued in this behalf and in exercise of the powers conferred upon me under Sub-Clause (d) of Clause 3(1) of the H.P. Hoarding & Profiteering Prevention Order,1977 I, Padam Singh Chauhan, IAS, District Magistrate, Sirmour at Nahan do hereby refix the maximum margin of profit on the commodities mentioned below (Listed in schedule- I of the said order) which will be charged by the wholesalers and retailers in Sirmour district on wholesale and retail transaction as under:—

1. The element of expenditure incurred/actually paid by a dealer to be taken into account for computing the landed cost of the commodities listed above:—

(i) Purchase price (ii) Freight. (iii)Central/Local Tax/Vat. (iv) Loading and un-loading (v) Market Fee (vi) Interest on capital @ 1% for wholesaler and retailer on item No:-(i) to (v). (vii) Other incidental charges @ 1% for wholesaler and retailer on item (i) to (v). (viii) 1% shortage will be allowed for wholesaler and retailer.

2. The dealer involved in wholesale as well as in retail sale business shall charge only one margin of profit on the transaction i.e. wholesale margin on wholesale transactions andराजपत्र, हिमाचल प्रदेश, 5 जुलाई, 2010/14 आषाढ़, 1932 1969 retail sale margin on retail sale transaction. The wholesale margin shall be allowed at one stage only at one particular sale.

3. Wholesale transaction means a single transaction of not less than the quantum fixed as under:—

(i) Foodgrains, Gur, Shakkar, Khansari, Sugar, Pulses= One quintal.

(ii) Paper = One Rim. (iii) Eggs = One hundred.

(iii) Fruits and Vegetables = 20 Kgs. (v) Bottle Beverage = 24 Nos.

This notification shall come into force from the date of publication in official gazette.

NOTIFICATION

No. FDS 2-58/99-II.—In supersession of all previous notifications and in exercise of the powers conferred upon me under Clause 2(d) of the kerosene oil (Restriction on Use & Fixation of Ceiling Price) Order,1993 I, Padam Singh Chauhan, IAS, District Magistrate, District Sirmour at Nahan do hereby fix the maximum wholesale rates of superior kerosene oil at Zero Point and retail sale rates for different stations in Sirmour district due to change in bulk rates from source and revision of dealer commission in respect of wholesalers M/s Baveja Brothers, Nahan as under:—

*Note.—The Kerosene oil Wholesale Dealer will deliver kerosene oil to the Depot holders mentioned at Sr. No. 20 at Puruwala Kanshipur and Sr. No. 21 at Sataun. Further these Depot holders will carry Kerosene oil by their own arrangements through Tractors/pickup van for which additional carriage is allowed which is mentioned in column No.5 against their names.

This notification shall come into force with immediate effect.

No. EDN-A (B)7-2/08-Loose.— The Governor, Himachal Pradesh is pleased to allow revised pay scales w.e.f. first day of January, 2006 to the following categories of Officers of the Himachal Pradesh University as per Fitment Table 1, 2 and 3 annexed to this Notification :—

The Interim Relief already allowed to the officers from time to time shall be adjusted in the Revised pay and the officers shall be entitled to draw only the additional amount on account of the difference between the revised pay and the emoluments being drawn by the officers, on the corresponding date. In case, emoluments in the Revised Pay structure become lower than the emoluments being drawn on the corresponding date, due to payment of Interim Relief, the extra amount, if any, shall be adjusted against the Pay Arrears of the concerned officers.

The pay in the revised pay structure shall be drawn in cash from the first day of September, 2009 and arrears with effect from first January, 2006 to 31st August 2009 will be paid in such manner and at such time as may be decided by the Government. An undertaking will be obtained from every officer, before the fixation of pay in the revised scales/disbursement of arrears to the effect that any excess payment made as a result of incorrect fixation of pay in the revised pay structure or for any other reasons, will be refunded by him/her to the H.P. University against future payments or otherwise. It shall be the responsibility of the concerned University authorities to ensure correct fixation of pay in the revised pay structure. However, in case any discrepancy in fixation of pay is noticed resulting in overpayment, such amount shall be recovered from the concerned officer.

The pay fixation formula of the State Government shall be applicable to the aforesaid categories. The rate of increment in the revised pay structure, the date of increment, fixation of pay on promotion and exercise of option to draw pay in the revised pay structure, shall be as per the formula applicable in the State Govt. Specimen form of OPTION and form of Undertaking shall be the same as applicable in the case of State Govt. employees.

Necessary amendment in the statutes, rules and regulations, etc. will be made by the University/Government, where called for.

This issues with the prior concurrence of the Finance Department obtained vide their Dy. No. Fin- ( PR)B(7)-4/2009-51467012 dated 30th June, 2010.
