( ( ( (बी)बी)बी)बी) एफ (5)एफ (5)एफ (5)एफ (5) 67/267/267/267/2010010010010....----यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामत गांव मटयारा/556, तहसील बल्द्वाडा, जिला मण्डी में जोगिन्द्रनगर-सरकाघाट-घुमारव सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते है, की जानकारी के लिए भू-अर्जन अधिनियम, 1894 की धारा 4 के उपबन्धों के अन्तर्गत जारी की जाती है।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र मेेंं कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के तीस (30) दिन की अवधि के भीतर भू-अर्जन समाहर्ता, लोक निर्माण विभाग, मण्डी, हिमाचल प्रदेश के समक्ष लिखित आपत्ति दायर कर सकता है।

No. TSM-A(8)-1/2010.—In supersession of this Department's Notification No.TSM-E(3)- 5/2007 dated 7.07.2009, the Governor, Himachal Pradesh, is pleased to publish the records and other activities of the Tourism & Civil Aviation Department at Administrative Department level at Secretariat as required under the provisions of Sub Section (1) (b) of Section 4 of the Right to Information Act, 2005 as under:—

(i) THE PARTICULARS OF ITS ORGANISATION, FUNCTIONS AND DUTIES;

Chief Minister is the Minister-in-charge of Tourism & Civil Aviation Department and the organization setup of the Department is as under:—

GOVERNMENT/SECRETARIAT LEVEL

1. Principal Secretary (Tourism & Civil Aviation) to the Government of Himachal Pradesh.

2. Special/Additional/Joint/Deputy/Under Secretary to the Government of Himachal Pradesh (as the case may be).

3. Section Officer as Section Incharge. 4. Superintendent. 5. Senior Assistants. 6. Junior Assistants. 7. Clerks. 8. Personal Staff i.e. Private Secretary/Personal Assistants/ Sr.& Jr. Scale Stenographers/Steno-typists.

9. Peons.

FUNCTION AND DUTIES:-

At Secretariat level the Tourism & Civil Aviation Department has one section. Principal Secretary (Tourism & Civil Aviation) is the administrative head of the Department and discharges the following duties of the Department:-

1. Development and promotion of Tourism. 2. State and District Tourist Advisory Committees. 3. Tourist Services- Supply of information, reservation of accommodation and provision of other amenities. 4. Hotel Legislation. 5. Construction/maintenance of departmental tourist accommodation. 6. Sports such as Aero Sports, Adventure Sports, Winter Sports, Golf, Boat Clubs, Mountain biking, River rafting etc. 7. Recognition of Travel agents and Shikar agents. 8. Matters relating to shooting of films in Himachal Pradesh. 9. Establishment, budget and accounts matters. 10. Fossil Park and Food Craft Institute. 11. Development of lakes in Himachal Pradesh.

12. Civil Aviation and Flying Clubs including Flying Training, Aero Sports Institute, Hang Gliding, Para Gliding Training and competitions, Site selection for airstrips, Helicopter services, Air-craft operations, upgrading of helipads and upgrading/extension of airports.

13. Establishment of ropeways. 14. Appeals relating to Essentiality Certificates.

This Department is administrative Department in reference to H.P. Tourism Development Corporation.

(ii) THE POWERS AND DUTIES OF ITS OFFICERS AND EMPLOYEES;

Principal Secretary (Tourism & Civil Aviation) to the Govt. of H.P:-

Principal Secretary is the head of the Department and maintains overall control of the Department.

Special/Additional/Joint/Deputy/Under Secretary (Tourism):-

To assist the Principal Secretary (Tourism) on the issues as stated above.

Section Officer:-

The Section Officer is the in charge of the section. He/she performs following duties:-

1. Supervise all the work of section and marking dak to the Assistants. 2. Ensure timely submission of time bound cases/court cases. 3. Ensure all the Dealing Asstts. And Diarist are maintaining al required registers and keep the same updated.

4. To keep carefully watch on the movements of dak /files between section and higher authorities.

Superitendent Gr-II:-

Superintendents Grade-II working in the Secretariat supervises work of the dealing assistants posted in the Section and submits their cases through the Section Officers. In the absence of Section Officer, the Superintendent Grade-II supervises the work of entire Section.

Senior/Junior Assistants:-

Senior/Junior Assistants deal with receipts and submit cases to the Section Officer through Superintendent. They are required to compile data or information and deal with matters including Cabinet Memorandums/Court Cases/Replies of Vidhan Sabha Question, so as to present complete cases with all relevant data and information with past precedents and viable/ feasible solutions to facilitate the authorities to arrive at a definite decision. They are also required to maintain record/registers.

Clerks:-

Clerks posted in the Section perform duties and functions as assigned to them by the Section Officer/Superintendent including the Diary/Dispatch work, maintain casual leave account, distribute dak after dairying to dealing assistants in the Section and open new files.

The general function of Personal staff i.e. Private Secretary/Personal Assistant/Senior and Junior Scale Stenographers/Steno Typists is to assist the Minister, Secretary and other Middle level Officers in their day-to-day disposal of work and carry out such duties officially assigned to them. They have to handle files/records of confidential or secret nature and as such they have to retain the faith reposed in them by maintaining secrecy. They are also supposed to be fully equipped with knowledge of both Hindi and English shorthand and typewriting to assist the authorities in quick decision-making through dictation and typing. Further they have to perform the duties of Receipt of dak, preparation of notes and drafts. Attendance of telephones, Maintenance of Engagement Diary, Control over Vehicle/Driver, Arrangements for tours/pay etc., and also for maintenance of records.

(iii) THE PROCEDURE FOLLOWED IN THE DECISION MAKING PROCESS, INCLUDING CHANNELS OF SUPERVISION AND ACCOUNTABILITY;

All the cases received in Tourism Section are submitted on files by the concerned dealing assistants, supervised by the Superintendent and submitted to the Section Officer. He submits it further to the Under/Deputy/Joint/Addl./Special Secretary and then to the Principal Secretary. Routine matters and informatory references are disposed of at Under/Deputy/Joint/Addl./Special Secretary level.

(iv) THE NORMS SET BY IT FOR THE DISCHARGE OF ITS FUNCTIONS;

As stated at point (iii) above.

(v) THE RULES, REGULATIONS, INSTRUCTIONS MANUALS & RECORDS HELD BY IT OR UNDER ITS CONTROL OR USED BY ITS EMPLOYEES FOR DISCHARGING ITS FUNCTIONS;

The following various rules, regulations, instructions are followed while functioning the different works:—

• Rules of Business of Govt. of H.P. • Standing Orders issued by Tourism Deptt. • RTI Act, 2005 and Rules framed thereunder. • Office Manual. • CCS (conduct) Rules, 1964. • CCS (Leave) Rules, 1972. • CCS (CC&A) Rules, 1965. • TA/LTC Rules. • GPF Rules. • H.P. Financial Rules. • CCS (Pension) Rules, 1972. • FR & SR. • H.P.Tourism Development & Registration Act & various rules framed thereunder. • Handbooks Volume-I, II & III on personnel issued by the Department of Personnel. • Vigilance Manual. • Instructions regarding maintenance of ACRs. Instructions regarding pay fixation, Stepping up of pay, granting of ACPS benefits and removal of anomaly in pay of senior and junior officers and other relevant instructions issued by the advisory departments from time to time.

• Guidelines/parameters relating to Essentiality Certificate/Ropeways.

(vi) A STATEMENT OF THE CATEGORIES OF THE DOCUMENTS THAT ARE HELD BY IT OR UNDER ITS CONTROL;

Personal files of Class-I & -II Officers, all files relating to service/establishment matters of all categories of employees and other files relating to subject matters of Tourism Department. (vii) THE PARTICULARS OF ANY ARRANGEMENT THAT EXISTS FOR CONSULTATION WITH, OR REPRESENTATION BY, THE MEMBERS OF THE PUBLIC IN RELATION TO THE FORMULATION OF ITS POLICY OR IMPLEMENTATION THEREOF;

The policy formulation matters are sent to the cabinet for decision in consultation with advisory Departments i.e. DOP, Finance and Law HP and HP Public Service Commission (if needed be).

(viii) A STATEMENT OF THE BOARDS, COUNCILS, COMMITTEES AND OTHER BODIES CONSISTING OF TWO OR MORE PERSONS CONSTITUTED AS ITS PART OR FOR THE PURPOSE OF ITS ADVICE, AND AS TO WHETHER MEETINGS OF THOSE BOARDS, COUNCILS, COMMITTEES AND OTHER BODIES ARE OPEN TO THE PUBLIC, OR THE MINUTES OF SUCH MEETINGS ARE ACCESSIBLE FOR PUBLIC;

A Tourism Development Board under the chairmanship of Hon'ble Chief Minister has been constituted. Tourism Councils for Manali has also been constituted for the development of tourism. The minutes of the Board/Council are accessible for public.

ससससंख्या टींख्या टींख्या टींख्या टी....पीपीपीपी....टीटीटीटी....-एफ (6)-एफ (6)-एफ (6)-एफ (6)-2/2000-2/2000-2/2000-2/2000....----हिमाचल प्रदेश की राज्यपाल, मोटर यान अधिनियम, 1988 (1998 का 59) की धारा 212 के साथ पठित धारा 211 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या 5-24/88-टी.पी.टी.-11, तारीख 12 जुलाई, 1999 द्वारा राजपत्र हिमाचल प्रदेश (असाधारण), तारीख 27 जुलाई, 1999 को प्रकाशित हिमाचल प्रदेश मोटर यान नियम, 1999 में और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करती है और उन्हें जनसाधारण की सूचना के लिए राजपत्र, हिमाचल प्रदेश में एतदद्वारा प्रकाशित किया जाता है ;

2. इस नियमों द्वारा संभाव्य होने वाले किसी व्यक्ति को, यदि इन नियमों की बाबत, कोई आक्षेप या सुझाव करने हैं, तो वह उसे/उन्हें प्रधान सचिव (परिवहन), हिमाचल प्रदेश सरकार, आर्मजडेल भवन, शिमला -2 को उपरोक्त प्रारूप नियमों के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से, तीस दिन की अवधि के भीतर भेज सकेगा :

''''''''69-ख, रजिस्ट्रीकरण नम्बर (चिन्ह) के आबंटन के 69-ख, रजिस्ट्रीकरण नम्बर (चिन्ह) के आबंटन के लिये विशेष्लिये विशेष्लिये विशेष्लिये विशेष रजिस्ट्रीकरण फा रजिस्ट्रीकरण फा रजिस्ट्रीकरण फा रजिस्ट्रीकरण फीसीसीसीस....-हिमाचल प्रदेश 69-ख, रजिस्ट्रीकरण नम्बर (चिन्ह) के आबंटन के 69-ख, रजिस्ट्रीकरण नम्बर (चिन्ह) के आबंटन के राज्य में, समस्त रजिस्ट्रीकरण एवं अनुज्ञापन प्राधिकारियों द्वारा केन्द्रीय मोटरयान नियम, 1989 के नियम 81 के अधीन मोटरयानों के लिए निम्नलिखित रजिस्ट्रीकरण नम्बरों (चिन्हों) के आबंटन के लिए रजिस्ट्रीकरण फीस के अतिरिक्त, निम्नलिखित दरों पर विशेष रजिस्ट्रीकरण फीस प्रभारित की जाएगी :-

क्र0 सं रजिस्ट्रीकरण चिन्ह विशेष रजिस्ट्रीकरण फीस 1. 0001 75,000/रूपए (पचहत्तर हजार रूपए) 2. 0002 से 0009 50,000/रूपए (पचास हजार रूपए) 3. 0010 से 0100 35,000/रूपए (पैंतीस हजार रूपए) 4. 0101 से 9999 20,000/रूपए (बीस हजार रूपए) परन्तु क्रम संख्या 1 से 3 के सामने विनिर्दिष्ट विशेष रजिस्ट्रीकरण नम्बर (चिन्ह) पूर्णतः समादत्त नम्बर होंगे, और पहले आओ पहले पाओ, के आधार पर आबंटित किए जाएंगे। तथापि, जहां किसी विशिष्ट नम्बर के लिए एक से अधिक आवेदन प्राप्त होते हैं, वहां उसे लॉटरी के द्वारा आबंटित किया जाएगा :

परन्तु यह और कि रजिस्ट्रीकरण एवं अनुज्ञापन प्राधिकारी उपयोग न किए गए नम्बरों को राज्य सरकार के स्वामित्व वाले यानों को विशेष रजिस्ट्रीकरण फीस प्रभारित किए बिना आबंटित कर सकेगा :

परन्तु यह और कि क्रम संख्या 4 के सामने विनिर्दिष्ट रजिस्ट्रीकरण नम्बर की दशा में विशेष रजिस्ट्रीकरण फीस, केवल तभी प्रभारित की जाएगी यदि मोटर यान के स्वामी द्वारा क्रम संख्या 4 के सामने राजपत्र, हिमाचल प्रदेश, 2 अगस्त, 2010/11 श्रावण, 1932 2593 विनिदिर्ष्ट रजिस्ट्रीकरण नम्बर में से किसी विशिष्ट राजिस्ट्रीकरण नम्बर के लिए चयन उपदर्शित किया जाता है, ऐसा न होने पर ये चिन्ह क्रमानुसार/कालानुक्रम में, पहले आओ, के आधार पर आबंटित किए जाएंगे। क्रम संख्या 4 के सामने विनिदिर्ष्ट रजिस्ट्रीकरण नम्बर के प्रयोजन के लिए क्रमानुसार/कालानुक्रम रजिस्ट्रीकरण नम्बर 0101 से आगे प्रारम्भ होंगेः-

परन्तु यह और कि यदि कोई मोटर यान दुर्घटनाग्रस्त हो जाता है और बीमा कम्पनी द्वारा सम्यक, रूप से पूर्ण क्षति प्रमाणित की जाती है, तो उक्त मोटर यान के स्वामी से, नए यान हेतु उसी रजिस्ट्रीकरण नम्बर के लिए विहित विशेष फीस संदत्त करनी अपेक्षित नहीं होगी, यदि उसने बीमा कम्पनी द्वारा पूर्ण क्षति के प्रमाण-पत्र को जारी करने की तारीख से छह मास की अवधि के भीतर, नया यान क्रय कर लिया है :-

परन्तु यह और कि स्वामी, अपने यान के विक्रय के पश्चात केवल तभी अपने यान का रजिस्ट्रीकरण नम्बर रख सकेगा, जब विक्रीत यान को राजिस्ट्रीकरण और अनुज्ञापन प्राधिकारी द्वारा नया रजिस्ट्रीकरण नम्बर पुनः आबंटित कर दिया गया हो और पहला (प्राइमरी) नम्बर इस शर्त के अध्यधीन/अभ्यर्पित कर दिया गया कि स्वामी को रजिस्ट्रीकरण नम्बर के छोड़ने/अभ्यर्पित करने की तारीख से, दो मास के भीतर, नया यान रजिस्ट्रीकृत करवाना होगा । रजिस्ट्रीकरण नम्बर को रखे रखने के लिए, पहले स्वामी से कोई विशेष राजिस्ट्रीकरण फीस प्रभारित नही की जाएगी'।

NOTIFICATION

Shimla-2 the 30th July, 2010

No. TPT-F(6)2/2000.—In exercise of the powers conferred by section 211 read with section 212 of the Motor Vehicles Act, 1988, (59 of 1988), the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Motor Vehicles Rules, 1999, published in Rajpatra, Himachal Pradesh (Extra Ordinary), dated 27th July, 1999 vide this department notification No: 5-24/88-TPT-II, dated 12th July, 1999 and the same are hereby published in the Rajpatra, Himachal Pradesh for information of the general public;

2. If any person, likely to be affected by these rules has any objection (s) or suggestion (s) to make with regard to these rules he may send the same to the Principal Secretary(Transport), to the Government of Himachal Pradesh , Armsdale Building, Shimla-2, within a period of thirty days from the date of publication of the said draft rules in the Rajpatra, Himachal Pradesh;

3. Objection(s) or suggestion (s), if any, received within the stipulated period, shall be considered by the Government of Himachal Pradesh before finalizing the said draft rules, namely:-

DRAFT RULE

1. Short title.—These rules may be called the Himachal Pradesh Motor Vehicles (Third Amendment) Rules, 2010.

2. Substitution of rule-69-B.—For the existing rule-69-B of the Himachal Pradesh Motor Vehicles Rules, 1999, the following shall be substituted, namely:-

"69-B-Special Registration Fee for allotment of registration marks.—There shall be charged a Special Registration Fee, in addition to the registration fee , prescribed under Rule-81 of the Central Motor Vehicles Rules, 1989, for allotment of the following registration marks to the Motor Vehicles by all Registering and Licensing Authorities in the State of Himachal Pradesh, at the following rates:-

Provided that registration marks specified against Sr. No. 1 to 3 shall be totally paid numbers and shall be allotted on first come, first serve basis. However , where more than one application is received for a particular number, the same shall be allotted by draw of lots.

Provided further that the Registering and Licensing Authority may allot unutilized specified marks to the motor vehicles owned by the State Government without charging any special Registration Fee.

Provided further that in the case of registration marks specified against Serial number 4, Special Registration Fee shall be charged only if choice is indicated by the owner of the motor vehicle for any particular registration mark out of the registration marks specified against Serial number 4, failing which these marks shall be allotted on first come first serve basis in seriatum/ chronological order. For the purpose of registration marks specified against serial number 4, the seriatum/chronological order shall start from registration marks 0101 onwards.

Provided further that in case of any motor vehicles meets with an accident and is a total loss duly certified by the Insurance Company, the owner of the said motor vehicle shall not be required to pay the special registration fee prescribed for the same registration number for a new vehicles only if he purchased the new vehicle within six month from the date of issuance of total loss certificate by the Insurance Company.

Provided further that the owner may retain the registration mark of his vehicle after the sale or scrapping of old vehicle only when the sold motor vehicle is re-assigned a new registration mark by the Registering and Licensing Authority and the primary number is vacated/surrendered subject to the condition that the owner has to get the new vehicle registered within two months from the date of surrender/vacation of the registration number. For retaining the registration mark, no special registration fee shall be charged from the primary owner.
